  1. Hi all, I'd like to share and ask if anyone is going through a similar situation as my fiance and me. 1) My fiance had his interview in Guangzhou on 2019-01-24. The interview was ~10 min, and the CO did ask about his PhD in Materials Science & Eng and also kept the resume my fiance brought. None of the instructions asked to bring a resume, but we wanted to be very prepared as my fiance is in a TAL field. After the interview, the CO gave my fiance the blue slip with only "Administrative Processing" marked and informed him there were no problems and the processing would take ~3 wks. 2) On 2019-01-28, we received a follow-up instructions email from the consulate with a Word doc attached named "SAO-M" (we presume SAO indicates Security Advisory Opinion-Mantis"??). When we opened the doc, the header was "Administrative Processing". The doc asked for my fiance's detailed resume in both English and Chinese (format resembled the DS-5535). And on 2019-01-29, we emailed the resume as instructed by the consulate, and we have been waiting every since.. 3) We have emailed the consulate multiple times. I have called and emailed both my senators and my congressman. My congressman has been very helpful in contacting the consulate and then the DOS (Bureau of Consular Affairs). But each time, we still receive the same AP comment. I did call NVC last Fri, and received conflicting responses: 1st response said a note had been placed into the system stating the case has been returned to the USCIS on 2019-05-31. When I called again to confirm, the 2nd response said there was no such note. One of my senator's office did say the consulate will often return cases for further background checks. Right now, we are just very confused and frustrated. Any tips would be much appreciated; thanks!
  2. Hello everyone, First of all a big thanks to everyone who's posted helpful guides of the DCF process for those of us living here in China wanting to bring our Chinese spouses over to the US. Everything was going well and approved (thanks to the advice on this website) until today when my wife had her interview in Guangzhou. When it came time for the interview, the visa officer asked her a few questions about our relationship but was mostly interested in our plan for when we go back to the US. When she started describing what she would do, he cut her off and asked about me (the petitioner and US citizen) and what my plan was. She told him truthfully that I was going to go back to school part-time and work part-time. After hearing that he declared that a part-time job wasn't enough to support two people so my wife answered that we'd have to stay with my mom (who is her joint sponsor) until we could save some money. She also suggested that we would both be working when we got into the US. He still didn't like this so he asked if I currently had a job in the US to which she answered no, because I am still working in China. Lastly he asked if I owned any property in the US to which my wife again answered no. After that he didn't ask her any more questions and gave her a white checklist for various petitioner documents with the section for "evidence of the petitioner's intent to establish and/or current domicile in the US" checked off. She also got a three-page document "9 FAM 40.41 N7 Domicile and the Form I-864" that lists the various requirements for domicile. Initially I was very confused why she got a request for this information because I had made a nice packet with a written letter of intent to re-establish domicile in the US and included a copy of my passport, birth certificate, driver's license, acceptance letter to study part-time in Fall of 2018, investment account statement, auto loan statement, insurance statement, bank statements and credit card statements. However, I didn't stick these with my form I-864 and instead had them as a separate "packet" in the front of the application binder. The document intake person didn't specifically ask for these documents (only form I-864 from me and our joint sponsor) and my wife didn't know how important they were so she didn't hand them in. What I am confused about is if I must include proof that I have a job in the US due to how much the visa officer asked about whether or not I had one or if my bank account, investment, auto loan statements, etc. that I had originally prepared (and they didn't see) are enough? I did some research and found on travel.state.gov's I-864 section under the heading "If a petitioner does not have a domicile in the United States can a joint sponsor file form I-864?" it says:"No, the petitioner must meet all the requirements to be a sponsor (age, domicile and citizenship), except those related to income, before there can be a joint sponsor." When reading that it sounds like I just need to prove my domicile in the United States with things like bank statements, etc. but not necessarily have a job already lined up since we have a joint sponsor whose income is $64,000, is this correct? I want to make absolutely sure that I give them enough evidence to show my domicile in the US. Also, after I submit these documents through CITIC bank, is this a "one chance" deal where if the evidence still isn't enough, we have to start all over or is it a back-and-forth process until we meet their requirements? Secondly, will my wife need to interview again? She said that before leaving the visa officer said there was nothing wrong with her interview but that they needed more information. Aside from the two white pieces of paper mentioned earlier, we have not received any further information from the embassy.I have not seen anyone else mention that a job in the US is mandatory although I understand it can be a big help. Thanks for any advice/information others can provide.
