  1. USCIS approved my wifes 10 year green card! With all the other 'problems' we've had with all the dealings with the government in getting visas, etc. I thought for sure...ahh what the heck...not a time to be thinking negatives...THIS IS A POSITIVE!! YEHAAAAA!! CELEBRATE!!!!!!!!!!!!!!!!!!!!!
  2. ChunMei's 10-year green card came in the mail last Saturday, and she's thrilled. And so am I. We'd filed in early October and she was complaining about filing so late (I was waiting for some copies of supporting documentation.) She wanted to have her card before New Year. I'd told her that that would probably not happen. In early November she went in for biometrics, and we heard nothing after that. So I had to listen to her constant grumbling about the long wait, and maybe it would take one year, and why didn't I call and ask why she didn't have it yet, etc, etc, etc... So about 10 days ago we got the letter saying she'd been approved. Of course the letter has the usual "will receive your new card on 30 to 60 days" disclaimer in it, so now she's grumbling about not getting it until April. So when the card showed up in Saturday's mail... Now all she talks about is how she is a lucky lady, and how she got her green card very quickly in only 4 months, and how all of her friends waited 6 months, and so on. Funny how quickly attitudes can change.
  3. In 9 months we can file for Yuan's ROC. While we have been living on China for my work the company has provided our apartment. our name is not on the lease or any of the bills required for the apartment. I was thinking about putting the STAR program literature on the packet with the section marked about the company providing housing along with a copy of my contract as part of the packet. As far as other evidence we will have 1. Bank statements from 1 month after wedding till current 2. NYS DL showing our US home address 3. Chinese birth cert for our daughter 4. CRBA from the shanghai consulate for our daughter 5. insurance cards with both of our names 6. Credit card with her as authorized user not really helpful but it will not hurt to send it 7. Electric bill's from Feb of this year on with her name. I know we should of done this sooner but for some reason our local elec company would not add her without the GC, she had to fly back to china before it arrived in the mail due to final trimester of pregnancy. 8. We will get her a secured credit card or loan when we are back in the states in a week. 9. life insurance and 401K showing her as ben 10. Pictures of us with the baby from birth thru the filing of the packet, along with pictures from various trips in china and around western NY. 11. Hopefully we will have a new house in both of our names by the time we file. I could add her to our existing house title when we pay it off next week but do not want to waste the money if we can sell it when we buy the new place. 12. Copy of my work contract showing that I was working in China for 11 months. My main concern is the amount of time she will have spent out of the country during her conditional GC. We have a I-131 covering last year, but it expires mid feb and we are coming back until middle to late april. I do not think we will have any trouble entering this time. But with us only staying 2 weeks then leaving again for 2.5 months they might give us problems with the ROC. She will have been out of country for approx 15 months of her 2 year GC time. The time she was out was because of traveling with her spouse for work purpose so that should time out of country should be ok, at least I think it should be. Anything that I am missing in my thoughts on the packet?
  4. We never received a 797 for my wife's 10 year GC. We did get the biometrics letter and already took care of that. The USCIS officer we talked with in MN when we did the InfoPass, said it may have got lost or something, but that the bio letter shows they received it and moved forward with processing the request. Do you think a call to USCIS is in order to see why we never got the 797? Thanks and MERRY CHRISTMAS!!
  5. Hello! Rosie and I got all the evidence for the I-751 sent off about a week ago. We were just wondering (of course) how long the process takes? When should we expect to get a letter from USCIS? Will it just be an initial approval letter or just for biometrics? USCIS says 6 months for processing at the CSC. Any experience at this time from anyone else on how long they've waited? "The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth" Question. If date and place of birth are not offered in the affidavit letters, will they be disallowed as evidence? I have letters from friends and family (that I gave them copies of sample letters that showed to include this) and they omitted it. My sister put her date of birth and not where she was born. 3 friends have no date of birth or where they were born. Can I write this info on there or have them do it and initial it? They are typed letters.
