  2. Randy, because there are a few variables, it would not be good to paint this with a broad brush. FBI files contain a good deal more information about each one of us than a third-party background check. Additionally, there might be those who have been charged and acquitted, and had files expunged. The FBI does not expunge, but third-party and local agencies must. The well-intentioned but backward IMBRA law wants to alert would-be spouses of: 1. Previous sex crime convictions 2. Domestic violence convictions Those that have these sorts of convictions on their record would do themselves a favor by having an open hearted talk with themselves, their therapist, the police, and their partner. 220954[/snapback] But what I'm getting at is this - would it be reasonable (or possible) to order NOW the same check that might be imposed on an IMB under the law? What I'm afraid of is that Joe Blow, who met his SO through AsianEuro and applied after March 6, might find that the VO says, "Oh, we just declared them a Marriage Broker last week" and blue slip them for the background check. If were able to order one NOW, that would minimize the delay. There are a LOT of details to work out w/this act.
  3. The IMBRA law is all in the interpretation and execution. The only thing that has meant so far is that any petition submitted after March 6 was recalled from the consulates. And this is only to make a revision to the I-129F form. Which specific web-sites are actually IMB's under the law is open to interpretation. I'm going to toss this up to see what others think - why not be pro-active and order a criminal background check on yourself to be sent to your SO? It seems like that in itself might stave off an RFE or a blue slip. Let the USCIS worry about which web-sites are marriage brokers under the law. The intent is to get a criminal background check into your SO's hands. You can do this youself. One of David's links (usimmigrationattorney.com) said this: Is this reasonable?

  5. I believed it appeared at one point that the date reflected the date of the most recently processed application (at the time the page was updated). That is, if Joe Blow applied on Jan 1, and his zipped through, that is the date that would show. Then, when a slower application that was received earlier was processed, the time might go backwards to that date. In other words, don't be really suprised if it shows a date LATER than your own and yours still hasn't been processed.

The I-129F application still shows the Nebraska, Texas, California, Vermont, and Chicago addresses, but has NOT been updated for IMBRA.

  12. "it takes time to open and processed each letter" was the closest to an informative response that I got. This was several weeks after they had signed for it. It's that act of entering it into the computer that finally registers something that they will report.

I think we're finding that red flags don't necessarily mean that the VO will want to deny the visa, but if they get a favorable impression, they will spend more time looking for Green flags to justify awarding the visa. That, coupled with USCONGUZ's assertion that the VO does NOT review the case in advance, says that it's all about the 5 minute impression made at the interview. Thus, increasingly, I like Ken and Jie's idea of the 5 foot tall, 3 part, hinged backdrop of their life together, to set the mood at the interview (only a slight exaggeration - she actually had photos and passports to set out on the counter where they might catch the VO's eyes). Seriously, though, GO FOR THE IMPRESSION that you will make on the VO. Here's a case where a photo says a lot more than 1000 words (he won't have the TIME to read 1000 words) - Jiaying wasn't shy at all about passing my camera around to whoever happened to be handy.

  15. I've actually been known to cut myself with one. It wsn't until they came out with the 4-blade razors that I could reliably shave without drawing blood.

  17. Out of status is okay for K1 - you are allowed up to 180 days (or is it 360) to apply for AOS.
  18. You have to file a request for an extension and pay your actual taxes owed by April 15. Bring a copy of that form. Alternatively, you can file an actual return now, and let your accountant file an amended return later. Interest and penalties are fairly low, if you know tha ballpark amount. Or, you can overpay now and get a refund later.
  19. SS, DL, and any name changes NOW . Don't forget to get married (I'm sure you feel like you already are). Congratulations and Welcome to the US.
