  1. Hi to any old-timers here, it has been 8 years since I was here last. After losing my Xiaoli I moved away from my home town and got a new career, but no luck on the personal front. But that's not why I am here; I came here to seek advice and information for a coworker. I work with a sweet little Chinese bride who has her green card, is working on citizenship, and just had a new baby with the man she loves. And before anyone here gets the wrong idea, I'm not envious of her husband (she's barely half my age) I actually envy her father. She has her younger sister here attending university on a student visa, and her mother is here on a visitors visa to help with the new baby. Her question to me was "is there any easy way to get her mother here permanently as part of her family?" I have no idea as that was not something I had researched in the past. And all her Google searches turn up sites and publications that neither she nor her husband can understand. But then I remembered how much help and guidance I had received here and thought how could it hurt to ask. Her mothers visitor visa probably doesn't last much longer (I didn't ask) and she is OK with her going home to China for now. But she would really love to get her here permanently to help with the baby as she and her husband both work fulltime and once her sister graduates she will be going back to China, so no one will be left to help with the baby. Since I'm not asking this for myself, but for her and her husband, please don't be offended if I don't promptly acknowledge any posts or advice offered. I will need to either tell them what I have received here, or, ask them for further info you all may need. And since I know probably the first suggestion will be to get one or both to sign-up here, yes I will try. Thanks in advance for any advice or suggestions!

  3. Hi friends, I have a question for my friend. She is a citizen now and she applied for her brother to immigrate to America in 2013. There are negative information about petition for siblings.   4. My father in law who is 75 years old and a US citizen petition 1-130 for his adult son who is married with 2 kids and his wife this month. The priority/receive date on the letter is 12/10/18. The preference classification on the letter said "201 A3 INA ADULT CHILD OF USC." 2 questions: 1. Can someone give a rough estimate how long is the waiting process now, from beginning to end? Is it minimum at least 6 years, or 10 years wait, or more etc.? 2. What does the preference 201 A3 INA ADULT CHILD OF USC means? Is this preference on top of the list, middle or bottom priority?   5. See related posts below by me here under Now no advantage for US citizen for background story. ...... Just checking on all our options and doing some contingency planning. Pregnant unmarried adult step daughter faces the possibility that after her Priority date comes up, she may be unable to travel to USA to get her green card because of safety concerns (pregnant, late in the term, long flight etc). What happens if her priority date passes, she interviews, passes and everything is fine but because of pregnancy late term she is medically unable to travel to USA to get her green card? Can she come to get it 6 months later? Can she wait 12 months? If she doesn't get it in 12 months does she have to start at the back of the line? Thanks for your help!
  6. Haven't been around the site for a few months as I have been buried at work. Need some advice! Facts: - wife is US citizen and her unmarried adult daughter in China is now just 24 days away from an F1 visa slot. [F1 China line has moved forward VERY slowly recently, only 7 days in the past 4 months.] - daughter is almost 34 years old, engaged and anxious to start a family (wants to have a baby before she gets "too old" and by Chinese standards she and future mother in law and her mother all think she is already "too old". Lol). She is also trying to line up a job in USA, but is not sure what to tell potential employers about vacation travel plans as she wants to get married ASAP. Questions: 1. Assuming her visa slot date comes up in the next several months, is there any way she can get her Green Card while in China (e.g. Without actually coming to USA) so she can then get married in China as soon as she gets green card approval? Then come to USA? 2. If not, then she will need to come to USA to physically get her green card and credentials. Assuming this is the case, is it better (better being defined as faster for her future husband to be reunited with her) for her as new green card holder to (a) return to China to marry, (b) bring fiancée to USA to marry (he has a tourist visa so I am thinking that will be a huge problem), © bring him to USA on tourist visa and marry on a cruise or in Caribbean country outside USA. He would then return to China to his job to await his green card. They don't care about big wedding, just whichever way can get him here fastest with his green card that won't create any issues or risks. They want to start trying to have a child as soon as they are married as she is concerned that age 34 (or later) is "old" by Chinese standards to have a healthy baby. On a related question, when she finally gets here she might not have a job (or a full time job with benefits) right away. Any suggestions for medical health insurance policies I can buy that might also cover maternity costs? Would she be eligible for an Obama care subsidy? Not sure if she will be living with us or in another city with better job opportunities yet but she is too old for me to add to my work policy as a dependent.   