  1. Well, I got the RFE that I was half expecting, instead of a NOA2. I'm trying to see this as a blessing in disguise... The problem is, the USCIS won't tell you online what the RFE is for - you have to wait for the letter to show up in your mailbox. With that being the case, it spawns a few questions. I expect that they're easy to answer. I have prepared a goodly amount of relationship evidence with my wife. 2 trips there so far, with all the associate plane tickets, boarding passes, hotel receipts, and a lot of pictures. I've put those all in a lengthy doc that tells the story of the visits and time with the family. I've written a EOR letter, and have a year's worth of chat records, email records, money transfer records, etc. I'm hoping that I can send these in with the response for the RFE. But what if the RFE is for something completely unrelated to relationship evidence? Let's say, for sake of argument, that the RFE is due to a hiccup on Yifang's passport photos or some-such. Would I still be able to send in all the additional relationship evidence along with the requested item and have it be accepted? Secondly, once this evidence and/or requested info is sent, does anyone know if they look at it right away, or if we sit for another 5-6 months in the queue? My cheetohs are running low...might have to switch to shots of bourbon...LOL Thanks folks!
  2. Hello, I need some advice on the fiance visa. I have been married twice. First time was back in 1980. The visa application asks for the final divorce papers from both of my marriages. I have my divorce papers from my last marriage but being I was divorced back in 1981 I do not have those divorce papers anymore. The lawyer that I used has long since passed so I can't get a copy from him. But even if I could get a copy they say I need to show the original copy later in the process. If I do not include that I was married back in 1980 will they find out I was in fact married and kick back my application? I thought that having my recent divorce papers would be enough because I couldn't get married again without proof of my first divorce. But on the application it asks for both papers. I can not believe I am the first person to have this problem. Has anyone else encountered this problem? If I were to go to China to get married and bring her here on the spousal visa could I get around this problem or would there be a similar issue? Thanks to all in advance.
  3. I started the K-1 process in September. Since then I have learned that being recently divorced is a red flag. I met my fiancee online in June of this year while being separated, and my divorce was final in mid-August. My ex-wife (also an American) had a job that required travel (it's how I became interested in China) and she spent most of her time in the U.K. over the last year making it difficult to fit in the court dates to finalize everything. Also I have no children from the marriage. So my question is, is this a reason for concern? Or is it more significant when the beneficiary is recently divorced? Also there is an age gap with my fiancee, but on the positive side, she speaks excellent English and should be able to explain the situation if needed. So my concern is the divorce and also the speed of the relationship with my new found love. Even though we have only known each other since June we have either texted, or video chatted on Skype twice a day for hours since meeting. We have gotten to know each other so well that we are now watching videos, reading stories to each other, and asking trivia questions just to keep the conversation going. I have hundreds of pages of chat logs if needed. I think we have ask and answered just about every personal and relationship question possible. Also, we spent two weeks together in late August, and we will meet again in late November for another two weeks. This is my first attempt at sponsoring anyone for a visa. Any input is greatly appreciated.
  4. I was separated from my previous wife for more than two years while I lived in China. I met someone in GZ before I recently returned to the US to complete my divorce. After that I returned to China to be with her. Now, regarding the requirement of having met face to face within two-years of filing, is it okay to say we met before my divorce was complete, or should I simply state we met after I returned to China?
  5. I have a friend from China who married an American and arrived in the United States a year ago. She is a good girl, but married a guy who is emotionally abusive and a real jerk. When she was unable to live up to his unrealistic expectations, he decided to divorce her. She received the divorce papers yesterday, and broke down in tears. He is trying to bully her into returning to China by threatening to withold any support unless she leaves the country. Furthermore, he told her that she will never get her ten year green card because they are getting divorced. Is this true? If he divorces her, will that prevent her from getting her ten year green card? Will she be forced to return to China?
