  1. Hi all. My wife and step-son have been here in the US for nearly 2 years and we just got the letter from USCIS saying its time to submit the I-751 to remove conditions. I had a few questions - sorry if these are repeats listed somewhere else. 1- Is I-751 the only form we need to fill out and submit? (ex...I dont need to submit the 865 geographic again or affidavit of support to I?) 2- Do we need to submit a separate I-751 for my step son who is 15 yr old? thanks all! Don
  2. Question on immigration procedures. My wife's friend came to the USA to visit her. While here, her friend starting seeing a guy and now is very interested in marrying him. She has a child in China and will be going back to settle matters and bring her child to the USA. The child already has a visitors visa. if after marrying in the USA, what is her next step? Where do they file? Where can she wait pending the review? Must she go back to China? Can she interview in the USA? thank you

  4. Hello, I am helping a good friend do his paper work to bring his new wife and her children to the US.. We got everything ready to send off to Chicago. I have one question. How much money should we have to send for the first round of paperwork. My math says $ 840, but for some reason my mind has $1120-1125 stuck in it. He is going the CR1/IR1 route. He is filing two I-130 (one for him and one for his wife) and four G-325A. ( one for himself, his wife, wife's older daughter, and one for his wife's younger daughter). Older daughter is turning 18 at the end of this month. So am I correct? $ 840 dollars? Just want to make sure I am correct. Thank You for your help. Danb
  5. Well, its that time ... time to file for ROC for my wife and step daughter. My step daughter is now 23 years old and came to the United States at the same time as her mother. My wife came on a K-1 and my step daughter as a K-2. My wife and I were married 6 weeks after her arrival. The daughter was 6 months from turning 21 when she arrived in the States with her mother and received her 2 year Green Card before aging out. My question is this ... does my step daughter's age have anything to do with the filing of the I-751? I have my wife's I-751 ready to go. On Part 5 - Information About Your Children, I have listed my step daughter, her Date of Birth, and her "A" number and "Yes" ... Living with me. Do I just file the one I-751 for BOTH my wife and daughter with one submission fee and 2 biometric fees or does my step daughter need her own I-751 with a SECOND submission and biometric fee? Their 2 year Green Cards will expire at the end of June. Any advice would be helpful and very much appreciated.
  6. Hi, My wife and daughter are both Japanese citizens, and I'm a US citizen. We live in China, currently, but we are considering moving back to the US during the years when my daughter goes to college. It looks like some things would be easier if my daughter had a green card while she is attending college. For example, it will be easier for her to get a part-time job, tuition might be lower, etc. Maybe there are other benefits, too?? As I understand it, getting a green card for her will be more difficult after she is 18. Is that true? Are there any other age limits that I need to worry about? She is currently 14. She is my wife's biological daughter, but not my biological daughter. Would it make any difference if I formally/legally adopt her? thanks ciao
  7. My wife and her son, then 16 years-old, were admitted to the USA in 2008 on a K3/4 visa. My wife go her 10 year Green Card in 2010, but her son returned to China to finish school after only 8 months in 2009. Now he is 22 years-old and wants to return to the USA. I have filled out the I-130 but I am not 100 percent sure what other document are required. What I think need to send: His birth certificate 2 photos of step son my wife birth certificate proof of marriage proof of my citizenship $420 What about divorce papers or her green card? Do I send a copy of every page of my passport? It's been awhile since I messed with this stuff and I am on a tight schedule. I am leaving for Shanghai in two days (Thursday morning), I may be gone 2 month but the wife will stay in the US. I need to get this application in the mail before I leave of I will have to pay some unknown price. Thanks for the help. I know this stuff has to be posted somewhere but I sure can't find it. Michael
  8. Curiouser and curiouser.. I checked the dates on the visa bulletin yesterday and they are working March 2006 for unmarried sons and daughters over 21. Yesterday my stepson received a package from GZ. I'm not sure what yet. The case status shows nothing new, just the same old "post decision activity".
