I know that about the heat, I did not mind much the nearly 4 weeks I spent in Phoenix, each weekend I did end up driving up to Prescott, I also got to drive a semi from California to Yarnel up and down a twisty road, was so severe and restricted we needed to use a short trailer. I enjoyed linking up with you for dinner.

  4. Correct this is a non issue, if it does come up they will request a waiver, however in all of my time on the board it has never come up in a K-1 AOS case. Only once have I seen it cause an issue when someone applied and interviewed for citizenship, It came up at interview, the applicant gave an answer to the interviewing officer that they did not like so they were told to apply for citizenship again in a couple years.
  5. My wife served in the Chinese Army, we noted that and it never came up, our I-485 was processed through and automatically approved without interview. Be honest, answer the question and wait for an interview, if this came up at the K-1 interview and was waived, then it should not be an issue at adjustment of status.

Yep, In order to have avoided dealing with a civil surgeon in the states you would have had to ask the medical center to split the medical packet in to two parts, one for interview and the other vaccination record for adjustment of status in a separate sealed envelope. When dealing with a state side doctor, insist that they transfer the yellow book record to an I-693 and nothing else. That one probably does not need to be noted, it was a youth club, I suspect much like cub scouts, Boy and Girl Scouts, 4H, or the brownies in the states, it is not an adult political organization. My wife was in the PLA, (Chinese Army) of course she noted that when asked and it was never an issue.
  8. One other thing we did when my wife got her 2 year card, we revisited the SSA office and ordered a SSN card without the work auth notation on it, List C, item 1 (3) in the list below. In this case all the I-9 requires for employers is a state ID (DL, Permit, or common non driver ID) AND a SSN, without that notation, no need to show them the GreenCard, Letter, or Passport, the expiration date is really none of the employer"s business when provided with a state ID, AND unrestricted SSN card. https://www.uscis.gov/i-9
  9. The I-751 does not need to be completed to file the N-400, only needs to show resident for 3 years. You can file the N-400 exactly 1 year after filing the I-751. Doing this sometimes jumps a stalled I-751. My niece in law just filed her N-400 before her I-751 completes, she got her 10 year card shortly after filing for citizenship.
  10. Schedule an info pass appointment at your field office, bring her passport and the letter and request an I-551 stamp, further acting as evidence of permanent residency status. Also note just because the letter expired her status as a lawful permanent resident does not. So NO she is NOT an illegal.
  11. I highly doubt they will give you any guff over on forgotten AR-11, if interviewed and asked, just be honest and indicate could not remember if you did one or not.

Similar topic, http://candleforlove.com/forums/topic/45297-conditional-green-card-holder-not-living-in-the-usa-i-751/ In this case they gave up the green card, and applied for a visitors visa for use to visit the states while living abroad and will eventually reapply for a spouse visa when they are ready to move to the states to live permanently, at which time there would not be the need to go through the trouble of filing the I-751 they would be married longer than 2 years when getting the 2nd spouse visa. Removal of conditions while living abroad is not an easy option, biometrics for the I-751 need to be handled at an ASC in the states near your home, as well as any potential interview.

  20. Yep, a short term overstay less than 6 months has no automatic bar, it tends to prevent visit entries within 6 months of leaving, but yes a 6 month overstay can cause a 3 year bar requiring a hardship waiver.
