I apologize if this topic belongs in another place, but I could not find any forum which addresses this subject. My Chinese wife is not a U.S. citizen and got her "permanent" green card in 2014. The increasing likelihood for the U.S. and China to be on opposing sides if a new Korean or world war breaks out has made me wonder how likely it would be for our government to rescind her "permanent" residency and deport her to China. I'm neither fostering nor looking for any political opinions. I have this genuine concern and would like to hear thoughts from other Chinese-American couples and anyone who knows more about this than I do. Becoming a U.S. citizen might be one solution, but I'm not sure there is enough time. Would she have to learn English well and study US history? Is the citizenship test in English?

Does anybody have a link or know how to get a Chinese translation of the Nevada driver's handbook?

Since this change is took place only last month, I will post it for anyone else who has been under the same rock as I have. "Effective April 26, 2013, DHS began automating the admission process. An alien lawfully admitted or paroled into the U.S. is no longer required to be in possession of a preprinted Form I-94. A record of admission printed from the CBP website constitutes a lawful record of admission. See 8 CFR § 1.4(d)." From the US Customs and Border Protection website.

Note, I-693 is only needed if a K-visa holder did not do vaccinations overseas getting the DS-3025 Vaccination record at the visa medical sealed in a separate envelope, avoiding having to deal with a US Civil Surgeon all together. Thanks everyone for the congratulations, well wishes, and helpful information. We arrived back in the states together yesterday. The 90-minute secondary CBC processing at the LV International airport was unreasonable in my opinion, but we finally made it. Now for one day of rest and jet lag recuperation before I research the websites and discover what we need to do next. Then we begin filling out stateside forms and more processing and fees.

It looks like they finally tired of keeping us in the system. She received notice on April 15 that the visa had been printed. It arrived 2 days later on April 17th. I will be going to China for another visit on May 6, and this time we come home together to the good 'ol USA!

My fiancee finally received the k-1 visa approval notice, but we are not sure what the Consulate is asking her to send before they will mail the visa to her. The first item is marked with an (X), so it is clear that she needs to send her passport and new visa photos, along with the filled out waybill which they enclosed in her notification. The next two items are not so clear since they are marked with a slash (/) and blanks are not filled in. / Your Police Report has expired or will expire on _________ (blank not filled in). If your Police Report has already expired or you cannot submit it to the Consulate before it expires, please renew your Police Report and send it to the Consulate with your passport. / Your Medical Report has expired or will expire on _________ (blank not filled in). If your Medical Report has already expired or you cannot submit it to the Consulate at least one month before it expires, please return to the panel physician for a new medical exam and medical report, and submit the medical report with your passport to the Consulate. ------------------------------------------------------------ Her Police Report expires on May 18, 2013. We do not know when her Medical Report expires, but it was completed on October 27, 2012. Is it good for one year? So the question is, What besides the passport, photos, and waybill do we need to send to the Consulate? Does she need to get a new medical report?

What I am wondering most is, will it really "push back my inquiry date and delay response time to our case" if I send repeated emails? Do they really expect me to just sit "patiently" and say nothing? Oh, darn! That bumped me off the lucky number "888" in total posts.

Your case requires additional processing. We will contact you by mail to inform you of our decision when we finish the processing. Is this normal, or do I have cause for concern? The first part of our K-1 application went through surprisingly fast from application on June 4, 2012 to interview in Guangzhou on October 31, 2012. Instead of getting a visa, my fiancée received a blue sheet requesting my last 3 tax returns and a co-sponsor affidavit I-134. GZ received these additional documents the end of November 2012. GZ called my fiancée 3 months later on February 28, 2013 and asked her questions about my previous marriage. When was my previous marriage? (It lasted from May 2003 - April 2011). GZ also said they tried to call me several times, but nobody answered. I checked my phone logs and found no such calls, but there were a couple calls where nobody left a message. I sent an email to GZ the next day explaining that I could not answer my phone while at work, but I would return their call if they left a message. I asked them to call my cell phone late at night (daytime in GZ) and I would be happy to answer any questions they had for me. It is now March 10, 2013, and we have been waiting 3 ½ months for GZ to look at the new documents they received from me and render a decision on our case. In boldface caps on the US Consulate GZ website it reads,” REPEATED EMAILS PUSH BACK YOUR INQUIRY DATE AND CREATE A DELAY IN OUR RESPONSE TIME TO YOUR CASE.” My patience so far has not yielded a visa or a decision. Do you think it is time to start bothering them like back in the BH days of 2002? Or is it so different in 2013 that I can do nothing but wait for GZ to force me to choose between love and country? Surely there is someone else on Candle going or gone through this situation. I welcome any insight.

