  1. Hi, First time poster. I love this site, it has given me so much information and confidence as I prepare to start the process for my wife's green card. I have lived in China for the last 6 years and haven't filed a tax return since I have been here. I am getting ready to file my back taxes. I will file for 2013, 2014, and 2015. My question is: Is there any chance that I will need a tax return from 2012? Or is the last 3 years going to be enough? Thanks so much in advance.
  2. Hey there everyone! I'm happy to say that our I-130 paperwork was accepted and we are on to Step 2! Now I have a few more questions: #1- We were under the impression that my husband would get his vaccinations during the medical examination before the interview. However, in the DS-260 application, they asked if he had documentation showing that his vaccinations were in line with US requirements. He doesn't. Is this going to be a problem? What should we do? (There is an explanation box; right now we just have that he expected to do them on the medical exam day.) #2- I quit my teaching job here over a year ago so we could try to have a baby. (My job was stressing me out.) Will we be judged if we put my occupation as 'homemaker'? Somehow that seems better than 'unemployed'. I do sell some handmade jewelry here and there and do odd jobs for exchange of goods, but I don't think that counts as 'occupation.' I report all of this as 'other' income for my taxes. Any ideas what's the best way to fill in this category? #3- They also asked what job my husband intends to do when we return to the States. He'd like to get a job in his field, but I don't know that that will be possible till we get there. I know he could probably get a construction job or something like with a relative for the first few months. Should we try to actually secure that for him first before filing the DS-260 or just file it and tell them about the job or potential job in the interview? Thoughts? (The same goes for me-- we have potential job ideas, but nothing concrete yet. We were planning to show them at the interview.) Thanks for all of your help!
  3. I submitted the financial and supporting documents to NVC through Elecronic Processing (EP) and have received a new 'GZO' case number. I also received email notifications from the NVC that they received files from me and to allow 30 days for them to review the documents. I'm hoping there are no problems or checklists and that I get a Case Complete soon. I'm wondering how long it typically takes the NVC to review the submitted documents. I've read timeframes ranging from 2-3 months to just one week (EP case for MTL). Does EP make a difference in the time it take to review the case? Please kindly share here how long it took your case to get to case complete after submitting all documents, if you encountered any problems and if you did EP or mail processing. Also, how long after the case complete date were your interviews scheduled for. Thanks.
  4. Eventually, my spouse will be interviewed in Guangzhou for IR1, and will bring all of the originals and photocopies necessary. Our case number begins with GUZ. We both reside in China. I'm the sponsor and putting together the Financial Documents aka I-864 aka Affidavit of Support. My immigrant spouse is gathering the Supporting Documents aka IV aka Immigrant Visa packet. All of the above will be organized and delivered together at one time. Looking at the NVC website below, it appears we have a choice of processing, or we can decide how to submit our documents: email or mail I haven't noticed this question being addressed, so I wanted to check to make sure I'm understanding it correctly. To me, it seems that organizing and submitting PDFs by email will be easier than mailing printouts. I want to double check that DCF really can do email processing. Step 6: Submit Documents to the NVCAfter you collect your Affidavit of Support form(s) and financial evidence in Step 4, and supporting documents in Step 5, you must submit all of your forms, financial evidence, and photocopies of your original civil documents inONE package to the NVC. Your case may be significantly delayed if you fail to submit all of your documents in one package. Review the methods below, and choose the one that applies to your case. Method 1: Email processing If your NVC case number begins with one of the following prefixes: AKDAMMDMSGZOMEPSAAScan and email your financial forms and evidence, supporting documents, and translations to nvcelectronic@state.gov. Please place your case number in the subject line of the email and keep your attachments below five megabytes (MB). If you have more than one case, use a different email message for each case. For more information, review our Document Scanning FAQs.   5. We are DCF, and therefore my Chinese income for past 3 years (even though it does just barely qualify in USD at the 125% poverty threshold) won't matter. I understand what's important is showing how I can support my spouse in the USA. My question is what is the golden number to hit for the value of my assets? EXCERPT from I-864 instructions: Part 7. Use of Assets to Supplement Income (Optional) Only complete Part 7. if you need to use the value of assets to meet the income requirements. If your Current Annual Household Income (indicated on Part 6., Item Number 15.) is equal to or more than needed to meet the income requirement as shown by the current Federal Poverty Guidelines (Form I-864P) for your household size (indicated on Part 5., Item Number 8.), you do not need to complete this Part. If your total household income does not meet the requirement, you may submit evidence of the value of your assets, the sponsored immigrant’s assets, and/or assets of a household member that can be used, if necessary, for the support of the intending immigrant(s). The value of assets of all of these persons may be combined in order to meet the necessary requirement. Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner’s claim of its net cash value. You may include the net value of your home as an asset. The net value of the home is the appraised value of the home, minus the sum of any and all loans secured by a mortgage, trust deed, or other lien on the home. If you wish to include the net value of your home, then you must include documentation demonstrating that you own it, a recent appraisal by a licensed appraiser, and evidence of the amount of any and all loans secured by a mortgage, trust deed, or other lien on the home. You may not include the net value of an automobile unless you show that you have more than one automobile, and at least one automobile is not included as an asset. Item Numbers 1. - 4. Assets. To use your own assets, you must complete Part 7., Item Numbers 1. - 4. and submit corresponding evidence with this affidavit. Supporting evidence must be attached to establish location, ownership, date of acquisition, and value of any real estate holding. ### My spouse and I jointly purchased two rental properties in 2014 and 2015. Both generate some rental income. They are townhouses, and 90% paid off in cash already. Still, I'm not sure if the appraised value of our real estate will be high enough? That's why I was wondering what the golden number is to hit for asset value... (Additionally, I don't have employment lined up yet, so I'm unable to show proof of that point. The only proof of future income is from our rental properties, but the net income falls short of the 125% threshold.) (And, we really don't want to obligate a joint sponsor to sign a 10-year contract for us.)

