Hello all, I am writing on behalf of my husband, a Chinese citizen. Here is a brief rundown of our most pressing question: “I got my 2- year conditional permanent resident card after coming to live in the US with my wife in 2017. I filed an I-751 to remove the conditions on my permanent residency in April 2019, and received an I-797 extension on my 2- year card until October 2020. Due to a family emergency, I had to come back to China in August 2020. The issue is now resolved and I would like to go back to my wife where we live in California. My USCIS status is awaiting interview for removal of conditional status, my receipt number is recognized by the USCIS help line when I call in to check on my status. I need to know if there are any additional documents I need to travel back to the US. Will they stop me from entering the United States with my current paperwork (an expired two year green card and an expired I-797, but which is still valid according to the USCIS until they judge my case)? I didn’t have time to file for a reentry permit when I left, so is my only option to go through the process to get a returning resident visa?” thank very much to anyone who might have some insight!!

Happy new year Candleforlove friends, I want to quick explain my situation. We filed I-751 in 11/20/2018, and have been waiting for NOA I-797 since then. We did receive a text message 11/29/2018 from USCIS that the case was received, along with an WAC number. We noticed the checks had been cashed as well. Looked online and saw this page https://www.uscis.gov/news/alerts/form-i-751-data-entry-delay-california-service-center. Because the WAC case number in text message cannot been found on USCIS - "Check Case status", days before the green card expiration, we scheduled an infopass, and the only time available is in Janurary 2019. Green card expired just before Christmas. Till today there is no I-797 in mail, and the WAC number still cannot be status-checked online. Does anyone have idea, will the upcoming Infopass be helpful? Is there anything that I should be preparing for it? Meanwhile, can I work with my immigration status? Thanks for your thoughts in advance. Also, this is a painful lesson that filing I-751 early in the 3-month window is a better choice. -
Good day Candle for Love! In a bit of a pickle now, and was looking for some advice. Wife, and I are getting ready to send off I-751 petition in the next couple days. Her conditional green card expire November 9th. (I know a bit late filing, but life has been crazy lately). I understand we will receive I-797 NOA extending her LPR for a year upon petition acceptance. Here is the issue. Her grandfather has become ill, and she is looking to get back to China soonest possible, but we understand I-797 can take up to a month generally to get back. Could we mail off the petition, confirm USCIS has received it via tracking number, and get her on a flight ASAP while waiting for I-797? I plan to fly over and meet up with her end of November and could bring the I-797 with me for re-entry… If they see that she is out of the country while waiting for I-797 do you believe there will be issues? I know its all shaky ground but kinda a crappy situation we are in… I also posted this in the squak box. Any input would be great. As always, thanks all!

Hi, 1) I'm wondering what the current turn-around time is for when sending in the I-751. I hope to get it sent this coming Monday. Any ideas? 2) Are materials sent to the USCIS for this process, photos, etc., returned? 3) What is the best way to ship the materials to them? My guess is that I will have over a pound. 4) I'm confused over the passport pictures that must be sent. How many should I send of myself? How many should I send of my wife? Thank you -
My wife just called and told me that the national corporation she works with requires a valid green card. The 1-year extension notice has expired. It appears as if the company is now considering her as illegal, or not able to legally work! What to do? The website says they are just now working on November 1, 2016 applications, when ours was submitted 4/27/2017. Ironically, a month ago it was on 11/1/2016, then the time got extended a month, putting her back to October 15th or so. Getting an Infopass appointment seems to be nearly impossible! Should we simply just barg into the San Francisco office on the basis of an emergency? https://egov.uscis.gov/processing-times/

