  1. I mailed in the application to renew my wife's 10 year green card on September 23rd. She had her biometrics appointment second week of October. She received the new green card in the mail yesterday. So 41 days for the complete process. Next we go to the Chinese Consulate in L.A. to get her passport renewed.
  2. My CR-1 visa has been approved (Woohoo!) My husband (the US citizen) and I have started seeking employment in the US. As he currently has a full-time position in China, we think the best way is: I find a job in the US, then he quit his job in China and come join me. This way, at least one of us would have an income at any given moment. Then it raised a few questions: 1. I read that the US spouse should be present or already in the US when the immigrant is going through POE. Is that a must? 2. If my husband must come with me to the POE, can he return to China right after and continue to work in China for a couple of months while I'm in the US? 3. The most ideal scenario is I get a job offer now (though online applications and interviews), then we go to the US together. But since I haven't gone though POE yet and I don't have a Green Card or a Social Security Number, would US employers consider my job application and make offers? Thanks, guys! Love to hear your advice.

My wife entered at the POE this past week, I have some family in Mexico that we would like to go visit, and was wondering, her passport was stamped with a regular entry stamp (blue in color) and the officer wrote IR-1 and signed under that. This is proof of status when it comes to coming back into the US after entering Mexico? We want to be sure she can come back, we are just going for 1 night 2 days to Mexico. Thanks Nathan
  4. I hope I have posted this in the right subforum. My wife (Chinese citizen) has recently received her IR1 and will make her initial POE in a couple weeks. I am a US citizen and we have been married for over 6 years. She has been employed in China by a US company for the last several years to help develop their Chinese market. It seems the company would still like to keep her employed after her receiving US LPR status, but will want her to be in China for a considerable amount of time each year (each trip to China for approx 3 months or so, definitely less than 6 mo). One of our concerns is quite obvious - we don't want to risk her immigration status (perception of abandoning greencard). We have read a lot about this and are confused about the real rules used to determine this. Some simply say it is required to sleep in the US more nights than out of the country, others say be out of the US for less than six months, some say be out of the US for less than a year. It is also quite possible that I have misunderstood what I have read as well. We are definitely confused. Her job pays quite well and she would hate to have to give it up, but of course would if need be. This brings us to our next question. Her US employer pays her in China in USD's that are converted by a Chinese service company (as required by China for tax reporting purposes) to RMB and deposited in a Chinese bank. I am certain we need to consult a tax advisor on how to handle this for IRS filing purposes, but can this also affect her immigration status? Just for the record, we own homes free and clear both in the US and China and have joint bank accounts (checking, savings) here in the US (no joint accounts in China).   6. I was wondering if its ok to travel back to China after entering US on CR-1 visa but before green card is issued. My wife will come here after interview for a month using her vacation time then travel back to China for 1 month to tie up looses ends and retire then return back to US. Its all about timing and maximizing vacation and retirement date will this be a problem for her to return back to US before green card? I was told it takes about 3 months to get green card now. I wasn't sure if the Visa they put in passport was just a one time use.. Anybody have an answer for this...We just got through the USICS and NVC stages sooner than we thought and now waiting for interview date, thinking interview will be in early October.

