  3. Hi, I always thought that immigration only cares about the alien's criminal record and not the US Citizen's record. I was wrong. Something I didn't consider.   4. I was married to a chinese woman but after she recieved the green card everything thing change and we went our seperate ways. That was about a year and a half ago. In the mean time, I had a language exchange pen pal that I made friends with back in 2008. Only chatted a few times a month, nothing major. But now we became more then just friends. The relationship has grown stronger for about a year now and she was a lot of support after my divorce. I've been to China twice (Sept, 2013 for 3 weeks and Feb, 2014 for 2 weeks) to see her and even though she really would like if I moved there, I told her with my investment properties it won't be that easy so I said she could come here on the K-1 Visa. She worries about a couple of things. One being that we were friends when I was still married so she thinks the VO will think she was the cause of the divorce. The other is that since the marriage was so short (ending right after my ex received the 10 GC) she will worry the VO will think I'm marrying a 2nd chinese woman to do the same thing. I told her enough time had passed. All my papers are almost ready to be sent but she just wants to make sure we are not going to waste or time and money waiting to find out that she will just get the blue slip when that time comes. Has any other member here been married to a chinese woman only to divorce and then want to petition another woman from china or any other country about a year and a half later? Thanks
  5. I have been visiting this forum for several months and have found a lot of very good, hard to find information thanks to some very good people on the forum. I am now in the process of completing my own I-129F and am unsure how to answer a question regarding having previously filed any petition for a K-1 fiancé petition. I filed a petition in the year 2000 (13 year ago) that was approved. My fiance at that time came to the US and we came to a peaceful and mutual conclusion to not get married. She departed the US within 90 of arrival, so there was no overstay. The I-129F asked for the filing date and the city/State it was sent to. Because more than 13 years have past, I, nor my past fiancé, have any documentation regarding the month or day it was submitted back in 2000. 1. How would you complete this part of the I-129F? 2. Should I include more information to the DHS-USCIS about why that person and I didn't marry? Thank you. Steve
  6. Well.....I received another email from USCIS today letting me know that our petition was denied. Words can't express how I feel right now. I mean....after making us wait for over 3 years, and allowing us to have the hope that it will be approved, they decided to deny it. I don't know what to do. I want her to come to the U.S. to be with me. But, if they denied this one, then they will only continue to deny any petitions I file. I am filled with so much hate and anger right now that I feel like I am going to explode. I don't want to stay living in China for the rest of my life, especially since due to my criminal history, I can't get a good job here in China. I just don't know what to do. I love my wife with all my heart, but I don't want to stay here in China forever.

  8. Hi, I am asking this question for a friend who has met his first Chinese woman and may be serious about marrying her and trying to bring her to the States. He is a convicted felon. He served his time and is now on parole. Does anybody have any information on if this situation will cause him problems down the road in the visa process for her? And will it even affect his chance of obtaining a travel visa to go to China? Any input would be greatly appreciated. m-coon
  9. I am thinking about filing some kind of appeal about our denial. I thought I had read somewhere that decisions related to the Adam Walsh Act are considered final by USCIS and cannot be appealed. But, it does not say as such on their website, so I am not sure. Also, I have been seeing many posts of AWA related denials filing appeals on other website forums, but have not seen what the results of those filings have been. If the decision is considered final and cannot be appealed, then I would be jut wasting time and money by doing so. Would you suggest I file an appeal? I have already written to my attorney inquiring about this matter, but I wanted to see what everyone here has to say about it. If I decide to do so, my attorney will assist me. Also, there are 2 different forms for filing appeals. There is the I-290B and the EOIR-29. I think we would use the EOIR-29, but I am not sure. There is a basis for an appeal. The issue is the USCIS concern for my wife's safety. We have lived together in China for more than 1 year, and have evidence to show this as fact. Also, my wife can write a very heartfelt letter telling them that she is aware of my criminal history, that I have never hurt her, etc. If I am going to file an appeal, we would need to move pretty quick because I only have 30 days from when the decision was mailed to me: January 4th.
  10. Well....finally after 3 years and 2 months of waiting...USCIS has finally made a decision in our I-130 petition. I received an email today notifying me that a decision was made on December 31st. However, it did not tell me what the decision was. Instead, I have to wait for it to come to my mothers house in the mail. It is a great relief that after all this time a decision was finally made, but now we will be totally stressed out waiting and worrying about what the decision is. If it is a denial, I don't know what we will do. Anyway.....please pray for us that it is an approval.
