Firstly you will need to remove conditions from the two year card by filing an I-751 and get the 10 year green card, or be in the process of getting the 10 year card befor entertaining citizenship. She can apply for citizenship after 3 years of residency based on marriage to a US Citizen. For my wife the big advantage of citizenship was her ability to file petitions for her mother and sister, her mother now has a green card and is living with us, her sister's petition will be another 11 years or so before a number comes up at which time her sister can make the disision to immigrate, bringing her son and husband.

Thanks for your advices. My wife should have round trip airline tickets when she travels to/from U.S.. Does that help her at POE even though her I-130 may still be pending? Quite often a round trip is less than a one way ticket, so people often buy RT and abandon the return trip. Showing intent to return to a job may help, though I can't remember anyone posting being denied entry at the POE on a visit visa with an I-130 in process. But It can happen,

Do you live in Beijing with her? If so, why not wait until closer to the time she intends to move to the states? If living in China the processing time from filing an I-130 to getting the spouse visa is around 4 months. DCF. Or you could always take an extended visit shortly before intending to immigrate and file the I-130 there for the faster process. Lastly if this is done closer to 2 years of marriage the resulting green card will be a ten year unconditional card if use of the IR-1 visa takes place after 2 years of marriage. 1. Yes the visit visa is still valid, however the POE may or may not block entry if they suspect she may simply stay in the states and file an I-485 to adjust status based on the pending I-130 2. No such thing. At one time a person may file an I-129F for a K-3 visa, but that was at a time when the I-130 was taking an excessive time to process, now a days they simply tie the two petitions together and send them together to DOS at the same time where NVC drops the I-129F. 3. The B-2 is the only option.

You can always apply for and become a citizen, after which a spouse or fiancée visa is much quicker to process than a spouse of a LPR. -

Sounds more like they are looking for green card holders NOT living in the USA, not persons who live on the states and simply visiting the home country for a short time such as a month or so. -
It’s DOS that issues the case number, the office In Beijing you dealt with is USCIS.

If you submit and it’s accepted DCF, you can always contact USCIS withdraw the first petition explaining you filed a second iat the local Field office on China. You will be out the fee though.

Cumulative, basically living in the states longer than total time away. Being out of the country for 6 months consecutive will reset the clock, not a few weeks. Can file the N-400 at 90 days prior to the three year mark. -
One other option would be INFOPASS appointment, asking what the hold up is, and asking nicely if they will rubber stamp her passport with an I-551 stamp to allow her passport to serve as a temporary green card while they are working on her naturalization. The I-551 stamp tends to be valid for a year.

Unless needing an unexpired green card for something you could always hold off on filing that I-90 form and wait. LPR status does not expire with a 10 year card. https://www.uscis.gov/sites/default/files/USCIS/Resources/B2en.pdf Read carefully, the implication is you “should” renew within 6 months of expire date however also says can file the I-90 after the expire date.

I advised a friend to not take the EITC when filing her taxes this year, she filed without claiming it and a month or so later the IRS sent her a letter insisting that she qualifies for it and they cut her a check for it. I wonder how that will fly when she applies for citizenship? The OMB DATE is not the form expire date, it's just a date that USCIS needs to finish a survey for the Office of Management and Budget as part of the paperwork reduction act. The form remains valid until a newer edition is published. The current form was released 2/27/17.

More than likely they confused the I-751 with the I-90 The I-751 for removal of conditions is taking a year or so to process the I-90 is simply an application for a replacement card so should be quick. -

Not correct, an IR-1 or CR-1 visa has the I-551 notation on it which makes it a temporary green card, green card holders are work authorized, no EAD needed. The visa with I-551 notation is all that is needed to apply for an SSN. Do not assume checking the box on the visa application will generate the SSN card, go to the SSA office and apply for a card in person.
