  1. Thanks! But her income is $0. So when she fills out the 864 she just puts $0 in all the income spots? Or because we file jointly can she use my income per the joint tax returns?
  2. Sorry for all these questions...about everything. I'm needing to fill out the I-864 for the visa process for my wife's daughter. My wife is the petitioner (she sent in the I-130 for her daughter), I'm going to be the sponsor. Do I just fill out the regular I-864 or ? It gives these options.... You can use the I-864EZ if all three of the following are true: You filed a Form I-130 petition, for your relative (I didn't file the 130. My wife did.)There is only one applicant on the Form I-130 petition, and (There is only one applicant on the 130, her daughter)All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive (All the qualifying income does come from my salary and shows on my tax returns I'll be sending in.)Then it gives this.... If none of the above apply (but some of them do apply) and you can use the regular I-864 So my main question would be is my wife the sponsor and I am a supporting sponsor? Or am I the sponsor as it's 'my' income it will be based off of. And what form do we use????? Sorry. Maybe I have "form overload" and they all scare me!!! Or at least making a mistake on them does.   3. I recommend the use of 'sneakernet' technology Sure, if you've got a jump drive that's working and available. They have a nasty habit of disappearing when you need them. Another alternative is to simply email it to yourself and and keep it in a do not delete status. That way it's available from any computer where you have access to email. Right click on any of those documents and there's no SAVE option. But thanks!

We put the families address in China, as that's where she's living now and that's what her permanent address is, in China. But they must just be quessing she's wanting the IR-2? Because we never told them we wanted that. Nor is my wife a citizen of the USA. As I understand the IR-2, it's for the children of a US citizen. My wife is not a US citizen. Thanks for the info. I'll give NVC a call and see if I can get this straightened out.

I can't see how they would think she's trying to get an IR-2 visa? Her mother is the one that is the applicant and only a GC holder. Her daughter was in London studying which is where she was when we went through the whole K2 fiasco with the attorney screwing that all up. So I had only guessed that they sent it to her there even though we put an address in China for her residence, as that's what it is now. She's living in China. So how do we go about getting this changed to GUZ??
  9. MORE: http://travel.state.gov/visa/visa_5163.html In your case you will be submitting the DS-260 on line to NVC where they are processing the case and taking Visa and I-864 fees. So how long before we would get the GUZ case number? Or is that the one that NVC sent us that starts with an LND*******. Thanks!!

So her Priority Date has already become current, we just got the letter from NVC that they sent to London instead of Chengdu (which was sent about November 6, 2013 and sat in London becase she wasn't there and the people in the home she was living in just sat on it and didn't mention she got the letter). It took USCIS almost 18 months to process the 130. We just got the DS-261 taken care of. I need to now send in the 864. Are we behind? Sorry for more questions. I just need to know if we should be calling someone up with concerns that this took so long (way longer than most could believe) and try to get it pushed through because it took them so long? If that's even possible.
  11. Her Priority Date is December 6, 2011. I guess I really don't know how to 'read' the info on the State website. According to this, when approximately will her date become current? Sorry for all the questions. THANKS!!
  12. Was wondering. If I go online and fill out the DS-261 to become the 'agent' for my wife's daughter, and I go through the entire process and "SIGN AND SUBMIT", will it be OK that I do this? Or will it show it was done on a computer here in America and her daughter is in China. It says on the instructions as I was filling out the 261..... By clicking “Sign and Submit Form” you are electronically signing the form. You are required to electronically sign your form yourself, unless otherwise exempt by regulation, even if the form has been prepared by someone other than yourself. Your electronic signature certifies that you have read and understood the questions on this form and that your answers are true and correct to the best of your knowledge and belief. The submission of a form containing any false or misleading statements may result in the permanent refusal of a visa or the denial of entry into the United States. All declarations made in this form are unsworn declarations made under penalty of perjury (28 U.S.C. 1746). Just want to make sure. We don't want 'premanent refusal of a visa'. Also, since the case is at NVC now, do we have to fill out the DS-260? Thanks!!
  13. Just wondering how long we have with all the new things we need to take care of for my wife's daughter coming to the US. We got the letter from NVC. Paid the $88 for the 261 (waiting for it to say "Paid" so we can see the next step. THANKS!!
  14. We never received a 797 for my wife's 10 year GC. We did get the biometrics letter and already took care of that. The USCIS officer we talked with in MN when we did the InfoPass, said it may have got lost or something, but that the bio letter shows they received it and moved forward with processing the request. Do you think a call to USCIS is in order to see why we never got the 797? Thanks and MERRY CHRISTMAS!!
  15. "Also step daughter can send NVC a DS-261 to choose you as her agent." Isn't her mother her 'agent'? She's the petitioner. "Affidavit of Support fee invoice to the petitioner" Shouldn't we have received this already? Been over 60 days.
  16. I've looked everywhere to see what this is. We just got this from NVC that we had to pay something to keep the visa process for my wife's daughter (F2A) going. But I cannot find how much it is? Any help? She's a Chinese national coming to the USA but has lived in the UK for the past couple years for school. WHich brings up another thing. Why when we showed that her address was in China did they send a packet to London? We never put the London address on her app. Thanks!!
  17. I've learned that molehills very often become mountains when you're talking the government and immigration. Guess I'll call USCIS and ask them just to be sure and report back and let everyone know. Thanks for the responses!
  18. So basically your thoughts are that it's not going to create any issues. I just want to be sure that as she comes through customs that they don't just say, "Your A# on the passport stamp doesn't match your green card!" and deny her entrance.