  9. My wife's been here over a year now, and she met a Chinese lady who recently came on a CR1 visa. This lady friend wants to bring her 15-year-old son to live with her in America, and I told her husband to write to the consulate asking about follow-to-join from what I read. The husband wrote the consulate: Dear Consulate, I am very happy that my wife (XYZ) is adjusting very well in America this past 3 months she’s been here. Now that she has settled down well, we would like to start the process to bring her son (my stepson), ABC (DOB: xxxxxxxx), to live with us in America. I understand he can come with “follow-to-join” eligibility. Please advise what I should do next. The consulate replied: Dear Mr. Z: The follow-to-join case must be filed with the U.S. Citizenship and Immigration Services (USCIS). Upon approval of the application, the case file will be forwarded to the National Visa Center (NVC) for processing. This office will start processing the follow-to-join visa application as soon as receiving the physical file from the NVC. Since we don’t have a petition regarding your stepson's visa application at present, we suggest you to contact either USCIS or the NVC if you have any questions. From what I read, a follow-to-join process starts with the consulate. If that's not the case, how does one start the process? File a new I-130 for the child? Any advise? Thanks! Bobby
  10. Hi all. We have been back in the US and married for about 10 days now. As we are now looking to start working on the AOS, is there something I need to do prior to filing? One thing that comes to mind is do we need to start getting her name added to power bill accounts, phone bills, bank account...etc to show proof that she and I live together?   11. My wife has been in the US for about eight months and she is the best woman I have ever had a relationship with! We have difficulties like anyone does but other than that things are going great. She came here on a CR-1 Visa. Now we would like to bring her 16 year old son here on I assume a IR-1 Visa. I have already submitted his I-130. Recently we recieived an RFE requesting a copy of the court document submitted to change his name. Now according to my wife that is not how it works in China. She said name changes go through the Police Department. But any records kept by the Police cannot be copied. So her ex went there and received a notarized or certified document that substantiates the name change. My question is will that document satisfy the RFE? I am not so sure. I would have thought the USCIS having done this thousands of times would know there would not be any "court" document if name changes are done thought the Police. Does anyone know what I "really" need to do? Thanks a million!
  12. My chinese wife has been in the USA now for five years. Her 17 year old son is still in China waiting to become 18 and immigrate to the USA. The problem is that his father will not allow the son to use the family registration or ID for the purposes of obtaining a copy of notarial birth certificate or any paperwork needed to secure a passport and eventual visa. I know that when we make application for my wife's son, the American Counselate will need a copy of the birth certificate (notarial). Upon applying for his chinese passport, they will also need a birth certificate copy and maybe even the family ID or family registration. The father will do everything that he can (regardless of son reaching 18) to keep him in China. Therefore, he will prevent any use of paperwork (no cooperation). Questions are how to get around that? Will the Counselate recognize this plight? We don't want to do anything illegal. My wife's son is quite the prodigy; wants to attend either Yale, Harvard or Princeton. He is now on the second to last year of high school in Xing'an China and is the number one student out of over 4000. We will, if successful direct him to MIT because his interests are in nuclear physics. If anyone knows some answers or had a similar situation, please get back to me. Send a PM
  13. My wife has just had her approval letter received here for her permanent residence and no interview was required. We now have to soon start the procedure (I-751) for her son. My question is: Do we gather all the same materials and go about the same procedure as we did with his Mom? I understand that there is rarely an interview for the sibling, which is fine either way, but want to be sure we send immigration the correct package. Thank you very much. Mark
  14. Hello I am totally confused about what should be a simple concept. With the help of everyone here I was able to get married - K1 to 10 yr green card for my wife and CR-2 for my stepson. I was able to relax for a while but now my stepson's CR-2 status is almost up. I'm sure I have to file the I-751 for him, but now I'm lost. I remember filing the I-751 for my wife and we submitted all types of evidence to prove that we are married. My questions are : What do I need to prove now? Relationship evidence between my stepson and me? Or evidence between my wife and I? Who should fill out and submit the I-751 form? Me , my son or my wife and I? Thanks, AlDO
  15. 1) When I was in the process of getting the CR-1 Visa for my wife, her son did not want to come with her to the US. Now as of last Sunday he has decided he wants to come. Of course we both think that is great since it is what we wanted in the beginning. He is15 and is finishing middle school this year so won't be able to come until the end of the year. My question is what is the best visa to apply for with him? Should I do another CR-1? 2) I am not sure of the legalities, but a good friend of my wife's gave us some Chinese Calligraphy to try to sell in the US. We watched him make several while we were there. He is certified by some government agency to charge so much for his work. If I remember correctly is it 10,000 yuan/sq meter. I calculated twice that they would be over $10,000 a piece! I surely don't think we can sell them for that much. Any ideas for a more reasonable price and what type of client would like to buy them?

  18. Are they starting a new trend of routinely asking for the ex-husbands "permission" to allow the child to go to America on CR-1 applications? Even when the mother has legal custody? I realize they "sometimes" ask for that, but lil' rabbit is seeing it more and more, one woman said it's becoming a standard at the NVC stage. Anyone see this as a new standard hoop to jump through? tsap seui
