  2. Lee, I was thinking the same thing reading this thread. There have been a few members here that have been burned by 3rd party corrispondence. It is a good idea to let GUZ know what's up before hand. Sad but true that GUZ would weigh 3rd party gossip over the proof presented to them at the interview and the 9 month long investigation they make all applicants have to wait for. Be proactive, especially if you have prior knowlege. If you are denide your visa. You'll be asking yourself woulda, coulda, shoulda about the 3rd party corrispence. In my opinion, GUZ knows before the interveiw whether your visa will be granted or not. They won't ask for more evidence before your interview. They make you show up, reject you, then ask for more evidence. CYA
  3. Do they think that a CR1 visa applicant would be sitting in front of them for an interview if the visa bill wasn't paid? Good point about the receipt. Give a copy of the certified check or money order to your wife along with the receipt from St. Louis saying they received it in the mail. They won't mail the ds-230 until they get paid.
  4. If your filing K-3, there is no "other" petition, until you recieve your NOA1. The 129F can not be submitted (to Chicago) until you recieve your NOA1 from CSC. I would follow the instructions given by the USCIS. Did you recieve a "rejection" letter or RFE? I would write a clear cover letter explaining the situation. Try to keep the facts in and opinions out of it. Good luck,
  5. I would say that if you think that your fiancee's job might put your visa at risk, it would probably be a good idea to find another job that didn't. The job would only be a temporary one if she plans on being with you in the US. Is it worth the risk?

  7. I don't think anyone would get sued (well maybe). I would just make it clear to people that we're dealing with the goverment. They make the rules and can change them however they deem nessesary. Your doing a great job David. It's amazing your not burned out on all this stuff.

The lady on the phone can not give you any details via land line. snail mail only. What you will recieve is called an RFE, not a denial. They need more paperwork to support your 130. Maybe you forgot something or forgot to check a box on the app. In my case, they said I needed more evidence that I was a US citizen, even though I was born and raised here, went to war for my country, white skin, blue eyes yada yada... come to find out, my lawyer submitted my old passport instead of my new one. There was about 7 other screw ups on my 130 CSC never caught, but I corrected and mailed an explaination letter back. two weeks after you mail your RFE back to the service center you'll be approved with an I-797 and then it will go to the visa center in NH as a CR-1 visa application. your I-129 will only do you any good if you sent it to the VSC. There isn't much thinking on behalf of our immigration officials, they just follow the SOP. take a #, get in line. You'll be ok. Let me know. GZ isn't denying a 130. 129F maybe. I haven't heard of that in over 2 years. OK, i think your confused. I think I got it now. Don't write to GZ. they have no idea what your talking about. You got an email from USCIS. From California. It will explain everything. 195160[/snapback] Menqxin..Sorry for my short response earlier..Right depressed these days..Got back from china around feb.5th..1am with a letter from uscis asking for evidence..its been a war and a ton of money i dont have since that day..Can't say details here but due to something done by an (ex) many years ago..belive it or not a (fake) paper filed by them that uscis found to be just that(fake)..I-130 is denied as of today..Just got letter today..Crazy thing is I-129f is approved and sitting in GZ right now..I got a 5 page from uscis with a lot of blah..blah..and more money to pay but nothing about what happens to our I-129f now..And ur right they wont say shx anyway but snail mail..Realy thank you for help though, told me many things i did not know..Guess it's a few more months to wait for another snail mail saying I-129 is shot to..So will be slapping me to real soon 195480[/snapback] Sorry to hear that. When you say your 129F is approved, does that mean that your waiting for an interview date? If you really want to get the scoup on your case status in GZ, you need to call DOS. GZ will never give anyone a straight answer.   9. David, 1st of all I would cover my ass with a disclaimer if I were you. Make it clear that the "kitchen sink" is merly a recommended list of items you might be asked for. Some people get the blue slip even if they bring the sink and a toilet with them. others just smile at the VO and they got the visa. "Any given Sunday" or should I say in this case, "Any given day, other than Sunday", anything can happen. Or like Forest Gump said "IT HAPPENS". I would rate your list of items. What items in your (our) opinion carry the most wheight? what are people most likely going to need on a scale from 1 to 10. My kitchen sink set me back $178 bucks. A real kitchen sink would have been cheaper to ship to my wife. The door is open to anything, like the little chuw wa wa dogs, birthday hats and a flameing hula hoop. (still not on your list yet.) In the end fortunately, my wife was only asked for some photos. GZ already tells everyone what they want you to bring. What documents should I bring to the visa interview? The applicant should bring the following original documents: Forms in the appointment packet Chinese passport Two visa photos Notarial birth certificate Notarial marital status certificate. If divorced before, previous divorce certificates for each marriage are required. If any child from previous marriage will also apply for visa, a divorce decree showing the child's custody is needed Notarial police certificates are required from each visa applicant aged 16 or over issued by his/her local municipal notary office where he/she has resided for at least six months since attaining the age of sixteen. Police certificates are also required from all other countries where the applicant has resided for at least one year. Medical report Affidavit of Support - I-864 and copies of the three most recent years' tax returns if not already submitted to NVC. Relationship evidence including family photos, correspondence and household registration to prove the claimed relationship. Translations: Police certificates from other countries not in English, or in the official language of the country must be accompanied by certified English translations.     Randy: This may be true. After thinking about it it brings some light to the situation. I am a paralegal for an attorney that practices civil and bankruptcy law. Many times we will file oppositions to a opposing motion with the court. The judge very seldom reviews the opposition and ends up ordering an evidentiary hearing where all the documents are reviewed and a decision is then made. I realize this analogy may be a little off track, but it seems all to familar to me. The problem I have with this is the VO is not an elected individual with a proven track record but instead hired by our government to take a persons future into their hands Larry 193934[/snapback] Laywer?     You said your VO was a "she". (GULP! ouch... ) I think you got the infamous "black widow". Asking for an interview in Chinese, not good. have either of you been previously married? that is also a point against you with that VO. You got a bad apple. fix it, set em straight. you'll get it next time. Do something quickly, don't wait. there will be more helpful posts behind mine... oh carl... we need your help over here please.