Hi All, Wife and I went up to St. Paul for an InfoPass to get the I-551 stamp on her passport since the 10 year green card hasn't gone though and probably won't before we go over to China in Jan. 2014. Officer was a little surprised that we didn't have a receipt paper for the 751 we sent in, but only got the biometrics appointment letter. He just calmly said though, "Maybe it got lost in the mail." and went forward. Stamped the passport, but today, my wife sees that while her A# is A08...... the officer wrote A8..... leaving out the 0. How critical is this? I sort of thought that it might not be that critical but she's worrying. Any thoughts? Thanks and HAPPY THANKSGIVING!!!
  20. Hi, I need to make an InfoPass appointment to get my wife's passport stamped for when we go to China in January 2014. I'm doubting that the 10 year GC will be here by then so just want to make sure everything is OK for her going and coming back. I went in to make the appointment but there isn't a specific direction they lead you to make one for this specific request. Only thing they direct you to would be You need information or other services. So I go in there and it gives us only November 21 for an option for the appointment date. Should I go ahead and make it, and then when we go for the appointment will they ask us what we need and take care of it? Sorry if that sounds stupid, but I just don't want any mistakes. Thanks! Marc

  22. Thanks Randy! We went down to Milwaukee and took care of the biometrics. Went fine..I thought..until she walked out of the area for fingerprinting with a sad look on her face. When asked to sign her name for the new green card, after 50 years of having her name be "last name first then first name", she signed it that way but realized she had not done it the way we do it here in America (and she had on her 2 year green card and other things), first name then last name, mentioned it to the officer there, she said it was OK and that you can't change it. Hope this doesn't create issues. Question on the InfoPass deal. Can we go to the one up in St. Paul, MN or do we have to go to the one in Milwaukee where we had the biometrics? I should've tried scheduling one when we had the biometrics...I know. Thanks! Marc
  23. We only received the 797 for the biometrics, which we are leaving for in a couple hours. Is the 797 for the 751 we sent in coming after the biometrics? Or do we only get this one? A little worried right now with going to the biometrics with an expired green card and no receiot except for the biometrics. Should we be?
  24. So...we have not received a 797 for receipt of the 751, just the 797 for the biometrics. Is it one in the same? Or will it come at a difficernt time after the biometrics is processed? Wife's green card is now expired October 25th. Does the 797 for the biometrics work as the 1 year extension?
  25. Thanks Randy! Any idea on the rest of this stuff? Also, will we get a 797 saying they received our evidence for the 751? Or just a letter giving us the Biometrics date and the 1 year extension on her green card. Also, I was looking at the USPS receipt for the 751 we sent to the CA USCIS. Says it was delivered, I had signed the waiver for no signature to be required, but it says that someone signed for it and it was delivered to INS EXPRESS WS. I'm calling USPS of course to see what the deal is, or is this some service USCIS uses to deliver all their mail??
