  2. The Chinese people I know at work had a VERY easy time bringing their Chinese spouses here while on a F-1 student visa. Would this (F-2 spuse or child of an F-1 visa holder) possibly work for you? The cases I know of probably pre-dated 9-11, however.

  4. Jiaying and I found that the human translators would always add their own spin of one kind or another. We found the electronic ones to be much better. It was not an issue at the interview.

  6. It was much longer than I expected and lots of subtle issues...takes too much time to try to convey in a post.. but feel free to ask anything. Without a translator, not sure we would of passed... Although I knew they would ask the I-485 questions, the wording is too difficult right now for her. When asked about being a terrorist, the translator stated the questions.. then the AO got real interested in what 'terrorist' is in chinese and asked for it to be pronounced a few time... All in all, this guy was good at his job.. he probed us with thoughful and emotional questions and always glanced up to see our response and body language.. 197065[/snapback] Did you hire a translator, or was this a friend or acquantance? If you don't bring a translator, I'm sure it's unlikely that they will have anyone who speaks Chinese. My other question was about the EAD, but you've already answered that. THen I thought I had another one, but it looks like the information is all there. Thanks again for your good help.
  7. As I understand this, she is NOT eligible for the SSN until AFTER she gets the EAD (meaning that she is eligible for the TIN NOW). But you can always file for an extension - figure up your tax, fill out the return, and send in the ("estimated" - although you will know the exact amount) amount due. Then, after she gets the SSN, send in the full return. 197050[/snapback] It may take a bit of time to gather the supporting documentation for the W-7 in time to meet the deadline. I would suggest filing without joint status and then filing an amended return once you have your documentation together. It is not clear if getting the paperwork to Philly by the filing deadline is the same as being postmarked by the filing date when sending to the service center. 197101[/snapback] Or - you can get two automatic extensions to Oct. 15. The extensions don't apply to money owed, just to actually filing the return.

  11. Yes - this post is about a visitor's visa only. Good for 6 months, with a possible 6 month extension - 12 months max. They will be very happy to have her visit the consulate, take her application and $100 fee, and say "No!". From the probability perspective, the odds are very low. Maybe 20% that I've seen. But you can improve your chances by demonstrating that she has strong ties to ensure her return to China, and will have the financial support while she is here. There are plenty of cases where the visa was approved. Read up on what you can, including Tine and Ella Good luck!

  13. The K-1 by itself (without a stamp or seperate EAD card) is recognized by the SSA as providing work authorization. Individual SSA employees (and even offices) may not know this, however. Be sure to apply within 80 days of entry, and find a supervisor of SSA office that knows what they're doing. A 90 day work authorization authorizes you to work, of course. But individual employers may be reluctant to hire a 90 day employee.

  15. But they apparently (at least when I was watching last year) fill the dates at the END of the month first, and then move toward the BEGINNING of the month. Another couple and us were predicted (by CFL) to get the same interview dates. They managed to squeeze into the end of the October allocation with an early October interview, while we had to wait for the November allocation - and got a late November date.

  17. I think it's for Employment Authorization, but as a K1 she is authorized anyway, But only for 90 days. For K-1's, I think that stamp doesn't help you. The moral of the story is - when she gets here, apply for an SSN AFTER 2 weeks (to allow her time to show up in the computer). Then, if she wants to work, you wil need to apply for EAD (employment authorization) as soon as possible.
  18. There has been some conjecture recently that, in cases of a low-income petitioner, the VO may have suspected that trips might have been paid for by the benificiary. If I remember correctly, this was brought up by SmilingAsia, who has worked with a number of overcome cases in China.

  20. Mike - check out going through Beijing. I thionk the price is cheaper, but more importantly there are many more flights from Beijing to Nanning.
  21. That flight shows as $846 on Travelocity (with taxes and fees), but goes to $1288 when you buy LAX to NNG (leaving this weekend). Was the price you gave all the way to Nanning, or only to Beijing? Sorry, but I have a great deal of trouble comparing apples-to-apples. I have found the leg from Bejing to Nanning to be much cheaper when you buy a separate ticket.