Good day all, Wife, and I are nearing time to file I-751. It has been a crazy couple years, and through my job we have moved 5 times. I was reading over the I-751 to start prepping. Question 22 of Part 1 asks "Have you resided at any other addresses since you became a permanent resident? If 'Yes," attach a list of all addresses and dates". Upon reading this I realized CRAP I THINK I forgot to file one of the address changes as per below. Address 1 (Original File Address) -> Address 2 (AR-11 Submitted) -> Address 3 (AR-11 Submitted) -> Address 4 (Forgot To File AR-11 "I think") -> Address 5 (AR-11 Filed Current Address) Is USCIS going to give us crap about this? Should we submit a memo explaining we forgot? Should we just leave it, and play the "we have been so busy we must have forgot" if they ask? -
Hi All, Checking online I can see my wife's I-751 app status showing last updated in early March from the local Seattle office. It will take a few more months for the next step for sure. My question is, my wife is now pregnant and I would like to add this info to bolster the application. Is it possible? How? Thanks! John -
Let try to explain a little better. We have the Cr1 visa right now. We have her green card and social security card. We came to the United States in late October 2017. I think we need to change from Cr1 to Ir1 three months before our second anniversary. Our second anniversary is December 15, 2018. Which forms do we need to fill out? We don’t know exactly what to do? Thank you

We filed the I-751 to remove conditions in December 2017, received confirmation, and then moved in March 2018. We immediately reported the address change to the USCIS using the online form and received confirmation. About two weeks later, we received a letter at our new address from the USCIS with the following quote: "After careful review of your request, it has been determined that your issues will be best addressed by the USCIS office having jurisdiction over your case. Therefore, we have taken the liberty of forwarding your service request to the California Service Center. If you require additional assistance, forms and/or filing instructions, we invite you to visit our website at uscis.gov or, if you do not have internet access, contact customer service at 1-800-375-5283. During the above referenced call, you or your representative request that we update your address. Please note that there are instances when we are not able to update an address. We will notify you if we were unable to update your address. If we are able to update your address, we will do so as soon as possible" I called the USCIS several times attempting to get this cleared up as there were letters mailed to our old address while the USCIS sent this ridiculous letter. Finally, on April 13, I was able to speak to a USCIS officer who changed our address for us. He said he had no explanation as to why our address was not changed, and said it would have been easy for any office to change it, and further stated that the Texas Service Center that sent us the above letter should have changed it. Now, as of this morning, I contacted the USCIS again attempting to confirm our address change again and also request that all letters and communications sent to us be resent to our new address. Further, the new case status shows our case was transferred again to the service center at Arlington, VA. Now awaiting a call back from a USCIS officer this morning. Here is the USCIS status as of this morning. Note that our case was transferred on April 10, 2018, and the letter was most likely sent to our old address, and all USCIS communications cannot be forwarded. Case Was Transferred And A New Office Has JurisdictionOn April 10, 2018, we transferred your Form I-751, Petition to Remove Conditions on Residence, Receipt Number xxxxxxxxxxx, to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case. Please follow the instructions in the notice. If you do not receive your notice by May 10, 2018, please go to www.uscis.gov/e-request to request a copy of the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address. What a mess. Makes no sense!

Hi guys, Well, I'm in the middle of the Removal of Conditions for Rose and Kerry. The USCIS sent the package back, as I had used the wrong version of the I-751 form ( dated 11/23/15, Expiring on 11/30/2017) Dumb Mistake... But the returned package had a letter stating for me to use the I-751 form dated 12/23/2016. That form is no longer available on the USCIS website to download. They have a new version dated 12/05/2017 that becomes mandatory to use beginning February of 2018. i called the USCIS and spoke to them about this. After several conferences with supervisors, they agreed that even though the letter told me to use the earlier dated version, it is ok to use the one dated 12/05/2017. I just wanted to pass that along to folks. Now for the fun part. In filling out the new form, in section 7, the instructions aren't the most clear. It tells you to select 1a or 1b (1a - Rose can read and understand every question on her own. 1b-She has an interpreter listed later in the doc that read them all to her) Then #2 is that she has requested the services of someone else (me) to prepare the petition for her. So the question is, do I check 1b, and then also check #2? Or do I just check #2? Additionally, the new form allows me to check what I want, but won't allow me to write my name in on #1 or #2 like the older form did. It is an auto-fill PDF form....any ideas of how I can get around that to put my name in there as the person that either was interpreter or person who filled out the form?

