  1. Fiancee K-1 is a NON-Immigrant visa which uses only the I-134 not the I-864 in this case father providing an I-134 as a joint sponsor should be sufficient if his spouse is unemployed. Later in the states when filing the I-485 to adjust status after marriage the I-864 will be used to sponsor the green-card, at that time is still using a parent as a Joint sponsor the parent's spouse can also provide the I-864A if their income is to be added to that of the joint sponsor, and again if the spouse has no income the I-864A probably will not be needed.

As for moving case around, it sounds like they sent to your field office and may be preparing for an interview. Seems like the I-751 has been going long lately, my neice-in-law filed her I-751 over a year ago (Jan 2017) and only recently got her unrestricted card, while it was in process she filed her N-400 for naturalization at 3 years of residency status and I think filing that jumpstarted the pending I-751 and got it quickly approved without an interview.
  3. My Mum-In-Law is living with us on a green-card and because of the afordable care act we are paying for medical insurance for her, it's not very afordable in Texas though. The key thing is Mum-In-Law is a lawful permanent resident not a visitor.
  4. I don't think it would affect the visa petition process however I am not sure about exit control when exiting China, not sure if they would prevent leaving the country.
  5. I believe would need to do something to get a derivative immigrant visa for the baby. If birth before the interview then probably have to apply for two visas with extra fees, and new I-864 affidavit of support for each. If birth happens after interview and before using visa to enter the country, I am not sure how the baby's visa would be handled.

Should be fine with the birth certificate you have if it is not in English, you will need to attach a translation to it, it can be a literal translation and simply certified by someone conversant in both languages they sign their translation and note that they are conversant in both languages and provide contact info. As for F1, you should have no issues adjusting status, my wife's cousin was in Texas for college and married someone and adjusted status without issues. Easy to show your intent was college and found a mate.
  7. I-485? What type of visa are you adjusting from? As for Birth Cert, there are a few posts regarding aquiring the Notary Certificate, if state side filing of the I-485, more than likely USCIS will accept what you have if there is a translation attached to it. Also it in not needed to be attached to the I-130 petiion, its needed later at a visa interview or if filing the I-485 it is attached to the I-485/ Lastly treat the I-130 and the I-485 as if being filed independently, do not share things between them. make two copies of things that may be common between them.
  8. Seems China has a different definition for controlled and un-controlled, when you lose contact with a satilite or space station in my book that is un-controlled. In most cases when a satilitein low earth orbit becomes obsolte or compleated it's mission the controling space agency tends to deorbit the satilite and controls where that happens to allow any part of it that survives reentry to fall in a place that would not be of danger to people on the ground, typicially that is a remote part of the Indian Ocean. Control requires radio contact with the satilite and some fuel on the satilite to initiate the re-entry where and when apropriate.   9. I would not worry about the CR-1 clasification, It will be reclasified upon arrival at the POE as an IR-1 and will result in a 10 year green-card. One of my friends was in visa process for nearly 2 years and her visa was CR-1 I told her to hold on using the visa until after 2 year aniversary, which she did and her resulting green-card was 10 year IR-1 card, Yes, I would note "None" for A#
  10. Correct, your parents don't claim you on their taxes, thus you are not a member of their household even though you may claim domicile there, they should not be counting you, only the intending immigrant.

Your parents are acting as joint sponsors you are technicall not a member of their household since you are not living there so they do not count you, they only count themselves and intending immigrant. On your I-864 you count yourself and intending immigrant, you do not count your spouse as "spouse".

  16. This is normal, they will typically cut the corner off the old one as a way if indicating it is no longer valid. Simply carry both passports if needing to use the still valid visa in the old passport. If traveling to a place where the visa is not needed like Canada, or Mexico, you can leave the old passport at home. I seem to recall my old passport returned seperately when I last renewed my passport.

Her visa petition is based on a petition filed by a parent, not a spouse, they really do not care about her marriage plans after immigrating. Stay the course and don't sweat this, tell her to tune out the "experts".

  22. Many states have health care plans for low income people, for example Healthy NY and Covered California. Also check healthcare.gov for rates. My friend in Californa grossed around $10,400 income last year she qualified for the free plan out there.