Well, my co-sponsor changed his mind. The next day would be my fiancee's birthday - not the most desirable time to tell her that our co-sponsor chickened out. I was devastated but found a new co-sponsor that same night. Our new co-sponsor is a relative and has no dependents. She owns a house free and clear, has a savings account, and makes enough money from pension and Social Security both directly deposited into her checking account every month. She went to the bank and got a year's worth of statements showing payroll deposits on the same day. She is not required to file income taxes, so no IRS transcripts needed. I will be driving to her house this weekend and getting the papers filled out. I will send the package to my fiancee Tuesday (because GZ wants her to add her original blue sheet to the package [God only knows why]). Then she sends the package to GZ and we wait for who knows how long. I went to the local IRS office, waited outside 20 minutes (13th in line) until they opened, and then waited inside. I spent a total of 53 minutes waiting and then 4 minutes at the counter while the agent printed the transcripts and stapled them together by year of tax return and of wage statements. They were free.

As I understand the i-134 instructions, the co-sponsor only fills out the form and does not need to provide tax returns. Right? GZ also wants a statement, written by cosponsor, explaining why he is willing to agree to sign my affidavit of support form. Does anyone have any experience to know what the cosponsor should write?

So the second paragraph which says, "Individuals marked with an X above"... should have certified copies mailed directly to GZ with her name and case number on them, would not apply since it is not marked with an X? My fiancee had already presented my copy of my 2011 return with P4. I thought it curious that they would ask for it again, unless they wanted only a certified copy. I have scanned and saved complete digital copies of my returns each year since 2000, so it would be no trouble at all to print them from my computer if GZ would accept them instead of certified copies. My 2009 and 2010 tax returns are joint returns and would only meet the Poverty Level requirements because they included my x-wife's income. 2011 and 2012 are my first 2 years out of "Poverty." It will take a few days for my co-sponsor to get the I-134 ready, because as I understand the instructions for the I-134 Affidavit,he has to get a letter from his employer personnel office on business stationery showing date of employment, date and nature of employment, salary paid, and whether position is temporary or permanent.

I understood the yellow page to mean that I needed a co-sponsor as well as 3 years tax returns, so I went out and got a co-sponsor. I tried again to post a new topic, but it still will not post. The page refreshes and I get the red band at the top which reads, "You must enter a post." I used Firefox. I tried Google Chrome with the same result. I tried MSIE 9 which would not let me paste a jpeg, but it would let me post the text only.

Do only the paragraphs marked with "X" pertain to me, or does the entire page apply? The paragraph marked with "X" says to send 3 years' tax returns. But the paragraph below which is not marked with "X" says to send "IRS-certified" copies directly to GZ. Do I need certified copies or just my copies that I have saved? The form 4506 that is mentioned does not have any provision for requesting "certified" copies of for requesting the IRS to put her name and case number on them. It does however have a provision for requesting that the tax returns be sent directly to GZ.

I can't post a new topic. I compose the post and every time I hit the post button I get the message in red: "You must enter a post. " What does that mean?

Our K-1 process took off like the wind but came to a screeching halt at the Guangzhou interview on Halloween. It seems that the $3,000 capital gains loss that I get to carry over each year on my tax return (from a stock market loss in 2007) put my adjusted income to $344 dollars under the Poverty Guideline for 2012. I guess that $344 dollars was enough to cause the V.O. to shake his head and deny our visa. Now I have to try and find a co-sponsor and wait God-only-knows how long for them to render a decision. It looks like I will be stuck waiting indefinitely . . . deja vu 2002 B.H. all over again!

The visa process seems to be moving so fast. We just filed the I-129f in early June of this year. My fiancee's interview is scheduled for October 31, which is just a little more than 1 year after we met. I have visited her twice this year and will be going to China (next month hopefully) so we can fly back to the U.S. together. She wanted me to go to the interview with her, but I already had job commitments that I could not change on such short notice. She reasoned that the V.O. might give her "bonus points" if he knew I was waiting outside for her. Hopefully all goes smoothly and she gets the visa on Halloween. I think I deserve a fast processing experience after the prolonged hell I went through with the INS k-1 process 10 years ago.

Does anybody know if the invitation letter from my girlfriend in China has to be a snail mail original? Or can it be a printout of an email invitation that she emails to me?

USCIS is moving so fast, I am finding it hard to keep up. On 9/28 we received an email notifying us of our visa interview appointment in Guangzhou on 10/28. They are now dispensing appointment letters and P4s electronically. I guess no more waiting for EMS snail mail. Is this something new, or has it been this way for a while? These are the instructions we received via email:

My fiancee just received an EMS packet from GZ, DS - 230 and OF -169. If memory serves correctly, that is P3. Am I right? Maybe the state department, GZ, and the Pres all remember what a constant pain I was the last time and want to push me through quickly and get rid of me this time....heh heh.

I believe that you can never have too much relationship evidentiary support. Include evidence of an ongoing relationship, such as letters between the two of you, phone records, chat records, a few emails, and so forth. Show a progression of various dates to show that there is an established relationship. Include the letters from family and friends if getting them does not cause delay in your filing, but I would consider spending your time and resource first on getting the co-sponsorship paperwork together. You don't need it now, but you will definitely need it at the interview. It is better to do it now than have to deal with it last minute.