  3. I recently received a message like the one below after my wife's visa interview in Guangzhou. She studied in the USA on a student (B1) visa. The thing is, they are asking me for something I am unable to give them: "Passport with valid B1/B2 visa". First of all, they already have her passport, although it is a new one and does not have the B1 visa. However, the wording of this really is strange. It says VALID B1/B2 visa, and her visas in her old passport are expired, so I am unable to provide a VALID B1/B2 visa, nor could I as they already have her new passport. Does anybody know what is going on here and how I should proceed? Thanks sincerely! -Josh Dear Applicants, /尊敬的申请人, Under the section 221(g) of the Immigration and Nationality Act, the Consulate General is unable to issue you an immigrant visa at this time. 4. So, the jealous ex is at it again... My wife is formally on China’s blacklist, or those that are forbidden to buy anything extravagant or travel. She tried to buy tickets for a family trip to another city and was denied because she was trying to buy good tickets. Her ex went to the court to say she wasn’t paying him per their divorce agreement (she had) and then saying she denied him access to his daughter (she hadn’t). She’s been to 2 different judges on 5 occasions and each time they say they will take her off, but nothing seems to happen. A question- is this something to be concerned about for a spouse visa application? Would they deny her in the consulate? Anyone else have issues with the blacklist? She’s obviously upset, and I’m concerned and frustrated. I don’t understand how he can lie to the court without being in trouble himself, but then again there is a lot that happens there I’ll never understand.
  5. Hi there! My fiancee doesn't know what the type of membership with the CCP she has. She just says she is the lowest level of member. She joined as a student and hasn't done anything else besides pay her dues. I see a lot of talk about "rank and file members" when talking about the CCP, but I feel like that's always in relation to a job that has "rank and file" duties. I may be totally wrong. I'm just confused. Can anyone clarify this for me? Thanks, Matthew
  6. Hi All, Need some help.. I started the following topic to know about the average time for the visa process and understood from Randy that it would takes about 2 weeks or so.. http://candleforlove.com/forums/topic/48372-how-long-does-it-take-to-get-passport-and-visa-after-the-interview/?p=626561 I haven't yet been able to find any information on how to get some kind of document which allows me(foreign national) to travel back to Beijing from Guanzhou while I wait for my passport and visa packet Has anyone done this before ? ("This" as in coming back to Beijng while your visa is being processed in Guangzhou)? Or is it that most people would wait in Guangzhou for two weeks until they pick up their visa and passport in Guangzhou CITIC bank pick up centers? For Chinese nationals, of course this is none of their concern since they can travel with within China. I need this information so that I can choose my pick up center Beijing (if I could travel back to Beijing without my passport) or Guangzhou (if I do not have any choice). Any information regarding this is helpful, thank you all in advance!
  7. Our case is at Guangzhou. She has passed the interview. However, the status was "Issued" but then I was contacted to send a document that was mistranslated (her mothers name from Chinese into PinYin). We got the correct document, and sent it via Citic bank 3 days ago. CGIFederal has changed from "Your passport is still with the US Embassy/Consulate" to now showing "Document Delivery Information:" but no location, just blank. Does this mean it's in processing, on the way, or has arrived? Any ideas how long?
  8. Received a heart dropping email this afternoon! We listed my husband's nickname on the application. I remember reading a comment somewhere on this site that mentioned NOT including any nicknames, but in my family and friends affidavits of relationship, they all referred to my husband by his nickname (since his birth name is hard to pronounce). At the interview, the officer did mention it, and asked my husband why, he told them the truth. It's how most people refer to him. The email said that a visa cannot be issued until they receive "certification regarding your use of the alias XXXX". I'm freaking out, we have no official paperwork to show his given and nickname are the same people. What can we do?? Will I have to start all over?? I did a quick google search and found something called a One and the Same Person Affidavit. It's to be written by the beneficiary swearing on oath, explaining exactly why they have this name. Will this be enough? I feel so stupid for ignoring the advice I read here! But anything to help is appreciated!!
  9. My wife had her interview this morning in GUZ, we had everything prepared very well. My wife is a CCP member but they didn't seem to care at all. They were mostly looking at my income, and asking if we could get a cosponsor. I have a job offer in the US for well above the requirements they need above poverty level. But it's just that, only a job offer, and I have not formally accepted it yet pending salary and benefit negotiation. They didn't think this is enough. My situation is as follows, originally I was going to have my father sponsor me, he is retired and is receiving his pension, social security, and my late mothers pension as well. He has a very sizable savings, would they generally be able to accept a retired person as a cosponsor? He is single and has no dependents. My wife got a green slip and no blue slip, they basically insinuated to my wife that as soon as she had cosponsorship that she would be able to get her visa. Attached is the green slip https://ibb.co/bJHOkQ
  10. I'm about to submit our DS 260. My meaning is that we'll need to fly to Guangzhou for the interview, if all goes well and the visa is issued, how will we fly back to our current city, if the office keeps the passport? Anyone have experience with this? Thanks!
