  2. My wife (a naturalized US citizen) just got her visa to visit China in May. They gave her a ten year visa. I was a little surprised because she only has 2 years left on her passport before it expires. I assume when the time comes she need only present her expired passport along with her new one.

  5. You could still file the I130 in HK you just can't file for DCF. It would have to be sent stateside. Moving in the midst of filing could cause problems. You may be able to file DCF in Guangzhou while living in HK. She would interview in GZ regardless if you file in Beijing.

When I first got involved in the immigration process I was gung ho to fight for change. 13 years later not much has changed nor do I see any significant change on the horizon. You might as well knuckle down and do what it takes to get your sweet heart here.

  8. I've been watching this issue for 13 years. I doubt any significant change will ever be made. The sad truth is the average Joe Blow on the street is anti immigration. Politicians know this and are afraid to approve any immigration reform lest they lose their cushy job screwing the American people. It is what it is. You might as well just knuckle down and do what it takes to get your sweet heart here.
  9. Welcome to CFL. The best place on the web for visa information as it pertains to China. Hong Kong is still China so I doubt there will be any problems. You didn't mention how soon you want to move to the US. Having a permit to live and work in China entitles you to file a DCF. The fastest of all visas. 4-6 months usually. You might want to wait until you're settled in HK before filing. Unless things have changed since I last heard your wife would have her interview in HK. If you file in the mainland her interview would be in Guangzhou. Check out the DCF forum. There's lots of good info there.
  10. Oklahoma? I hate that part of Texas. I thought you were moving to Idaho. There is no law that you must carry an ID card but legal permanent residents are required to carry their green card. Honestly my wife has never been asked for it except at the border going in and out of Canada and at the POE returning from China. Unless you are living in a border state I wouldn't worry about keeping your green card in a safe place.
  11. Too many Americans who go abroad forget that the bill of rights does not go with them. They shouldn't expect preferential treatment just because they are US citizens.
  12. The Classifieds forum was created for members to offer items or services to other members. For instance if you had a Pimsleur language CD set you no longer wanted you could sell it there. Since no one uses it I have no objection to deleting it.
  13. It's all a matter of intent. If she came here with only the intention of visiting, met someone, fell in love and married him then that is perfectly legal. Of course they would still have to convince the interviewer. If she goes back to China gets the child and comes back on a tourist visa with the intention of getting married and staying that is visa fraud. She could be deported and banned from coming back. Either of the above options has risk. The only safe road is to marry or file for a fiancee visa and return to China to wait out the visa process. Generally 9 months to a year.
  14. As I recall one member's wife was stuck in China because the airline didn't recognise the extension letter as a replacement for her expired green card.
  15. It's been a couple of years since our last fund drive. I just paid our annual IPB fee of $25.00, out monthly Gator fee is $8.95. The CFL kitty is getting low.   16. Clarification. Unless something has changed that I haven't heard about you will still need a civil surgeon to sign off on the vaccinations. A new exam won't be needed but it can be difficult to convince a civil surgeon. Here is a link to a civil surgeon locator. https://egov.uscis.gov/crisgwi/go?action=offices.type&OfficeLocator.office_type=CIV I recommend making a list in an outward spiral from where you live and start calling until you find one that will sign off on the vaccinations for a reasonable fee.
  17. It varies from person to person but about 4 feet. Closer and people get uncomfortable. It also depends on the relationship. A loved one maybe as close as 1 1/2 feet, a complete stranger in public as much as 12 feet.
  18. I would like to add that if you file DCF now you are very likely to get her visa before July. As soon as the baby is born you will need to get an American passport for the child. If China won't issue an exit visa you'll need a Chinese passport for the child for the consulate to issue a proforma visa.
  19. I didn't catch who your lawyer is. I'm not usually a fan of lawyers but in your case I would recommend one. Marc Ellis of Marc Ellis law is an authority on NOIR cases. He lives in Vietnam but does work in China and knows the consulate well. Last track I had he and his assistant Eunice who lives in Guangzhou have never lost a case.
  20. We've all been there Warren. My own case took over a year to get my wife here as well as overcoming a blue slip and taking an emergency trip to China to straighten it out. I was bitter against GZ for years because of the hoops we had to jump through. Now we're an old married couple going on 11 years. You will most likely get your sweet heart's visa and one day it will be ancient history. Meanwhile we're here to guide you along and lend an understanding ear. Pull up a chair, grab a bag of Cheetos and endure the ride. CFL makes it a little easier.
  21. Truth is I don't see Americans jumping up and down saying "pick me! pick me!" to work in the fields. We do need a guest worker program. Those guest workers also need protection to keep them from being abused. Something they definitely aren't getting now.
  22. Chances of success are fair. However it is not without risk and the consequences of failure are daunting. She could be deported and banned from re-entering the US permanently. Not worth the risk IMO. The new immigration policy is focused mainly on undocumented immigrants who came here as children. It doesn't give amnesty to every illegal in the country. Yes the immigration system is broken. Neither political party is seriously interested in fixing it. Big business likes cheap labor. I have said for years the solution to illegal immigration is simple. Stop focusing on the immigrants and make the penalty for hiring them so severe it is no longer worth the risk. If there are no jobs they won't come. If they can't find a job they'll go home.

  24. I wonder what would happen if the US told Xi Jinpeng not to get too chummy with Kim Jong Un or Hassan Rouhani. The Dalai Lama has no power, leads no revolution and is no threat to China. He is likely to be the last Dalai Lama. He seems to be a very nice and wise man. Seems to me like China should look for more important matters such as to quit being the neighborhood bully in the south China sea.
