I must be nieve then because it sure seems like there have been countless situations where an attorney has made a mistake and the outcome reversed because of it. This country is supposed to be based on good people trying to help other good people. Compassion. Doing what is right. Not just the law. Many laws were written a hundred years ago and they had no idea how things would change. So those laws may not apply in these times. Sorry. I'm babbling. But this type of thought i.e. "what's done is done" is why things DON'T change. Make waves. Question. Force people to do what's right. After all, it is OUR country and we ARE the bosses. I know. Dream on. As for Rosie's daughter ruining her life coming to America? You can say what you think, but such things as you suggest don't happen to all people. Look at all the ridiculously successful, happy people that have immigrated to America. And a huge percentage of the most successful are from Asia. And if we all thought like you suggest, America would never have been. All people would have just stayed in Europe and there would still be vast herds of buffalo roaming this land with the native people living their lives just as they had for thousands of years. Because if they left their home land and their culture, they would be doomed. I guess that was proven wrong. People do what they feel is best for themselves and their families for the most part. And help each other overcome situations like this as best we can and build our lives around what we believe in. This is what we are trying to do for Ashley. And I have contacted Marc Ellis.   2. Thanks for all the replies. But I guess I'm just an everlasting optimist that there is something other than just plain old procedure to resolve the injustice that we had concerning my wife's daughter's K2 and poor direction given by our former attorney. We did not make the mistake that caused this to happen. We just followed the directions of a licensed attorney that was supposed to be an expert in these matters. It seems to me that there would be some compassion somewhere in the American system that allows for situations like this to be resolved reasonably. Not just cut and dried because it's written in some book and 99% of all government workers just read what's in front of them if you ask them what can be done. This is why I asked here. Though maybe someone here had had similar things happened and gone beyond what the 'system' says it alows and as successful in resolving an issue such as this. Sorry. Just unwilling to give up and just send the 130 and wait for 8 years because we trusted our attorney. There has to be something that allows this to have a happy ending...soon...and not in 8 years. Guess I'll start sending letters to congressmen, senators, Obama. There has to be a way. Thanks for your help! Have a great Thanksgiving.
  3. 1) #14 on the I-130 asks this.... "Date and place of admissions for or to lawful permanent residence and class of admission." On Rosie's green card the date of residence (when she was approved) is October 26, 2011 and under the Category of CF1. She was admitted through CSC (papers processed) but our local office is St. Paul. I'm unclear what they are actually asking for here. 2)Rosie's daughter was admitted at one point with the K2. Does she have an A#? She has been to the US a few times before under school programs. It would seem like she would have an A# or is that just a K1 deal? 3) Rosie's name is Liang Ping as they say it in China. On her SS card and GC she has Ping Liang because we say our first name first etc. Is this 'another name' (Ping Liang)? Thanks for any help. I looked at the instructions for the I-130 but they don't do a number by number description of what they actually want.
  4. Hi Everyone, Hope all is going well for all of you. Our lives recently got a lot less stressful with the approval of Rosie's GC. Here's what I want to do now. Rosie's daughter is soon to be 21 (January 2012). We want to file the I-130 in the next week. But I'm just looking for answers on a few things and the amount of knowledge in this forum seems to far surpass what my attorney has in such things. As some of you might know, she had the K2 visa and our attorney suggested it would be OK for her to come to the US to visit and then go back to England and just await the 485 process there. Coming back then to do biometrics, etc. Of course sooooo wrong. But that is past and now we must do the best we can to try to help her come over here. I know they say there's an 8 year wait for a visa after she turns 21. I assume the Child Protection Law doesn't help if she ages out so quickly after the 130 is filed? How about the K3/K4 process? If Rosie got her citizenship would her daughter be allowed to come to the US more quickly? How long after the 10 year GC is issued can you go for naturalization? And after Rosie would become a citizen does things change for her daughter in how quickly she could get over here? I just want to do the very best thing we can do to try to help her daughter come over here and realize her dream of living here and studying here. Also, does it do us any good to file the 130 if we would be looking at Rosie becoming a citizen and then filing for her daughter? I know there's a lot of questions here, but we just want to do what's best. Hope you guys can help. we greatly appreciate any direction you can give us. Thanks so much and have a great day!!!   6. Rosie got her green card!!!!!!! YEHAAAAAAA!!!! Almost 4 months to the day it was transferred to CSC. Thanks to all of you that have been patient with me in asking all the questions. Hope all is well with all of you and God Bless You!!!! Marc and Rosie
  7. This is what an InfoPass officer told my attorney. It was suggested "An interview wasn't often necessary in these cases and the official flatly stated that interviews are always necessary." With the CSC transfer stats it seems like that's a bunch of baloney, as the vast majority never have an interview.
  8. We still haven't received the green card, but am trying to be positive. One of our friends from China told us that you can not be out of the country for over 120 days while under the 2 year green card. I read on the USCIS site that you can stay out for up to and over a year but it might be tough to get back in. Any solid times a person can be back in China before the US starts to cause problems about coming back? If there for 3-5 months is it a problem? Thanks!!
