  2. Good day Candle for Love! In a bit of a pickle now, and was looking for some advice. Wife, and I are getting ready to send off I-751 petition in the next couple days. Her conditional green card expire November 9th. (I know a bit late filing, but life has been crazy lately). I understand we will receive I-797 NOA extending her LPR for a year upon petition acceptance. Here is the issue. Her grandfather has become ill, and she is looking to get back to China soonest possible, but we understand I-797 can take up to a month generally to get back. Could we mail off the petition, confirm USCIS has received it via tracking number, and get her on a flight ASAP while waiting for I-797? I plan to fly over and meet up with her end of November and could bring the I-797 with me for re-entry… If they see that she is out of the country while waiting for I-797 do you believe there will be issues? I know its all shaky ground but kinda a crappy situation we are in… I also posted this in the squak box. Any input would be great. As always, thanks all!
  3. Hello Everyone, Your help is greatly appreciated. My wife currently works in Beijing. She has had 10 yrs B1 Visa before we married in U.S. in 2016. Now she plans to retire in 2 yrs. We are thinking maybe it's time to start I-130, CR1, and so on. But we are not so sure what is going to happen to her current B1 Visa. 1. Can she still use her current B1 travel to/from U.S.? 2. If not, what other traveling document does she need to apply during the period while she would be waiting for her CR1 visa? 3. What any other possible options might be available for her to be able to travel to/from U.S. while she would be waiting for her CR1 visa? Thanks a lot in advance
  4. my wife went back to china to visit her grandmother passed away and wont be back for 4months do she need to get a visa to reenter the U.S or can she use her green card?when she first came here the visa they issued was only for 5 months. thanks
  5. Hi all. I know this is a common topic but I had trouble finding info on it. We applied for my wife's 10 year ROC (and step son) in November of last year. She is planning to go to China to visit this summer and I don't think she will have her new 10 year green card in time for her trip. I thought I read somewhere on this site that you could go to the local USCIS office and request a stamp or something? Could someone tell me about that and how we get an appointment? I forgot to mention her 2 year perm res. card is almost expired and she did receive the 1 year extension letter thanks Don
  6. Hi all, Thanks in advance. My wife's two year green card expires Aug 28th. We sent in all the paperwork in June, received received of payment and had the biometrics completed couple weeks ago. We received I-797, Notice of Action receipt notice on 07/17/2014. It states amount received $590.00 and it states "Your conditional resident status is extended for a period of one year. During this period you are authorized employment and travel". Question - My wife needs to go back to China for a few weeks to help take care of her mother (surgery). Does she need anything else besides this letter and old green card to travel back and fourth from USA to China? She will be leaving next week but wont be back until mid Sept. Her 2 yr green card expires on Aug 28th. I just dont want her to have problems coming back in September with a expired 2 year greencard and only a letter stating its been extended for 1 year.   7. Wife needs to go to China for a few weeks for some business she needs to attend to concerning her art and the museum she is part of starting up. She just got back into the states August 3rd. Needs to go back pretty quickly as a meeting was scheduled and the only time it can happen is soon and is critical to making this project all come together. Sooo...what's going to happen if she goes back and then comes back in a few weeks. Or can she even do this. Has her 10 green card. Been back to China a few of times since getting her 2 year green card to care for her parents. Any suggestions? Thanks!
  8. Hi everyone! I'm new to this website and impressed with the amount of info provided here. Thank you very much! Here are my questions: once I (chinese citizen) receive the immigrant visa and enter the US, do I need to stay in the US until the actual card arrives? Or am I free to travel internationally as a green card holder during this period? I need to travel back and forth betweem the US and China and maybe to Japan/Singapore to sort out several things that can be done only in person (such as selling/leasing out the house, dealing with a few bank transactions etc) before I finally move to the US. Thanks!
  9. Hi everyone, So I'm about to leave for the USA in one month to look for a job while my wife and kids stay in China. I sent in the documents to the USCIS at the end of November in 2013. The documents were sent to NVC in June 2014. This entire time, I haven't received anything in the mail. I got this info via email and a phone call to the NVC. Was it the way I filled it out on the application? Was it stolen (suggested by my colleague as both of our mailboxes open without keys - she has had things stolen in the past). Going back to separation and the travel visa visit: It will take at least a few months to find a job once I arrive in Houston. Once I find a job, it will still take a while for this visa process to play out. While my wife is waiting for the immigration visa, can she apply for a travel visa to come and visit me? I have heard no, she cannot, from many people, including the Consulate office in Guangzhou. It will be very difficult being separated for a year or two. Also, how long will I have to work to prove I have sufficient income for the Affidavit of Support? Looks like I need to be preparing myself for a long time of separation, right? Let's hope not...   10. I have a question regarding the timeline. Working on a CR-1 visa for my wife (just received the form for affidavit of support today), but wondering if we can also apply for a tourist visa for her? I have my parents' 50th wedding anniversary in November, and looking through these posts, not sure if I can trust the timeline to go smoothly. Would she need to stay outside of the US during this process, or can we apply for a tourist visa simultaneously? Thanks! Sammy
  11. We might be planning to head to China. My question is, how long can my wife be in China with a Green Card and not lose the Green Card? Do we need to "establish residency" at some point in a few years? Anybody can shed some light on this subject?? Thanks.
