  2. I honestly don't know but I do want to say hello and welcome back. Seems like ages ago we had the Columbia Gorge get together. Closest thing we've had to a national get together. Bing still tolerates me after all these years. Give Ning Ning our best. Carl
  3. You can't download them online now. You can still order them online or by phone. For some reason the online order won't work for me. When I ordered them on the phone they never came. Yesterday I downloaded the transcript form, filled it out and faxed it in.
  4. I haven't heard about this so I don't know. We just got our welcome letter from NVC a few weeks ago so after 7 years were finally getting close. They're working on Jan 08 right now so we have about 10 months to go I assume.

  6. It's all a matter of intent. If your sweet heart comes here on a tourist visa with the intention of returning to China and after being here a while you decide you can't bear to be apart, marry and file for adjustment of status, that is perfectly legal. But, and this a big but. If the interviewing officer doesn't believe you and decides she used the tourist visa with the intent of marrying once here that is visa fraud which could result in deportation and a permanent ban on re-entering the US. As Randy mentioned the chances of you succeeding are fairly high but is it worth the risk? Not IMO. As far as marrying here, as Randy said you can marry anyone anywhere anytime. If you marry here while she is visiting and she returns to China without overstaying her visa I seriously doubt it would affect the chances of her getting a spousal visa. Whether or not it would affect her being able to return on the tourist visa, it is a possibility. Her returning to China without overstaying would bode well but as Dan said trying to return too soon could result in being sent back or getting a short stay. Good luck Carl
  7. Yup, that's the place. It says "not invoiced" Another question, on the I-864ez it asks for the mailing address. Since we plan to do all the filing electronically is there any reason we can't use our address instead of his?
  8. I've gone through choosing an agent and paying the affidavit of support fee. I am still gathering documents and filling out forms but I can't proceed to the next step until I pay the immigrant visa fee. Every time I check the status it says "not invoiced"
  9. She makes enough to qualify on her own but only by a few thousand. I thought it prudent to do the I-864a. Now I'm not so sure.
  10. I have PDF copies of the last 3 years taxes, I ordered IRS transcripts for the last 3 years but so far I have only found the last two years W-2 forms. Technically only the most recent year is required but I have always subscribed to the kitchen sink approach. The select an agent form has been processed and I payed the affidavit of support fee. Once it's processed they will invoice us for the visa application fee. I'm in the process of gathering up all the documents required and filling out the forms. I have a few questions about the I-864 EZ and the I-864a. The federal poverty guidelines for 2015 with a family of 3 is $20090.00. At 125% that's $25112.00. My wife qualifies for that on her own income but only by a few thousand dollars. I think it prudent to submit the I-864a as well. Part 5 lines 6a, 6b and 6c ask for adjusted gross income. This is confusing me since we filed jointly. Since I have no adjusted gross income for her alone should I just put line 22 adjusted gross income for both of us from our 1040? On the I-864a line 2 It asks for my individual income. is this line 1 from my individual w-2? Thanks in advance.
  11. It appears that my stepson won't have to move in the immediate future after all. There is a new development in his petition. We received a NVC welcome letter (PAOSF) Friday. The case is now at NVC and has been assigned a GUZ number. They sent a list of steps needed along with a checklist of Documents. Step 1. Chose an agent. I filled out a DS 261 on line. This will take up to 15 days to process before we can do the next step. Step 2. Pay fees. We can't do this until NVC processes the DS 261. The only fee invoiced is $120.00 for an affidavit of support. Step 3. Submit visa application form. I'm not sure what this is yet. Step 4. Collect financial documents. There is a check list of financial and supporting documents but I'm not positive what's needed and what's not. Step 5. Collect supporting documents. Step 6 Submit documents to the NVC. The checklist is somewhat confusing for me as I'm not sure what's redundant or applicable. there are 3 check marks, Enclosed, Unavailable and Not Applicable. 1. Document cover sheet. Self explanatory 2. Financial documents: Affidavit of support. Self expanatory. IRS tax transcript. I already have PDF files of our tax returns for the last 5 years. Is this still needed? Federal Income Tax Returns. Form W2. Is this redundant and not needed in lieu of Federal tax returns? Evidence of income Do our tax returns cover this or is a letter from employer needed as well? Proof of relationship I don't think this is needed since we filed a copy of his birth certificate with the I-130 Proof of US status I presume this is Not Applicable since he's in China. Social Security Earnings Statement Not applicable since neither of us are drawing Social Security. Proof Of Assets. I presume this is only needed if we don't have enough income to qualify. 3. Supporting Documents Adoption Documentation Not applicable. Birth Certificates We submitted this with the I-130, do we need to submit another? Court and prison records. I'm assuming this is not applicable Marriage certificate. He's never been married is a single certificate needed? Marriage termination documents Not applicable Military records. Not applicable Petitioner documents Doesn't say what's needed. Photocopy of valid passport. Self explanatory Photographs. Not applicable? Police certificate When to get this? I suspect it may be more than 6 months before interview. Translations Self explanatory Photo copies Not sure what they want here. 4. Other documents What other documents? Thanks in advance guys. We've been waiting almost 7 years for this. I have no experience with the new electronic filing methods or what to expect from here on out.