  11. Hey all.....long time no see! Well.....after waiting for a very long time for a decision in our case. I did, in fact, move here to China last year in September with the assumption and hope that USCIS would approve the petition within a few months at the most (silly me). Here it is 1 year later and still nothing. All I get every time I call is "Your case is pending and is currently being processed". I am told every time that if a decision has not been made within 3 months to call back. For those of you who do not know, we have been going through all this heartache because of the fact that I am a convicted felon from 10 years ago (no it was not for domestic battery or any violent crime). I even waited for 1 year for the FBI to complete a background check on me before they returned our case back over to USCIS in May of this year. So, here is the issue I am wondering about now. With a case currently pending with USCIS at the Vermont Service Center, and my criminal history, would we be able to do a DCF in Guangzhou? I have more than met the 6 month residency requirement, but I am concerned about my current petition and my criminal history. The form to file for the DCF is only the I-130, which does not ask about the petitioner's criminal history (when we filed the I-130 for spouse visa in 2009, it was required to file an I-129F form as well, which DOES ask about the peitioner's criminal history). Basically, would I need to/be able to withdraw my current petition at the Vermont Service Center, and them file a DCF in Guangzhou? Since it is a DCF, would they do a background check on me or just my wife? Also, would they be able to get on their computer and see that I had a petition pending at the VSC and ask why I withdrew it and/or see that I have a criminal history? Anyway.....since I have no idea when/if USCIS will make a decision in our case, I was wondering if we could file a DCF since I have lived here with her for more than 1 year. Any input is appreciated.   12. My wife had used a marriage company that led to our meeting. Now that we are married and have started the visa process, her contact person with the company has given her the name of a company which helps procur visas. I know nothing of these companies. I would appreciate any information concerning them. Are they a rip-off or do they provide a valuable service at a reasonable price? The specific company in question is ¹«Ë¾½Ð· ( YU CHENG). Any information, in general about such companies as well if anyone knows something specific about this company would be greatly appreciated. Thanks

  14. We are preparing to apply for K-1 visa. I have a total of 3 misdemeanor DUI convictions 24 to 30 years old in Oregon and California (CA). According to the CA. Department of Justice (DOJ), based on my livescan fingerprints,there is no record of my CA conviction. I also checked with the arresting police department, their records department and also the courthouse and all indicate in writing that I have no record in CA. I have contacted 3 CA. law firms, that claim to specialize in arrest records, and requested they obtain this 1987 record for my K-1. All 3 firms advise me that if DOJ has no record then it's not possible for anyone to obtain this for me and they doubt that USCIS will find anything - that in 1987 files for misdemeanor DUI were paper files as were fingerprint files and most likely my fingerprints were never sent to DOJ which is why no record is found - they suspect my paper file is in the basement and was never entered into the computer database (all over the phone speculative advise/opinion). In Oregon I can only find record of my 1981 arrest from the State Police records (Oregon's clearing house for all arrest records). I have hired an Oregon lawyer to obtain the required certified copies of my 2 Oregon arrests. I am afraid that if I don't disclose my 3 arrests it will come up in the USCIS check and we will be denied, however if I do disclose and don't provide the required certified records (that I can't obtain) then we will be denied. My lawyer advises me to obtain the records but so far has not told me how to accomplish this. How do I obtain these required records? Should I disclose this at all? Please advise.
  15. i just read of one mans petitioner interview?i do not recall seeing in that in any of visajourneys website. will i be interviewed in the united states? and if yes, where? also, if i could pull off being in china when liu and her daughter go to the interview, how much will that help? i am running out of vazation time!thanks...todd
  16. I want to thank everyone in advance for your help. I do not know how anyone without the information from you fantastic people here can get through the Visa process!!!! These might be silly questions but I am just trying to make sure everything is in order. A little background real quick. Started talking to my lady in June of 2009. Have been to see her 3 times now. Oct of 09...national holiday, Feb of 2010......Chinese New Year, and Sept of 2010......mid autumn festival. I just got home a few days ago..haha. I am putting the package together and have these questions. 1. Should I include the receipts of places visited....Great wall, Tianamen square, some other simple places in Beijing. I have the ticket stubs of many places we visited in Beijing, Hong Kong, Macau, and Xiamen. They are more ticket stubs than receipts. 2. I am listed on the hotels that we stayed at as 1 guest. Her name does not appear on anything. Possible problem? 2a. Should I include the bill of the hotel we stayed at with receipt of payment? 3. Did you include your itinerary with your boarding passes as proof of you actually going to China? now my last question....send to Lockbox in Dallas or the address? I want to have proof of sent. I will be sending everything Fed ex...not overnight but just the cheapest. Thanks everyone again for your help. I will be starting my time line here soon.   17. I fell in love with a Chinese lady and am wading through all the forums and learning all I can about the long and relentless process of marrying someone from China. My biggest question right now is I have been convicted of growing marijuana 2 times in my past. That's 2 felonies. 14 years ago was the last time. Nothing since then but I did get a DUI. I also have one maybe two domestic violence convictions from the same time period. I know this sounds terrible and I hate to think how bad it looks. The thing is I am wondering if anyone has had any experience or info regarding getting a fiance visa with all this bad stuff on record? Any and all comments are welcome.