  7. Hello everyone! me and my wife are approaching the 90 day window for our 2 year anniversary in the USA, and we are preparing to file the i-751 to remove conditions. I noticed it says to include evidence of a relationship, and the instructions look exactly the same as the first ones we did when we first started this process almost 3 years ago. Is the evidence as important in this step as the first time? Should I pack all the same stuff I had in there before, plus more? Also, I called them up and they told me after I send it they would send a receipt, which my wife is to use until the new green card comes, is this receipt good enough for renewing a drivers licenses? When my wife got her licenses they made it expire on the date on her green card, she drives to school and i'm concerned this will be an issue. After she removes her conditions, when can she begin to apply for citzenship? Thanks,
  8. Thanks to all the information and help I have received here through the years. April 28th had AOS interview in Buffalo. A week later got a letter we were approved. And last week we finally got Jun's 10 year Green Card. Thanks once again to all here and all my family and friends for their support. During the interview she asked a few questions and intently wrote down all our answers. But after about 10 minutes she stopped writing anything down and just began to listen and look at photos and proof, asking only a few questions. Interview lasted about 30 minutes. After she found out we had been together for almost 4 years already I guess she realized we were really married and in love. For those of you who do not know our story to sum it up. After I married Jun, I moved to China after I got everything paperwork and financially done here. Spent 11 months with her in China, taught English while there. Soon as she got approved to come to the U.S., we moved here. So in the 4+ months we have been married have only been separated for the 6 months from when we got married till I moved to China.
  9. Thanks to all of you. This forum helped me tremendously. Quick note - We had RFE because I didn't send sufficient info showing a marriage relationship for the entire 2 years of marriage, for example, they mentioned I sent only a few monthy joint bank statements rather than statements covering the 2 years. So I went to the bank and had them print a copies of statements from the time I added Ling to present. Instead of only a few copies of health insurance, assets, etc etc. I sent everything I had covering the two year period which has both our names. If I can offer any advice, it would be get everything possible in both names and keep monthly copies. Ling got her 10 yr GC on the 24th. Such a relief Thanks again, everyone.
  10. Well, its that time ... time to file for ROC for my wife and step daughter. My step daughter is now 23 years old and came to the United States at the same time as her mother. My wife came on a K-1 and my step daughter as a K-2. My wife and I were married 6 weeks after her arrival. The daughter was 6 months from turning 21 when she arrived in the States with her mother and received her 2 year Green Card before aging out. My question is this ... does my step daughter's age have anything to do with the filing of the I-751? I have my wife's I-751 ready to go. On Part 5 - Information About Your Children, I have listed my step daughter, her Date of Birth, and her "A" number and "Yes" ... Living with me. Do I just file the one I-751 for BOTH my wife and daughter with one submission fee and 2 biometric fees or does my step daughter need her own I-751 with a SECOND submission and biometric fee? Their 2 year Green Cards will expire at the end of June. Any advice would be helpful and very much appreciated.
  11. I came to the US in April 2012 under a K-1 visa and got married in May 2012. We applied to change my status in July 2012, and after my interview, I received my temporary green card in October 2012. My husband recently asked me to move out on my own because he thinks our relationship is not working, but he wants to help me get my green card by pretending we live together until he can sign the paperwork for me to get my permanent green card next year. I am worried and I do not want to lie to the immigration services. Here are some details to help you understand my current situation: When I arrived in the US, my husband was unemployed, so his ex-wife helped us by putting the apartment and all of the bills in her name. My husband has been diagnosed with depression by a psychological counselor. I am working and preparing to attend school by myself. I do everything by myself, and my husband is more like a roommate that I share a bed with than a family member. He has no interest in helping me look for work, prepare immigration paperwork, find doctors, get ready for school, or even eating with me. He does not interact with other people, not even his family, and I do not believe he has a social life. I have only met his sister 2 times, and I have not met any of his friends.His parents passed away. We have a joint bank account. We do not have joint insurance. He uses his VA benefit for his insurance, and I have insurance from my employer. I don't drive, so I am not on his car insurance policy. Now, he wants to separate because he does not feel any relationship is working, but he wants to help me get my green card. He would like to write a letter about his depression and why he wants to separate and get a divorce. I am considering divorcing him now and applying for a green card by myself (I-751), but I am not sure if that is the best thing for me to do. He asked me to move into my own apartment. He wants to use my address as our joint mailing and tax return address even though he doesn't plan to live there with me. He wants to be closer to his 2 deaf children and replace the babysitter that his ex-wife lost. He wants to live near his kids in a city that is about 30-40 miles away from where I am working and planning to go to school. His kids and ex-wife live in an area where public transportation is unavailable. Please give me some suggestions,thank you guys!
  12. I am wondering if this I-751 is the form used to obtain the 10 year green card after the 2 year green card expires. We have no problems and really don't need to adjust anything. Just want to be legal for the next 10 year period. So.. we need to use this form I-751?? Correct?? Hope all is well with everybody in your pursuit of happiness!!
