  1. Does the USCIS still mail out the Notice of Action (I-797C) document? I expected to see this in the mail by now.
  2. The waiting period during the time the NVC releases paperwork to Guangzhou has always been an obscure gray area. During the past year the methodology for processing Fiance Visas (K1 and K2) has undergone several changes. The change with the biggest impact includes the introduction of the ustraveldocs website. This website was intended to reduce hard-copy paperwork and allow for online processing. But, the intention has missed the mark by embellishing the pre-existing "limbo" period. The best available information from the US government is obscure, but a few warnings do appear on the ustraveldocs website that suggest the K1 applicant do nothing until they are contacted via receipt of P3 paperwork. When does that happen? What if anything should a couple do during this period? The best instruction I've been able to gleen is to avoid the rumor mills of mis-information. We received the following response from the US Consulate in Guangzhou after three attempts sending inquiries via their website. The first two responses contained statements that they were unable to verify identify despite the fact we entered the very information they requested again on the form page. The first two replies indicated that unless several questions were answered correctly, and the sender of the inquiry submit to removal of unwanted body parts and / or a pint or two of fresh human blood. Quote I'm just blowing off steam here, but there is a lot of room for improvement. I'm not one to accept status quo as the new norm.
  3. Hi All! Good news, just got notice that my I-129F has been approved! I know we have to get married w/in 90 days of my fiancee's entry into US using K1 visa. I'm looking way ahead here but once the K1 is issued, how long is it valid?

I was checking my I-129F status on USCIS web site and noticed the following, which has me a little worried: Request for Evidence On May 27, 2014, we mailed a notice requesting additional evidence or information in this case I-129F PETITION FOR FIANCE(E). Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. Anyone ever gotten this? I called the hotline and the person on the phone says they do not know what additional evidence is being requested so I have to wait for the letter. The person did mention something about I-797E form. How far will this set me back on my application? I'm a little frustrated,,,
  5. Today nvc ceac shows our case is ready. The protocol has changed a lot so need help on how things will go now. We've completed the I-160 online for both k1 and k2, and printed/saved the confirmation. I am finishing up the financials to send. She has ordered police reports for herself and daughter. So, do we just wait for paperwork in mail or can she do the medical now and pay fees? I haven't been able to find a step by step procedure for GZ K1, so thanks in advance for you help
  6. I called the NVC today and they provided me a new case number for my K1/K2 (begins with GUZ). Now that I have this case number does it enable me start other processes online? It's very difficult to find clear information about this new process.
  7. K1 was just approved. Wow, cannot believe it. Almost exactly five months from the NOA-1 date of December 11. Now, I have to figure out how things are done now. I assume the paperwork is on it's way to the NVC where it will spend a little time before being sent to the US consulate in GZ. Both K1 and K2 will need to get copies of their police reports, and I think there is paperwork that needs to be completed online now, but you must wait for a number from the NVC? Yes? Just need to make sure all my ducks are in a row. Moved to Austin a few weeks ago to start a new job. Going well so far. I didn't work at all in 2013, and before that my income was in China since 2008. My new income is well over the minimum needed for I-134, but don't know how tough they will be on my income part of this deal.
  8. Hello all! Glad I came across this forum, I've found a lot of useful information. One thing I haven't been able to find, and I'm surprised, is how the heck do we get a proper Chinese address on the "mailing address" sections? Both my fiance and I are living in China at the moment, and on the other fields like the G-325a, I'm not too worried about abbreviating/shortening the addresses, but the mailing address needs to be totally correct or the paperwork will never arrive here as it should! Plus, as I'm sure you already know, the Chinese way is to give a call when a package arrives, and there are no fields to put in your delivery phone number. What have the rest of you done in this situation? Also, a simple second question for the future interview -- can I join my fiance at the visa interview in Guangzhou?? All stories I read of other people they are not attending the interview. I thought it was an option, but I never see people attending together in anyone's personal story...