8. Greetings: My Wife's son (step-son) is going through the final stages preparing for his interview on 23rd of June for his CR-2 Visa. The process has changed a lot and I've searched the forums here for any recent information pertaining to the consulate process for CR-2 Visa. So far he's getting his medical scheduled at which time he is required to bring the Following: 5 Visa Style Passport PhotosThe Guangzhou IV Appointment letter received via emailShot RecordsPassportQuestions: Is he required to bring the DS-260 Confirmation Page ?Appointment Confirmation Page?Finally I've heard of a "document turn day" what is that ? I've tried to find this information within any of the documents that we have received from the consulate, I've also tried to find any information on the CGI website, (http://www.ustraveldocs.com/) but yet found no information about a "document turn in day". I'll be traveling to his interview but my wife will remain in the US. Any other information would be appreciated. Dan Seattle
  9. My step son, who is now a US citizen, has recently applied for his wife (who is in China) to come here to US. He filed I-130 form. Recently, I suppose it was approved and his wife has received an appointment for interview in Guangzhou. The two of them were married here in US while she was here on student visa. Her visa expired meaning she had to return to China, and has been there over a year. I believe she is applying for the F2A Visa. If all goes well with her interview, how much longer might this process take? I have heard that it is fairly immediate that she will be able to return here. Thank you very much.
  10. Hello all CFL members ; I just checked my wife's I-130 petition status on line for her 13 years old son and it said it was denied on Feb 7 ,2017 . Have not received the letter and the explanation for denial reason . He was living with his father but he is biological son of my wife . His father has recently signed a transfer for his custody to my wife . We did not include this court document in the I-130 application . My wife has been in this country for over 5 years and still maintaining her LPR status . I am confused what could be the reason ? Waiting anxiously for the USCIS letter . Anyone who wants to guess ?
  11. F2B Legal Permanent resident is now faster than US citizen. (at least for this month it is) - see July Visa bulletin http://travel.state.gov/content/visas/english/law-and-policy/bulletin/2014/visa-bulletin-for-july-2014.html. I believe a US citizen can request the faster of F1 or F2B. Can anyone confirm? FAMILY-SPONSORED PREFERENCES First: (F1) Unmarried Sons and Daughters of U.S. Citizens: 23,400 plus any numbers not required for fourth preference. Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, plus any unused first preference numbers: A.   12. We decided to file the I-130 for my wife 30 year old single daughter. I wanted to have her apply for visitor visa first but she got advice from an agency in China that there is no way her daughter would get a visitor visa while we wait out the I-130 process. We received the I-797 and were assigned to California service center WAC********** My question is does the 6 to 7 year wait start from the day they received the application? I see that at that service center they are working on May 2015 for approvals of unmarried children over 21 was hoping the clock doesn't start ticking after the approval. Can anyone who was in this situation share how that works when the clock starts...Thank you
  13. I am 20 years old. My biological mother filed me for IR-2 and the interview will begin in couple of days. Here are some questions, thanks. 1. Could anyone who had such experience tell me the interview process and what kinds of questions will VO ask? 2. I cannot find pics with my father and the photos taken with my parents recently. They also don't come back often. Will the scarce of such material interfere my application? What should I do? I would appreciate anyone's response!! Thank you very much!
  14. Wife asked me to talk to lawyer to get her nephew to come here to live. He is 28 years old. Is this even possible? I guess I will call the lawyer and ask him but I thought I would ask here. She just got her 10 year green card. It does not matter to me. We have the room and I like her family. But I did not think a family member could come here and live just because they wanted to (from China to Tennessee).