  13. Greetings CFL'ers. It's been a long time since I felt the need to ask for advice, or for moral support, from you all. If I had asked for your input last summer, maybe this situation could have been averted. Anyway... So, last August (2012) I mailed out the I-751 form for my wife and stepdaughter to finally receive their 10 year green cards. I was seeing bright light at the end of the multi-year tunnel, and I smugly sat back in my chair and congratulated myself. We waited... Finally, last week a letter from USCIS appears in the mailbox. It did not contain the long awaited 10 year green cards. It contained an I-797E, a letter describing the RFE, and a return envelope. What did I do wrong! The salient point in the RFE explanation letter is as follows: "...the evidence is dated shortly before the application was submitted and does not support the bona fides for the length of the marriage." This is the list of evidence that I submitted with the I-751: Copies of the passports and green cards of Lixin and Ni .Copies of the Social Security cards of Lixin and Ni .Transcript of 2011 federal joint tax return of Kris and Lixin.Transcript of 2011 federal tax return of NiCopies of drivers license for Lixin, and Learners Permit for Ni.Copies of Visa cards and debit cards for joint Credit Union account.Copy of latest joint saving/checking account of Kris and Lixin (Credit Union)Copy of latest joint saving account of Kris and Lixin (Bank)Copy of latest joint saving account of Kris and Ni (Credit Union)Copy of loan agreement for purchase of a vehicle in 2011.Copy of Fidelity 401(K) Beneficiary Summary and Account Summary showing Lixin as my beneficiary.Copies of our Blue Cross/Blue Shield health insurance cards showing a joint policy.Copy of Ni final student grade report for school year 2011-12.Copies of a few photos of us, from the last two years. As I have been writing this, it becomes clearer to me that I focused more on the period of time that was covered by the original green cards. But we were only married for about six months before the green cards came. There is not a whole lot of evidence to provide from before the green cards arrived. We are feeling pretty low right now.   14. my wife just got her 2 years green card today. after 2 years is up, what application do we need to file to renew her green card? and how much would it cost? what kind of evidences would they need to renew for a 10 years green card? i know bills with both our names are good. but i dont have too many bills to pay except for my credit card and mortgage. would that hurt her chances of 10 years card renew? if we don't have any bills under our name, what are some other good evidences to submit? thx in advance.
  15. 1. should the biometric fee be paid up together with the I-751 application fee ? 2. when would they set the appointment for biometric ?shortly after filing or it may take sometimes ? In case she is travelling abroad at that time , how should this be handled ? The 1 year automatic extension letter after submitting the I -751 .   16. IEveryone here has been so great to us - I hope I can give back a little re: our recent experience applying for AOS. Short version: For those in the queue, just hang in there, hurry up and wait Long Version: Here is our story -Applied to Vermont Service Center around Thanksgiving -Got a notice that it was received on November 30th -Wife checked web site 2-3 times a week for a status update - her most recent check was on Wednesday - it still said "in processing" -Received letter in mail Saturday that 10 year green card has been approved and is on it's way within 60 days -Based on other posts here I am expecting it sooner - maybe in 3-4 weeks Based on great advice here we included: - 3 years tax returns, - a slew of bills with both of our names on them (based on what we owe - this was NO PROBLEM for us - hahaha), - 6 letters from neighbors and coworkers who knew us both well -everything else mentioned in a checklist we found here AND We got the advice here that a PICTURE is worth 1000 words [but we got the advice late in the game so we didn't have a lot of pictures] SO we took some -pictures, pictures, pictures - we send about 120 of them in total What I did was copied them onto standard paper and printed on a color printer by making a collage of 4 pictures per page - we got a great tip that wherever we were together, get someone to snap a pciture oif both of us in front of a sign showing the location But we were behind the power curve because we had taken some but we hadn't taken a lot of pictures togetherd SO - here's how we "caught up" - when we flew to LA with stops in ST Louis and Kansas City to change planes, we got pictures in those airports even though we were "just passing through" We framed the picture to cut off the word airport and it said "Welcome to St Louis" - hahaha - we also got tons of pictures together in small towns in front of "Welcome to ______town" signs, pictures in front of state park signs, pictures showing us together at a slew of places and sometimes (if the sign advertised July 4th fireworks or Memorial Day parade) also showing we were together at a date Nothing fancy - a small pocket camera or cell phone is fine and just hand to a stranger and ask them to take a picture of you together with the sign showing location and in some cases also showing an upcoming event date. Don't forget that every different town in the"suburbs" counts so if you don't have a huge travel budget (we didn't) then