  9. Hi All, I'm so glad to have found this community and hope to share and support one another! I'm flying over to Shanghai this Thursday for 2 weeks to spend time with my girlfriend and meeting her family. If all goes well, I will propose to her I need a little guidance on what's the best way and the general SOP (standard operating procedure) of getting her over here so we can start a life together. Quick background: I am a naturalized Chinese-American citizen - I'm full bilingual in Mandarin and English. I met my girlfriend October of 2012 while backpacking through China. She (A Chinese citizen, no connection to USA) was a fellow traveler as well. The chemistry between us was off the charts and we knew there was something special between us. We spent some time together and I flew home after 2 months in China. Since then we have chatted through social media, talked on the phone etc. almost daily. Then she came to visit the US October of 2013.(California) with a friend and I met them there and vacationed with them for 2 week. Sparks flew even more and by the time her vacation ended we knew we would be life partners. Again, we have kept in touch almost daily since then. So my question is, can someone give me a general overview of what my next steps should be? I should apply for a K-1 visa for her to come visit and get married within 90 days, correct? Any gotchas with the process? Through third hand information I heard I should take as much photos with her and her family to prove our relationship is not a fraud?   11. I was married to a chinese woman but after she recieved the green card everything thing change and we went our seperate ways. That was about a year and a half ago. In the mean time, I had a language exchange pen pal that I made friends with back in 2008. Only chatted a few times a month, nothing major. But now we became more then just friends. The relationship has grown stronger for about a year now and she was a lot of support after my divorce. I've been to China twice (Sept, 2013 for 3 weeks and Feb, 2014 for 2 weeks) to see her and even though she really would like if I moved there, I told her with my investment properties it won't be that easy so I said she could come here on the K-1 Visa. She worries about a couple of things. One being that we were friends when I was still married so she thinks the VO will think she was the cause of the divorce. The other is that since the marriage was so short (ending right after my ex received the 10 GC) she will worry the VO will think I'm marrying a 2nd chinese woman to do the same thing. I told her enough time had passed. All my papers are almost ready to be sent but she just wants to make sure we are not going to waste or time and money waiting to find out that she will just get the blue slip when that time comes. Has any other member here been married to a chinese woman only to divorce and then want to petition another woman from china or any other country about a year and a half later? Thanks
  12. hi, we are doing a K1 visa, and my fiancee's interview is scheduled for march 25th. we are gathering all the necessary documents right now and I see this IV pre-interview document submission cover letter pdf on the ustraveldocs website. What's the purpose of this document? the k1 instructions say to bring all the documents to the interview. Can we actually mail in some documents before the interview to be part of her profile? I'm thinking of sending in more evidence for a bona-fide relationship to make a stronger case and hopefully guarantee an approval even before the interview. thanks
  13. Hi everyone. Reading these boards have been very helpful to my fiancee and I but we still have some questions regarding the K1 visa process. We're getting ready for her interview March 10. 1. She got her birth certificate from her local Gong Zheng Chu but no "white book" translation. Can anyone give me the name in Chinese of the translation/white book so I can be sure to correctly convey to her exactly what she needs to ask for? If she asks for bái běn 白本 will they know what this is? They seem pretty clueless thus far. 2. My fiancee has never been married. I've seen mention of certificates stating a person is single are available in China but I don't see anywhere in the K Visa Instructions that such a certificate is required. Is this something she needs to get? Thanks for any help you can give us.
  14. Hi guys, I'm in a similar situation. I've been living/working in China for about a year now (have the official residence/work permit and all - Chinese GF and I met when we were both studying abroad in Europe). I'm planning to go back to the US in August (for more grad school), and am looking for the quickest way for us to get married and for her to get over to the US (I already have cosigners for the app, etc). It seems like the DCF would be the quickest, although would I still have to be in China after August? I read somewhere that if I do the DCF, I have to wait 5 years to marry an American green card holder? And also that it could take 6 months to 1.5 years for the green card through DCF? In that case, it seems like it would be best to file for K-1 / I-129F through the USCIS, etc. Also, just to make sure, when first submitting the I-129F, this requires lots of documentation (cover letter, ,etc), correct? Thanks a lot in advance ...
  15. A few questions relating to K1/K2 1. Does anyone have specific information as to what documents are included in the K1 P3 and when and how they arrive to the beneficiary? Via email, snail mail, both? 2. What documents/forms are included in the P4, and when and how is the P4 information sent? 3. I think the police reports are good for only 30-days from date of issue. Are they requested during P3 or P4? 4. When are the K1/K2 medical testing and information taken (P3 or P4)? Pre-interview? How much does it cost? I have looked around a bit, but am not able to find a list of what documents and forms are requested after the P2 and when they arrive. I've seen a short list on VJ, but it's not specific. Thanks guys....