  15. Hi all. Hope everyone is doing well. My wife and I are beginning our research on options for bringing her parents to the US. They are both over 65 and we are trying to learn what assistance, if any, they would be able to receive once they are here such as assisted living, health insurance options....etc. as they would like to have some independence of their own. Can someone who has experienced a similar situation share what you did or point us to existing posts on this topic. Any assistance or input would be greatly appreciated Thanks all! :-)
  16. Been a while since I have been here. My wife has been here now for long time. She became a citizen this past April. All is going well. One question however.. We applied for her son to come maybe 5 years ago. We hear little or nothing from USCIS. We were told when she became a citizen it would speed up the process. The only number we have comes up as not a good number. So, does it take this many years, with very little communication? He is now 28 years old... Appreciate any suggestions. Jim
  17. Hi, I need to know what options may be available for getting my 22-year-old stepson here on any type of visa. My wife is here with me on a greencard. She heard that it is impossible for my stepson to get a visitor's visa. I have no idea if that is true. We have already applied for him to get a greencard, but we want him to be able to visit us.   18. My wife and I will be filing the get permanent residence status for my mother in-law, my wife's mother. She is here on a B2 visa now and is getting older and will not work here, also she partially blind. I think I have all the forms for this: I-130 filled out by my wife I-485 filled in as her mother I-864 filled in by myself I-693 filled in by wife G-325A about her mother The questions that have on the forms are: The I-485 Part 2 I am applying for an adjustment to permanent resident status because: (letter H) Not sure what to put, don't want to get denied. Do we file all the documents at the same time? USCIS does not make it easy to figure out. Any help would be great. Frank & Stephanie

  20. Hey guys, This one is a bit convoluted, but it's for a friend who needs some help. I think the answer is to have him contact Marc Ellis or someone similar, and I might need that contact info for him. My buddy is married to a Chinese woman, and they are both here in the states. She claimed asylum, and then they were married. She has her green card now, and they are doing well. She has 2 daughters in China, who are living with friends of hers. They have been there for 3 years. She sends support to them constantly, and talks to them every day on video. Now that she has her green card, they are working to get her daughters here in the US. The daughters are ages 6 and 12. Within the last month, my buddy and her traveled to China to get the daughters their passports, so that they can work through the process. They have already submitted I-130's, and those are at the NVC stage. The problem here is that the friends now want $20 k for my buddy's wife to bring the girls to the US. They never let the mother see both of the girls at one time - in effect, they are holding the girls hostage for a cash payout. The mother has never signed anything giving these people the rights to her kids, but the kids have lived there for 3 years. Although they are well taken care of, they really want to be with their mom. No knowing the laws in China, my buddy is pretty confused, and doesn't know where to turn, so he asked me if I knew of anyone that could help. any ideas? My first thought was to get him in contact with someone familiar with the laws in China, and also familiar with immigration law in the US. To me, that would probably be Marc Ellis or someone similar.
  21. Hi everyone, I would like to get some suggestions on my parents’ green card interview scheduled in early Jan. Some background information: parents both in their mid 70s. My mom is healthy but dad has colon cancer. It has been two years since his diagnosis. The cancer seems to be under control now and there might be another surgery coming up to completely get rid of the tumors but the decision has not been finalized yet. Side note: They actually got green cards approved a few years ago, but their SB1 visa (returning resident visa application) was denied in Guangzhou in 2014 because ‘protracted stay abroad was not caused by reasons beyond control’. To be more specific, they applied for green card while they were in the US a few years ago and left US with advanced parole before the green cards were issued. SB1 visa was denied because they didn’t return to US within 12 months of the advance parole, as we were told by the officer even we have the physical green cards. My questions are: I know cancer might potentially impact the interview results due to the public charge factor. What is the possibility that they will be denied? Does anyone have similar experience? Do we need to prove above and beyond financial records for support for my dad? Do I need to get a lawyer to help me? Any suggestion is appreciated. Thanks for your help in advance.

  23. We filed an I-130 for my stepson 7 years ago. A visa should be available in about 10 months. Recently he learned he will have to move because the government wants the building he lives in. I was looking at the online change of address at the USCIS website but it seems to be more for if I move not him. After some serious head scratching I decided to ask here.
