  1. My wife has her 10-yr AOS. She is now visiting china. She wants to change her flight to stay longer to take care of her mother. She is worried that if she stays longer than 6 months that she will have problems reentering the US. Is this correct? I thought you could leave the US for up to a year. Does anyone know? Also, if she does stay longer her passport will expire so she will have to get a new one. Thus she will be using a different passport to reenter the US than the one she used to leave. Are there any potential problems of doing this that anyone knows about? Thanks.
  2. I received the NOA for I-751 about 4 weeks ago. Still waiting for the biometrics appointment to come in the mail. How long should it take? If it takes too long is there anything I can do (looking up status somehow or calling someone)? Thanks.
  3. I sent in the I-751 and have received 2 mailings back from the DHS. The first one is a plain white paper which is for my K-2 stepson which extends his current AOS by one year. The second is for my K-1 spouse and is the NOA for the I-751. It extends my wifes AOS by one year. So it appears that should they leave the country my stepson would need the white paper to get back in to the USA while my wife would need the NOA. Is this correct? Or will I be getting another mailing for my wife that is similar to the one I received for my stepson? Secondly, the wording on the NOA is confusing to me. It states the following: "In order to further process your petition you will be receiving an ASC appointment notice with a specific time, date, and location to capture your fingerprints, photo, and signature." This is what I expected. However, the next paragraph states the following: "NOTE: Conditional resident applicants, including conditional resident dependents residing oversears pursuant to military or government orders WILL NOT RECEIVE an ASC appointment notice. To complete biometric processing these applicants must submit the required items listed on the I-751 form instructions." This last part is confusing. From everything I've read I was expecting that my wife and stepson will receive the biometric appointment in the mail as is stated in the first paragraph. However, aren't they both conditional resident applicants (K1/K2) which the second paragraph says they won't receive the appointment. Can someone please let me know what this means? Will they be receiving appointments or not? Thanks.
  4. He shovel's if asked otherwise he just stays on his computer in his room. He seems to shovel ok when he does it. Is there anyone who knows for sure if I use my wifes expiration date or my stepsons date that is later? I thought it was the date of my wifes AOS expiration but I could be wrong. Thanks.
  5. My (K1) wifes AOS expires on 05/21/09. My (K2) stepson's AOS expires on 07/06/09, and is thus within 90 days of my wifes. I will file the I-751 to remove conditional status for them together (so that I won't have to pay the $465 fee twice). Do I use my wifes expiration date when determining when to file (within 90 days of expiration ... the earliest I can file being 02/20/09)? I'm hoping that I don't have to use her son's expiration date since I then won't be able to file until early March. Does anyone know for sure which date I need to use? Thank you.
  6. I will be sending the I-751 for my wife in early February 2009 for removal of the conditional status on her AOS. However, she needs to go back to Beijing China before this date in early January 2009 to help care for her ailing mother. She will stay in Beijing until June 2009. Her conditional AOS expires May 5, 2009. In order for her to be able to be allowed back into the USA in June I have read that she will need the expired AOS along with an extension letter/receipt that USCIS will mail to us after they receive the I-751 application. This letter extends the AOS expiration date by one year. Does anyone know if this is correct? I will then have to mail the letter to her in Beijing after I receive it. This could be dangerous, but I'm assuming that I cannot send a copy. Does anyone know if there is a better way to do this? Thanks.
  7. Should I file a single I-751 to remove conditional status for both my wife and stepson? My stepson came to the USA as a minor via a K2 visa when my wife came via a K1. However, he is now 19 years old and thus no longer a minor. Does this mean we will have to file 2 separate applications or just the one? Thanks.
  8. My wife and stepson both have their AOS. What do I need to do now? I need to lift the conditional permanent residency 90 days prior to the expiration date on the AOS ... is that correct? How do I do that? Is there some form I should fill out? Is there a good link that explains this part of the K1 process? I read something about an I-551 stamp in her passport. We don't have that? We mailed in her AOS application and got the AOS in the mail. We did not send in the passport to get a stamp. She is now in china (her father just passed away) but will be coming back soon. She has her AOS as well as her AP with her so hopefully there will be no problem getting back in the USA. One more thing ... her son has a different date on his AOS because I had to send it back for a correction and they took 6 months to send back a corrected AOS. Can I still lift the conditional part of his AOS at the same time as his mothers? I really don't understand what this "conditional" is all about. How can they call it both conditional and permanent? Not sure what that really means. I think my brain is a little fried after having gotten this far. Thanks.

I got an infoPass and took the day off of work and went to Chicago and got searched at the USCIS building and waited for my number to be called and the guy had absolutely nothing of value to tell me. He just said ... "it says here you need to submit an I693" ... yah, duh. So then I got a lawyer and sent him all the info and he responded with ... "I'd go to a civil surgeon and have him perform the medical again and pay him and make sure he puts it in a sealed envelope" ... hmmm, ok. So now that is what we are going to do. But I have one question. I got a copy of I693 to bring to the civil surgeon, but what about the other forms that USCIS says they never got (the DS2053, DS3024, DS3025, DS3026). These are not part of the I693 from what I can see. They did not ask for them in the RFE, they just said they did not have them. Do I need to worry about those forms? I'm thinking I only need the I693 and the I693 Supplement. Is that correct? Thanks.

