  1. Hello, I am in a similar situation. I have been living here for the past four years, working as a teacher with Universities. The salary isn't very high, somewhere around $10,000 per year. I've filed my taxes stating such. I have no one else to co-sponsor me. I have my Mother, but she is retired and has no income save her pension and retirement. I've had very good jobs when I was working in the States. Seeing this, it is making me very nervous. What should I do?
  2. I'm applying for the K-1 visa and currently living in China. Just got the NOA2 over a week ago. Looking at the I-134 it asks how much income I derive annually. Well, as I'm living in China, the money I make here I am able to deduct. That's nice when it comes to taxes but if what I'm supposed to report on the I-134 is my adjusted gross income it means I have none! :/ I realize that my current income/salary will mean nothing when I go back to the States to get married and reestablish residence there. Therefore I do have a cosponsor. But I was wondering if the VO will look negatively on an application where the petitioner has no income to report and is 100% dependent upon the joint sponsor. Should I then fill in the amount I actually make and bring in my contract and a letter from my employer to verify it (and perhaps an explanation written from me regarding the discrepancy between the tax return and the income recorded on the I-134)? Or does my current salary (since it's foreign earned and will not continue when I go back the US) mean absolutely nothing regardless of what I bring in and should therefore just write $0 and not bother with it? Any input is appreciated!
  3. I am a student and therefore did not make any income these past 3 years. I have my sister sponsoring me and have her tax transcripts for past 3 years. My question is, because I did not make any income do I have to submit tax returns to the VO? If so, where can I get them filed. I am in China now. Also, is it okay to file all zeros for income since I have a sponsor? I am under the assumption that as long as I have my sponsor's paperwork in line that I should be fine. Please advise.
  4. I'm about to start the process of getting US visas for my wife and daughter. I've been reading about the requirements for an IR1 visa, and I'm getting nervous about this "domicile" thing. Seems like I need to have a fairly permanent place of residence in the US. I don't have one, since my family and I have been living overseas for the last 4 years. We have a hefty pile of cash, and plan to buy a house when we get back to the US. It should be clear from our financial records that we can support ourselves for decades to come (which is the real point of the requirement, I assume). So, what to do ??? (1) Hope that cash will serve as a substitute for a domicile (risky) (2) Ask a friend to be the "sponsor" (embarrassing; possible ??) (3) Quickly buy some house I've never seen (stupid) (4) Get a K3 visa instead (no domicile requirement ??) Any suggestions ? thanks
  5. Dear All, I just discovered a problem on my I134 form. The expiration date is May 31st while my interview date is on 1st June. I went to the USCIS site to download the official version and it's the same expiration date. I searched everywhere online, same expiration date. I dont understand, how is it possible that there is no new version available as people are having interviews later than May! Or, should I understand it differently, as long as the signature of my fiancé is before 31st May, then the document is valid ????? I am getting so nervous all of a sudden as I dont have much time left ... If any one has a newer version, please kindly send it to me. Thank you in advance. Jiali
  6. What are a co-sponsor's obligations, and how long are they responsible for the person moving to the US?
  7. I just realized that my cosponsor I planned on asking was the same one that sponsored my uncle,wife, and kid on their visa. They all have their green cards and are working, but I'm pretty sure the cosponsor is still on the hook for them. Will this be a problem? He makes about 60k a year, which might be cutting it close if you're counting him, his wife and kid , and my uncle and his family. Then if you add in the two of us.... Maybe I should just ask another person... While I met the bare minimum on the guidelines starting this month, I was a student for the last two years, so I don't have any tax records. I will file for 2009, but my income for the last couple of months I was finding a job means it'll be minimal. I'm guessing this might be a red flag for the GUZ consulate, so I'm trying to figure out what I should do. I know I can use some assets, but those are kinda minimal? About $7k in savings/checking, coownership in a house and a car. Oh, and I'm filing for the K-1. Received NOA2 on March 3rd.
