  1. It looks like we have to ask for postponement of my step son interview date that is scheduled on Nov 21 . My wife just received the news from the pathology that small lump in her breast ( 1 cm ) is cancerous so she definitely will have to go for surgery. Is a request for postponement for consulate interview allowed ? Thanks for sharing your experience.
  2. Hello all ; My step son , 13 years old , got the appointment letter to interview in Nov 22 for IR-2 visa . He has to go to the Medical office in Guangzhou , which my understanding is located next door or in the premise of the US Consulate . He has to bring vaccination certificate in China . He does not have one . What shall he do ? Just got the necessary vaccination/ immunization at the Medical Office in Guangzhou ? Thanks.
  3. Thanks so much . Of course, there is the custody letter fromt the court or an agreement from the custody parent that the minor child is allowed to immigrate to the US. This is what so called as NO Legal Impedement as listed in one of the response from GUZ way back then.

  5. Hello GUZ; My USC petition for my step son ( 13 years old ) just got approved . My wife is in China now , It would be most convenient for her to prepare any notarized documents while she is there . Can you tell us what are going to be needed for minor child from China ? Thanks.
  6. Hi every one ; I just want to update my petition for my minor step son . ( 13 yo ) It is been approved by USCIS . It takes 6 months ,,,, yes, twice the time from what it took for my wife back in 2010 ..... Next is NVC and Consulate in Guangzhou . I will probably need to accompany him ? What documents are needed from the China side pertaining to him ? since my wife is in China now , it will be convenient to have them done now . Things like photos, vaccination and medical exam can be done in Guangzhou later t before the interview. Thanks.
  7. Hi ; I petition my step son on February this year . Assuming the I 130 will get approved this year . What is needed by Guangzhou for the interview process of a 13 years old ? My wife is an LPR ( 10 years GC) and I am a USC. A separate question , after he arrives in the US , is there an intensive language program that he can enroll to quickly bring his English up ? Thanks.
  8. Went to the local USCIS office today. The officer opened up my case. He said that my request for expedited service has been denied. He also said that my application is now being reviewed or on an officer 's desk for review / process . He doesn't know when it will be completed . All he can tell is the application is not lost . Well, overall, it is much more useful than calling the USCIS customer service ...... having said that hopefully it is not too far distant we will get the news....
  9. I had to file an expedited request on the basis of emergency yesterday with the USCIS Customer Service Center. My petition for my step son was filed on Feb 27 with the Texas Service Center and so far is still in processing. My concern is about his safety . His biological father has beaten him up before . Serious beating. Luckily he was able to escape and ran outside to ask help from neighbors. Otherwise, he could have been hospitalized . We are talking about serious beating on the head . He is 13 yo. From Sun - Fri he used to live in the school dorm and he went home to his grandma place on Fri and Sat night. His biological father has remarried and raised another boy - 10 yo . He doesn't want my step son, but , he wants the financial support that my wife has provided the grandma to take care of my step son. He likes to give pressure to the grandma to not host my step son . The issue is his explosive temper which really brings a major safety concern. My wife is in China now since early July until Sept because the kid is not in school. We are concerned that if his grandma doesn't want to take care of him during this time, he has no choice but to be with his father. This can bring a major safety concern. I don't know how low life this man can be. He wants money out of people who takes care of his son. Otherwise, his temper may flare and he doesn't hesitate to do beating to his son. In China, domestic matter is not seriously addressed unless it involves a foreigner. He saw my wife and me as a source of money if he can extract , instead of being thankful that someone wants to accept his son and brings him to the United States to enroll in school and be a good person. Just recently, his current wife saw my wife and her son in the shopping area , it really made them very upset. He immediately called his son to harass him. He really wants his son to leave town to go the US but he believes his son will later beg to come back to China. While in China , he wants his son to live with him and his new family but with my wife supporting them with the living expense. What an absolute jerk ! The court custody agreement has been assigned to my wife and he also signed a notarized document that he agrees for his son to immigrate to the US with my wife expense.
  10. We have both court custody agreement and letter of consent ( notarized ) from his bio father . Any other documents that are generally needed ? while my wife is in China , she can get it ready . Thanks.
  11. Thank you so much Randy for this post . I will attend the interview , it seems to be critical for the USC Petitioner to be there. Also, in addition to the court document stating custody , there needs to be a letter from the bioogical father that he consents his son to immigrate to the United States. My wife is already an IR -1 , not a CR-1 , hope that helps smooth things out but it seems that it would be the best for me to be there.
