  1. Hello GUZ; My USC petition for my step son ( 13 years old ) just got approved . My wife is in China now , It would be most convenient for her to prepare any notarized documents while she is there . Can you tell us what are going to be needed for minor child from China ? Thanks.
  2. Greetings: My Wife's son (step-son) is going through the final stages preparing for his interview on 23rd of June for his CR-2 Visa. The process has changed a lot and I've searched the forums here for any recent information pertaining to the consulate process for CR-2 Visa. So far he's getting his medical scheduled at which time he is required to bring the Following: 5 Visa Style Passport PhotosThe Guangzhou IV Appointment letter received via emailShot RecordsPassportQuestions: Is he required to bring the DS-260 Confirmation Page ?Appointment Confirmation Page?Finally I've heard of a "document turn day" what is that ? I've tried to find this information within any of the documents that we have received from the consulate, I've also tried to find any information on the CGI website, (http://www.ustraveldocs.com/) but yet found no information about a "document turn in day". I'll be traveling to his interview but my wife will remain in the US. Any other information would be appreciated. Dan Seattle
  3. Just getting the final things together for bobs and jens CR1/ IR1 papers. I have a 3 questions 1) I-130 section C line 17. (List spouse and all children of your relative) Do i put bobs wife and son here? (There reason i ask is when i filled this out for hong i put none and had no problems.) 2) same section and same line for stepson. What should be entered here for stepsons I-130 3) section D line1 I would enter stepsons name here right? Mike
  4. My wife received approval of I-130 to bring her 18 year old son to US. This was approved on 8-25-2014. It shows they sent it on 9-3-2014 to NVC. She is US citizen so there should be no wait for Visa. Any Idea how long should we expect to receive the instructions packet from NVC? Visa Bulletin seems to indicate maybe we should call if it has been 3 weeks? Does that sound about right?
  5. Was wondering. If I go online and fill out the DS-261 to become the 'agent' for my wife's daughter, and I go through the entire process and "SIGN AND SUBMIT", will it be OK that I do this? Or will it show it was done on a computer here in America and her daughter is in China. It says on the instructions as I was filling out the 261..... By clicking “Sign and Submit Form” you are electronically signing the form. You are required to electronically sign your form yourself, unless otherwise exempt by regulation, even if the form has been prepared by someone other than yourself. Your electronic signature certifies that you have read and understood the questions on this form and that your answers are true and correct to the best of your knowledge and belief. The submission of a form containing any false or misleading statements may result in the permanent refusal of a visa or the denial of entry into the United States. All declarations made in this form are unsworn declarations made under penalty of perjury (28 U.S.C. 1746). Just want to make sure. We don't want 'premanent refusal of a visa'. Also, since the case is at NVC now, do we have to fill out the DS-260? Thanks!!
  6. Just wondering how long we have with all the new things we need to take care of for my wife's daughter coming to the US. We got the letter from NVC. Paid the $88 for the 261 (waiting for it to say "Paid" so we can see the next step. THANKS!!
  7. I filed a I-130 for my 14 year old step son in Nanjing on 10/03/2013 and received the I-797C on 10/07/203. Nothing after that for 2+ month and the USCIS online status is still showing initial review. Called NVC today and it's not in their system yet. I am wondering what is the normal waiting time between the first I-797C and the 2nd Notice of Action right now. Many thanks.

