After almost 3 months in Administrative Processing for CCP (wife was preliminary approved in November 2016), we received an email yesterday with the following: Dear Applicants, Under the section 221(g) of the Immigration and Nationality Act, the Consulate General is unable to issue you an immigrant visa at this time. If you have already submitted your passport to the Consulate General, we will keep your passport with your file pending the issuance of your visa. Further consideration will be given to your visa application after you meet the following requirement(s): REQUESTED DOCUMENT(S): • For All Applicants: Please submit a passport (with at least 8 months validity) and two new visa photos taken within the past 6 months. Starting November 1, 2016, colored or eye altering contact lenses or eyeglasses is no longer allowed in visa photos. For further details on photo requirements please visit: https://travel.state.gov/content/visas/en/general/photos.html THEN, it states when our police check, medical report and DS-260 will expire. THEN, at the bottom, it states WARNING: IF YOU FAIL TO TAKE THE ACTION REQUESTED WITHIN ONE YEAR FOLLOWING VISA DENIAL UNDER SECTION 221(g) OF THE IMMIGRATION AND NATIONALITY ACT, SECTION 203(g) OF THE ACT REQUIRES THAT YOUR APPLICATION BE TERMINATED. IN ADDITION, APPLICANTS WHO WAIT MORE THAN A YEAR TO PURSUE THEIR CASE AFTER A 221(G) REFUSAL MUST REPAY THE IV APPLICATION FEE BEFORE PROCESSING OF THE APPLICATION MAY RESUME. Im confused. Is this a denial or the part where they will put in the visa? If so, why do they make the wording sound like a denial? Any help is much appreciated! Thanks! -Flash
  3. I will be using my brother as a Joint Sponsor on the I-864. His income is obviously stated on his tax returns from every year and every year his income has been well above the Federal Poverty Guidelines. Is a letter from his employer verifying his current salary a required document? Thanks for your help! -Flash
  4. To be in compliance with your instructions, you would bring original copies of everything you have submitted. My guess is that you won't need them, however. The person accepting your application may simply have not taken the time to sort through what was needed. Thanks alot Randy! Always so timely and helpful! Better to be safe and just bring everything!
  5. On the DS-260 Form, in the "Security and Background Section", one of the questions is: "Are you a member of or affiliated with the Communist or other totalitarian party?" The wording/tense of the question is what I am confused on. I have read through tons of CCP related posts on here, but still don't really know how to answer this question because I thought the question was supposed to be "Are you or have you ever been affiliated.....blah blah blah with the CCP", which includes the past tense aspect of it. Anyway, here is my wifes case: In 2012, her senior year of college, an advisor came to her (because her grades were top of the class) and suggested attending a training day/class affiliated with the Party. The advisor insisted she go so she went for the one day, paid a small fee to get a certificate, and that was the end of it. She never participated in any other events and hasn't paid her dues since that one time in 2012. I know even this one event counts as CCP related, but still need to know how to answer this question. Should I put down "Yes" and then provide the explanation I just mentioned? I thought at the time of the interview was the time to answer this question and then post interview fill out the CCP Waiver. Any help and clarification would be much appreciated! Thanks guys! -Flash
  6. I just filed the I-130 in Beijing this week. When I was submitting everything, I also submitted all the evidence of bonafide marriage: Affidavits From Family, Shared Financials Evidence, Translated Rental Contracts showing living together past few years, Photos of Us together and with family and Letter of Evolution Letter. My question is this: Since I have already submitted these things at the time of filing, do I need to bring another copy of these at the time of the interview? Thanks for your help! -Flash
  7. My brother will be the co-sponsor and will be filling out a I-864 as well. Is it okay if after signing the document, he scans it and emails it to me to print out, or does he need to send it to me through the mail all the way from the U.S.? In the I-864 Instructions, it says "Each affidavit must be properly signed and filed. For all signatures on this affidavit, USCIS will not accept a stamped or typewritten name in place of a signature". It never says anything about not allowing scanned copies, so I am just curious if anyone knows through experience if they allow it? Thanks for the help!
  8. So a few weeks ago my wife and I went back to her hometown to get all of the whitebooks and also to have her old divorce certificate made into a whitebook. Anyway, the local ֤ couldn't get it done in time, so they said they would send the documents to us in Shanghai. We got back to Shanghai during the time when the Typhoon was rolling in. It was raining non-stop throughout most of China for several days. When the documents arrived, they were pretty wet and a few of the corners/edges of the Whitebooks were a little worn down and ripped from the water damage. We dried them out and there is no damage to the ink or anything. You can still read them without a problem. There simply isn't enough time to get new ones made and sent to us, as I go to Beijing on Monday (3 days from now) to file. My question is: Will the consular officers care about the minor damage to the corners and the documents not being in perfect condition? Thanks for your help! -Flash
  9. I have been looking through the forum and several people have mentioned themselves or their spouses having a prior divorce. They mentioned to bring the divorce certificate to show them the previous marriage was terminated legally. There was never any mention of the certificate needing to be translated or notarized. In my case, my wife got divorced a few years ago. She has her divorce certificate, but it is only in Chinese. Do we need to get this translated and notarized? If so, does it matter where the translation/notarization is done? We live in Shanghai and her hometown is in Hunan. We already went back last week to get all of the White Books needed for filing. I will be filing the beginning of August in Beijing. Any help and information would be much appreciated! Thank you!
  10. Brian, I am curious to know if at the time of your interview, your wife was an active member of the CCP or if she was just a member in the past and ended her membership? Over 1 month later, are you still waiting for the final processing of that additional document?