  11. Hello everyone, We applied for our DCF about a month ago, and we received the news of filling out the DS260 and passport copy, photos, etc yesterday night. We received unfortunate news of my mothers passing and rushed here (Texas) from China to attend my mothers funeral, and we will not be able to return to China until July due to I have business here. Will someone be able to turn in these documents through CITIC Bank on behalf of us in China? They have all of the documents already. Please advise Nathan
  12. My wife (not Chinese) will have her interview in Guangzhou on Monday. She's has to fly back to Beijing so we'll take her passport and then mail it back to GZ via CITIC as others have mentioned. Then they'll mail it back to her via CITIC as well. But something just dawned on me: How will she be able to pick up her passport from the CITIC Bank without a passport to identify herself to the bank? Does the GZ Embassy give you some sort of paper to use to identify yourself to CITIC to retrieve your passport? Just worried about winding up in a catch-22 situation here. Anyone have experience with this? Thanks.
  13. Hello everyone. During my interview i forgot to submit one document, so a consular made me send it through CITIC bank with my passport as I am a foreigner who was applying for K1 in GUZ i had to go back home and needed my passport. So right now it's more than 2 weeks since they've gotten my passport with the required docs and still no visa issued.... But CEAC site keeps changing my visa status from READY to ADMINISTRATIVE P then ahain READY and again AD... Did anyone have same experiences? Do you know how long it usually takes to get a visa in my case... Thanks
  14. Hi...Is anyone aware of any extraordinary situations right now in Guangzhou that may be affecting Wait Times for K1 Visa Issuance? I know that each case is different but after my fiance was told that she was approved during her interview her visa was held up in Admin Processing for a month as shown on the CEAC site. It turned to Ready over a week ago but hasn't changed. I emailed them and was told that computer issues had slowed down the process but my fiance is acquainted with others who interviewed later than her and they have already received their visas so our concern is growing. Plus I really can't find any good information on what 'Ready' really means for those who already interviewed. Does anyone have any insight? Thank you.
  15. So, we received the notice that we can go ahead and book an appointment, and when logging in, only dates for the next couple of weeks show as available. Actually, when I logged in this morning, the only available dates were May 4, 9-11. When I logged in again now, dates the following week now appear (May 17,18). There are no available dates in the months after that (all the way to the end of the year). It's great dates are available so soon, but we can't book an appointment until July (because we have to get a police report from my wife's home country and it takes 2 months to get it and her embassy wouldn't let her apply for it until she had the paper from the US embasy saying she needed it). So my question is, do dates become available later on? In other words, next week dates will "free up" one month from now, etc.? How does one book an appointment later than the dates that show now? It can't be that these are the only available dates until the end of the year. Screenshot:
  16. Hello again community. I'm asking this because I want to know if it's common for administrative incompetence to get in the way of getting the visa for the spouse to go to America. My husband had his green card interview and everything seemed to go okay. According to my husband, he asked his interviewer if she needed the translations of all his police certificates and if everything was correct. She said she didn't need the translations, everything was correct, and the final words she said to him were "You're all set." Sounds like everything is good to go for the visa right? Well now, we get a letter saying he is unable to get the visa now because they need: -two new visa photos taken within the past 6 months -a notarized birth certificate -a notarized marriage certificate -a notarized police certificate (it is not specific whether this means a Chinese police certificate, even though we did all that needs to be done to get the white book and everything with it) -notarized English translations of marriage certificate and police certificates from both the Netherlands and Spain My husband brought all this stuff (and much much more) to the interview. His interviewer blew it off and acted like it was unnecessary, now we are here. We will try to call the embassy Monday to see what is going on. Would arguing this situation help and result in a "Sorry, just send what you have to us," or would it be better to just tediously gather up all these documents once more? I've read about administrative incompetence causing couples to not get the visa, but I would have never thought it would happen to us...
  17. I'm referring here to the interview in Guangzhou. My wife (beneficiary) is non-Chinese, so she needs her passport to travel back from GZ to Beijing after the interview. So I'm wondering how long she'd have to plan on staying in GZ to get her passport back after the interview. I read on this forum that apparently you can take your passport back after the interview and then once you travel back home (ie. Beijing), then mail it to GZ for final processing. Any idea how long that takes and if it delays things? I'm trying to figure out the whole timetable in advance due to various other factors. Thank you.