  12. questions to CFL members who have petitioned for minor child . What documents NVC or GZ are asking for ? For 13 yo , does he need to go to GZ to do the interview ? who needs to accompany him ? My wife is in Sichuan until early Sept , perhaps, she can start collecting those documents ? Thanks.

  14. My US Citizen filing for my step son was received on Feb 27 ( NOA1 ) . Still have not received anything yet from USCIS TSC . Is it slowed down a bit lately ?
  15. Hi ; I applied I-130 for my step son as US citizen minor child ( he's 13 yo) . The application was received on Feb 27 . We still have not heard anything from USCIS -TSC since the first notice. Now, he is on 2 month summer off school . Can I apply for his tourist visa to visit the US ? what's the chance of him getting one ? given the fact that I already filed for an immediate relative petition . Thanks.
  16. yea ,,,, you are guilty unless proven innocent . when demand far exceeds supply , of course, the burden is on the applicant to be vigilant in every way. it is essentially useless to argue but a waste of time and money .
  17. the long awaited letter of denial for I 130 of my wife to her son has finally arrived. It says that they sent RFE on Oct 4 but the letter was returned by the post office as undeliverable ; so the case is abandoned ; no recourse unless we can prove that the RFE was not needed or the address sent was incorrect ,etc.... suggested to refile and get a new priority date . Oh ,well , I already sent mine and got the NOA1 from the Texas Processing Center this time instead of CSC.
  18. My I 130 application has been received and they are generating the I 757 now . Just a curious question , assuming everything goes well , the kid comes here, his English command is poor , how is going to attend a middle school ??? It probably will take 1 year intensive English training to get where he needs to be in order to attend classes ? How is he going to do it ? He is now in his 2nd semester in Sichuan Middle School . Pretty good studious kid. Excellent in math.
  19. Correct . Already filed IR-2 of USC last week ,,,,, on the mean time, I sent a letter already to CSC to ask the supervisor for I-130 to resend the denial notice and the reason for denial. More than likely, the dead line for filing an appeal has already passed . However, we would like to know the reason for denial . If I may speculate, most likely we did not send the " custody " or Child Raising Court agreement . In reading the certified translation of that document , my wife would not have the right to bring him over to the United States , let alone , she would not have the right to be raising her son because the divorce agreement indicated the son's child rearing responsibility was solely with his father and she was only helping to pay alimony ( expense ) . Now, as of last year in August ( after the filing of the I -130 ) , when she went home to visit her son, the ex husband agreed in the court as the defendant to transfer the custody to her . This document is signed by the local court and the judge. Again, in my opinion, without this custody agreement , there is no way, an established family relationship that allows the son to be apart from his father would have been given and therefore the I-130 can not be supported due to the lack of established family relationship to qualify for immigration benefit . He is a minor at this time.
  20. Got the email response from the California Service Center stating the case was denied and the notice was sent on Feb 2 and expect to receive it within 2 weeks. Really waste of time ..... don't know what to do next other than writing to the California Service Center to send us the denial notice with the reason for denial and any action forward that can be used to appeal . Really so difficult to get to the bottom of it .
  21. we went to the USCIS Detroit office this afternoon . The officer checked the application that my wife filed for her son as a child of LPR . He said that the application was last reviewed on Feb 8 ,2017 in California and still in process or under investigation . I told hime then that according to the USCIS case tracking , the application was denied on Feb 7 . He then checked a different system and confirmed this denial . Unfortunately, he was not able to tell us the reason for denial. If we have not received the denial letter by Feb 22 , then, we need to go to the link to request the denial letter. Our address is good because we received the application receipt in the mail in June last year . I am really puzzled but have no option other than going to the link and make the request to resend the denial notice .
  22. Still have not received the notice of denial yet , so , we have no idea why the I130 was denied ? Strange , we never receive any RFE either . Usually they would send an RFE prior to denial notice. regardless, we already made an appointment to see the local USCIS next week ,
  23. Thanks again. We have made an appointment with USCIS Detroit office next Wed , this way at least if the letter never gets here , we will find out the reason why ? Just a speculation ..... indeed , she did not have the custody Chinese court document along with the I 130 petition application , also, in the divorce agreement , it says that her son stays with her former husband family . Indeed , only after we filed , last year in August , she went home and had the court with the agreement of her former husband issued a custody agreement paper on her son to her . This document is in Chinese . Where can this be translated to English ? In China , they have notarial service , how about here in the US ? for convenience sake to proceed forward , just in case this is the missing piece to establish the family connection , ie. eligibility to immigrate under immediate family status.
