  1. Hi Missingyou, My own opinion about the time line to refile again. I have seen people on this web site who have gotten a denial and refiled so fast that they have not addressed the issues of the first denial. People can do as they please ,,and file immediately but if you do than the VO is going to see that you were "fast on the draw". "In my opinion only"..I think a relationship should be given minimum 6 months to develop and also "In my opinion only",,if you are denied than there should be about 6 months before another petition is filed again...if nothing else, to address the issues of the first denial. "Just my opinion". And people can and are going to do what they want.. Tom and Ling I see. I just thought that it was like mandatory, since I fwd'd what you said to my friend who just got a K-3 denial in Japan. My hubby got pink the first time, so we didn't really look much into what we should do if we got denied. By the way, my sister-in-law's interview will be sometimes next month or March, so I am going to advise her to come to this site and ask you questions. I hope it is okay with you!
  2. Why should there be a 6months waiting period for K-3 or CR-1 before re-filing or continue on with CR-1?

  4. When I called DOS everyday back then, I was told different things all the times. First from waiting for the physical file, to admin processing to waiting for interivew date and back to the first comment again. Just hang in there, and keep calling them. I think if the operator you get is nice enough to look through all the screens, you can get some better accurate answer. For my last call to them, I asked that lady to look further down, because I was sure that GUZ got my physical file, so they s/not be telling me that it is still pending for whatever...
  5. I think after you send in your docs and if GUZ approves your visa, they will send you a letter asking your fiance/wife to personally go into the GUZ Bldg again w/ passport. I don't believe you can just send your passport to them. After that, you will probably follow the same procedure as if you got "PINK" at your original interivew. Fill out the slip for the Chinese Postal Service then wait a few days in GZ to pick it up in person. Good luck and hopefully the wait will be short after GUZ gets your docs.
  6. agree with jin979. I am one of those who makes only $30,000.00ish/yr, so when my hus told the VO that I flew back to China 4 times during 2008, VO just questioned where and how I got the $$$??? Good thing I had proof from my frequent flyer...
  7. I think you should go to ACH in Feb. When you are there, the VO probably will just read you the white slip again w/out wanting to look into your case, but don't let them push you away so soon. Stay at the window until you get an answer. I was at ACH twice myself and seen many who denied were not given chance to explain anything. Keep insisting, though it may not do overcome your denial this time, VO always leave note in their system saying who, where and what the USC went to ACH for. Hopefully, this will at least show GUZ that you and your wife are serious in your relationship and you care for her.

  9. In the past, I've read other posts who are in the similiar situation as you, just simply provide what they want and send it in, usually good news comes in a month or so. best wishes!
  10. Um... just my opinions... Did your lady say she doesn't know when they ask her those dumb questions? I meant, even if you love jazz and she said R&B, who's going to know? Were there anything else go wrong at the interview? When the VO were looking through our photo albums, he asked my hus if I like Chinese dumplings and what kind (I was eating some in the photo)? So, my hus just said yes and love the kind of w/ pork & veggie, even though I don't like dumplings at all. I don't think that questions was meant, maybe just trying to say something so the conversation between them didn't die while he looks through our photos. No matter what you do, do not go one of those Chinese agencies in that same bldgs that ask you to pay so much $$ and claim that they would help you write a letter to request a hearing on your case. The agencies would draft the letter and tell you to write it as you are the one requesting it. It is no use. Since it is almost Wed in China, so the next ACH will be next Monday...
  11. From what I understand, she needs NOT to return to her home country. If her husband is a USC then he can just file AOS for her.

Sorry to ask more questions...becasue I am still confused. 1) To apply for 2 years green card = Adjust of status? 2) To apply for 10 years green card from 2 years green card = Remove condition? 3) The wait for a 2 years one is about 6 months according to other member's timeline? I'm a K3. Will be procedure same as K-1's? 4) When 2 years green card close to expire and apply for the 10 years ones, the wait is much longer then original AOS and sometimes be one year? 5) What if when my AOS (original application for 2 years gc) my marriage has not been 2 years and when USCIS approve my application, I met the 2 years, will they automatically give me the 10 years kind, or do will they just reject my application and have me file again? thanks....
  17. My husband came into US on K3. We have not yet file for EAD or GC. Since we are in the process of relocating, so we want to do it later. Just curious, if there will be an interview for my husband's green card? Also, I know we will need to in for biometric, but is it once for both application or total of two seperate trips? I read some posts here that some did have interview and others didn't. thanks!

  19. Not sure how many here is from WA. For DMV here, you need to show legal residency in WA and if you have no SSN, they will require you sign a piece of paper stating that you have legally came into US and not able to obtain SSN at the moment. My hus got his driver lic already. As for written test here, they check nothing. It is for the road test part that they begin all the questions and want to see paperwork.
  20. Welcome to CFL. I am a Chinese American woman. My husband had successfully came into US two months ago. When I first begin our immigration process, we thought we were the only couple who is a female bringing a male over from China. Anyways, CFL is a wonderful site. I am sure you will learn a lot from here.
