  1. First of all, I want to say thank you for this forum! I just came across it and it's invaluable. In fact, I wish I had known about it earlier. My wife is non-Chinese, and we live in China. We have two young children. I'm employed in China, my wife is not. We have two young children so she's busy with that. On the G235A form, employment record, for the period we've been in China, we put "none", as technically she's not employed. However, in addition to homeschooling our preschool son, this has evolved into a class of children of Chinese friends and neighbors who are the same age, who she teaches together. It's grown into an informal business of sorts that she wanted to turn into an actual registered business but could never get the legal paperwork sorted out to make that happen. Over the years, she's also privately taught classes to children of different friends off and on. She's never taught at a school or ESL center or anything like that (legally or otherwise), just privately with friends/friends-of-friends. So on the one hand, she's not employed, but on the other hand, she's self-employed, depending on how "employment" is defined. So under "employer" we put "none" on the G325A, but now I'm thinking that's a mistake and we should have put "self (teacher)". What got me thinking about this was the DS260 it asks for Occupation, which is more clear that in her case it's teacher (she worked as a teacher before coming to China and was going to work at a school here, but got pregnant almost right after we got here and had 2 kids since, so somewhat ironically never worked as a teacher at a school in China). So on DS260 I think we should put "teacher" and "homemaker" as her 2 occupations, with "self" as the explanation under teacher, and say she's done private classes. But then the DS260 and the G325A wouldn't match up, so that's when I realized we should probably have put "self" on the G325A instead of "none". (As an aside, in China, her teaching other children, even informally and privately, is technically illegal, or at least a legal grey area, much like doing any kind of freelance work in China, even if legally employed, is technically illegal or at least grey. At least that's my understanding. But I doubt if that's of any concern to the US CIS. My main concern is that our application is truthful -- I wouldn't want her application to get denied for "false information". And in the interview she wants to be truthful as well, of course. I mean sure, these are private lessons, there are no legal records of any employment by anyone, etc., and yeah, she could just say she's a mom that homeschools her children (all true) and leave it at that. But if they ask for more details we don't want her to lie. We just filed the I-130 (with the G-325A) last week, but I'm thinking we should correct it and submit a new one. My questions are: - how to correct the G325A? Do I bring an updated version to the CIS office? Do I submit the corrected version with the DS160? Bring it to the interview? - any advice on the correct answer to "employer" ("self" or "none") - am I overthinking this? Thanks in advance.

  4. When I checked how a lawful resident to file 1-130 form for his/her spouse, it said complete Form -0325A, Where can I find that form?
  5. Finally almost done preparing the I-130 petition! Yet I always seem to be coming up with questions about these tiny bits and pieces... (sorry) Quick background: My husband and I met and lived in South Korea for the majority of our relationship. We did, however, move a lot in 5 years and while we always considered Seoul "home", we also spent a significant amount of time visiting my family in the US and his here in China. I already know I need to include an attachment to fit all the addresses in, but should I include our parents' addresses to fill in some gaps in time? For example, we spent 4 months visiting the US last year (mostly traveling and for the holidays) before we came to China. My husband was on a travel visa so I don't want to make it look like he lived there. The same goes for me visiting China for a month a while back. Except for the 4 month visit (we came to China afterwards), we maintained our Korean residency status but didn't have an address there while we traveled. I was thinking of including our parents' addresses followed by a " (Family visit) " note in the address column...would that work or is it unnecessary? Thanks again! This site is so helpful. ^^
  6. hi everyone i have some questions about DCF and I-130 , hope you can give me some information . 1- in addition to the translation of civil documents like marriage certifacte , birth certificate , should we provide any certified copies of them sperately ? or just normal copies are sufficient ? would you please point out which documents need to have cetified copy ? 2- at form G-325A we need to fill out applicant's residence last 5 years , i was living in china in last couple years , but i have travelled to my country couple times (while i had my valid chinese visa and kept my lease in china) ,are all travles to my country considered as residence ? or it depends on how long i have stayed there ? 3- at form G-325A , what should beneficiary and petitioner mark for "this form is submmited in connection with an application for : 1- naturalization 2- statuse as permanent resident 3- other (specify)" in their seperate G-325A? 4- how many pictures are appropriate to be included in I-130 ? i have thousands of them 5- our house lease is in chinese , translation office wants a very unreasonable price for translation , can we translate it by ourselves or it has to have Official traslation stamp? thanks in advance for your time and help!