  9. Hi, My wife and daughter are both Japanese citizens, and I'm a US citizen. We live in China, currently, but we are considering moving back to the US during the years when my daughter goes to college. It looks like some things would be easier if my daughter had a green card while she is attending college. For example, it will be easier for her to get a part-time job, tuition might be lower, etc. Maybe there are other benefits, too?? As I understand it, getting a green card for her will be more difficult after she is 18. Is that true? Are there any other age limits that I need to worry about? She is currently 14. She is my wife's biological daughter, but not my biological daughter. Would it make any difference if I formally/legally adopt her? thanks ciao
  10. My wife and her son, then 16 years-old, were admitted to the USA in 2008 on a K3/4 visa. My wife go her 10 year Green Card in 2010, but her son returned to China to finish school after only 8 months in 2009. Now he is 22 years-old and wants to return to the USA. I have filled out the I-130 but I am not 100 percent sure what other document are required. What I think need to send: His birth certificate 2 photos of step son my wife birth certificate proof of marriage proof of my citizenship $420 What about divorce papers or her green card? Do I send a copy of every page of my passport? It's been awhile since I messed with this stuff and I am on a tight schedule. I am leaving for Shanghai in two days (Thursday morning), I may be gone 2 month but the wife will stay in the US. I need to get this application in the mail before I leave of I will have to pay some unknown price. Thanks for the help. I know this stuff has to be posted somewhere but I sure can't find it. Michael
  11. My wife has her green card. Daughter had a K2 but due to our attorney screwing up big time that path is closed for her to come here. We were forced to go ahead and file the I-130. Both are Chinese nationals. She was 20 at the time. Now she's older. But here's the question. I've been trying about everything to see if there's a way so that her daughter can come over here to study. She's now in London studying but has always wanted to come here to study. Can we recind the I-130 and file for the F1? Or will she always be tagged now that she 'wants to immigrate' and would not be allowed the F1. Basically what happened was our attorney told us that she could visit with the K2, go back to London, when the biometrics and interview were needed, she could come back. Of course that wasn't true.   13. We have been waiting for the green card for my son for 5 years. I didn't join citizenship because I go back to China every summer vacation, greencard is easy to back and forth. My qustions are :1) How long will still ahead to wait? 2) Can he get married during the waiting time? 3) How can they find out married or not ?
  14. Curiouser and curiouser.. I checked the dates on the visa bulletin yesterday and they are working March 2006 for unmarried sons and daughters over 21. Yesterday my stepson received a package from GZ. I'm not sure what yet. The case status shows nothing new, just the same old "post decision activity".
  15. Hi All, My wife and I were married May 2011 in China. Shortly after I returned I lost my job. I finally found a permanent position in Jan 2012. My finances did not recover until August 2012. I started become ill in September of 2012 and finally had an operation for removal of a tumor in Jan 2013. I am now recovered both financially and medically, but a lot of time has elapsed since May2011. My wife and I are concerned that immigration will hold this against us. I was wondering if any advise you can give me. I am also applying for my stepson, (he is 15 years old). Do I need to supply a separate cover letter for him or should I list his documents on the same cover letter? Regards, Chris
  16. My wife and I have been married for eight years. Two kids of our own. One is 7, the other is 2. My wife had a son from her first marriage. He stayed in China as his Dad would not let him come. Now he is 16. He will turn 17 in August. My wife is thinking let him come to US after he is finished with high school. Someone told her that she could bring him while he is 17 (next year). He can get his green card once he arrives. Apply for Advanced Parole for him to return to China to finish his last year of High School. Does this sound like it will work? My wife says a few on 001 said they have done it this way. If we wait too long. Then he would have a long wait. What is the maximum age she can bring him without waiting years for visa. Also, my wife is a US Citizen. She obtained citizenship in 2008 to bring her parents. What avenue does this provide her son if he wants US Citizenship? Does he need to apply by a certain age to use her citizenship as a path? My wife is planning for her son to attend University in the US. We thought of him coming on a student visa. Not a great option. Cost will be less if he is a resident with green card or citizenship. Any help would be greatly appreciated.
  17. I am pretty sure of the answer but again want to make sure I pass along the correct info to someone else. Once the son is over 21, the USC husband cannot file for them but rather the Chinese national mom must. Can they do this as a 'conditional resident' or do they need to be a 'permanent resident'? And I know that if the chinese national files it is probably 7-8 years (?) and if they become a USC that filing would shorten to the time for USC, maybe 4-5 years?