We filed the I-751 back in 4/2017. But they seem to be stuck, and have been stuck at processing that form in 8/20/2016 for nearly three or more months, eight months before we filed. The temporary green card expired in 6/23/2017. The temporary letter expires on 06/23/2018. Will they send another letter? Or do we have to wait between 06/23/2018 until they finally send the results of the I-751 before we can travel abroad again?

Hi all, We are waiting for my wife's permanent green card to arrive - we filed our I-751 in July. My question is: can my wife still travel to China and back to the US while waiting. Her old green card is expired but we have the document stating it is extended for a year. Thinking we can just bring that but wanted to double check. Also, completely unrelated, but I'm curious if we need to do anything in the US to "legitimize" our marriage other than what we've already done by getting a marriage visa/green card.

hi, i am trying to submit my wife's I-751 to remove the conditional status, but i received back the application stating that she needs a copy of her I-551 card. We never received it and honestly i forgot that we needed to follow up with immigration if we did not receive it within a certain amount of time. The sheet that was given to us stated that the stamp in her visa book was good until we receive the temporary. How long will it take for me to get this card? Do we have to have it? Can i file for an extension to file the i-751? Thank you in advance for your help.

Hi All. I have some questions about the I-751 petition. Sorry if there are repeats that have been answered previously. Thank you all so much for the advice you have given over the years. I don't how I could have gone through this whole process without your knowledge. 1. USCIS Online Account Number C I'm not sure where to find this number. According to instructions You can find your USCIS Online Account Number by logging in to your account and going to the profile page. I dont even know how to log in to my account. 2. In Care Of Name for mailing address C Is that just the informal name that they would send mail to? My wife goes by Winnie but she obviously has a Chinese name. 3. When my wife signs the petition C Should she sign as we would write in America (given name followed by family name)? Or would she write it as she would in China (family name followed by given name)? 4. We have a daughter who was born in China, now an American citizen. Do we need to include a Biometric services fee for her? She is not a conditional resident but I think would included in Part 5 C Information About Your Children. 5. Can the fee for filing the petition AND the biometric services fees be included on the same check?

Something really weird happened. My wife passed her green card interview in Guangzhou, China on March 31, 2015. She was qualified to get the CR-1 on that date. Her immigrant visa is dated 3/31/2015. We entered the United States, San Francisco, on June 23, 2015. We were told when we entered the US that we had to file the I-751 90 days before the second anniversary of her entrance into the US. They attached a form to her passport that clearly says she entered the US on the June 23, that said the same thing. Her green card also says that. In other words, we would have to file the I-751 after March 25, 2017. HOWEVER, on December 6, 2016. the Department of Homeland Security sent us a letter, saying, "Our records indicate that you entered the United States as a conditional permanent resident (CPR) on (3/31/2015). As provided by Section 216 of the Immigration and Nationality Act, you must file Form I-751, Petition to Remove Conditions on Residence, within the 90 days prior to the second anniversary of the date your were granted CPR status...." Okay. So which date should we do? If we apply too early, that is a problem. If we file too late, that is a problem. To file between March 25 and March 31 is the safest, but because of other circumstances, not easy to do. Anybody else experience this same problem? If the one computer system of the Office of Homeland Security that says 3/31/2017 is the cutoff date, is the same one that would cancel her green card, we probably would have to find an immigration lawyer, right?

