Hunter, my Li has excellent english skills.  It seems Amy has asked her for help, they talk on 001.  Li is happy to do this for her.  We both have the same shipping date from the NVC.  Li sent her P3 papers back the next day and I hope she can help you in your filing.  Maybe we will meet at GUZ on the same day.  You have sailed through this process with no barriers.

    Last night, instead of chatting as we would normally do, my chunqiu filled out the p-3, checked with me on some things to be sure she had some spelling and such right, made sure my phone number was correct. She has already mailed it. Yes, you are right we have had no hitches so far, but i am waiting for the big one. There has to be a big one. I'm not this lucky in anything, well except in who i have as a wife. I am very greatful to your Li if she has helped my wife. I hope our spouses can be there for each other. I will not be able to attend the big day, but i'm sure if your Li and my Chunqiu are present, they should definatly be there to encourage and support each other. Thanks again. =)

  2. My wife has p3, she is from Tieling city, lived there most of her life. she has lived in beijing for 2 years. She got her police report when i visited last week. She says she doesnt need a police report from Beijing. I think she should get it. What is the final word on this if you please?

  3. I filled out a W-7 and my 1040 and mailed the signature pages to my wife in China.  The W-7 does have spaces for USCIS information.

     

    I am using tax prep software, so granted it isn't professional advice.  However, the W-7 instructions and the 1040 instructions indicate that I can mail in the W-7 with my 1040 and that will not only get her the ITIN but also work for documentation, along with a passport copy.  I am also going to submit a copy of our certified marriage documentation just to be sure. 

     

    I don't quite understand this statement.  Isn't the W-7 your statement, along with your 1040?

    It's just like the USCIS, they just love their documentation.

     

    As a nonresident spouse, who has not yet entered the US, the IRS does not have the right to treat her income or lack of income as US income for tax purposes unless you declare in writing that you wish for this to happen.

     

    It is out of their jurisdiction unless you make this claim in writing.

     

    If it is to your advantage to claim the additional deductions then it's not a bad idea, but if it would cause you to pay additional taxes then it's not unless you feel that giving the US government more money as a gift. :D

     

    For most people this is a one time shot because once she has been in the US for 31 days, she will fall into the category of Dual Status Alien.

    I just wanted to add, that we made it all the way to Shenyang, which is about 1.2 hour drive, to find the gate locked at the consul and a nice note saying, closed for pres day. What kind of bull crap is that, I mean, I dont get pres day off at my work, /grumble. ok anyway it was a nice day to take a drive anyway. Thanks so much for the info on this, its very helpful and were gonna go ahead and do the w-7, its a couple bucks for me and her, and sinse she will need to learn to drive and all that stuff, we can prolly use it.

  4. And you also need go to the nearby consulate to make her passport certified, it takes 30$.

    If you do this at a US Consulate tell them it is for tax purposes- they *MAY* do it free.

    This is the 2nd time I heard it should be free.We asked it should be free while we were there in Beijing consulate,and we told them we need it for tax return, and they stil charge.

    (ii) Exception for involuntary membership.- Clause (i) shall not apply to an alien because of membership or affiliation if the alien establishes to the satisfaction of the consular officer when applying for a visa (or to the satisfaction of the Attorney General when applying for admission) that the membership or affiliation is or was involuntary, or is or was solely when under 16 years of age, by operation of law, or for purposes of obtaining employment, food rations, or other essentials of living and whether necessary for such purposes.

     

    (iii) Exception for past membership.-Clause (i) shall not apply to an alien because of membership or affiliation if the alien establishes to the satisfaction of the consular officer when applying for a visa (or to the satisfaction of the Attorney General when applying for admission) that-

     

    (I) the membership or affiliation terminated at least-

  6. If she were your K-1 fiance, they might look at whether you can reasonably afford to go trolling for brides in China, or whether you might just be in it for whatever kickback you might get.

     

    Undocumented deposits to your account are a sign of this. I had several when I transferred money from my brokerage account to my bank account, but they apparently didn't get any attention since I had plenty of money to cover my expenses. Just in case, I had prepared a document for Jiaying to take to the interview which connected the deposits to the brokerage withdrawals.

    Hey guys/gals. That part about paying for airline travel. Say im in usa, and im just a bit strapped for cash, and I get a real good deal for airfare. so my wife, who is in china wires it to me. Would the VO be bent if they found that out?

    I mean seriously, I was saving for the ticket I knew I was gonna have to buy anyway, but for what I paid that was the only way to do it. I might add, I am impressed a woman from china can wire that kind of money. I always was under the impression chinese people were kind of poor. Thanks.

    All I really have to say in reply to this. I researched everything on the uscis web site, visited numbers of other websites, asked a few lawyers and called my congresspersons office and got some words of wisdom there, in addition my wife has done a lot of research for me too. All of course augmented by some well answered questions from this community. I think what I mean to say, the helpful people here can and will help you, but thats only 5% of the total 100% of the digging you will just need to do yourself. I think perhaps if someone is a bit testy with you, it could be that you are asking questions that you well should have looked around for yourself first, perhaps something really obvious like, what forms do you need to send in I-129F or something like that. Well, mate, good luck, and remember also, the peeps here are willingly helping out, so if you dont get along with em, find another web site to ask question on, cause all these people are nice and straight people in my experience and my humble opinion.

  10. 120 days is the max, however, I think 30 to 60 from NVC to GUZ is average.

     

    My own petition was sent 9/23 from NVC, and it was recieved by GUZ on 11/7........45 days. I think you are right in there, I would expect it to release from DHL in the next 2 to 3 weeks.

  11. I called DOS today, and they told me it can take 120 days for GUZ to get to the approved application once it has been mailed from NVC. I was innitially under the impression it would only take 30 or so days. Anyone have any definitive info on that? According to DHL, the package was mailed Dec 9, 05, and received by ??? Dec 16, 05. The agent who stores or warehouses petitions has had it for way over 30 days. Our application is K-3 visa. Thanks guys.

    I recommend you check that web site, the FAQ's there can probably help you. I think also, look in the phone book, in the blue section will be government listings. Look up immigration and call them, or visit them, and you can ask them. Good luck and major gratz on your lady coming home, finally.

I think the wisest course is to just be patient, but is there a point to where I should wonder if our case has been lost or something?

    Is there a cure for the cheetos addiction? I actually get the sudden compulsion to run to the store and get a bag, Meijer had them 2 for 1. /drool.

    I read before, that once NVC mails the package to Guz, that it can warehose for 30 ish days before its even looked at. That is why I am leaning on being patient. On the other hand, my wife saw that our package was very light, and something was said about faster processing. Oh well, gimme more cheetos please.

  16. Theoretically, filling out the I-129F should take less time for a K3 than for a K1 because several items are omitted when using the petition for K3.

    The I-129F was designed for the fiancee visa. It is only a substitute  form for K3's.

    I loved my woman so much, I went to china and married her, then I filed I-130, got receipt mailed off I-129F. Look at my time line, I went from sending in paper work to package sent to GUZ in 3 months. My wife will hopefully get her P-3 soon, if i'm lucky she will be here in March April ish.
