  1. Thanks for all you reply. The guy at the UPS Store wouldn't notarize the new form, even after I'd request him to do so. Pfft. He wouldn't because there's no spaces where he can stamp it. Anyhow, I went ahead and fill out the old I-134 form which I had on my computer previously and got it notarized.

My mother-in-law will have her interview for a tourist visa soon and was wondering if the new I-134 form (10/30/08) doesn't require it to be notarized. http://www.uscis.gov.../i-134instr.pdf Execution of Affidavit: "...It is not necessary to sign form I-134 in front of a notary, nor have your signature notarized after you sign it" So my questions is, does GUZ still requires the I-134 to be notarized? Thanks.

  5. OK - You can NOW file a K-3, but I'd front load that packet with the kitchen sink. Since you used an attorney and that got you no where, why not do some self study here and at visajourney.com, see what you can learn ? Warmest Regards.. Yup.. That's what we did. First time, we got a white slip for our K1. Got married. Came back to the US. Sent a letter to USCIS to cancel our K1. Applied for K3 with the kitchen sink along with what we believed that caused the denial. And passed the interview later.

My blue slip Also, can anyone recommend a good competent attorney in GUZ that is reasonably priced? Derek, PM smilingasia as she can give you a choice of attorneys. Basically you will have to make a quick trip to GZ and go to the consulate and make a lot of noise. Sometimes this works and sometimes it does not. As far as an attorney, I did not get one and I did not go to GZ. And here I sit. DO NOT listen to the DOS!!!!!!!!! They make everything sound like it is so simple. "Yeah, you can get married and do the K3. You can wait a month for the case to be returned to the USCIS." This is all hogwash Derek. Bottom line, GZ has ruled. In a couple of weeks there will be nothing you or anyone can do about it except wait. GZ likes to play Dr. Phil. They do this to a certain number of K1s especially the ones who have had recent divorces and/or multiple marriages. Basically they want to see if you and your fiancee will last. Contacting Senators and Congressmen will do you no good also so don't waste your time. As I said, you only chance to try and get this resolved quickly (if possible) is to get a lawyer in GZ and go there and make noise. Yes it is expensive but remember, GZ wants to see how far you will go for your fiancee. Thanks.. I'm planning to fly over next week to attend ACH. As for the attorney, can someone recommend one in Guangzhou who is a bit inexpensive than Peter Paget? Thanks!

  9. No.. Just on the letter that my SO got, it says that based on the information I provided thus far, they do not believe my SO and I have a bonafide relationship. That my case will be returning to USCIS and they do not have further information for me if I wish to contact them in the future. All questions should be directed to USCIS once it's returned...................... As for the cost of a lawyer, I'm not sure yet. I contacted Peter Paget's firm and his assistant by the name of Tim gave my SO a quote of $1000 just for them to inquire to GUZ about this denial and have it stay in GUZ for the time being. My SO also talked to several 001 members and they suggested that we shouldn't waste money on a lawyer because it's no help. Just find out the reason of this revocation, then get marry in China and apply for K-3. DOS also told me this morning when I contacted them that I should wait about a month for the case to be returned to USCIC so I can dispute the revocation. DOS does not have any further information on the reason for the revocation.

I called DOS on the drive to work and they couldn't provide me with any answer to why my case was revoked and will be returning to USCIS. I guess I'll send a fax to GUZ and ask them if they can provide me with further info. Thanks again.

  12. Well.. It's 2:30AM PDT and I'm sooo mixed with emotions.. Pissed off and sad.. My fiancee turned in the documents needed for the overcome on monday and today she got her results. And guess what? K-1 visa denied. They're sending the case back to USCIS. This is such BS! Really. We do have a bonafide relationship! In 4 hours I have to go to work. I'm sleepy and tired. What's else is there for us to do? 1 year+ and still we're not able to be together. No second overcome or anything. We thought we'll pass 100% since there's no other thing they can ask for. Well we're partly right. They didnt ask for anything else. Can anyone give me some advise on what to do now? Thanks.
  13. Did you ever call DOS? Is it possible that NVC had sent your file to GUZ a long time ago? Yes I called DOS. The lady i spoke to said NVC aand DOS share the same system. No case found.
  14. Sigh.. It's 90 days now and it's still not at NVC. I just got a letter from my senator yesterday which enclosed a copy of the response from NVC. Anyhow, they said that they still dont have it and it "may be" lost in the mail. I mean come on, I have to wait 90 days just to know that it's lost? Geez. CSC and NVC Thank you! Well, today I express mail a letter to the USCIS Ombudsmen to complain and ask them to help me resolve my predicament. I also faxed NVC a copy of my NOA2. I'll just wait and see what happens. Should I resubmit my I-129F application? Can someone who is/was in the same boat as I am give me some advice? Thanks in advance.
  15. I'm not quite sure where exactly is my case. I also called DOS and they were no help at all. Normal canned response about no record of my case, call CIS to find out where it is, and call back 90 days from day of approval.