  16. I have been visiting this forum for several months and have found a lot of very good, hard to find information thanks to some very good people on the forum. I am now in the process of completing my own I-129F and am unsure how to answer a question regarding having previously filed any petition for a K-1 fiancé petition. I filed a petition in the year 2000 (13 year ago) that was approved. My fiance at that time came to the US and we came to a peaceful and mutual conclusion to not get married. She departed the US within 90 of arrival, so there was no overstay. The I-129F asked for the filing date and the city/State it was sent to. Because more than 13 years have past, I, nor my past fiancé, have any documentation regarding the month or day it was submitted back in 2000. 1. How would you complete this part of the I-129F? 2. Should I include more information to the DHS-USCIS about why that person and I didn't marry? Thank you. Steve
  17. For K1 visa that government requires the petitioner to complete the I-134, which current requirements are that income be 100% of the poverty guideline. Then, later to adjust status, the petitioner must complete the I-864, which current income requirements are that income be 125% of the poverty guideline. Because some USC may have trouble meeting this requirement, they allow these documents to be supplemented by a joint sponsor. I know some of the members here have chosen that route. I am not sure about how those petitions worked out in the end, but just found this piece written by immigration lawyer Ilona Bray, J.D., of the NOLO publishing company: First time I've heard this, but of course I haven't really been paying much attention to the visa world for the last few years. Anyone heard of someone being refused visa based on income when they have a joint sponsor? Or, for that matter, being refused based on income at all?
  18. I've talked to RandyW a little about filing for fiance visa while living in China. My fiance's daughter turned 20 last month and we would like to bring her to the US with us. Because she is a potential age-out, I have been told that it may be possible to succeed using a fiance visa and making the application "RUSH POTENTIAL AGE-OUT." It's important to file now to allow enough time to get all approvals and complete the interview so that her daughter can enter the US before her 21st birthday. I am not sure however about whether there is a requirement to be living in the US for the initial filing of the I129F. Does anyone know specifically whether it's okay to show my current address in China on the first forms, and then later, after the petition is approved to move back to the US to establish residency?
  19. Hi everyone, I'd really appreciate any help, I'm starting this thread to ask questions about the i129f that I can't find answered elsewhere. I want to get this done right! My first question: When typing in mine and my fiance's address on the form, I check "Apartment" and then I assume I would type my apartment number and name in the next box, but it will not let me click there. Am I doing something wrong? My Second Question: I'm a U.S. born citizen, do I need to get a certificate of citizenship before filing? There's an option to check "No, I don't have one," but should I get one? Will it improve anything?

  21. My I-129F petition was approved, sent to NVC, and was just sent to the GUZ embassy. I made a mistake in the beneficiary mailing address (written wrong in English), but the mailing address written in Chinese is correct. Can anyone who has already received P3 interview packet know how the embassy writes the mailing address to be delivered? In English or Chinese? Also what delivery service do they use? "kwai-di" (UPS/DHL type delivery)? or regular postal mail? Thanks!
