  1. This is my first post. I’ve gotten a ton of valuable information from this community and so far I’ve been able to find answers to all my questions here! However I’ve hit a roadblock and we are working on a tight timeline so I need some help. My husband was born in the US and lived there till he was 6 years old before leaving due to his dads work which brought him to many countries. He returned to the US at age 17 for university for 4 years. During university he traveled in and out of the US to visit his family. After that he moved back home and never lived or worked in the US but would travel back for business or pleasure. He definitely meets the 5 year physical (incl 2 years after age 14) presence requirement for our children to receive CBRA. However he does not have his first passport which shows his first 6 full years in the US. He has his university transcripts and passports showing his total presence in the US after age 14 to be just under 4 years. We have been married for 15 years and have two children born in China, aged 8 and 10. We live in Beijing but never went to the US consulate there to register their birth. We never went through the CRBA process because we could not provide evidence of the total 5 years physical presence before the children worn born. My husband found work in the US and left in January to start a new job there. Myself and the kids are still in China trying to get our PR or passports to join him. We hope to leave in June after the school year so that the children can start school in the US in August. Since we did not file CRBA, in December he filed a petition for all three of us to obtain immigrant visas. The process has been smooth and quick. We received notice to book our interviews in early March and I’m busy gathering all the documents for the interview which we plan to schedule in May. However, after much research and talking to someone in a similar situation it seems that we need to prove that our CRBA was denied and its not our own choice to choose either CRBA or I-130. My husband will be back in May to try filing CRBA and get US passports for the children. If that is denied then he should get a letter of denial which we will present at our immigrant visa interview. My questions are: 1. Is this a feasible plan? 2. If CRBA is denied, do we get the denial letter on that day? Because we would like to go for our medical and immigrant interview ASAP after the denial. 3. Will Guangzhou accept the denial letter at the interview or was it supposed to be submitted at petition time? I wonder why they didn’t ask for that when it’s clear that my husband is a US citizen through birth in the US. 4. If we go our our visa interview in mid May, would we be able to leave China on the last week of June?
  2. Hi All, It’s been about three months since our son was born and I wanted to have him get his passport/ssn taken care of. But we are in Hangzhou and the easiest location for us is the Shanghai embassy. On the website we are unable to select any date for that reason at all, but for Beijing or Guangzhou we are able to select a date. My question is , does the Shanghai embassy handle newborn baby passports anymore? It would be a hassle for us to go all the way to Guangzhou for this if we can avoid it. Also he has an English name and we aren’t applying for a chinese passport, probably obvious just wanted to be clear. Bill
  3. Hello All, hope everyone is well. As the topic states I have a question about passport renewal. I sent it in about 2 weeks ago and already have my New passport in my posession. My question is I was expecting them to update the old passport with the new Exp date listed in it but they sent a whole new passport. This normal? Will I ever need to show dates of travel that were listed in the old passport? DO I request the old one be returned also? Let me know what you know... Robert
  4. Maybe not the right place for this question bur what the hell I'm a Rebel! Going to get a nice shiney 10 year visa in a few weeks and I see I got 15 months left on this passport. If I get the visa 1st will they limit it to the exp date on my passport or can I renew it after and still have the 10 year? Also anyone know how long to get a renew? Robert
  5. When I file the I-130 petition, I know I need to show both original passports, as well as copies of the biographic pages. Will my Chinese wife's original passport be retained at that time, or will it be returned to her? I will need it to apply for an ITIN for her later. Also, can anybody explain what this means: " Your wife needs to apply for ITIN with IRS. If she needs her Chinese passport to be certified, please make an online appointment with ACS for notary service." What is meant by a "certified" Chinese passport? Is the original passport in some way "certified" or authenticated, or is a certified/authenticated copy issued? Or must a "certified" copy of a Chinese passport be obtained from the Chinese Government?
  6. Hi folks! I recognize some people here from an old, dead forum. Nice to see ya'll! I've spent number of hours this past week trying to figure out what my wife needs to file to renew her Chinese passport in the United States. This forum had an excellent post that discussed how this was done with links, but it's a 5-1/2 year old thread and I'm concerned the linked form is an old version. Some of the links were broken too. We're in NY, so we'll go to the NY Consulate. The confusing thing is, the Passport and Visa link on the Consulate website doesn't have any forms for passports. I then went to the Embassy website and every consulate website in the US, and can't find any form on those sites either. All I can figure out is she needs to fill out an H-1 form (?), but I've read they recommend filling this form out online and printing it. But where is it??? The other conflicting thing we're trying to figure out is how to pick it up. The Consulate website says they don't mail the passport, but we've been told you can have it sent. Huh? Which is it? Perhaps an agent can pick it up for us? Also, can my son (5 years old) and I go in to the Consulate with my wife? I read on the website someplace that they reserve the right to refuse entry to anyone who has no business entering the facility. If anyone has any advice or a link to whatever form we need, we'd really appreciate it. We're looking to go to New York City before Christmas, perhaps 12/13 to 12/16. So I want to get things booked now (Amtrak, hotel, etc.). Thanks everyone! -Paul
  7. Hello. Both me and my fiancee live and work in China. He is Spanish, and this summer we will get married in Spain and return to China at the end of August. At that time we will then start with the Green Card procedure and filing the I-130 petition. My passport will expire in July of 2017. I plan to renew my passport in Spain this summer before returning to China. Will this pose any sort of problem for filing the I-130? Or will this pose a problem for me returning to China? I only ask this because my current passport has my residence permit, and it will be cancelled the moment I apply for a renewal passport. I don't want this to cause any sort of problem. Thank you very much!
