Tax Return and filing a joint return
Randy W replied to hankster's topic in AOS & Immigration Challenges
Are you saying that if you don't "lie" and file singly that the IRS will do it for you? While the IRS and USCIS don't communicate too well, if at all, if the tax returns submitted with the I-864 show a person filed single status after filing and I-130 for their spouse might raise a few questions. Since the I-864 is a sworn statement that everything you provided as evidence is true, I can see a definite problem with a married person filing single status. So if it comes down to it, file married-separate and get the W-7 stuff together when you can and then file married-jointly with a first year declaration and use the extra money to take a trip to China. B) But you still need your wife's TIN or SSN when you file married-separately. You have until October 15 (with 2 extensions) to get the documentation together to apply for a TIN. Without it, like you're saying, you can't file married either. -

from Dan's link Individual Taxpayer Identification Number): The W-7 says to mail it to the Philadelphia address. -
Make sure she has the I-797C (NOA1) for the AOS, the Marriage License, and of course her passport with visa. We had a late flight w/a 1 hour connection, and a little confusion with the Immigration Officer (he didn't realize she didn't speak English - I thought he was telling me that all was okay with the AP form - so I went off to get the luggage - they had to find me to furnish the NOA1 and Marriage License). We still made the flight.

AP's are fairly routinely given out to AOS applicants for trips to visit home, business trips with a spouse, and I'm sure honeymoons as well. Jim_julian and his wife even got one during an Infopass appointment so she could go on a business trip with short notice. We got two originals of the AP form. When you re-enter, be sure you have a copy to leave with them. The airline at the other end may insist that you show them the original, as well as the IO at the point of entry, but make sure you leave the copy. The original can be used multiple times. The AP is good only for entry to the US. Your SO must have passports and/or visas appropriate for whatever country you are visiting.

Good luck, Scott. We'll be waiting to hear. -
ok what is the I-693 vaccination supplement ,and how and where do i get this, sorry if i sound stupid , but i am still lost, thanks I-693 Vaccination supplement This is not needed, since the civil surgeon is supposed to have these, put I like the idea of filling in your details ahead of time. That shows them EXACTLY what you need, so, hopefully, they won't try to tell you a full exam is required. Tell THEM what you need. The supplement will be sealed in an envelope for you to include with the AOS application.

Buying a clothes dryer and a dishwasher in China...
Randy W replied to rogerluli's topic in The Middle Kingdom - 中国
So what you're saying--if I understand correctly--is that our US 110 volts is safer but is actually less efficient than the 220 volt system with regards to receiving the same amount of energy (transmission). Is this correct? We're basically sacrificing some efficiency for safety? I believe that's true - I don't know of any other advantages to 110. But anytime they tell you to use a short extension cord because of the current, with 220, you could use a cord twice as long. -

I have always wondered this and never had the time to do some real research into the difference. I'd like to know why the US uses 110 and most of the world uses 220. There must be pros and cons to each system. So for the experts, can you please explain why the US uses 110 and Europe and China use 220 volts? Please explain the pros and cons of using both systems. Thanks! 220 provides more power with less amperage, while 110 is safer. Higher voltages are used for transmission because they require less current, and less loss is incurred. At lower voltages, more current is required. The conducting wire itself generates a resistance (loss). -
What type of SSN card do they gave you?
Randy W replied to Alexli's topic in AOS & Immigration Challenges
2. Nobody, except on a "Authorization pending" basis You are ONLY getting an SS card. The SSA does NOT authorize you to work. The USCIS will issue the EAD card when you apply, which is your employment authorization. What are you confused about?? -
After buying 2 new cars and adding 1 inexperienced driver, my bill went from $580 for a 9 year old car to $1040 for 2 brand new w/2 drivers for 6 months (insurance for Houston is the most expensive in the state).

Yes - the reason they go to 220 here is for appliances that need more wattage - AC, dryer - the wiring for a 220 volt appliance carries 1/2 the current, and wouldn't need to be as heavy. -

If you have 220 and ground I think you can pick off either hot wire and ground to get 110. Perhaps an electrician can verify that. Go out back and look inside your breaker box. That's how it's wired. My old house that was built in 1952 carried 220 volts through the attic - then each socket was fed by 2 wires, one from a hot wire, the other from ground. The 50 cycles won't affect lighting. Then, on the other hand, you could simply buy new bulbs in China if they fit the socket. Ha...you think an olde house was built in 1952??? Try 1910... Randy you lost me with the first sentence... I need the "for dummies" take on this...You seem to be saying I can just screw Chinese bulbs into my lamps and badda-bing...light??? The light bulb is the only part that uses any current. The wiring simply carries the current to the bulb. Unless the socket is metric or something like that, you should be okay. Check your lamp to see how easy/difficult it would be (worst case) to replace the socket. Try one next trip. Buy a cheap lamp with a standard sized socket to take with you. -

Her papers are (or will be soon) in her file at USCIS. You will see them at the AOS interview, if you have one. All you need for medical is the I-693A vaccination supplement, not another full exam.

"Abuse" is not a charge that would be brought against Scott - if she wants to claim it, she will. My guess is that it only takes a little bit of coaching to be able to flavor it as an abuse case - virtually every break-up has incidents that can be patterned as abuse. There is a chance that they might pair up Scott's evidence with her case, but it's not definite at all. No court is involved, since no one is actually accused of anything. -

but if she hooks up with a rich guy (or even a moderately rich guy like most of us), it won't be hard at all to show that she is already living above the poverty line. -
Any DVD disk you buy in china needs to consider two issues (concerning the data): 1) Region Code 2) video format (PAL vs NTSC) But most DVD's made in mainland China are Region 0, only a very few are actually coded for Region 6. Most of the recent players can play these, even Region 0 and PAL. Hong Kong is Region 3 - these are much more likely to be coded as Region 3. The Chinese players are region free, so any DVD you take will likely play on a Chinese player.

David told me that the remarriage has proven to work in getting the conditions removed with the new husband??????????????? Yes - in most cases, it puts her over the poverty line. It's still in effect, but you do not have to pay anything. (edit: Sorry, I thought you meant the I-864) -
If wife leaves the country........
Randy W replied to fortunecookie's topic in AOS & Immigration Challenges
Nope, it stays in effect - but it seems to me that she would already be well above the poverty line in that case. When circumstances change, you have to go back to court to get the award adjusted (I'm assuming it's like child support in a divorce). It takes some creative lawyering (common law marriage, anyone?) How much is the room and board he is giving her worth? How much in the way of gifts does he give her? What is her income potential? I don't believe that she can refuse to work and get you to pay for it. -

Randy W replied to fortunecookie's topic in AOS & Immigration Challenges
The I864 itself doesn't award anything to the beneficiary. She must go to court and get a judgment which will contain the terms of the payments. -
Check at yesasia.com. I think we've pretty well covered what's available here.

Your 100% right--you dont! How very mature of you. Criticizing someone in context and with content, personal or not is within the boundaries of legitimate debate (within reason). Taking something out of context in order put false words in their mouths is very immature and nothing more than juvenile flaming. (sorry to add to the crapfest but sometimes, the crap needs a little toilet paper and a good flushing.) I think we need a (very) special Mods attacking members forum.