take a picture with each of 12 suburb signs shows travel together within your state. Even if you "travelled" 20 miles to visit 12 small suburb towns in one day - it can look like you were travelling together over an extended time. Note: bring spare, shirts, jackets,, sunglasses and hats, change poses, camera settings and orientation and time of day to help "mix up the look". So If you are filing in a week or 2 and you want to take a couple days to rack some up (USCIS isn't going to make the connection that all 12 pictures may be taken in 1 day) carry spare shirts, jackets, hats and sunglasses in the car so if you take 12 pictures in 1 day you can "vary the look" and it looked like separate days, months or even years. BTW I never put a date on the pictures or don't advocate that you are untruthful. Just labelled the pictures for what they were - various pictures 2010-2012 and let USCIS draw their own conclusions Good luck everyone!   17. The question on part 4 is asking of whom you gained your conditional residence. My step-son came here several months after his Mom, thus we filed the follow up visa and conditional resident for him. How should this question (Part 4) be answered...with his Mom's name or his sponsor's (myself) name? Thank you anyone for your help. Mark
  18. Hello I am totally confused about what should be a simple concept. With the help of everyone here I was able to get married - K1 to 10 yr green card for my wife and CR-2 for my stepson. I was able to relax for a while but now my stepson's CR-2 status is almost up. I'm sure I have to file the I-751 for him, but now I'm lost. I remember filing the I-751 for my wife and we submitted all types of evidence to prove that we are married. My questions are : What do I need to prove now? Relationship evidence between my stepson and me? Or evidence between my wife and I? Who should fill out and submit the I-751 form? Me , my son or my wife and I? Thanks, AlDO
  19. My wife's 2 year green card will expire in February. Will we get something in the mail from USCIS telling us to apply for the 10 year green card? or Do we just voluntarily send in the fees and application? I had heard that you want to get this done within 90 days of the expiration date. Can some one point me to a link to the process? (sorry I have been a bit under the weather, on NyQuil and am a little "foggy", so I want to be sure I get the most recent link to instructions. Many thanks to everyone here for all of their help.   20. My wife's 2 years GC is expiring in march and she wants to go to china for chinese new year but is wondering how long before it expires can she renew it so that we dont have to risk it expiring while she is out of the coutry. Any ideas on this ?
  21. Wow, I feel like such a newbie having to post this! My wife has been here on a Fiancée Visa for about a year and a half now. She's nearing the end of her two year green card and we have to start preparing to file for her 10 year green card. I'm lost... Can someone tell me what the form name/number is or a description of what I need to look up? LOL - Is this just an AOS or is it called "permanent residence" or what? Thanks... This forum is the best.   22. I have a friend from China who married an American and arrived in the United States a year ago. She is a good girl, but married a guy who is emotionally abusive and a real jerk. When she was unable to live up to his unrealistic expectations, he decided to divorce her. She received the divorce papers yesterday, and broke down in tears. He is trying to bully her into returning to China by threatening to withold any support unless she leaves the country. Furthermore, he told her that she will never get her ten year green card because they are getting divorced. Is this true? If he divorces her, will that prevent her from getting her ten year green card? Will she be forced to return to China?
  23. I've read some posts on subject before, but can't seem to find them now. We are just about to mail I-751 Removal of Conditions and we are considering name implications. Situation Spouse entered on K1 and we married here. For all immigration related items (EAD, advance parole, 2yr GC, etc), my spouse has continued to use only her Chinese name. Also her SSN is in Chinese name only. For everything else (Driver's license, banking, credit cards, insurance, mortgage, etc) she has taken my married name with her Chinese family name as middle name. She's also had her Chinese passport updated by Chinese consulate to include the "Also known as _________" statement with her married name. So the question is, what name to use on I-751. If she wishes to have 10yr GC in married name, can we just fill out the paperwork with married name, even though 2yr GC is in Chinese name only? Frankly, it doesn't matter a big deal to us either way, just wanting to understand our options. Also, would either option cause any kind of complication at this stage? Thanks

On our I-797C, Notice of Action it reads, "NOTE: Conditional resident applicants, including conditional resident dependents residing overseas pursuant to military or government orders WILL NOT receive an ASC appointment notice. Should not there be a comma after "dependents" to make this sentence more clear? Secondly, am I correct in assuming my wife will receive a ASC appointment notice since we are NOT overseas. Thirdly, my wife's conditional resident status was extended one year. Will we receive a new Green Card with an UPDATED EXPIRATION date? Thank you. Pat