  18. Are there any requirements for the Husband to be that must be met: I will give two that apply to me. 1)I live on a disability check. Are there Minimum Income requirements that must be met? 2) In my younger years, my drinking resulted in 3 DWI's. That made me a Felon. Does a Felon status kill the chance of a K1 Visa approval?   19. Well....received an Intent to Deny Petiton notice from USCIS! As some of you know, I am a convicted Felon. It is something that I have been trying to avoid disclosing to everyone here....but now I think it is time to do so. I served 2 years in a state correctional facility for a sex offense. I know some of you may cringe when you hear this, but all that I ask is you try your best not to judge me. I still choose not to disclose details, but I will say that it was not rape or a violent offense. I wish it never would have happened.....but it did, and I can never take back what I did. I will have to live with it for the rest of my life. My friends and family forgave me long ago, but I was not able to forgive myself until recently. I have done my best to make amends for my crime, and to better myself. I dated many women here over the past few years, but as soon as I told them about my past they assumed I was some sick weirdo and rejected me. I thought I would never find anyone that could see through the cloud of the bad thing I had done, and see me for who I truly was. Then.....I finally found Xiaorong. I told her of my past when our relationship first started because I felt she needed to know. She was upset when I told her, and I was worried about losing her, but it would not be right to keep it from her. We talked about it, and I told her everything. She told me that she knew in her heart that I am a good person that just did a bad thing. She said that the "past does not matter.....the only important thing is the future, and what I decide to do with my life to make things better." I, of course, I am going to provide as much documentation as I possibly can to the USCIS. They may still deny the petition, but WE WILL NEVER GIVE UP!! It is sad that I may be forced to do so, but if I have to I will leave the country that I love, so that I may be with the woman who is my world. I am sorry to have written such a long post, but I had to get this off my chest. Just know that I did not write this to invoke pity from anyone, I just wrote it to express my feelings, and to tell all about my past so that I may hopefully be able to help someone in a similar situation in the near or distant future.
  20. i met my fiancee through a website called my foreign bride. this site is not compliant with the imbra law, but they charge men and women the same fees to join. i have read that the vo can deny the visa if you meet your fiancee on a site that is not imbra compliant. i am very concerned about this and hope someone can ease my mind a little bit. i am currently in the early phase of the k-1 process.
  21. I am not sure if I posted this in the right place but I am in desperate need of help. I am a convicted felon in the state of Indiana. It happened 6 years ago and it was not for any of the specific crimes listed on the I-129F form. Also, my fiancee already knows about it. Since I am a felon, will the USCIS automatically deny my petition? Are there any other felons on here that went through the Visa process? If there are, could you please help me.   22. I've read the articles and posts about IMBRA. The law stinks. My question has more to do with whether the fact that I met my gal on chinesekisses.com will come back to bite me in the butt. I doubt that website sent her my criminal record (one speeding ticket a few hours after Nixon lowered the speed limit) and did all of the other stuff that it is supposed to do according to the law. Has IMBRA directly hit you? If so, how? Is there a way to mitigate the problem?
  23. Something that has bothered me about IMBRA is the Multiple Petition Waiver requirement. The law specifically states it is required "...with respect to two or more applying aliens...". But USCIS has interpreted this to mean it's required for the same beneficiary. I wrote an article about it. There are some editing errors I hope they fix. But those C4L members to whom California Service Center is sending out letters stating they need to apply for a waiver to sponsor the same beneficiary, might benefit by reading it. http://www.ilw.com/articles/2007,0206-ellis.shtm I think USCIS blew it on this part of the law. This problem is compounded at the California Service Center and the TSC, which sends K-1's to CSC for processing. Unlike Nebraska or Vermont, CSC does not send out NOID letters to returned K-1's. So CSC petitioners find themselves in the position of being unable to prove the consulate was wrong in sending back the petition and being forced to apply for a discretionary waiver, without ever having a chance to respond to the consulate's allegations. CSC at least, should change the way it handles the return of K petitions from consulates.
  24. In reading through some of the past posts on here, I discovered the story about Jany and Cindy and their plight. Now when that was happening in realtime, I can empathize with the outrage and the call for new laws to prevent such events from happening again in the future, but now that the IMBRA law has passed and is implemented, it has affected so many innocent lives in such a negative way, do you folks still support this law? It's caused endless delays for many petitioners. I wasn't here when the events unfolded with Jany, so I can't say about the past, but currently, I am no supporter of the IMBRA law. I believe it penalizes the majority of the innocent to try and prevent the minority of evil doers. You don't punish the innocents in trying to locate and prosecute the guilty parties. I'd like to hear other people's thoughts on this.

As I read through all the information listed on this site a big question has arisen and I post here in hopes someone can provide me with correct info for a petitioner who has a past felony conviction. I am sorry for airy my dirty laundry on this site, but my future with Wen Li hinges on this question. Prior to '86, no criminal history. In '86 I was in the wrong place, wrong time with the wrong people and was convicted of a felony crime of delivery of a controlled substance. Post serving a short time imprisoned, I have not received so much as a parking ticket. Now my question is quite evident at this point. How will this effect our goal of becoming future husband and wife? Thank you in advance for any knowledge on this subject that perhaps will arise as our paperwork begins in the near future.
