  5. Carl, there is no fast track to citizenship if the child is over 16. I have done extensive research on this and I even paid an AILA lawyer to confirm it. Jim, neither of my ladies want to change their names so I have no input on that. -James

  10. My wife tells me that in China they get medical services pretty much 7 days a week most any time the need them. She is having a LOT of issues with the 'make an appointment and wait' system. I have had to explain that skin problems are NOT emergencies and we cannot get immediate treatment unless we have a true emergency. Still she says that the 'American Medical System is not good'. I don't think it helped when I told her that probably 95% of all Americans would agree with her. -James
  11. Carl, you have hit the nail on the head for what LC is going through. She has told me several times "In China I felt so powerful, here I feel so weak". Being a single parent for the last 6 years has made her cope with most things on her own. Here, she is still too dependant on me due to language issues. Still we make strides in independance every day. She took her daughter to the doctor by herself for the first time yesterday. -James
  12. Nobody is ever the same day-to-day, but Loving Candle is adapting to the United States and all the little bumps in the road VERY well. I am very happy and I believe she is pretty happy, but just going through too many changes in a very short time. As soon as she gets AP she will have a chance to go spend some time with her family again in China. BUT with Yahoo, QQ, and ITalkBB she is in constant touch with them anyways! -James

  14. Curt, The street Jim Julian told you about also has a noodle shop, a great lunch for about 50 cents US. I also highly recommend the Citic Bank plaza. There is a fantastic Thai restaurant on the fourth floor, great fast food and a nice Japanese restaurant in the basement, the Citic bank of course and Bank of China also (they will cash travelers checks). If you are allergic to cigarette smoke (I am!!) be aware that all McDonalds are well air conditioned and non-smoking. They have guards that enforce this. They also have the McDonalds breakfast menu but it is not displayed you must ask for it. The bathrooms at McDonalds are squatters but very clean. The Citic Plaza has western toilets in spacious very clean restrooms. Consider writing a personal letter to the VO for your SO to give to him/her with your passport. THe VO asked my wife only four questions. The third was 'is your boyfriend still here' (I went to ACH) and the fourth was 'can I see his passport'. She handed him my passport and 'two widows' letter which he stopped to read. Then he smiled at her and reached for a pink slip. -James
  15. God Bless the PC workplace crap! When my first wife died, I immediately decided it was WAY too hazardous to date coworkers, I don't like bars or church. So, internet dating was my option. I sent emails to all the women who seemed nice and I thought I could have a real marriage with. Only some Chinese women answered and one turned out to be so special and so wonderful and now she is my wife! God Bless the PC workplace crap! -James
  16. Ok, thanks to everybody for quieting my panic. I DON'T think we would be ready for the AOS interview! The ASC we are scheduled at is almost walking distance from our house and they set our appointments for 11:00 A.M. so we can do this during an early lunch. Thanks again. -James and Loving Candle
  17. Hi, We filed our AOS paperwork on March 8, 2007, we now have an appointment for ASC biometrics at the local office on April 3, 2007. Reading Mercator's latest post it appears that his ASC biometrics was also the AOS interview appointment?? It was my understanding that the first appointment is just for fingerprinting and all the paperwork we need is the appointment letters and their (mother / daughter) passports? Hello, The AILA now has an immigration lawyer search site specifcally for location AILA (American Immigration Lawyer Association) members in your area. http://www.ailalawyer.com/ AILA membership isn't a guarantee of compentence, but it goes a long way. You should still seek a specialist in each area of immigration law. -James

  20. Ty, I neglected to ask about household count, but USCIS did confirm that my K2 does NOT get listed or counted on my K1's I-864 and vice versa. Yes, I agree that all would probably be well anyways, but Loving Candle and I crossed all our "t's" and dotted all out "i's" on our I-129F and had a completely trouble free experience (EXCEPT for GUZ mailing the P3 to the wrong address...) -James
  21. Hi David, The household size of '3' on the K1 document is due to me having responsibility for my 16 year old son who does not live with me, but is my dependant. So, I listed my wife and my son on her I-864 which makes 2 dependants and me (the sponsor) makes 3 for the K1 I-864. WOW, this IS REALLY a confusing thing, but I do believe this is correct now. -James

Hi all, After MUCH reading here and a phone call to USCIS I will fill out the two I-864's thus: K1: Myself, my wife and my one dependant son for a household size of 3 K2: Myself and my stepdaughter for a household size of 2 When I called USCIS, the lady who answered the phone had NO IDEA what I was talking about! Then HER SUPERVISOR had to ASK HIS MANAGER with about 10 minutes of conversation just to determine that DavidZixuan (and Frank1538 in another thread) were right and my step daughter was listed alone as a Principal Applicant. Since these AOS petitions are truly independent the household size for her petition is 2 (sponsor and immigrant). The household size is 3 for my wife, son and myself. (sponsor + immigrant + dependent American Son). -James
  23. That's gutsy advice... file for AP when out of K1 status? You simply include a copy of the I797C for your AOS. pushy said to file AP anytime.. that came after: 2. File within 90 days (or 270 if you're brave) I'm a little worried about the filing in the "or" case.. which would be filing when out of status My "whenever" wasn't clear. Sorry. I was simply expressing my ignorance of the appropriate time to file for AP. Didn't know where it should go in the order. "Something like this" should indicate I was giving a rough example. Since you didn't offer a counter example, I guess you just wanted to find fault?? I think 'fault' jumps off the page when someone says 'file whenver'.. just after a step where the K1 is described as out of status.. but apparently , you wrote it but it didn't jump off the page at you. No harm.. no foul.. I'm sure nobody ran out and file AP while out of K1 status... Just think twice before posting such advice. I wasn't posting advice. I'm glad you clarified that it was not advice.. some people might take this forum as serious posting and seeking meaningful answers to immigration issues... Let's just clarify that your previous post.. where you said, "LEGAL WAY" was a slip of the tongue and should not be understood as knowing what your talking about nor should be taken as 'LEGAL' ADVICE: Sorry to get so pedantic and push the issue... I guess this means that my K2 stepdaughter gets a unique I-864 filled out as IF SHE WAS THE K1 and I do NOT count her on my wife's (K1) I-864 AND these documents are NOT notarized anymore? The K2's household size on HER I-864 will be 1 (for her only) ?? -James (trying to file AOS and AP and THOUGHT he was ready...)