  14. I concurr w/ Frank. My wife is also here on CR-1. Been to Canada, Got her green card and SSN already. ...jeez, she's only been here 4 weeks already. the driving part is a little scary though.

I-130 to CSC, no need to send the I-129F. Come back with translated / notarized copies of her birth certificate and your marraige certificates. The offical white one with 4 pages, not the red book. Two weeks after you get back and submit your paperwork, your I-130 will be approved and on it's way to NVC NH as a CR-1. I fell for the "K3" thing too, then came the visa backlog reduction act. It started in Aug 04' , what an unpleasant surprise that was for many members here that thought they were going to go the "K3" route also. peace.

  19. If you marry in China you'll get a really cool little red book, jiehunzheng, and a really cool case to keep it in. I agree with pushbrk's perception that expedience should'nt be the motivating factor in deciding which visa to pursue. There has been some to think I was crazy to say such a thing. I can only sum that up in one way; "haste makes waste." 180017[/snapback] Ty, I think that regaurdless K1 or K3, you should love your fiancee as would your wife. The commitment in your heart should out wheigh the buracracy behind the paperwork. I don't judge a K3 app as a sign of a man who loves his woman more deeply than a K1 app. Neither would I say a K1 is smarter because of a K3 that ends in divorce due to a hasty descision. Shit happens. I'm guessing that any member here came here because they want to be happy with the one they love. If K3 is faster, go for it. K1 faster, then wait. The .gov says the descision to be married shouldn't depend on the speed of the visa, but why would anyone in there right mind make there descision based on what the goverments opinion is. Unfortunately there are VO's that feel a need to abuse there authority for passing out blue slips over frivolous reasons. If a Chinese female terrorist wants to be a threat to the US goverment, would she wait over a year for a 15 minute interview with a VO from GZ. I think that terrorists might be a little smarter than that. The .gov says they are against forced marraiges. with the extremely long timelines and need to submit a legitmate case. They have forced all of us to marry sooner than we would like to. No marriaige = No Visa, "oh but we don't want to force you to marry." give me a break. They have the authority to take away our right to pursue happiness, does that make them smarter? Oh god, I'm ranting again... you get my point. I'll spare everyone the rest of the "oh like duh, because we're your gov and we said so." kiss kiss till GZ lets your wife arrive. state what you really think after she's here. Peace and Love
  20. I loved my woman so much, I went to china and married her, then I filed I-130, got receipt mailed off I-129F. Look at my time line, I went from sending in paper work to package sent to GUZ in 3 months. My wife will hopefully get her P-3 soon, if i'm lucky she will be here in March April ish. Hopefully they really are speeding up.
  21. Go K1!!! Look at my timeline and then look at K1 timelines. I wish I would have waited to get married so we could be together sooner. CR-1 = Misery my friend.
  22. Dan, I would strongly recommend waiting to get married until after she arrives. CR-1 visa takes forever. you need 4 signatures on your proof of singleness doc. 1. Notary from local poastal annex. 2. Notary from the county clerks office. 3. Notary from the D of S. 4. Notary from the Chinese consulate in the US. They wouldn't even issue Amy a passport without a letter of intent to marry also. Congratulations and good luck.