Before filling out the AOS applications for my wife (K-1) and stepson (K-2) I had to pay over $300 at one of the USCIS civil surgeons in order for them to fill out the I693A supplements (the CS said each had to have some shots). They filled out the I693A and gave it to me (not sealed in an envelope). I sent in both AOS's and my wife has since been approved (will get green card soon). My stepson, however, has an RFE which states as follows: ================================================== Request for Additional Evidence (I-485): This office is unable to complete the processing of your Application to Register Permanent Residence or Adjust Status, (Form I-485) without additional information. Please submit the information requested. Medical Examination (Form I-693): Note: All medical examinations and vaccinations must be conducted and administered by a physician who is on the list of Civil Surgeons approved by the USCIS. All medical examinations MUST be submitted in an envelope that has been sealed by the Civil Surgeon. A review of the record indicates that you entered the United States pursuant to a valid K-2 nonimmigrant visa. All USCIS records relating to you have been reviewed. The U.S. Department of State medical forms DS-2053, DS-3024, DS-3025 and DS-3026 are not in any of those records. I-693 Medical Examination: Please submit a properly completed and signed Form I-693, Medical Examination of Aliens Seeking Adjustment of Status. The medical examination must be conducted by a physician who is on the list of Civil Surgeons approved by USCIS. Current regulations now require that the tuberculin skin test be completed by all applicants 2 years of age and older. A chest X-ray is required only when the reaction to the skin test is 5 millimeters or more. Immunization Form: Please submit a properly completed Supplemental Form to I-693, Adjustment of Status Applicant's Documentation of Immunization. The supplemental must be completed and signed by a designated Civil Surgeon. ================================================== 1) I thought that only the I693A (supplement) was needed, not the entire I-693. My stepson took the medical in Beijing China along with his mother before the interview. There was no I-693 given to either of them to bring to the USA. 2) Are they asking for all of these documents: DS-2053, DS-3024, DS-3025, DS-3026? They were given the DS-3025 which had their immunizations (which the civil surgeon transfered to the I693A). I don't know what the other forms are. 3) I'm sure he got tested for Tuberculosis during the exam in china. Not sure what to look for in the documentation he has for the medical. Does anyone know? In short its not clear to me what I need to send in (sounds like both the I-693 and I-693A sealed in an envelope). Not sure why or how I go about getting this done. Can I just go back to the civil surgeon and tell him he made a mistake and must give the I-693A in a sealed envelope? Are they asking that my stepson again get a complete physical even though he got one at the same time as his mother? Is it possible that they lost all his medical information from china and thus don't have those DS-xxxx forms so they now want a full I-693? If anyone has any insight please let me know. Thanks.
  12. I had registered for email updates for the AOS, AP, and EAD status changes for my wife and stepson. I had sent in the applications for all on March 6. I just got several emails: 1) AP for wife has been approved 2) AP for stepson has been approved 3) AOS for wife has been approved 4) AOS for stepson requires additional evidence 5) Notification that a notice has been mailed welcoming the new permanent resident (my wife) I'm a little confused by this. Maybe I'm misinterpreting these emails. Can anyone answer the following: a) I have not received anything about the EAD for both my wife and stepson. Can my wife work if she gets the AOS but not the EAD? B) I thought that the AOS takes a couple of years, not 2-1/2 months. c) Not sure why my stepson's AP is approved at the same time that his AOS requires more information. d) Don't I have to do anything else when my wife gets her AOS. I seem to remember having to do something 90 days before the 2nd anniversary of her arrival in this country (I94) but not sure what. Any comments would be apprciated. Thanks.
  13. Can my wife's (K1) son (K2) get his SSN before the EAD (work permit) is granted? The reason I'm asking is that I signed him up for drivers ed during the summer and I think he needs the SSN in order to get his license.
  14. I took my wife and her son to a different civil surgeon and was told they both needed shots in order for them to fill out the I693 supplement. The shots they specified were different than what the first civil surgeon said. I went ahead and paid them $334 for the shots (my wife for an MMR, or mumps, and her son for his second hep-b shot). They then filled out the form and I was able to complete the AOS and send it in. It cost me some money but now its done. However, the I693 supplement was not given to me in a sealed envelope. They just filled it out and gave it to me.
  15. I went to a Civil Surgeon to get my wife and her son's vaccination information transferred to the I693A Vaccination Supplement form. He told us the following: My wife needs a second Varicella shot (she got the first one in china during the medical exam) Her son also needs a second Varicella shot. He also needs second and third Hapatitis B shots (also got the first in china). The third shot must be done about a month after the second. He did not accept my insurance so I must get these from another doctor. When they are done I should bring back the information and he will transfer it all to the I693A for $60 each. He did say that he could transfer with the shots done so far but it would likely get rejected during the AOS investigation and I will possibly get an RFE later. He did say I could send it in before my stepson's 3rd hepatitis shot, but the same would likely happen (will get an RFE later for this). Does anyone have experience with this? Does this sound correct? Should I go ahead and get the shots or send in the I693A with whatever they got in china?