  8. I will be refiling the I-864 but I am still laid off. On page 3, should I state that I am "D. unemployed"? I was laid off in Nov but can still use the figures and tax return I used when I filed for the I-134. Just seams silly if they don't issue a greencard, she really wants to go to work to help me out in this tough time.
  9. So if I choose to play it safe and have a co-sponsor, is it form 864 that the co-sponsor has to fill out? Or is it both a I-134 w/ 864? Thanks in advance
  10. I make well over the federal poverty guidelines.... about $80,000 a year in salary, plus a potentially sizeable year-end bonus (no luck in 2009). I live in the Midwest, so this is a pretty respectable amount here. Do I need to list other assets on my 134 form, such as my home, etc? It's worth about 200k, and I owe about 125k on the mortgage. I also have retirement accounts, etc, although I'm only 32. I've heard people say that you shouldn't include other stuff if you make well over the poverty guidelines, to forget about the other stuff, but there's also people in RobertH's thread in results saying that anything under $100k could still be questionable!
  11. I grossed on 38,688 according to the summary on my w2, but it shows only 35177 in box 1. I don't get taxed on my 401k and cafe plan. Does the consulate recognize the actual gross? My employer will provide a letter of my current wage which will be higher for 2010, will that help. My assets are limited id probably estimate 10,000 to 15,000. I do have 30,000 in life insurance but it has no cash surrender, can that be listed on I134. I'm so worried They will reject me, I heard Vietnam does not allow Co sponsor of any type. I will get a second job if needed but want to return to Vietnam for her interview. Would my 2 children be considered partially dependent on me since since I recieve child support for them.
  12. I'm new here, just found the place a couple days ago. My fiancee has the interview in a few weeks. I think we've got everything ready, but I've been seeing stuff on here saying that it's necessary to turn in tax forms with the I-134 support form. It doesn't say this anywhere on the form, and the consulate didn't tell my fiancee we need that when she called -- so how are we supposed to know that? So what's up, is this really necessary? Has anyone been turned down because they didn't have tax info? For a little background info -- I feel very confident about proving bona fide relationship -- I lived in China for 7 months and have visited her several times in addition to that, have emails and phone records, pictures... In terms of support, I'm a graduate student so my dad is co-sponsoring. He makes plenty of money. We both filled out the form and gave bank statements and salary information.
  13. For a K1 visa. Does question 10 need to be filled in with SO's info from question 3 or would "none" apply to question 10? I am assuming the answer is "none" since it's pretty obvious this affidavit is executed on behalf SO name in question 3 and is submitted during the K1 interview. But then again, government forms are so obtuse it wouldn't surprise me if the answer is yes.
  14. Hi All - My fiance's interview is scheduled for the 3rd of December. In P.3 they ask that the petitioner fill out the I-134 for K1/K3 visa applicants. And, in her P.3, no mention of the I-864 is made at all. My question is, will the I-134, along with the necessary accompanying documentation (i.e. bank statement, tax, letter from employer), suffice?   15. Tax question... I have all of my W2s for the past three years, but I only have the 1040s for 2006 and 2007. I do not have 2008 because i am requesting a foriegn earned income tax exclusion(was in the Middle East). If I do need the 2008 return what would be the fastest way to obtain it?
  16. I've read that there are 2 main reasons for an AOS interview. Correct me if I'm wrong. 1) They doubt the relationship is real. 2) They doubt you can support your wife. Unfortunately I have been caught up in the current economic mess and lost a job of almost 8 years working for the state. We're pretty well covered on the relationship front. Plenty of documentation of our travels, common bank and checking accounts, credit cards, photos, and we've pretty much been together 24/7 since she arrived and we were married. What concern's me is my lack of employment and I am sure that will be their focus. I have submitted tax returns for 2006-2008 and have been pulling unemployment while looking for work. I have fairly substantial retirement savings and cash on hand to support us for awhile barring major emergencies or problems. I'm just not sure how to approach the AOS interview. I did ask family for a supplemental support form, but many were hesitant and didn't want to supply 3 years tax forms, income statements, and other information. Push comes to shove there are still other family and friends I could ask to help, but it is pretty embarrassing and depressing to have to ask for this sort of thing, especially considering we've done everything on our own. Just wondering what everyone thinks. If you folks feel I could get denied because of my employment status, perhaps I should swallow my pride and try again for a secondary sponsor before the interview. The crappy thing is some friends are in the same boat as I am - looking for work, so they can't help.