Please note these are ground crossings by car, if entry by air starting in September Canada will require an electronic travel authorization before entry into Canada, see: http://candleforlove.com/forums/topic/48686-visiting-or-transiting-through-canada-by-air/ not sure if this requirement will also be applied to the road crossings at some point. My mum-in-law arrived in the states two weeks ago on an IR-5 visa and entered through JFK where they endorsed her visa. We paid the immigrant fee and are waiting to the actual green-card to arrive in the mail. We had planned on going to a Scottish games we like to attend every year up in Maxville ON, which was on our calendar long before Mum would come, and the timing was such that she would be here in time to go with us, but before she would get her card. I decided that the I-551 notation should be sufficient for the Canadian POE so we took the chance. Our hotel was in Massena NY so would cross at Cornwall ON and return same day, and then make another crossing the following day at Ogdensburg NY in order to visit family in Kingston ON. So Saturday we crossed at Cornwall ON, the border guard was a little confused asked if mum had a visa to visit Canada, so I pointed out that the notation at the bottom of visa indicates that it serves as a green-card until her actual card arrives, the guard then consulted her supervisor by phone and Ok'd the entry for us, we had a great time at the games and then returned to NY the American POE understood we were waiting for her green-card and waved us on. On Sunday we drove from Massena NY down to Ogdensburg and crossed into Canada again, this time the Canadian border officer was a little less confused, he questioned that Mum's visa expired on the 26th, I had to explain that it was endorsed at JFK and again the endorsed visa acts as a green-card until her actual card arrives, this time no call to the supervisor, the guard accepted my explanation and allowed entry to Canada. We then visited Kingston and decided to shoot over to Toronto for dinner before returning to NY by way of Niagara Falls.
  8. my wife wants to go visit the Niagara falls she also like to go to Toronto on our visit. my question is with her being on her 2 year permanent resident green card will she be able to enter canada? i know she wont have to get a ETA (Electronic travel Authorization)
  9. How long is it taking for others to receive their welcome letter and green card after entering the US? My wife entered on October 2 through ORD and we have not received anything in the mail yet. I did pay the $165 immigration fee the day before we entered. Is there anyplace I can track it online? I found https://egov.uscis.gov/casestatus/landing.do but think I need a receipt number that comes in the welcome letter to use it.
  10. Well my sister in law and her son received there passports with the new visas today. next step is paying the Green card fees (165.00$) online at ELIS site. Note the last paragraph. Does this mean ONLY my sister in law can pay the fees? Or can the petitioner open an account and pay the fees himself? Mike
  11. The traveler arrived in the US Aug 2012, admitted as a Lawful Permanent Resident (LPR) and then the LPR departed the US with a 10 year Green Card (GC) Oct 2012 without a re-entry permit. Upon re-entry attempt Sept 2015 at POE the 1st Immigration Officer pulled the GC and sent the traveler for secondary Inspection. This process ultimately took over 3 hours. This was due mostly to a lot of people already in the room. A long and difficult Interview ended with the issuance of an I-193 'Application for Waiver of Passport AND/OR Visa' issued under Section 211(b), a Fee of $585 and the return of the Green Card. The Passport now has an I-193 stamp with 3 years notation. This POE secondary Interview required 'proving' that the long time away outside the US was unavoidable, unplanned and outside the traveler's control. It also required the $585 fee. Cheaper than multiple re-entry permits and multiple round trip flights. However, this re-entry method includes two big risks- 1. Immigration denies re-entry. 2. Immigration initiates removal proceedings. And, it was easier than a full SB-1 application process. From the SB-1 page- "If you are an LPR unable to return to the United States within the travel validity period of the green card (1 year) or the validity of the Re-entry Permit (2 years), you may be eligible and can apply at the nearest U.S. Embassy or Consulate for a Returning Resident (SB-1) immigrant visa. An SB-1 applicant is required to establish eligibility for an immigrant visa and have a medical examination. Therefore, this involves paying both visa processing fees and medical fees."

Many thanks to Mike NuWorld for the screen shots and write-up, which I've copied to a pinned topic from his original post http://candleforlove.com/forums/topic/47701-paying-the-green-card-fees/ This is normally done AFTER a successful interview, and before traveling to the U.S. Green card production will be ordered AFTER the visa recipient has been processed by the POE. If the fee has not been paid by that time, green card production will be delayed until it is paid.
  13. We're thinking about a trip to Montreal in April. I know that Chinese citizens need a Canada visa unless they have a green card. My wife's green card hasn't come in the mail yet, and we don't know if it'll get here before April. However, she does have her stamped IR-1 visa in her passport, which is supposed to act as a green card until the gc arrives. Do any of you know if she can travel to Canada on the IR-1? I would hate to be at the Quebec airport and have a border control person say the IR-1 isn't acceptable.

  15. Gents, Thanks in advance. My wife's two year green card expired Aug 28th. We sent in all the paperwork in June, made payment and had the biometrics completed Aug 14th. We received I-797, Notice of Action receipt notice that states amount received $590.00 and it states "Your conditional resident status is extended for a period of one year. During this period you are authorized employment and travel". So we are good until Aug 2015. What is the typical turn around time for the new 10 yr green card? Where can I go to check status of this? I check USCIS.GOV and entered in the our number and all it says is: Case Was ReceivedOn July 17, 2014, we received your Form CRI-89, Petition to Remove Conditions of Permanent Resident Status Received, Receipt Number EACXXXXXXXX, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by August 16, 2014, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address. Regards, Matt and Lili