  18. Hi Guys, My adopted daughter was interviewed on 8/16/2011, got an blue slip. The Consulate in Guangzhou did tell us they recieved all the required documents on 10/26/2011. I comtacted on 1/10/2012 asking for case update information. The Consulate replied and said the case is under Administrative Process (AP). Could any one tell me how long the AP will take as the Consulate did not give any time frame on how long we can get an answer. Thanks. Sunny
  19. My wife has been in the US for about eight months and she is the best woman I have ever had a relationship with! We have difficulties like anyone does but other than that things are going great. She came here on a CR-1 Visa. Now we would like to bring her 16 year old son here on I assume a IR-1 Visa. I have already submitted his I-130. Recently we recieived an RFE requesting a copy of the court document submitted to change his name. Now according to my wife that is not how it works in China. She said name changes go through the Police Department. But any records kept by the Police cannot be copied. So her ex went there and received a notarized or certified document that substantiates the name change. My question is will that document satisfy the RFE? I am not so sure. I would have thought the USCIS having done this thousands of times would know there would not be any "court" document if name changes are done thought the Police. Does anyone know what I "really" need to do? Thanks a million!
  20. 1) When I was in the process of getting the CR-1 Visa for my wife, her son did not want to come with her to the US. Now as of last Sunday he has decided he wants to come. Of course we both think that is great since it is what we wanted in the beginning. He is15 and is finishing middle school this year so won't be able to come until the end of the year. My question is what is the best visa to apply for with him? Should I do another CR-1? 2) I am not sure of the legalities, but a good friend of my wife's gave us some Chinese Calligraphy to try to sell in the US. We watched him make several while we were there. He is certified by some government agency to charge so much for his work. If I remember correctly is it 10,000 yuan/sq meter. I calculated twice that they would be over $10,000 a piece! I surely don't think we can sell them for that much. Any ideas for a more reasonable price and what type of client would like to buy them?
  21. Hey Everyone! Well sort of good news from the US Government. I've been told that the Child Protection law won't help us in bringing my wife's daughter over here. She's now 20 and will turn 21 1/16/2012. Was told yesterday that's not true. If the I-130 is filed before she turns, she'll be deemed 20 when her visa is issued, which they told me for an F2A, which is what she is now, is a little over 2 years. They will subtract the time it takes to process the visa from her age when they approve it. So basically however long it takes to process her visa request, that amount of time will be subtracted from her age at that point. So when you file is the most important thing. File before they turn 21 and the F2A applies. Cool. And no 8 year wait.
  22. Hi Everyone, Hope all is going well for all of you. Our lives recently got a lot less stressful with the approval of Rosie's GC. Here's what I want to do now. Rosie's daughter is soon to be 21 (January 2012). We want to file the I-130 in the next week. But I'm just looking for answers on a few things and the amount of knowledge in this forum seems to far surpass what my attorney has in such things. As some of you might know, she had the K2 visa and our attorney suggested it would be OK for her to come to the US to visit and then go back to England and just await the 485 process there. Coming back then to do biometrics, etc. Of course sooooo wrong. But that is past and now we must do the best we can to try to help her come over here. I know they say there's an 8 year wait for a visa after she turns 21. I assume the Child Protection Law doesn't help if she ages out so quickly after the 130 is filed? How about the K3/K4 process? If Rosie got her citizenship would her daughter be allowed to come to the US more quickly? How long after the 10 year GC is issued can you go for naturalization? And after Rosie would become a citizen does things change for her daughter in how quickly she could get over here? I just want to do the very best thing we can do to try to help her daughter come over here and realize her dream of living here and studying here. Also, does it do us any good to file the 130 if we would be looking at Rosie becoming a citizen and then filing for her daughter? I know there's a lot of questions here, but we just want to do what's best. Hope you guys can help. we greatly appreciate any direction you can give us. Thanks so much and have a great day!!!