  18. Hi guys, I had asked a few questions here after my wife's interview on Feb 2016. Thanks for all your supports. We finally gathered the required documents. One pain in the neck was police report from Kenya. Okay, background: She got the green slip, yes green paper not blue or white or pink, at her interview. The title is Final Processing Letter. It requested to submit required documents and my wife's passport. Question: Since they requested the docs and her passport together, does it mean the AP process will be done faster? How long will it take normally? Thanks guys!
  19. Been looking it up so much on here, visajourney, and Google but haven't been able to find any approximate processing times for the AP for CCP membership this past year? My wife and I will DCF in May, interview hopefully in July, and on from there have to blue-slip it until they get the AP done and over with... how long has it been taking lately? Nathan
  20. After almost 3 months in Administrative Processing for CCP (wife was preliminary approved in November 2016), we received an email yesterday with the following: Dear Applicants, Under the section 221(g) of the Immigration and Nationality Act, the Consulate General is unable to issue you an immigrant visa at this time. If you have already submitted your passport to the Consulate General, we will keep your passport with your file pending the issuance of your visa. Further consideration will be given to your visa application after you meet the following requirement(s): REQUESTED DOCUMENT(S): • For All Applicants: Please submit a passport (with at least 8 months validity) and two new visa photos taken within the past 6 months. Starting November 1, 2016, colored or eye altering contact lenses or eyeglasses is no longer allowed in visa photos. For further details on photo requirements please visit: https://travel.state.gov/content/visas/en/general/photos.html THEN, it states when our police check, medical report and DS-260 will expire. THEN, at the bottom, it states WARNING: IF YOU FAIL TO TAKE THE ACTION REQUESTED WITHIN ONE YEAR FOLLOWING VISA DENIAL UNDER SECTION 221(g) OF THE IMMIGRATION AND NATIONALITY ACT, SECTION 203(g) OF THE ACT REQUIRES THAT YOUR APPLICATION BE TERMINATED. IN ADDITION, APPLICANTS WHO WAIT MORE THAN A YEAR TO PURSUE THEIR CASE AFTER A 221(G) REFUSAL MUST REPAY THE IV APPLICATION FEE BEFORE PROCESSING OF THE APPLICATION MAY RESUME. Im confused. Is this a denial or the part where they will put in the visa? If so, why do they make the wording sound like a denial? Any help is much appreciated! Thanks! -Flash
  21. Its impossible to contact them as they have no clue about how long it would take. By the way I am getting K-1 visa in the third country...i donno if there is any problem about it.. Anyone who can share their experiences - pls help
  22. Hi, I gave CR1 visa interview at New Delhi, India embassy. After interview they said congratulations, you visa has been approved. When I went to pick up passport after 4 days, they gave me 221g mentioning that there is something wrong with China Police Certificate. Now our case is in administrative processing. My current police certificate is attached. Can someone please share screenshot of their police certificate (you can hide your personal information) so I can find what is wrong with police certificate i submitted.
  23. Guys, Thanks for greast webpage. Hoping someone out there with some relevant help and advise at hand. I have lived in Shanghai for some years for work. I am now in the US for the same work. I am Danish Citizen. I met my wife in Shanghai (chinese citizen from Fuijan) and we got married here in the US as its just way easier. She went bak to Shanghai for her L2 dependant interview (, I am on L1-visa) . She had same 2 weeks ago and everything went fine. Marriage certificate and all other docs were in order. VO had no further questions. A supervisor still decided to put her in AP and handed her a pink form for same. Told her 4 weeks or more... no further documents asked or anything else... they kept her passport... As she of course was upset she did not asked more into it as it was no way expected. Now, we have our honeymoon in 3 weeks time and I am starting to get worried... I have read on the american chamber in Shanghai that the Shanghai consulate are down to around 3 weeks in AP wait time, but I have read so many different stories that have no idea what to expect... does anyone out there have similar experience or advise on what / how to approach DOS? I have seen people posting that they have been in contact with DOS, but no idea how to do this... my company lawyer is of little help and jsut advise me to wait and tells me its "usual process"..... well... Hope anyone out there can share or chip in... thank you guys! brgds Peter
  24. Hello candelforlove community. My husband (who is Spanish) just completed the DS-260 online and I (an American) am getting all the required documents together. We both live and work and Guiyang and were wondering how the process works after the interview. He signed up to receive his passport with the visa at the Guiyang CITIC bank. So that means, after his interview in Guangzhou, he will have no passport, thus no way to return to Guiyang. How do these types to of situations work? Do we stay in Guangzhou until he receives his passport?
  25. Hello, we provided the required documents to the consulate and our case was touched the 21st. Today the status changed to ready with a case creation date change of the 22nd. Are we close to issue?