  8. Hello all, Jocelyn of Speaking of China introduced me to this forum, and after exploring for quite some time, I am still utterly confused about a DCF petition. Let me be specific about what I am confused about. My husband and I got married earlier this year, and we have only recently decided to go to the States. I've been living and working in Xi'an, Shaanxi for four years. I am aware that the following documents are needed (or somewhat optional) for a I-130 petition: - I-130 form - two G-325A forms (one is mine; the other is the husband's) - copies of my birth certificate or my passport's biodata page - copies of hubby's birth certificate or his passport's biodata page - copy of hubby's hukou and notarized English translation - copies of my residence permits (2010 to present) - four passport photos (husband's and mine) - affidavits of our marriage - photos or other documents to show we have a bona fide marriage Am I missing anything in my list? In addition, as far as the filing is concerned, I am confused as to which jurisdiction I fall under. For the eligibility for marriage notary, I went to Beijing. Therefore, I am uncertain whether I should file my petition in Beijing and let them pass it on to Guangzhou, or go directly to Guangzhou. Does anyone have contact information (as in phone numbers) for USCIS or the Beijing embassy? I've already attempted to contact them via email with virtually no luck. I still have a couple of other questions regarding the I-130 form. As for my address, do I put my physical US address, where I still receive mail, credit card statements and the like, or should I put my mailing address in China? As for the affidavits of marriage, do they have to come from US citizens, do they have to be notarized, and who are usually the best options for the affidavits? I ask this because my family, with the exception of my youngest sister, have met my husband. As for organizing all these documents, is there a preferred mode, as in one envelope or should some of the smaller, more likely to get lost items be separated? As for photos, do they need to have a printed date on them or is it acceptable for you to write names and dates in pen? Will they accept a scrapbook filled with photos and letters written to one another? What are the "other documents" that show a bona fide marriage and perhaps should be included in a petition? Is there anything else I may have overlooked about the process of DCF? I am fully aware that I am asking a lot of you all, so if you could even just direct me to a particular discussion within the forum that deals with one, or several of the questions I am asking, I will be content.   9. Hey all! We're working on our petition paperwork and I've come up with a few questions that I'm stumbling over. Research on CFL and VJ hasn't yielded anything, so here it goes: [i-130] I'm currently living with together with my wife in China (we've been living together for the last 2.5 years actually) and I'm not sure if I should put my Chinese or US address in section B of the I-130. [i-130] Section E of the I-130 calls for a phone number, but it's formatted in US style. Should I just leave it blank since I have no US phone number because I currently reside in China?[i-130 and G-325A] The only address that should be in Chinese should be where it specifically calls for it on the I-130 section C. #20, right? Thanks all. If there's some huge resource of filled forms for China DCF petitioners that I've missed I would sure love to know about them. My research has turned up jack. -Jake

  11. Hello, I am helping a good friend do his paper work to bring his new wife and her children to the US.. We got everything ready to send off to Chicago. I have one question. How much money should we have to send for the first round of paperwork. My math says $ 840, but for some reason my mind has $1120-1125 stuck in it. He is going the CR1/IR1 route. He is filing two I-130 (one for him and one for his wife) and four G-325A. ( one for himself, his wife, wife's older daughter, and one for his wife's younger daughter). Older daughter is turning 18 at the end of this month. So am I correct? $ 840 dollars? Just want to make sure I am correct. Thank You for your help. Danb
  12. Hello All, Long-time lurker, firstish time poster. We've gotten started on the paperwork. As I'm being very pedantic about this, I have quite a few form questions: For the I-130: Which address should we write on the form? Our (rented) apartment in China, our mailing address in China, or my mailing address in America? Re: B13: If you are a U.S. citizen, complete the following: What is the “Parents” section for? My citizenship was acquired via birth in the U.S. I’ve checked this box. Do I need to be concerned with any of the rest of the box? As a U.S. citizen, do I need to concern myself with B14, regarding lawful permanent resident alien? C17 asks to list children. This includes the children we have together, correct? C19 asks for relatives address abroad. Does this mean the Chinese address? As above, which address should be write? C21 asks for the address for where we’ve lived together, as well as the dates. We’re still at the same apartment, but I see no option for “present.” Do I just include today’s date for “To:”? There is not enough space provided on the electronic form for typing out addresses and phone numbers in full. What should we do?For the G-325A: On the G-325A form, how do I know my file number? The G-325A has a section which asks “This form is submitted in connection with an application for:” Do I check the “Status as Permanent Resident” or “Other” and then state the I-130? The bottom of the G-325A has a box “Applicant: Print your name and Alien Registration Number in the box outlined by heavy border below.” Is this for my wife? If this is something we fill out, how do we find out what her alien registration number is? For my wife’s G-325A, it asks for applicant’s residence for last five years in one box, and then immediately beneath this form asks for “last address outside the US of more than 1 years.” As my wife and I have been living together for the last seven+ years, do I restate the information in the box above, or do they want the address where she lived before we began living together in 2006? When writing my wife’s name in the boxes which call for Chinese characters, do I write the name as it would be written in Chinese (i.e. surname first)?   13. The G-325A form I just printed out yesterday, on the right upper corner it says, "Exp. 05/31/09". Do any of you guys have a link to a G-325A form which is not expired? Or is it ok for me to use this one I have? On this form, there's a "File Number" box, which should start with "A", Is it referring to alien registration number?

Hi Everybody - Does anyone have any info about the expiration date on the current g-325a form? http://www.uscis.gov/files/form/g-325a.pdf In the upper right-hand corner, a 05/31/09 expiration date is shown, yet that date has already passed. All of my data is gathered, organized and ready to send, but this date makes me reluctant to do so without waiting for the new version. Any advice would be greatly appreciated. - Will
  15. Hi again, I am in Shenzhen, China. Where do I get something notarized here? I keep asking my lady and she tells me she doesn't know. Also per previous topic from another member, Affidit of marriagebility, Do I need this included in the beginning process when I file the I-129F, G-325A forms? or the initial process? or Do I even need this at all?