  22. Hi everyone, About to embark on the long journey of k1 and I was hoping you experts will be able to look over our package and see if we will run into any problems. Thanks and I appreciate any help you guys can give us. A little background information on my fiancé and I. I’m a 27 year old Chinese American, aspiring dentist still in dental school. I was born in Shanghai and moved here when I was 2. She’s a 29 year old Shanghainese girl and we met through some friends while I was there vacationing January 2012. Her English isn’t that great but gets by as any college educated girl could. We usually communicate in mandarin and shanghainese. I don’t want to bore you guys with the sappy details so here are the cliff notes. Met in January 2012 in Shanghai through friends. I stayed there until April, and she came back to the US with me and left in July of 2012 on a b1/b2 visa so we spend 7 months together. Then I went back to Shanghai in September 2012 and stayed till November 2012. She then came and visit me in Chicago in March 2013 till June 2013, and we went back to Shanghai together, and I left about 2 weeks ago. We cant bare to spend any more time apart so we decided to hurry up and file for k1, instead of the risky b1/b2 AOS route. Included in our package are the following items: 1. 1 i-129f 2. 1 entire copy of my passport 3. 2 statements intent to marry within 90 days 4. 1 statement of how you met including dates, copies of airline tickets and or boarding pass. 5. Two signed G-325A 6. 2 passport pictures 7. 1 check for $340 8. Evidence of ongoing relationship. a. Facetime records b. 5 pictures of me and her friends, and pictures of us going on vacation together to Miami, NYC, Tokyo, and Hong Kong c. Copies of letters and emails d. Copies of visa to china, and passport stamps from my passport e. Engagement ring and wedding band receipts. As far as I know, it seems like we have everything necessary for a successful K1, granted her interview goes well. The only problem I foresee is financial problems. Since I’m still in school, I don’t have any income. However, nor do I have any student loans and my parents are willing to sign an affidavit of support. So how does everything look? I thank everyone for their support and the wonderful information this forum has provided us in our long journey. Thanks!!!
  23. This is my first post, been following this forum for months now, but I think perhaps our visa case is very unusual. My fiancé and I are both foreigners living in china as study abroad students. We were together 3 years before getting engaged, and are living in china currently. My fiancé is from Pakistan, and We had a baby last year which was born back home in USA. We were still waiting on the K1 when my son was born and my fiancé couldn't be there for his birth. Long story short, my fiancé is from Pakistan and since we stay in china we interviewed here. The interview went fine but he got a blue slip for Chinese police certificate (he already had one from Pakistan which we were informed was the only one he needed) and also work resume. We submitted both documents and they received them on Dec 8. Emailed 3-4 times and always the same "administrative processing" reply. I am unsure how long does it take because the police certificates expire at 6 months and I had to change my tickets back home from winter to summer. How long does this take, is it possible it will take until July to get an answer?
  24. Greetings, everyone. This is my first post as a new member. I am a 61-year-old gentleman who, after being a bachelor all my life, has finally found the love of his life. And of course, she is on the other side of the planet in China. She is nine years younger than myself and is elegant, educated, intelligent, and treats me like a king. I am ecstatically happy. But, of course, I now face the inevitable morass of American Immigration. For my first post I have two questions I would appreciate some help with. The first question deals with the evidence data that we are to submit with the I-129F. I know we should “Front Load” so I have amassed quite a large collection of material. What I would like to know is what is the best way to submit it. I have everything printed on high-quality inkjet printer paper and I will be printing the photos on photographic quality paper. Currently I have all printed pages inserted into sheet protectors and everything neatly placed by category (letters, emails, Skype data, etc.) inside professional grade binders. It all looks pretty good, but is bulky as an African Bull Elephant. I would have to ship it all in a large box and I am afraid the huge, awkward nature of the binders may be an annoyance to whoever inspects them at the Immigration Service. I am considering having all the printed materials professionally bound into nice books, sans the bulky binders and sheet protectors. What does anyone think about this issue? Any comments gratefully appreciated. The second question deals with my age and the age of my fiancée. Does an older age of an applicant, and that of his beneficiary, reflect positively or negatively on an application? Because of my age, this is essentially my “last chance” at this kind of happiness and I cannot afford to go through a massively extended process filled with problems. Nor can I do a lot of “repeat” filing or long-term legal work. And neither can I go looking for a new lady, if I loose this one due to government red tape. I would not want to look for a new lady, as this one is the only one I ever would want. Any comments on “older-age-applicants” would also be very gratefully appreciated. Thanks.
  25. I have read the site a lot recently and have been learning as much as I can. Of course, I want to do everything I can at this point to strengthen our case and I thought of something that I hadn't read much about anywhere. Some states require or prefer pre-marital counseling and many accept online counseling. If me and my fiancee completed the course, would it be wise for her to bring a copy of the completion certificate to the interview or would it be presumptuous? The completed certificate is good for a year. I'm leaning towards including it as it shows some effort and intent to marriage. Any other suggestions out there I'm open to. I feel like we have a little less evidence than I would like as I was living in China and didn't document everything very well until the end of my residence there. We have dated photos, and train passes along with chat records and skype records, but I want to make sure I'm doing everything I can. Thanks in advance