It appears I incorrectly believed that GZ conoffs may give a thumbs up or down when a Chinese wife submits a live signed copy of the I-864 and supporting documents that the husband submitted to the NVC. However, a legal source has informed me that conoffs do not readjudicate financial documentation already approved by the NVC. Any thoughts from ocd observers?
  7. A couple questions as I am gathering documents for both parts of the process. I feel that I have all the documents prepared for the preliminary petition for my wife as follows (found in the DCF Filing guide) But the following documents (I will highlight in red and explain why im confused) are unsure to me, and need some guidance. Firstly, the I-864, I need to print out and add anything that did not come up in the type by hand correct? Also I need to sign it by hand in black ink? No E-Signatures correct? 2. I only have one year of tax returns (for 2012) and 2013 and 2014 I was a full time volunteer for my church, and had an income of zero. How do I explain this to the CO, and what paperwork do I need to provide? I have a letter of being called as a representative for the church, that is signed by the leader of the entire church and the duration of the time, and also I have a letter of completion of service and the date of completion. Any advice? 3. Same question as the first: My mother is the joint sponsor, and so she has filled out this form, does she need to print this out, and sign it with black ink like my own form, or can she send it via email with an E-Signature? 4. Passport and Birth Cert are both fine? Photo copies make the most sense? 5. My mothers tax records are many pages long, some years it tops 100 pages. Does she need to give me HARD COPIES of ALL of this tax info? Whats the procedure on this? Thanks. Nathan&Min
  8. Hello, I am phyrwrks. I am a US native with a Chinese wife. We were married in China and I am staying on a visa. I ma having trouble with my financial qualifications. I am searching for a sponsor/cosponsor or benefactor for financial assistance. I expect to be able to go back to work and my wife will receive a green card and will be able to work, as well. We do not have the resources required to show financial independence. I don't anticipate having difficulty supporting us in the US, but the paperwork has become a roadblock.   9. Hello All, It has been a very long time since I last logged into Candle......... I hope all are well. I am working on my step-sons immigration documents and have what I hope will be a simple question for someone reading this. On the new I-864A form, In part 5 of this document, it is asked to give the ELIS number of the beneficiary (my step-son)......... I have no idea what this number is or if we even have had one issued to us. It appears to be a number issued IF we have filed any electronic documents - and I do not remember if we filed anything electronically or not. The form indicates that you may skip this if you do not have such a number - but I do not want to skip it if indeed we do have the number. CAN ANYONE TELL ME IF THIS IS A NUMBER I SHOULD HAVE AND IF THERE IS ANYWAY TO CONFIRM IF WE WERE ISSUED THIS NUMBER OR NOT? If we skip it and we do indeed have one - I don't want to cause there being anymore reasons to delay this already ridiculously long process! I would certainly appreciate the help from anybody who may know something about this matter. The only numbers I seem to have are the GUZ number, an INVOICE NUMBER, and a BENEFICIARY NUMBER. I really do hate to come here only when I have questions - but unfortunately Candle appears to be the only place to get such help - short of hiring an expensive lawyer. Hoping you understand.   10. Hi everyone, I would like to get some suggestions on my parents’ green card interview scheduled in early Jan. Some background information: parents both in their mid 70s. My mom is healthy but dad has colon cancer. It has been two years since his diagnosis. The cancer seems to be under control now and there might be another surgery coming up to completely get rid of the tumors but the decision has not been finalized yet. Side note: They actually got green cards approved a few years ago, but their SB1 visa (returning resident visa application) was denied in Guangzhou in 2014 because ‘protracted stay abroad was not caused by reasons beyond control’. To be more specific, they applied for green card while they were in the US a few years ago and left US with advanced parole before the green cards were issued. SB1 visa was denied because they didn’t return to US within 12 months of the advance parole, as we were told by the officer even we have the physical green cards. My questions are: I know cancer might potentially impact the interview results due to the public charge factor. What is the possibility that they will be denied? Does anyone have similar experience? Do we need to prove above and beyond financial records for support for my dad? Do I need to get a lawyer to help me? Any suggestion is appreciated. Thanks for your help in advance.
