  1. I actually did that one year. With income averaging, our tax bill worked out to be lower using the Married filing separately than jointly.
  2. If we don't hear anything about the green card soon, Jiaying will be filing for her 2nd EAD card in February.
  3. One of our members filed a return filing singly. Then when his wife got here, filed an amended return. I don't remember what his reasoning was for not filing for the ITN while she was still in China. You can also postpone filing until she is here. You will need to calculate and pay your taxes (married) by April 15, and file an extension. You can do this twice, to get the filing (but not the paying) deadline extended until Sept 15. The form to use is 4868.
  4. K-1's are eligible for an "authorized to work" SSN until the expiration of the visa - 90 days. Take her back with a copy of RM 00203.500 (the first link on this link http://candleforlove.com/forums/index.php?...f=7&t=10720 ) and/or go to a different SS office. Go NOW before the 90 days gets too close (80 days max). The name may be changed on an existing card, or you can just give the her married name (bring the Marriage License) for a new card. The AOS application may be submitted with the married name. The K-2 is NOT work authorized, and so will not be given an SSN without an Employment Authorization card. You didn't mention his age - younger children might be allowed to file with their parent (someone else can tell you this) - we are filing separately for my wife's 21 yr old son.
  5. Thanks, my wife tells me many people sell it over there and it can be very expensive, 120 rmb per bottle. Her family loves it, you can't buy it in stores only through people who "distribute" it. They all tell her family it comes from the states so I was trying to locate some for them. My PlecoDict also decodes "ÂÞÀû" (luo li) as Raleigh, if that helps any.

They are not required to offer you a driver's license or insurance or a bank account if you don't have one. The web page you link to ends with the caveat of how to prove to someone that you CAN'T get an SSN, if you are not Employment Authorized ( and says this MAY be helpful to prove this). But most ARE willing to work around a non-existant SSN (including the State of Texas).

  9. I think the "toss-up" aspect of it depends on whether or not the IO can communicate with her. In other words, it depends on her English ability, how well she understands the particular questions and the IO's accent. If her English is weak to the point that she may not fully understand the proceedings, bring an interpreter.
  10. The IO will need to be able to talk with her without you interpreting in either direction.
  11. I sent you a PM - PLEASE don't confuse it with legal advice. If you absolutely can't talk to a lawyer before the hearing, see if the DA won't postpone it for a day or two. You need GOOD LEGAL ADVICE.
  12. I hate to jump in here when the others are telling you you need a lawyer (they're right), but ask the lawyer: Would it stay off her record for the probationary period? What are her chances at trial? (My guess is there would be no witnesses against her and that the trial would be after your interview) I'm going to guess that she will need to accept the deferred judgment. Consult with an attorney TOMORROW if AT ALL possible.
  13. I am guessing that this guy was very cruel in doing this. Check up on the law, whatever similar cases you can find to back you up - bring the name of the person who told you they won't give you a receipt for the I-90. Hopefully, someone will have some better information about how this should be handled. And - can you apply for AP after receiving the green card? They should be able to give you this at an InfoPass appointment (more money for them, but something to consider if it's possible)
  14. It is always a requirement that the Immigration Officer be able to communicate with the petitioner without the spouse being involved. Any interpreter of your own choosing will do. We were also required to communicate with each other without the interpreter. Yes - a large part of what they do at the interview is to take the documents they need from you and stuff them in your file. Having the documents tabbed and organized is to your advantage for finding them. What was your complaint about DORA?
  15. Someone who's been surfing VJ may no better than me (from cases already on the books), but, if I remember correctly, there is nothing in IMBRA about actually denying petitions. That is, I believe the intent is to simply make sure the beneficiary has the information to be able to judge for his/her self. Of course, the VO has wide discretionary powers for the final visa approval or disapproval.
  16. You pay a high price with either for using your credit card and the internet. WU is much cheaper and allows a bigger transfer when you take cash to an agent location. Western Union uses China Post for agent locations in China - my wife's family would have to take a trip to Nanning to pick up an emoney transfer. Unless I'm missing something.
  17. In a long distance relationship like ours, it is very easy to 'lose it' due to things external to the relationship. You become frustrated with the process, you hear bad stories from other people on Candle or from your friends My advice is to subtract - everywhere where someone says either "yes she does" or "no she doesn't" - from the advice above and listen to your own heart and remember what it was like the last time you saw her. My guess is you'll want to get on a plane to go see her. You have nothing to lose except the relationship.

  19. I think the catch in Jim's case would be if they didn't let him take the passport long enough to get a notarized copy. Hopefully, that's not the case, but, if it is, I would say as a very minimum give her a statement showing the "Official US Government passport" ID #, and a list of trips made with dates.

  24. This is different in that the K3 is already awarded, and the K4 declined(by Doug's wife). Another example of how they accomodate the children, and an excellent essay by Doug.
