  1. Correct, marriage in the USA is not fraud, its the use of a visit visa to immigrate that is the fraud. Also in this case adjustment of status after a marriage is not an option, the adjustement of status requires an immigrant petition that would result in an imediate visa number, typically in the unlimited visa class such as in the case of a spouse of a US Citizen. The only scenerio in where an adjustment of status may work would be this, they marry after getting green-card, she files an I-130 and he returns home to China without overstaying, and 2 years or so down the line he were to come here after the petition has been assigned a visa number and while visiting they decide on adjustment of status, in that case it's possible, but then again it is advisable to go through the normal interview process in Guangzhou for the immigrant visa.
  2. This is not a problem as long as he could get a visit visa. Also could from time to time visit the states while the immigrant visa is in process using the visit visa. Visit visas tend to be valid for up to 10 years allowing multiple entries. As for the "Love Boat" wedding, I think how that one works is to apply for a marriage license in your local jurisdiction and then while on the cruise they simply do the ceramony and captain acts as an oficiant makes it legal and once return home turn the license into the local clerks office and receive the marriage certificate.

  4. Citizenship process tends to be 6 months to a year, it's really not that hard, yes, some English comprehension is tested for but not all that complicated. My wife became a citizen 4 years after getting permanent residency.   10. A couple notes. Police reports are considered valid for up to 6 months, so don't run out and get one too soon, best to do this a few weeks before the visa interview. Also if the report comes from the police office and needs translation she will need to take the report to the notary office and get it translated they will make a "white book" of it.

Gaps in your employment will have no effect on approval, the consulate is only concerned with how the sponsored immigrant will be supported if your employment record and status does not satisfy them they will ask you to get a joint sponsor. Also, the consulate treats the I-134 like an I-864 and tends to require the same kinds of financial evidence attached to the I-134. K-1 visa is a Non Immigrant visa, and as such does not use the I-864 or I-864A, you will provide an I-134 and your joint sponsor will also provide an I-134 affidavit of support, you should use the same sorts of financial vidence as you would and will later use for the I-864 when applying to adjust status in the states after marriage. If moving to China in March, why not simply marry there and file for a spouse visa to the consulate, the fees at less, and spouse once arguing in the states would immediately get green card status allowing work and travel. This type of filing tends to process in less than 4 months.

  18. Permanent residence status does not expire with the card, the rule is a person should file an I-90 to get a new card at their earliest convenience around or after it expires. In your case, if filing an application for naturalization you could do so now and if the citizenship interview happens before the card expire date great, if not and it happens after that date, again it's not a big issue. If really needing evidence of residency status, then file an I-90 around 90 days prior to expiration to get a new card, but it would suck to pay the $455 to get a new green card only to obtain citizenship around the same time the card gets replaced and then turn in that $455 greencard.

Simply doing the 1040-EZ for past years, mailing them off to the IRS and attaching copies of the returns to your I-864 that you will provide at the interview is proof enough, signing the I-864 form is swearing under penalty of perjury that the attached copies of your tax returns are the truth.