  11. What is the going rule of whether an original signed copy of the I-864 and supporting documents is required for interview or not? The NVC has an electronic copy. I've seen a little commentary on this but unable to find a government documented source that stipulates a requirement for original financial documentation from the petitioner. From the beneficiary yes. Any thoughts?

Hi All, My instruction for I-485 marriage-based cases (my fiancee came here on K-1) states we must bring the following additional items: Affidavit of support, COMPLETED AND NOTARIZED, WITH THE SPONSOR'S FEDERAL INCOME TAX RETURNS FOR THE MOST RECENT TAX YEAR. My questions: 1) Affidavit of support: does this mean I need to fill out a new form I-864? Notarized? I'm confused since I already submitted it with my I-485 application, do I need a new one? 2) Tax return: I e-filed, so I don't have a signed paper copy. Can I print out a copy and sign it? Does it need to be notarized? For the I-485 application I submitted 3 years of IRS transcript already. Thanks! John
  13. So my wife just got back from her interview at Guangzhou for her CR-1. We were going through the DCF process. She received a Final Processing Letter along with a green slip that wants her to get a co-sponsor. Here's my situation: I came to China for work 5 years ago and joined a startup. But my income was non-existent for those years and had very low AGI reported on my previous years tax forms. In 2015 (this year), I found a new job at a big Chinese company that pays above the poverty guideline for sponsorship but the consulate officer says they do not recognize my income from China. I also have a signed job offer from a US company that I will be working for in a couple months with high income and the officer says the job hasn't started yet so they don't recognize it either. I think it is pretty absurd. I can't find a cosponsor right now and I am asking for advice of what to do next. Some ideas off the top of my head so far: 1. Change my tax form info from last few year and pay additional tax to get a higher reported AGI. Will IRS allow this? 2. File a complaint with USCIS because I am not sure why they don't recognize my income from China. 3. Write to congressman and seek help What do you guys think? I think it's very strange that the DCF process requires me to be living in China and now they say they don't recognize my Chinese income when it comes time for the interview. WTF?
  14. In part 5 of the I-864, section 3. says to put "0" if unmarried, "1" if married. I am married and sponsoring my husband on the I-864 and don't want to count him twice. Should I leave this area blank or put "0?" If my income was a negative amount how can I enter this on the form? It won't allow me to put a negative amount.
  15. When submitting tax transcripts with the I-864 do you need to submit one ordered with the 4506t form or is the one ordered from the IRS website ok? On the IRS website it says you can order a tax return transcript via online but it doesn't mention this is ok on the instructions page for the I-864. Has anyone used this method? Any advice, please?
  16. Hi everyone, We have a few more questions about the I-864: For the Federal Income Tax Return Information in Part 6 section 19 - do you suggest putting down your actual income or total income? After my foreign tax exemption my total income is $0 for all 3 years. However, it says on the form to put your total income so I don't want to put inaccurate information on there. Advice? If my salary is in RMB which exchange rate should I use to transfer it to USD?Thank you!
  17. So I filed my wife's I-130 in Guangzhou a few days ago. So I have a few questions about what will come next. Can the medical exam be done in advance? I've read some conflicting information. First, I read that you don't need an appointment to do the medical for starters. But, while this may be true, I also read that you must have your interview with the IV unit scheduled before you can go do the medical. Then on the "US Travel Docs" website it says that the medical must be done 2 weeks before your interview. So... what's the real situation? Can my wife go do the medical now even though the I-130 is still being processed? Next up, we have read that she will be asked to provide documents such as criminal history, birth certificate, hukou, etc. Is this info still up to date? She already got the criminal history letter from the police at her registered hukou, and she got a copy of her birth certificate... but is she really gonna need to notarize/translate the hukou sheet as well? Anything else besides these 3 documents? The I-864 stuff I'm feeling ok about, I'm filling out my copy and my parents who are joint-sponsoring have already done theirs. When my parents mail their I-864 over here to China, they will just need the original signed form, copy of their passport(s), and copies of tax returns, yes? Thanks in advance! EDIT: One last quesiton, what are the other fee amounts we should be expecting? I know of the 1100 RMB medical, the visa fee of 160 USD, what else is there that I'm missing?