Hi All, We moved about 3 months ago and we filed the AR-11 shortly after. My wife recently received the USCIS notice stating her CPR status is ending soon and to file the I-751 and so on. However, this notice was addressed improperly. We live in an apartment complex and we definitely did include that on the AR-11, but the apartment number was completely absent from the address on the form. Also, and maybe this is normal, the name it was addressed to was just her first initial and last name. Luckily this is common in our apartment complex due to stupidly long street names, and the notice was received by the Leasing Office who wrote our apartment number on it (luckily nobody else has the name M. Li) and it was eventually delivered to us. Anyway, I'd like to avoid having a stroke while we wait to receive her next green card after going through the I-751 stuff. Is there another place we can update the mailing address to make sure that the green card will actually be delivered to us? Also, like KevinNelson posted about back in December, the notice we received actually stated the incorrect anniversary date. The issue date on her CR1 visa is 4-27-2015, and we entered the us on 6-21-2015. The Resident Since date on her GC is 6-21-2015 and the Card Expires date is 6-21-2017. The address error combined with the inaccurate information on this USCIS notice nearly gave me a heart attack. I guess I'm looking for advice on how to update our mailing address so we're more likely to receive her GC when the time comes. Is there a separate system we can use to update the mailing address with USCIS? In addition, we're also looking for insight into resolving the incorrect information in the notice. (I'm assuming we can safely ignore the discrepancy as her passport entry stamp states the correct date of entry and her GC card also states the correct residency date and expiry date.) I have a friend who applied for the I751 on May 19th 2016. She received the receipt letter shortly after that. It's now July 25th and she has not received her Appointment Letter for her Biometric screening and fingerprints to be taken. Does anyone know what the current timing is to get the Appointment letter is? She looked on the gov. website using the receipt number of the receipt she got back. I looked at it, and it says nothing will show up on the gov website until she gets the appointment letter. Is this process just slowed down now? She lives in MN, not sure if that matters , but figured I would throw it out there in case it does, Thanks for any help you can provide. -
Hello, quick questions regarding I-131 (to get Travel Document) and I-751(to remove condition on green card). Both of these need biometric taken (i.e. fingerprints). 1) Do biometric have to be taken in the US? Do US embassy in China do that? 2) Do the applicants have to be in the US to file the application? My wife's 2 year green card is going to expire in the beginning of Sept (now middle of June). She flips out when I told her a lawyer is going to cost $1000 to file for a 10 year green card (plus a fee I did not mention as she flips out when any money issue comes up and always asks. Must study receipt after every store visit and drills me on how much each item cost ect.) . I have the money but I try and listen to her. So far I found out I need to file a I 751 form. Do you guys have some places to go to for help? Or do you suggest not to listen to her and just get a lawyer? Sometimes I just wish life with her was easier. I think her Chinese friends tell her it is easy so she assumes it will be easy for me. I have found out a lot today, talked to a lawyer about prices-called a friend-and looked at the USCIS website. I am not sure where to post this or if this site is for questions like this.

First I want to say thank you for all the information throughout our process of getting my wife to the USA. She arrived 9/2/15. It has been great so far. Now, we must file the for I-751 to remove the conditions on residence. I am confused on when to file. Is it within 90 days of our two year anniversary? Or is it another date? Our 2 year anniversary will be 1/21/2016. Thank you, Paul and Betty -
Submitted paperwork back in April for my wife's conditional green card, which expired in July. Received the I-797 on 4/7/15. Received the I-797C (Biometrics appt form) on 4/24/15. She went to the appointment on 5/14/15 and did her biometrics. Since then... crickets. When I check status on USCIS it, oh so helpfully, informs: On April 7, 2015, we received your Form CRI-89, Petition to Remove Conditions of Permanent Resident Status Received, Receipt Number EAC1513251720, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by May 7, 2015, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address. Should it, minimally, reflect that she's done biometrics? Wondering what's up. Related: She'll go to China for a visit in just over a month. I've read others here that've said to make an infopass appointment and have them put a stamp in her passport. Any advice on what to choose in making the infopass appointment? None of the choices align to that, and I don't want them to bounce her out for not having an appointment that aligns with the ask...
