  1. I'm not speaking from experience, but I don't think the K-3 is renewable. Like you, we filed for AOS but off a K-1 which is now expired. Technically, my wife's status is considered a "period of stay authorized by the Attorney General". This means that she is here legally but in a kind of limbo while we wait for Atlanta to get its act together. From what I've been told, nothing can or needs to be done other than wait.

  6. I happened to catch that one while I was there. Good luck in getting the residents to use them. One thing I have deduced is that the women may not have a full appreciation of the sorry state of affairs related to men's bathrooms. While I was traveling from Guangzhou to Zhanjiang via bus, we made a pit stop along the way. Having not really slept on the plane from the states, I was still very groggy but had the need to relieve myself. So, I walked in the common entrance and hooked a right. Well, the bathroom was very clean, even considering this was a bus stop. Funny though, no urinals. Upon my exit, I noticed many women standing there waiting and laughing, then it dawned on me. Oh sh*t.

  8. If you are referring to your fiancee and she has never been married, I think a "singleness" certificate would be appropriate. Jingwen's notarial divorce document contained language to the effect that she had not registered a marriage since her divorce. I assume this was sufficient since she got her K-1 visa. I did not provide her with any documentation for her interview related to my single status, but we did provide the "intent to marry" document.
  9. Just a heads up for those of you traveling on AP. Jingwen and I just returned from China where she went after her dad's death. Since her AOS is still pending, she traveled on AP. I didn't give it a second thought, but we encountered resistance at every turn once we got to the airport (GZ) to leave. There was no problem checking in with China Southern with her having a passport, and expired K-1 visa and her AP, but immigration control, security checkpoint, and boarding all required two to three people to review and eventually accept the AP as proper documentation in lieu of a visa. I would have thought that this would have been fairly routine, but each time, the first person to look at her papers refused to let her continue and each time, I had to raise my voice to get a superior to accept the paperwork. If Jingwen had been traveling by herself, I'm not sure she would have made it. We also had copies of the AOS receipt notice and our marriage certificate just in case, but they weren't needed. Entry into the US was routine but with the added step of going to the "second interview" office (LAX) so her AP information could be entered into the system and her I-94 stamped.

  15. Some people fudge a little in checking off the documents so they can send the OF-169 back as soon as possible. This likely starts the clock on the P4, but that's just a guess. Most people will have already obtained the documents in advance of the P3 but end up getting updated copies because of the time lag. I may be naive, but why would the employer be involved in getting the various documents like the birth certificate and police certificate? Is there some connection between the notarial office and the employer that would be cause for concern?

  18. I hope I understand your post correctly. P3 (shorthand for Packet 3 - NOA1 and NOA2 being the first two) is the first of two packets of instructions and documents that your fiancee receives from GZ. Apparently, your fiancee has already sent in the applications and forms contained in the P3. The P4 also comes from GZ and contains the appointment letter, more instructions, and more forms. Your work is not quite done. You will have to provide your fiancee with an Affidavit of Support (I-134) so she can take it to the interview. Hopefully, you have helped her with the P3 documents which can be confusing and will help her with the P4 documents as well. Unless you are planning on being in GZ during the interview, even though you can't attend, you should also make sure that you send her all the supporting documents like e-mails, pictures, and anything else that proves a valid relationship. Many people at CFL, including myself, highly recommend that you try to be in GZ while your fiancee is there if you can afford the time and money. Good luck.
  19. When I first started corresponding with Jingwen, I bought Transwhiz, which I thought did a pretty decent job. If the letter was not complex, I'd use it, and when it translated something, I would check it against a dictionary, make a few changes, and send it off. After several of these, Jingwen wrote me an e-mail and asked that I send my e-mails only in English. She said it was easier for her to translate my English than my Chinese.
  20. For some reason, I don't think age 16 is a significant date. Hopefully, your fiancee's daughter was listed on the I-129F, and Part I of the DS-230 was prepared and filed for her as part of the P3 paperwork. As a general rule, whatever forms/fees/medical exams, etc. you have for your fiancee, you will have to duplicate for her child if she is to come to the US on a K-2 visa.

  22. Wow! The gods must be smiling on you guys. Wonderful news. Maybe GZ is getting its act together. To go from P3 to the P4 queue in less than a month is quite fast. Now, it's time to wonder why it takes so long to get an appointment. Sounds like others are waiting 3-5 months between P3 and P4. But, who really knows. Good luck. And just remember, the fastest way to get through three months is to sign a 90 day note now. The time will fly by.
  23. The I-131 is the application used for AP (Advance Parole). If you somehow got AP without filing the I-131, please let us all know how you did it. The I-130 (Petition of Alien Relative) is not needed for a K-1/K-2 filing for Adustment of Status (AOS).
