  1. Thanks guys! The application package is in the mail tomorrow. I'll bet they will be wishing he had made up his mind before he turned 21. Maybe immigration reform will move things along. One last question -- can he file for a student visa or tourist visa while this application is pending?
  2. In 2006 it look like I also had to send a couple of G325A forms and a photo of my relative and me. These are no longer required?
  3. My wife and her son, then 16 years-old, were admitted to the USA in 2008 on a K3/4 visa. My wife go her 10 year Green Card in 2010, but her son returned to China to finish school after only 8 months in 2009. Now he is 22 years-old and wants to return to the USA. I have filled out the I-130 but I am not 100 percent sure what other document are required. What I think need to send: His birth certificate 2 photos of step son my wife birth certificate proof of marriage proof of my citizenship $420 What about divorce papers or her green card? Do I send a copy of every page of my passport? It's been awhile since I messed with this stuff and I am on a tight schedule. I am leaving for Shanghai in two days (Thursday morning), I may be gone 2 month but the wife will stay in the US. I need to get this application in the mail before I leave of I will have to pay some unknown price. Thanks for the help. I know this stuff has to be posted somewhere but I sure can't find it. Michael

She was using the video chat and could see her friend but they could not see her. I will install the international version since I will need to configure and trouble-shoot any issues. Can you simply toggle back and forth between English and Chinese characters?
  5. It seems my wife's friends and family are only comfortable with QQ. My wife can navigate to the chat service okay but cannot setup the webcam and microphone -- she is a bit technically challanged. I am more than a bit Chinese language challanged, so can anyone help? I have a plug and play Logitech webcam that worked fine when we used Skype or Yahoo. Step-by-step instruction in both Chinese and English characters would be great. Thanks!

That seems like it may take some pressure off. His birthday is not until June so I am hoping to be done by then. However, while the law you cited may apply you only have to hope the interviewer knows the law.
  8. Where on the petition would you suggest I add those large red letters? Any idea of the timing? His birthday in early June. Also, do you think including any other document, for example a copy of the earlier Approval or his K4 visa?
  9. Good - not much room anyway. What do you think about the "place filed". I believe the package was sent to NE because of where I live but immediately transfered to CA. The Receipt Notice referenced CA Service Center at the bottom. So the "place filed" would be CA? Thanks so much again Dan. You are always so much help. Perhaps I am too careful with this stuff but so far so good.
  10. Okay,thank you sir. I am clear on 1 and 2 but not 3. The question asked is "have you ever before filed a petition for this or any other alien?" I did file a seperate I-130 for both my wife and her son -- they were both approved. Now that you mention it, I also filed an I-129, which covered them both, also approved. Seems like I should mention all three? Also, all wound up in at Califonia Service Center so I guess that is the "where filed'?
  11. In 2008 my wife and step-son came to the US on a K3/K4 visa (I-129). My step-son decided to go back to China after 8 months to finish school, which he has now done. I am now in the process of filing another I-130 for him and have a few questions: I am assuming since he did not seek AOS that he has no A number. He does have a TAX ID number used on tax returns but no SS Number ¨C should I enter the TAX ID number under SS number on the I-130? In Part D, item 2, they ask for the place and date of previous petitions filed. As I recall I filed in NE but my petitions were transferred to CA and the I-797C Receipt Notice was sent from CA, as was the I-797C Approval Notice. I presume I put CA Service Center as ¡°Place filed¡±. Since he was approved before would it be helpful to include copies of any documents, I797C etc., visas...from the first filing? Thank you in advance.

You the US Citizen step parent will file an I-130 for step child, you will attach copy of birth cert+translation showing relationship to your spouse, and a copy of marriage cert+translation showing marriage to step-child's parent these two docs prove marriage took place prior to child's 18th birthday, and step parent/step child relationship. Do it ASAP, so that can get IR-2 visa and entry to the USA before AGE 21. Any downside to her applying instead of me? If fact, looking closer it requires a lot less documentation.

  14. I have a related question. My step-son was 15 when we were married. He and my wife came to the US on a K3/K4 visa but my step-son decided to return to China and did not apply for a green card. My wife has her 10-year greeen card and now her son may want to live in the USA after all. He just turned 20-years-old. Is the process different if her son (or she/we) apply before he turns 21?
  15. I am far from an expert on this stuff except for the fact my wife managed to get her 10yr green card. Don't think I am being flip but the first thing I would do is fire the lawyer. You will find many people here will guide you with more care. Seems if you do not need the I-130 stop payment on the check. They will probably return your check in any case. What I always told my wife is we have to be very careful with the paper work and then get lucky. You don't want your case to get into any out-of-the-ordinary situation since then you will need to be lucky enough to get a case worker that can reason.
