  2. Sounds like they're going to do what they want to do there. Feedback is almost non-existant as to why denials occur, so it would be very difficult to say what the best approach. Parents are, in general, the most likely to pass. Good luck all around.

  4. Here's a link to the VSC IMBRA approvals. It's a little hard to find among the other IMBRA stuff. I saw this in the same thread - Basically. how can they issue a second NOA2?
  5. Does anyone have a feel for whether the approvals were for people who answered "yes", or "no" to the IMB question? or a mixture?
  6. I saw on VJ where some VSC approvals (NOA2) were mailed out on July 2. These were to people who had applied (NOA1) in June, and had received and replied to the RFE's.

  9. Some provisions of the IMBRA law affect both those who met through an IMB, and those who did not (hopefully, responding to the RFE will satisfy these provisions). An IMB is affected by additional provisions, where the IMB must collect information about the American client to give to the Chinese beneficiary. These additional provisions could cause delay, while DHS tries to figure out what to do with them. One website (chnlove.com) even claimed that your petition could be denied if the IMB did not satisy the provisions. The RFE's are here, our petitioners are expected to answer the IMB question - we still do not have clarification on exactly which websites are IMB's. Be VERY careful before you answer yes!
  10. No matter how many times you say "No", they will hold that option open for you. All he has to do to NOT come to the US is to NOT go to the interview.
  11. Your problems are with the IRS, not the INS. Even there, the penalty is only 10% annual interest , if any tax is still unpaid. Send whatever documentation you have. Tax returns, transcripts, W-2's. If you wish, you may document the missing W-2's. Write a letter including the company name, amount earned, and that the W-2 was not received. If you use only the mother's income, the father's need not be documented. The consulate will want to verify only the income, not the tax return itself.
  12. Yes - others have done this - simply set up a video camera to catch both you and the computer screen. Make sure that her window is large enough so that the VO will recognize her. Then transfer to VHS, DVD, or VCD.
  13. To further muddy the sand - Jiaying says that there are plenty of jobs here (Houston) for someone who is merely eligible for employment authorization. That is, with a (any) k-visa, passport, SSN and/or state-issued ID you can get a entry-level job, with the expectation that you will produce an EAD. I guess the employer's expectation is that the partial documentation would hold off any kind of an audit long enogh for them to "update their files", and that a legal alien is preferrable to an illegal alien.
  14. Yes, the fiance of an American citizen is eligible for a work authorization, but Someone on this board disagrees with you. As far as actually finding a job, this is a moot issue. But K-1's need to be aware of the documents this person links to and take a copy of it with them when they apply for an SSN, since they are asked for specific employment authorization. I believe it was a good friend of yours who provided these links.
  15. Yes - K-1's are actually authorized to work, although getting a job may be a separate issue because of the 90 day expiration. With some employers, however, simple eligibility for an EAD is enough.

  19. This sounds more like an Adjustment of Status INterview in the US than a Consulate interview. 227048[/snapback] . . . and it doesn't sound like an AOS interview at all. Both parties will be in the room together, and it will take maybe 15-30 minutes (AOS interview, that is).