  12. My wife became a US citizen in 2008 she filed an I-130 for her son in Oct 2008. US citizen filing for unmarried son or daughter over 21. They are currently processing cases for F-1 Nov 2007. Sons or daughters of LPR over 21 are F-2B which is 23% of F-2A. 2nd preference.is showing as Nov 2008. This puzzles me since first priority should be faster than 2nd priority. General consensus has always been file as an LPR and when you can become a US citizen and change the priority. Now I'm not so sure. Dan can you explain this?
  13. Tourist visas for Chinese citizens are much easier to get now than before. Concentrate on why she will return to China, emphasize that you are both living and working in China and you're not ready to move back to the states. Send a copy of whatever documentation you have for you working and living in China, what your job is, length of contract etc. The other option would be to marry and file DCF about 4-6 months. This can be difficult to maintain for a lengthy period but you could always abandon the green card and file again later. This would however be much more expensive than a tourist visa. I would try the tourist visa first.

  15. WAC I think, I checked visa bulletin They're working on Nov 2007 we filed Oct 2008. It was approved Mar 2011 Case status is the same on the USCIS website.
  16. We filed an I-130 for my stepson 7 years ago. A visa should be available in about 10 months. Recently he learned he will have to move because the government wants the building he lives in. I was looking at the online change of address at the USCIS website but it seems to be more for if I move not him. After some serious head scratching I decided to ask here.
  17. I submitted a copy. No one ever asked for the original. It's a matter of public record. The state you were divorced in can make you a copy.
  18. From what I've seen over the years is the CCP issue usually takes 3-4 months. There was a slow down on them a while back where they were taking longer.
  19. I think you got it. I don't think getting a lawyer would make a great deal of difference in the outcome but a consultation might help you understand the risk.
  20. It's very simple. It's all a matter of intent and how the visa officer views that intent. If your fiancee comes here with the intent to visit and falls in love it is perfectly legal. If she comes here on a tourist visa with the intention of getting married that's visa fraud which could result in deportation and a permanent ban from the US. What you or me thinks makes no difference. It's how the visa officer rules. This not a court of law. Your sweet heart has no legal rights on the matter. Visa officers have a great deal of power at their discretion. Put yourself in the visa officer's place then ask yourself if it's worth the risk.
  21. Welcome to CFL. The best place on the internet for information on getting a visa to the US as it pertains to China. The decision of K-1 or I-130 is a personal one. I frown on recommending one over the other. An evolution of relationship letter is a good thing to file with either. I think the fact that you met in the US and had a relationship prior to her returning to China weighs heavily in your favor. If you are leaning towards marriage obviously the sooner you can get there the faster she can come here. If you can't possibly get to China for a few months you have the option of filing K-1 immediately. K-1 tends to be slightly faster but not significantly. I-130 is less expensive and no adjustment of status is necessary once she gets here. The savings of the I-130 could be negated by an extra trip to China to get married. Either visa expect a wait of 10 months to a year. The fastest visa of all is DCF. This would require you moving to China and getting married there. Getting a work permit to live there can be tricky but doable. It can also be complicated by income requirements that may make a co-sponsor necessary. DCF generally takes 4-6 months. As others have pointed out one advantage of K-1 is if you're denied you have the option of going to China to get married and starting over. There are no do-overs for an I-130. You have to fight it out to the bitter end and it can take years. I seriously doubt this would happen to you. As I said the fact that you had a relationship in the US before she returned to China weighs heavily in your favor. Unless there are some extenuating circumstances such as overstaying her visa or getting arrested of course. Good luck on your journey. We're here to help you with the process and the wait. Carl