  8. ...so my second wife and I were married in the United States. It was on a tourist visa, which she got a few months before our planned summer vacation back to California. We live in China. About a month before we go, we find out that we're expecting. Looking at the marriage requirements for China, we just got married in my hometown because it was hella easier. (I also know from experience --my ex-wife is also Chinese -- that getting married in China has a lot of bureaucracy that I really wasn't interested in.) So we get married in California. Then we went back to China. About a month ago, my second son was born. My wife's tourist visa is good for 10 years. I want to apply for his passport but I have concerns about how it will affect my wife's tourist visa. She has no interest in immigration, but would like to visit in the summers. Will applying for our son's American passport affect her tourist visa? Looking at the instructions it says they need to see both parent's passport and marriage certificate. Thanks for the advice. maybe I'm being paranoid.

Your Passport Might Not Be Valid in Some Countries Even If It Hasn't Expired Yet So if your passport expires in 70 days, you might run into trouble on your way to France, which requires passports to be valid for 90 days after the return date on your ticket. Though not a new rule, it’s something you might not know if you don’t travel globally often and think that your passport is valid because of the expiration date. It was under administrative processing (probably because she was CCP member?) for just over 180 days (they said contact us again after 90 days if you haven't heard anything, when we contacted them after 90 days then they again said contact us again after 90 days if you haven't heard anything!) I guess her health check and police report expired by now? Anyway now we got this e-mail below, requesting her passport, a new police certificate, and a new health check, and 2 passport style photos which we sent in yesterday through CITIC Bank. We assume this means they are approving the visa and we should have the visa within about two weeks? Are we assuming correct and is that the approximate timeline?   11. Well as the title says. We just received a email from NVC (4:18am) for an interview date of 03-02-2015. Yes a bit tight!!! 3 weeks? Now there might be some small issues (For me) Two weeks ago i sent in my passport for renewal with standard processing 4-6 weeks. as we can see the time frame will not work. Plus i will need to get new visa added to passport. The visa is easy and fast and just cost some extra $$. I will be calling on Monday to see if i can get this passport rushed through. If worst come to shove we may have to ask for new interview date. Does anyone know how to go about this?
  12. Hey! The wife and I are flying back to China in March, staying till early April. RT tickets at $791 each out of JFK. My passport expires mid-May 2015, our return flight will be April 4. My 2 year visa has expired and I'll be getting another within the next month or so. My question is, with my passport expiring about a month after our return to the USA, and with getting a new visa, will this be a problem? I thought I heard some time ago that you had to have a certain amount of time left on your passport for traveling, like 6 months at least from your departure back to the states. We're prepared to buy the tickets, but if I have to get a new passport, I'll have to wait to buy the tickets because the passport number will change, etc. Any ideas, guys? Thank so much!   13. Hey everyone...I have a couple questions for you all again! My wife (green card holder) and 2 kids and I are thinking of heading back to China this year. She'll go first most likely with the kids (she's brave) and I will follow when school is out. I have a couple questions though: 1. My wife's Chinese passport has expired. Is that as simple as going to the Chinese embassy in NYC (we're in Western Mass) to apply for another one? Anybody been there done that? 2. How long does it take to get US passports and Chinese VISAs for 2 kids? Are we talking forever or a week or what? 3. My wife is a US green card holder. She won't have any problems leaving, arriving in China, leaving China and coming back to the USA right? Or is there something we need to know before all of this? 4. In all of your wisdom, should we secure the passports and visas first and then get plane tickets?? Thanks again for your help!
  14. Hi All, I was wondering if anyone could share some experience.... My Wife (Chinese Citizen with 2yr conditional green card) and I are currently living in Seattle WA area. Her Chinese passport is going to expire Fall 2009 and will need a renewal soon. The Chinese consulate covering WA is way down in San Francisco. A much closer (about 1/6th the distance) major city with consulate is Vancouver BC Canada. It would work out nicely to renew the passport there as we like to visit Vancouver. Has anyone renewed a Chinese passport in a third party country while visiting, not a resident? Is it allowed by Chinese consulate?