  18. Hello, Does anyone know what kind of documentation you should submit with the sponsorship form if you don't have any W-2s? All of my income was earned in China. Is a stamped letter from my company stating the amount of money I earned enough to prove my income? Are my certified tax returns enough? Thanks!
  19. I was preliminaily approved, however they want my husband to send in his 2014 tax return. He has not filed taxes for 3 years as he has been living in China and makes just a teachers salary well below 19,000 USD. He has always been told that he did not have to file taxes from co workers. The officer told me he could write a letter stating he did not have to file taxes but I want to know does he need to send proof of that and what proof does he need to include? We ae using his dad as a co-sponser so that is reason we were not worried because his dad has filed taxes. Now he is not sure if he is going to have to file, get transcript from irs, and wait. Has anyone beenin this same scenerio? Or does anyone have some advice? WE want to get this sent in soon since we are hoping to move back o states in 2 to 3 months. Also how long does it normally take to get visa after sending in needed documents?

Hi everyone, We are getting ready to submit our I-864 Affidavit of Support and I have several questions I am hoping someone can help answer: Should the mailing address be the sponsor's domicile address and the residence be our home in China? How do you write an explanation and provide documentary evidence of domicile? Does the sponsor (me) need to enter myself into Part 6, Section 6.a.? According to the I-864 instructions page, you are supposed to enter income entered in section 5 into section 6.c. as well, but this doesn't make sense to me, especially since in section 11 it acts as though I am not supposed to. Is foreign-earned income accepted? I have heard several mixed answers about this. Should I include my current bank account sum in Part 7,Section 1, even if my income is more than 125% above the poverty line?Thanks in advance for your support!
  21. HI to all, I received correspondence from GUZ this past April (2015) that I could schedule an appointment for my wife. I filed with NVC stateside, not DCF In that letter, GUZ mentioned that I would have to bring updated financial records (2014) for myself and joint sponsor. I was able to obtain IRS tax transcripts for my joint sponser. HOWEVER, When I tried to get my transcript by mail, the IRS website told me that my 2014 transcript was unavailable. I contacted the IRS and they told me just to wait and check back in a couple of days. Today is July 11 and still have this issue. My wife's appointment with GUZ for interview is July 29th. I have a photocopy of my 2014 tax return along with the 1099. I have a copy of the check I sent with the tax form along with an account record from my bank that the IRS cashed this check. I have USPS tracking receipt as well. QUESTIONS: Will GUZ accept the above tax information instead of an IRS tax transcript at my wife's interview? Should I contact GUZ ahead of time? What should I do? Does GUZ take into consideration situations like these? You can see how this is nerveracking because I did file a return that the IRS system doesn't have (they clearly cashed the check though lol). Thanks
  22. Dear all, I have a question about submitting the I-864EZ AOS to NVC. From the instructions on NVC website, I think I only need to send photocopy of the I-864EZ AOS with sponsor`s signature to NVC? As it is said the original I-864EZ AOS is needed in GuangZhou interview.

My background - US citizen married to Chinese hubby, DCF'd with visa interview set at July 27 (I'm getting so nervous...). We have been married for 5 years and living in China the whole time. Hopefully the questions make sense. :-) Thanks a bunch! Question 1: Part 2 Information on the Principal Immigrant - Mailing Address (2.a - 2.h) <-- Do I enter in the address my husband I live at here in Beijing? Question 2: Part 4 Information on the Sponsor - Sponsor's Mailing Address (2.a - 2.h), Sponsor's Place of Residence (3.a-3.h) & Other Information (4-5) Sponsor's Mailing Address (2.a - 2.h) <--Is this my current Beijing address? Sponsor's Place of Residence (3.a-3.h) <--Is this my US residence? Other Information <--(4-5) Which number to use: US or China (current mobile no.)? Which country to record for domicile? US?
  24. There are some different 1-864 forms, will NVC tell you which one is right for you to fill out ?
  25. We just submitted the all-in-one document packet to NVC. Got the automatic email that this address is strictly for document submission. My wife filed I-130 for her son (IR-2, she is USC). The NVC State web site asks for 60 days to review submitted documents. Does any one have any idea how long we can expect before we get an answer? Is 60 days about right? Will it take longer? Has any one experienced shorter time? My wife is curious how long to expect?
