  1. About the denial, with a tourist visa, the burden of proof that the intent to visit and not decide to stay has to be satisfied being married or engaged to a US citizen is a tough one to overcome. This is not the case with an immigrant visa, the visa is that intent. However, you need to show the marriage is genuine and prove the marriage is for just that and not only for immigration purposes. You only posted the required forms however you left out the relationship evidence that should be attached. For the most part, lawyers simply give you a list of things to gather and fill out forms, you are doing all the legwork. Lawyers typically cannot guarantee success. A few times I have seen topics where the lawyer screwed things royalty.
  2. Here is what a little searching found. https://finance.zacks.com/can-noncitizen-wife-receive-social-security-benefits-after-die-5427.html China and the USA DO NOT have a reciprocal agreement. U.S. International Social Security Agreements https://www.ssa.gov/international/agreements_overview.html Again Citizenship has its benefits.
  3. When my wife got her K-1 we did a wedding reception in her home town, with pretty dress and suit a few days before we flew to the states. Many doing fiancée visas tend to do that so they can have a nice party for friends and family in China, also it softens the blow if family are denied visitors visas. We then did the legal marriage in the states, and had a reception for my friends and family.
  4. Asking for a US Criminal record is highly unusual. "Note: Present and former residents of the United States do NOT need to submit any U.S. police certificates." https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/collect-and-submit-forms-and-documents-to-the-nvc/step-5-collect-supporting-documents.html
  5. Should not be any issue getting a Schengen Visa, typically apply for it with the country you plan on landing at and it covers the other countries in the compact, I belive the UK is not in it and would need a sepreat separate visa. My Niece In Law lives here on a green-card and shedid travel to the UK a year or so ago and the visa process for there was not that complicated. One option would be to contact a travel agent and work with them on getting the Euro Visa. This in not an issue for my wife, 4 years after getting her green card she applied for citizenship and naturalized, she has a nice American Passport.
  6. If wanting to use screen sharring there are other applications that can do this. Team Viewer https://www.teamviewer.us/ https://community.teamviewer.com/t5/TeamViewer-General/Is-Teamviewer-blocked-in-China/td-p/7551
  7. Switched to WeChat years ago, I believe WeChat will work with QQ accounts. WeChat has apps for iPad, iPhone, Android, windows 8 and 10, as well as web based.
  8. This one was in similar situation, he was in China and met his girl, they DCF and once they came to the states he went back to college in NYC, so it can be done even without a job lined up. http://candleforlove.com/forums/topic/47398-our-dcfd-cr-1-approved-in-guangzhou-nov-20/
  9. My wife grew up in the south Guilin, however she was born in Beijing she moved to Guilin sometime around 10 years of age she speaks Mandarin like a northerner, her mother insisted she pronounce things properly. I remember when traveling with her, while returning to Guilin after her interview in Guangzhou, I hired a car to pick us up at the Guilin airport and transport us to the city, the car had a guide to act as a translator thinking we needed one, the translator thought we were visitors from Beijing and complemented my wife on her precise mandarin, she said my wife speaks the royal tongue.
  10. Does not sound like a denial it is an request for more evidence RFE and case is placed into administrative process, you should be able to delay some before providing them with domicile evidence. Domicile evidence that should cover this would be. Bank account with address you intend on living at in the statesState ID with same address (Driver's License)Job offer.Tax returns showing domicile address.Apartment lease in the states.Quite often US citizen living overseas returns to the states before their spouse interviews and re-establishes domicile.
  11. Yes, the letter serves as evidence of LPR status for a year, and if it goes longer, schedule an infopass appointment and get an I-551 stamp which further extends status evidence. If naturalization is desired can file the N-400 next January with or without the I-751 completed, doing so usually jump starts a stalled I-751.
  12. The only sour pill of filing that N-600 for son's certificate is the $1170 fee for the peice of paper. DANG! it has gotten quite expensive dealing with immigrations. I cannot understand why the fee for N-600 ($1170) is more than N-400 ($725). Where does USCIS come up with this?
  13. The other route for son to obtain citizenship quicker would be for you his step father to legally adopt him, and once legally his parent you could file that N-600 along with evidence of adoption and he would obtain citizenship that way. Would be cool to go to mother's oath ceremony with her son already a citizen.