  9. Hey Everyone, Hope all is going well with all of you. We are still waiting on the AOS decision. Everyone sending to CSC is getting approved in a couple months usually. Most in less. We're at 75 days now since it was transferred to CSC and we're just wondering what the heck is going on and why is it taking so long?! (as compared to almost everyone else) They said it was sent there to expedite processing. I've called USCIS and the only response I get is one read off a sheet like a robot. So they have been no help at all. They do keep coming up with the dates they're working on though and they say it's for a family based 485 (March 27th was the one they quoted me). But based on all the info on the Poll for CSC transfer everyone is getting them processed and the dates they are giving don't seem to apply. ANYWAY...does the InfoPass deal allow for a person to find out exactly where their application is in the process? Or are we just worrying about this too much and just must be patient. That's difficult though with people getting transferred to CSC AFTER we were and already have their approval. Any help would be appreciated. Thanks and have a nice day. Marc
  10. My wife's daughter had emergency surgery today and Rosie wants to go over to take care of her. Green card seems to be taking forever. Now at 77 days after the bio when the average for a decision is about 73 days. Most it seems only taking about a month. Anyway what are the pitfalls of the 131? As I understand it she would need to get the Advanced Parole. It seems to suggest that she could leave before the 131 is granted. But what if it isn't granted. I imagine then that we'd be in a big mess. Anyone have any experience with this? Any thoughts/help would be appreciated. Thanks!
  11. Still waiting. Is there a way to know what office it was sent to? Looking at the stats and there's a number of different ones in CA and all with different processing times. Right now we are 62 days from the Biometrics. Average is 73 days before decision. But crunch the stats down to the last 90 days and the office at Chula Vista is at 141 days average for processing!! Sad. Hope they didn't send our stuff there.
  12. Thanks soooo much Dan! So as I look at this most people are being approved in 1 to 1.5 months after their case is transfered. We are right at 43 days now so still within those time frames. But the people at USCIS must not be giving the right info as they say they're processing papers (family based)sent in from Feb 14th now. And in 28 days they indicated by the dates they gave me that they processed 37 days worth of papers. I guess I just shouldn't worry and wait, but it's sort of important that Rosie gets to Chengdu as soon as possible. We're just trying to make some plans. Thanks again!!!
  13. We had our 485 sent to California. Just wondered if people could post their experience for how long it took in their case if CA took care of it. Right now it seems they are waaaaaay behind in their projected processing times with them supposedly processing family based AOS for Feb 14. So for us if they continue on this course it will be a 6 month wait, not the 4 they project nor way less like so many people say was their experience. Just trying to make some plans (I know that's tough with the US government) but Rosie needs to be in Chengdu as soon as possible. Thanks!!!
  14. Hey Everyone, Hope all is going well with all of you. Quickly. My wife's daughter has been in and out of the hospital in Chengdu for the past week. Rosie wants to go back to be with her. As I understand it the I-131 is the only way for her to go back under Advanced Parole. And suggests that the fee is waived because she has a I-485 in process.(our attorney says it would cost "a couple hundred bucks") How long does it take to get approval for the I-131? I read that she can leave before the approval? But if not approved I'm assuming all sorts of bad things would happen. How long can she stay over there? Any other info would be appreciated.   15. When I talked with USCIS the woman quoted a date of the 485's that they were currently working on. Is there someplace we can see those same dates? Thanks!

  17. Sorry for all the questions. Yesterday I called USCIS with a few questions. The girl told me that the California center was processing 485's of the date Jan. 9th, 2011. For one thing, this suggests way longer than the 4 months they are projecting. Is there someplace I can look to see what dates they're processing? We were told that our application was sent to California to speed things up in processing. But if they're processing only Jan 9th now, to me that suggests it's taking them almost 7 months???? Hope not. Thanks!!
  18. Yeah the processing times for the 765 says 3 months and ours was done in 14 days. So we're hoping the '4 months' is not really that long and quickly her green card is approved.
  19. Rosie was approved for her 765 which is great, but we're just wondering how long it might be for the 485 to be approved? And if the 765 was approved does this in any way indicate what the outcome for the 485 will be? It sort of seems they would not approve a 765 if they were not going to approve the 485. Make sense? They said at the California office they are now processing applications for Jan 9, 2011. This to me suggests 7 months for them to approve a 485?? They say 4 months on the USCIS site. What are your thoughts? Thanks!!

  22. Hey Everyone, I know some of you have followed the progression of our journey with bringing Rosie over here. She's here. We are married very happily. Had a few problems with our attorney misrepresenting what we were supposed to do and our papers were returned, we fixed the problem and sent them back. Then they requested more evidence which ended up being a different version of her birth certificate. Interestingly, GZ gave her the version we sent in and they requested a different one. Then a few days ago we went for the biometrics. Now we wait. But our biggest concern is Rosie's daughter. Because our attorney had no idea (we come to find out) how a K1/K2 visa/aos/etc works, he suggested to us that she could come to the US for a visit at New Years but go back to England where she's going to school, and it would not have any adverse effects on her getting her green card. As we know....now....this is not even close to being true. So now we are looking to see if there is any recourse for us to get her over her fairly quickly instead of the 4-8 year wait some people suggest. Transfer to school here in the US? Plead our ignorance (because of our attorneys screw up) to the USCIS and see if they could make an exception? I'm looking to this vast collection of experience and knowledge to try to go in the right direction. Let me know your thoughts. We're willing to try anything. Thanks and God Bless! Marc and Rosie
  23. When we get the wife's green card we will immediately send in the I-130 for her daughter. My question is this. Since my wife isn't working, will there be a request for proof of financial support from me? Or isn't this a requirement.Is there anything I need to do to make this happen? I can't file the 130 for her daughter because she's over 18.
  24. I'm so tired of all of this. Now they're asking for additional evidence for the I-485, although I don't know what it is. Just saw it online when I was checked on the status. I'm supposed to get notified via email asap but haven't got that either. Very frustrating. I put all my trust in this attorney, and all he's done was screw things up. Says the case has been suspended until the information is received.
  25. Yes but it says under the F1 designations..... Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers: What else can it mean but someone that has their 'green card' or is a 'permanent resident'? And says that this group uses any "unused first preference numbers".