  18. hello, have a question, we are in the last stages and will have interview next month, I-134 was completed showing myself working full time, however i have been offered a retirement and have taken this. should i fill out a new form showing adjustment of income? Also the 3 pay check stubs will be changed, pention is only given 1 time a month. How do you think i should handle this with this process? Thanks
  19. If the US citizen is self employed and normally makes a good income in construction but the income is very low now due to the poor economy,how will the vo look at this? My income for '07 was not very good and '08 is very low. For me ,things could improve at any time. I am 55. I have savings,several retirement plans,soc.sec.(when elgible)and no debt. I have more "things" than many people and my home is nearly paid for,(over $300,000 equity). I have the things I need but I do conserve money and I can support my K1 and K2. I saw the posting from 12-05 saying he had a lot of equity in his house and wanted to know if this is considered in some way. You told him to check another site for this info. but the link does not work now. Thankyou
  20. I am confused about which box a co-sponser should check on line 11,intend or do not intend. I think it is do not intend,because a co-sponser does not plan to support someone unless it becomes necessary.

Not a big deal, I just want to make sure I am doing everything properly.

My mother-in-law will have her interview for a tourist visa soon and was wondering if the new I-134 form (10/30/08) doesn't require it to be notarized. http://www.uscis.gov.../i-134instr.pdf Execution of Affidavit: "...It is not necessary to sign form I-134 in front of a notary, nor have your signature notarized after you sign it" So my questions is, does GUZ still requires the I-134 to be notarized? Thanks.

My wife's interview could be scheduled within the next 60 to 90 days, but it's becoming apparent that I'm going to have trouble showing adequate income over the past 3 years (I was a mortgage broker, need I say more?). Can anyone give me some advice? I can probably come up with something via my tax returns (which I haven't filed for the past 5 years; I have an attorney working on piecing my financial life back together, but I don't have the money [thousands of $$$] to do that kind of work over the next couple of months). Does anyone know anything about sponsorship? How much money does the sponsor need to have? I'm assuming their liability would be as great as mine would be as far as guaranteeing the financial well-being of my spouse. Could I "take over" the responsibility of sponsorship after I finish my convoluted and expensive tax issue, say in about 12 months or so? All advice will be greatly appreciated.
  24. Hello, Happy Thanksgiving everybody! I have some questions regarding the I-864 and establishing domicile: 1) I don't think I have enough information to show domicile. I have only bank statements ($1-200 in the account) and do get mail periodically at my permanent residence back in the US. My question is, what other types of evidence can be used? I do not have a job lined up, nor do I have any property. I didn't vote this year in the elections either. I've been in China as an English teacher the last year and a half, with the exception of going home to visit twice for a month at a time. 2) My mother is going to be my co-sponsor. I do believe she is to fill out the I-864A, correct? Would she be the primary sponsor (since she has the stable job in the US), or am I? 3) My mother filed me under her taxes last year, since I didn't do it and wasn't in the US at the time too. This year she may have to do the same. Will this be a problem since I didn't file my own taxes? On page 8, #25, it says I must provide a "federal individual income tax return". The word "individual" confused me since I'm filed under her. I think there will be many more questions regarding this form, but for now I hope you can help direct me to the right place or offer some advice. I took a look at the forums and didn't find anything similar. If there is, I must have missed it. thanks.
  25. Hey GUZzy My fiance has a blue slip that says we need (more) documents to prove that I have domicile in the USA. OK so really I don't mind doing this. Really really. But it would be better for you and for us if that requirement had been made clear somewhere. The closest thing I could find was here. But ... that is vague. If it is a requirement you should list it somewhere. Perhaps on the I-129F instruction sheet? Alsoalsoalso . . . if it is not too much trouble, could you explain why it is required?