  14. Son will gain citizenship when mother becomes a citizen, for now only need for your wife to file her N-400 and proceed through the process. Once she is naturalized and is a Citizen all you have to do for son will be file an N-600 to obtain his naturalization certificate, https://www.uscis.gov/n-600
  15. Only issue would be her green card, if you live out of the USA longer than 6 months the government can and often consider it abandonment of residency and revoke the green card. Becomes a choice, where do you want to live as a resident? Often if intent is to live full time or a long time would be to give the green card up and apply for a visit visa to visit the states and later apply for another spouse visa if intent to move back to the states. Or the other option is getting US citizenship and then having to deal with getting Chinese residency permits for two. Study topics tagged Residence Permit http://candleforlove.com/forums/tags/forums/Residence%2BPermit/
  16. Study topics tagged I-751 http://candleforlove.com/forums/tags/I-751/ but this won't be a factor until October 2019. For now just build a file of relationship evidence.
  17. Then the visa is used and is now canceled, nothing is needed to be done with the single use visa after it's use, she is now a lawful permanent resident with a two year conditional green card. Removal of conditions is not based on marriage anniversary, it is based on 2 years of residency, thus you file the I-751 within 90 days before the 2 year conditional card expires. Thus you file the I-751 a couple months or so prior to October 2019...
  18. It is very rare for the consulate to demand or require an I-601 for CCP, they simply interview and approve pending higher approval for the CCP, they place the case into administrative processing and the consulate requests an aproval from DOS Washington, then a monh or so later will request the passport turned in so they can affix the visa in it. CCP Waiver is pretty much automatic. Study topics tagged CCP Waiver I don't recall anyone ever having to do an I-601. I-601 has more to do with other hardships such as a bar on entry for an overstay in the USA.
  19. Once having the visa only two options: Delay using it to enter the USA until after 2 years of marriage (Dec 15 2018) probably not an option because the visa probably will expire before then.Use it before your 2nd wedding anniversary and then 2 years after getting the CR-Green Card you file an I-751 to remove conditions.
  20. B1/B2 visas can be valid for 10 years after issue they do not expire with the passport, the consulate wants the old passport with visa so they can cancle the visa since it is no longer needed after traveling to the states using an immigrant visa. For example my passport is about 5 years old and will expire 5 years from now, If I were to apply for a 10 year multi use visit visa for China and then renew my passport 5 years from now, when traveling to China I would carry both the new and old passports when visiting China the visa in the old passport is still valid.
  21. If you have not yet scheduled the visa interview you can always delay it for a few months or so until ready to actually move to the states. Only issues may have to get another police report if you have already done that, as for medical, that is typically done after you have set an interview date and have that confirmation. As for the 5 months, travel shortly after arrival, as randy indicated, see if can get SSN, State ID, name added to lease, etc to show establishing residency, 5 months away is close to the point where they ask questions, more than 6 months is the point where questions start to happen, less than 6 months a travel document would not be needed, also the processing time for the I-131 can be long so may not be worth the effort if the intent is to arrive in the states for a couple weeks then return to China to finish up with the job.
  22. This one is kind of nuts, what about chinese and other asian cultures wearing western clothing styles, or native Americans no longer wearing traditional native american clothing. America has always been about sharing culture, not seperating people by ancestry and saying its taboo to wear and apreciate other cultural styles. What the heck is wrong with aprecialting other cultures styles? When my wife and I were married I wore an Asian style jacket to our reception and weding ceramony, it offended no one either Chinese or Western. The people offended are professional whiners. It's just recreational outrage. They feel important by whining about something. People need to stop kowtowing to them. They clearly don't realize that the reason they have culture in the first place is because someone else shared it with them. Culture is essentially just ideas, and the free exchange of ideas is the reason we're not still living in caves. Girl gets bullied and shamed by mobs of people who claim they seek a fair and equal world for everyone, just for wearing a dress. Shows how truly compassionate they are.
  23. Some relationship evidence is needed if applying for naturalization at 3 to 5 years of residency, however beyond that point, relationship evidence would no longer be needed. What I would do with all that paperwork, I would scan it all and save the resulting pictures or PDF files in a safe place just in case it is ever needed for any reason. Renewal of a 10 year card is filing an I-90 and paying a fee, not much in the way of evidence other than if changing name. Citizenship is a little more involved, filing a N-400 Copies of joint tax returns.List of all trips abroad detailing exit and arival dates.Copy of marrige status document(s) (Current Marriage cert and (death cert, divorce, or anulment of prior marrhage(s))Evidence spouse is a US Citizen for at least 3 years if filing the N-400 at 3-5 years of residence.and other evidence related to ciminal and time abroad longer than 6 months.
  24. I don't know about Kevin Nelson, has not been on the site since last fall. However my Niece-In-Law filed her I-751 last year January and only recently a week ago or so she finally got her 10 year card, probably her filing an N-400 for citizenship jumpstarted the I-751. Note, because the I-751 can take a long time to process has no effect on status, a green-card holder remains an LPR indefinately until a desision is made on the I-751. If the process goes more than a year, you can always do an infopass appointment get status and request an I-551 stamp in passport to further show residency status.
