  2. My wife went into the interview knowing enough English to say, "No English. Chinese please". She says the pictures were very important in establishing the relationship.
  3. To clarify some of the terminology - K1 is filed in the US to bring an alien fiance to this country. When the visa is used, she will have 90 days to get married in the US. A CR1 is filed (in the US or at a consulate or embassy abroad) for a wife. DCF (direct consular filing) is the term used when the CR1 is filed at the embassy or consulate. If a CR1 is filed in the states, you may also file a K3, which may be processed quicker. The DCF is almost always the quickest.
  4. K-1 is a single-entry visa - she would not be able to leave and re-enter (I'm thinking of the cruise ship here). Back to the student visa idea - most of the Chinese people at work came here on student visas to go to graduate scholl. This (the student visa) might be easier if she has a bachelor's degree (although they are pre- 9-11 for the most part. I think (get married in China) the DCF is your best option, if you can do it.

  12. So we're in a couple of gray areas here - one is the AOS approval (pending FBI background check), the other is that he's 20 years old. My impression is that neither will affect it. I think (if I remember correctly) the over 18 is an issue with K-3's, but not K-1's.
  13. Lee and jim_julian are both following this path - Jim since they have to wait until the daughter is over 18. There are K-1 vs K-3 differences here that come into play. I think it's been discussed before (at least the under/over 18 aspect). Maybe Frank can help out - my head's already swimming .

  17. No - USCONGUZ informed one of our members that his wife had up to 2 years to decide whether she wanted to use it. The K-3 is good for two years, whether first time or other.
  18. Congratulations. We've seen in the past also that the interview dates at the end of the month are filled first (with the earliest applicants), then move toward the beginning, effectively inverting the order. If they continue to fill August dates, someone could end up with an early August date and as little as two weeks notice. It's happened before.

  20. Mike, hang in there, you'll get it. At this point, it appears that nothing is happening anyway. They did update to July 11th "again." That was interesting. It's like someone was told, "okay, go ahead and update it." Then something happened and they were told, "no, wait, don't do it yet, put the old date back in. Then, later on, "okay, update it now." The further ahead we go, the more behind we get. 230348[/snapback] It's been seen to do that before - when they process a file from July 11, then one from the old date, and then one from July 11 again. The time simply reflects the most recent file processed at the time of the update.
  21. Did you file an I129F, and have received the P1 and P2? If she is submitting the DS-230 without having gotten the P3, it ain't gonna work! If she has received the P3 and returned it with the DS-230, well, that's where you should be right now. Welcome to candle.

  23. Furthermore, I pretty well doubt that they have an answer to that question, either. I think this will be an iterative process, with, unfortunately, everyone who applied after March 6 caught in it. Yes, omitting the Exceptions from the instructions is a glaring change. Are you "lying" if you go by the law, rather than the I129F? Hopefully, they will realize that until they provide the means to the IMBs, there is nothing they can expect differently from those who answer Yes vs. those who answer No to the IMB question. First off, They will have to determine specifically who really is an IMB.