  6. Ok I read in 3rdtimes post about his engagement to his wife only being 18 months from the end of his divorce. My Divorce was final 3 months before I met Hui. We had been seperated over 1 year by the time Hui and I met in person. Will this be a red flag? I dont see why it should. The Ex and I were seperated for over a year..... Do they expect me to crawl in to a hole and hide from women for 5 years or something...... Robert
  7. Hi everyone, As the petitioner, do I need to send my fiancee a copy of my divorce decree along with the other required documents for P3? Or is the checklist asking for HER divorce decree only? Thanks, friends. Tom
  8. I am a US citizen resident in the USA. In September, I applied to USCIS for a Fiancee Visa (form I129F). My fiancee is a Chinese citizen living in Beijing. We have submitted all the documents, but they have now notified me that the document we presented as proof of her divorce from her former husband is not acceptable. This was the document issued to her at the time she registered her divorce. The letter states that "A Divorce Nisi is not considered to be evidence of a final divorce." (I don't know what a "Divorce Nisi" is.) The letter says that we must submit a final divorce decree and that this must be processed through the Chinese notary office and issued in the form of a "notarial certificate." The letter further states that the we must provide a translation into English and that "the translator must certify that the translation is accurate and that he or she is competent to translate." Does anyone have experience with this who can explain exactly what document she needs, and the form the translator’s certification of competency must take? Many thanks.

  10. Hello Everyone, My Fiancee does not have a Divorce Certificate or "lihunzheng." All that she has is a four page statement from the court that states how her divorce came about, or reasons for the the divorce. She does not have a one page "certificate" like we have in the US. He "shenfenzheng" lists her as "divorced." Her "paichusuo" will not issue her a "lihunzheng" because at the time, the divorce was not mutual. That is his excuse anyways (since then her ex-husband has remarried). He claims that the booklet only gets issued for mutual divorces. She has been able to get a statement saying that she is not married, and free to marry, but there is no certificate of divorce. Would it be enough to use that statement? It does not list who she was married to, or when the marriage was disolved. It only lists that up until the current time she is not married. She is from a small village and you now the rest of the story with the power and control structure that goes on there over simple things we take for granted here at home. Has anybody had an experience like this with no divorce booklet? Any suggestions?
  11. Would anyone here have any referrals to a divorce lawyer near Guandzhou city; my soon to be ex lives south of there in Zhanjiang city but I cannot seem to find any resources in the USA to help get the process started. Any information would be greatly appreciated. Thank you.
  12. Even though Li Hong had been separated from her husband for three years since we met, she has just recently gotten her divorce papers. No easy task sense they both live in Beijing but had to go to Changchun where they were married. It has been a couple of months and I plan on submitting my I-129F in the next few weeks. Is there any reason for concern or delay my I-129F because of this timing?? Thanks!
  13. Quick question - My sister in law wants a divorce. She is married to an American but she is a Chinese citizen. She is in China, he is in the USA. They got married in China and then she moved to the states with him. Turns out he has many psychological problems. She is in China now, and he is pushing to do the divorce papers here. Would she be better off doing it in China or going thru the US courts?
  14. Hi everyone, I divorced my American wife after 15 years of marriage. I met my Lao Po while I was seperated, and we married approximately 1 month after I got my final divorce. I recently sent the I130 petition to the CSC. Could this be a problem? Is there a mandatory wait time between a divorce and a new marriage? Your answers would be appriciated.
  15. Seeing How I have a couple of them to get together if needed, what are the VO's asking for when they want an"Actual" divorce decree? I have the certified ones that I ordered over the phone from the state. They are an offical form with the cerified stamp and all the names and dates, no details of what happened through the divorce. This is what I used for the I-129f and the I-130. Are the "Actual" decree's the thick stack of papers with all of the details? What is meant by "Notorial" divorce dercree? Is that another name for the Certified ones? If the world was flat, would they put a fence around the edge so us confused people would not fall off? Or just sell tickets?

I have a friend that married a lady in china and it has been a year sense than ,but she is not here yet, She has been going out with a man from her work and bobby does not want to stay married,if she has not come to america,is there a need for a divorce ,he says not ,but I think there is Ana if so where do you divorce from here or there???