  12. 1. should the biometric fee be paid up together with the I-751 application fee ? 2. when would they set the appointment for biometric ?shortly after filing or it may take sometimes ? In case she is travelling abroad at that time , how should this be handled ? The 1 year automatic extension letter after submitting the I -751 . Hi, My wife plans to go back to China this march for a month.I am looking at ticket prices now,and what worries me is this...her passport has her Chinese name ( maiden name ) and her green card has her married name ( my last name ).i believe the thinking is,i would book her tickets in her passport name.which would be fine getting to China.It's the return to America that concerns me.Her passport and green card,while have her picture....but have different names.She is going back to Chongqing,can she get her passport ammended with married name in China? what if she can not do this,what problem will she have getting into USA with passport(chinese) and green card,having different names?   14. We still haven't received the green card, but am trying to be positive. One of our friends from China told us that you can not be out of the country for over 120 days while under the 2 year green card. I read on the USCIS site that you can stay out for up to and over a year but it might be tough to get back in. Any solid times a person can be back in China before the US starts to cause problems about coming back? If there for 3-5 months is it a problem? Thanks!!
  15. My wife's 2 years GC is expiring in march and she wants to go to china for chinese new year but is wondering how long before it expires can she renew it so that we dont have to risk it expiring while she is out of the coutry. Any ideas on this ?
  16. Hey all, lots of great info here, so much as I have never even had to ask a question that wasnt already answered! thanks! We just sent back our p3 and are waiting for the interview date. After the interview we would like to go to a beach in Thailand but realize that the Consulate keeps her passport to attach a visa correct?? Does anyone know how long this normally takes? Because, of course, without a passport we cant go anywhere outside China. Anyone else have this predicament? Thanks again for all the help here!
  17. Sorry it's taken me so long to reply to my own question about whether or not Chinese Citizens can leave the Incheon Airport... the answer is no. US Citizens can, however, stay in South Korea visa free for up to 90 days. Anyway, I'm not going to go wandering around in Seoul alone with my Sweetie sitting in the airport. I guess we'll just have to skip out on the sightseeing. We're flying Asiana Airlines, we got a really good deal. From our local city airport here all the way to Chicago. The only catch is the layover in Incheon is from 5 am to 6pm. Reeealllyyy Boring. I hope Incheon is an interesting airport!! I was wondering if there's anyone who's flown with Asiana before? This is my first time. The website looks nice... esp. if it's true that each passenger in economy really does get their own tv to flip through... lol
  18. I'm surprised I didn't see this issue crop up in my quick search here. So we filed the Removal of Conditions in March 2007. The latest NSC processing time is June 2006. So technically we shouldn't get a result on our case until Dec 2008 at the earliest. Problem is my wife's green card expired last May. So what can we do between May and December? We were planning to head back to China this summer for a while. Is that possible?
  19. hello... how have you all been? anyone still here who remembers me? ... it's been only forever since i last posted... =) things have been going relatively well for us... the biggest news (which i don't think i mentioned before) was the arrival of our son Isaac last year, Nov 30. yep... it's been that long, he's almost one yr now. life has really been great, we just can't get enough of our little kid. the good and fun times sure out weigh the "bad". suppose it helps given the fact he is smiling 99.999% of the time. i'll try to post some pics or update my profile sometime so you can see the little dude... now for *real* question... is it safe to travel after we send in the removal of conditions? i know there is a biometrics thing, but i don't know how/when that gets scheduled? what about the i-751 "approval"? is there an interview? edith and i would like to travel to china early next year, but that is also right in the time frame we need to file the i-751. we just don't know if traveling is a good idea. any experience/advice anyone? thanks ryan
  20. Dannie and I will be going to China in Dec thru early Jan 2008. We have to file for the 10 year resident card end of sept (90 days before expiration). Will the card be sent right away (hahaha), can we travel and return to usa with an expired 2 year resident card? Or what do we need to bring with us? Dannies son will be getting married and so we have to travel then. Hope someone can help answer. thanks Mark
  21. Hi All... The wife and daughter are going back to China next month and see the family after a little over a year here going through the AOS process and finally getting their green card. Following are clips I got from searching about traveling back to China and am wondering if things are still the same...or anything changed? What DID catch my eye is the 'AOS STAMP' inside her passport...She has no such thing and wondering how does she get? lol...She set up the flight yesterday, couldn't sleep last night because she was so excited....