So, in what feels like has been taking forever almost a year later after submitting a book full of evidence after a RFE came in a few months ago, I have found our case was transferred from California to Memphis and it says we will have an interview (but doesn't talk about when). This has me a little nervous for a few reasons: 1. They are very slow, its almost been a year since this whole process started and in November her letter extension expires. 2. Her drivers licenses expires as a result of above, and our lease on our apartment expires around then too and I'm worried that could cause more issues. 3. She is attending University this semester and next, I don't know if this is going to cause issues. 4. I have no idea what more evidence I could bring. We did return to China last month for a second wedding party (our first was just my close friends) but her parents wanted to have their own party so we had another. I'm hoping to get a video of that event and put it on my phone for the interview but that's all else I can think of, besides bringing what I already sent! So how does this interview go? Is it any different then the one my wife took at the embassy while in China? Just go up there, he asks her some questions about how we met , ect, then its done? And is it normal to have to attend an interview at this point? The Immigration hotline is pretty terrible at explaining anything, they couldn't even tell us if they received our RFE. Am I almost done with this terrible process? Is the citizenship process just as slow and tedious?
  17. Hi everyone! I'm new to this website and impressed with the amount of info provided here. Thank you very much! Here are my questions: once I (chinese citizen) receive the immigrant visa and enter the US, do I need to stay in the US until the actual card arrives? Or am I free to travel internationally as a green card holder during this period? I need to travel back and forth betweem the US and China and maybe to Japan/Singapore to sort out several things that can be done only in person (such as selling/leasing out the house, dealing with a few bank transactions etc) before I finally move to the US. Thanks!
  18. We arrived last week (1/13) with Detroit as the POE, Social Security Card was received yesterday and hoping my CNH's Green Card arrives before we depart on 2/4. We can't seem to check the production status on the USCIS dashboard site: https://egov.uscis.gov/cris/Dashboard.do not sure if this is because we filed DCF or we are using the incorrect number. Any advice would be appreciated... Andy

Hi All, Wife and I went up to St. Paul for an InfoPass to get the I-551 stamp on her passport since the 10 year green card hasn't gone though and probably won't before we go over to China in Jan. 2014. Officer was a little surprised that we didn't have a receipt paper for the 751 we sent in, but only got the biometrics appointment letter. He just calmly said though, "Maybe it got lost in the mail." and went forward. Stamped the passport, but today, my wife sees that while her A# is A08...... the officer wrote A8..... leaving out the 0. How critical is this? I sort of thought that it might not be that critical but she's worrying. Any thoughts? Thanks and HAPPY THANKSGIVING!!!
  20. Well, in three days we can apply for removal of conditions, and we're getting the paperwork ready to send. There is one question I sort of need an answer to, though. Not specifically related to the I-751. When ChunMei last returned from China in June the immigration agent at LAX pointed out to her that her birth date on her green card didn't match the date on her passport. Her date of birth is 6-2-1963, and somehow on her green card they had entered it as 2-6-1963. She's been out of the country three times now, and this is the first time that anyone (including us) ever noticed it. ChunMei told the agent that in a couple of months we would be applying for the ROC, and the agent told her we could just wait until then and get it fixed on her 10 year green card. My question is, how do we do that? Do I include a separate page detailing the problem, or what? I'm sort of lost here.
  21. We might be planning to head to China. My question is, how long can my wife be in China with a Green Card and not lose the Green Card? Do we need to "establish residency" at some point in a few years? Anybody can shed some light on this subject?? Thanks.
  22. Hi, Hope all is well with you all. It's been a while since we have been on here. All is going great. Lili came over in December of 2011 and we married. She received her 2 year green card in August of 2012. When I did all the paper work I didn't send in the docs so Lili could work (we didn't plan on her working for a while). Now she wants to work? Can she legally work with the 2 year green card or do we need something else? Thanks, Matt and Lili
  23. 1. should the biometric fee be paid up together with the I-751 application fee ? 2. when would they set the appointment for biometric ?shortly after filing or it may take sometimes ? In case she is travelling abroad at that time , how should this be handled ? The 1 year automatic extension letter after submitting the I -751 . Wife is going to China for a week and returning with the inlaws as well,all on same plane(s).Airline is Air Canada,for her going as well as them (wife and her parents) coming back.I've heard that in Canadian airports that as far as cash goes (vending machines,luggage carts,etc.) that only Canadian currency is accepted.Any truth to that? Also would like to know what customs forms are requirted and if the required customs forms they will need to fill out prior to arrival here (and in Canada if applicable) are available for download so I can show wife what she needs to write (in) as well as the parents. BTW.,all will be coming to US./PHL.
  25. My chinese wife and daughter want to visit her sister and cousin in Canada. My wife is a US Greencard holder, and her daughter is a US Citizen. Is my wife required to get a Canadian Vistitor Visa to enter/exit with her US Greencard and Chinese Passport? My daughter is a US Citizen, so I guess her US passport is all that is required ....don't need Canadian Visa? I have been reading the Canadian Embassy website and various forums on people giving advice, it's confusion. Also,her sister is on a "6 months visitor visa" from China staying with her daughter in Canada.She received her visa by requesting that she visit her daughter for college graduation, can she stay in Canada and ask for another 6 months extension on her visa, or does she have to go back to China and re-apply there to go back to Canada on another trip. What are the odds that she will be refused to enter Canada again to be with her daughter? Thankyou, Chris
