  1. I came to the US in April 2012 under a K-1 visa and got married in May 2012. We applied to change my status in July 2012, and after my interview, I received my temporary green card in October 2012. My husband recently asked me to move out on my own because he thinks our relationship is not working, but he wants to help me get my green card by pretending we live together until he can sign the paperwork for me to get my permanent green card next year. I am worried and I do not want to lie to the immigration services. Here are some details to help you understand my current situation: When I arrived in the US, my husband was unemployed, so his ex-wife helped us by putting the apartment and all of the bills in her name. My husband has been diagnosed with depression by a psychological counselor. I am working and preparing to attend school by myself. I do everything by myself, and my husband is more like a roommate that I share a bed with than a family member. He has no interest in helping me look for work, prepare immigration paperwork, find doctors, get ready for school, or even eating with me. He does not interact with other people, not even his family, and I do not believe he has a social life. I have only met his sister 2 times, and I have not met any of his friends.His parents passed away. We have a joint bank account. We do not have joint insurance. He uses his VA benefit for his insurance, and I have insurance from my employer. I don't drive, so I am not on his car insurance policy. Now, he wants to separate because he does not feel any relationship is working, but he wants to help me get my green card. He would like to write a letter about his depression and why he wants to separate and get a divorce. I am considering divorcing him now and applying for a green card by myself (I-751), but I am not sure if that is the best thing for me to do. He asked me to move into my own apartment. He wants to use my address as our joint mailing and tax return address even though he doesn't plan to live there with me. He wants to be closer to his 2 deaf children and replace the babysitter that his ex-wife lost. He wants to live near his kids in a city that is about 30-40 miles away from where I am working and planning to go to school. His kids and ex-wife live in an area where public transportation is unavailable. Please give me some suggestions,thank you guys!
  2. I am wondering if this I-751 is the form used to obtain the 10 year green card after the 2 year green card expires. We have no problems and really don't need to adjust anything. Just want to be legal for the next 10 year period. So.. we need to use this form I-751?? Correct?? Hope all is well with everybody in your pursuit of happiness!!
  3. Is it possible for a person who was in a marriage, and is in the process of being divorced to Remove Conditions the two year card to the ten year card, without going for the spouse abuse plea?
  4. Hey all, I've read this thread and I am stressing a little bit about the removal of conditions...Allow me to explain. We got the Conditional Green card in August 2010, and since that time have not really "lived" in America. We just aren't ready yet, although we do plan on making the permanent move either late this year or early 2014. We have travelled back to America once each year and stayed for about 2 months each time. The reason I am stressing is I'm not sure I can be present in America for the interview/biometrics and all that. Basically, what I want to know is this: After you file the I-751, how soon will they typically schedule the biometrics and interview? I was planning to submit the application at the end of May then go to America in mid-June and stay about a month and hope the biometrics and interview would fall in that month timeframe. Does it not work like that? From reading this thread, it seems like they call you for an interview anytime in the year after you apply then you have like a week or two to show up for it. I know I haven't exactly "played by the rules" but believe me we are not trying to game the system; we still INTEND to move to America, we just aren't ready just yet. Anyway, any advice/feedback from personal experience would be much appreciated. Thanks!
  5. Greetings CFL'ers. It's been a long time since I felt the need to ask for advice, or for moral support, from you all. If I had asked for your input last summer, maybe this situation could have been averted. Anyway... So, last August (2012) I mailed out the I-751 form for my wife and stepdaughter to finally receive their 10 year green cards. I was seeing bright light at the end of the multi-year tunnel, and I smugly sat back in my chair and congratulated myself. We waited... Finally, last week a letter from USCIS appears in the mailbox. It did not contain the long awaited 10 year green cards. It contained an I-797E, a letter describing the RFE, and a return envelope. What did I do wrong! The salient point in the RFE explanation letter is as follows: "...the evidence is dated shortly before the application was submitted and does not support the bona fides for the length of the marriage." This is the list of evidence that I submitted with the I-751: Copies of the passports and green cards of Lixin and Ni .Copies of the Social Security cards of Lixin and Ni .Transcript of 2011 federal joint tax return of Kris and Lixin.Transcript of 2011 federal tax return of NiCopies of drivers license for Lixin, and Learners Permit for Ni.Copies of Visa cards and debit cards for joint Credit Union account.Copy of latest joint saving/checking account of Kris and Lixin (Credit Union)Copy of latest joint saving account of Kris and Lixin (Bank)Copy of latest joint saving account of Kris and Ni (Credit Union)Copy of loan agreement for purchase of a vehicle in 2011.Copy of Fidelity 401(K) Beneficiary Summary and Account Summary showing Lixin as my beneficiary.Copies of our Blue Cross/Blue Shield health insurance cards showing a joint policy.Copy of Ni final student grade report for school year 2011-12.Copies of a few photos of us, from the last two years. As I have been writing this, it becomes clearer to me that I focused more on the period of time that was covered by the original green cards. But we were only married for about six months before the green cards came. There is not a whole lot of evidence to provide from before the green cards arrived. We are feeling pretty low right now.   6. my wife just got her 2 years green card today. after 2 years is up, what application do we need to file to renew her green card? and how much would it cost? what kind of evidences would they need to renew for a 10 years green card? i know bills with both our names are good. but i dont have too many bills to pay except for my credit card and mortgage. would that hurt her chances of 10 years card renew? if we don't have any bills under our name, what are some other good evidences to submit? thx in advance.
  7. From everything I have read , the 3rd party affidavits are not required but have had a hard time finding if anyone here was successful without them? If they are not required, I wonder why in the instructions they specify "at least two"? If it was not required it would not list a quantity I would think, but I faintly recall in reading about this in the past here that there were a couple who were successful without them. Anyone else recall? I really do not want to subject my friends and family with having to go get a statement notarized. I can write the statement for them and they will sign it, but having them go off somewhere and get it notarized and returned to me would be a pain, especially since my friends and family live in other parts of the country. I do have a boat load of evidence other than that and intend to throw everything I have into the packet and go with that. If I get an RFE, then I will just have to deal with it. Also, am I seeing right that there are sometimes that biometrics are not required? Any reason why that happens? Do you get the biometric fee refunded? Lee
  8. 1. should the biometric fee be paid up together with the I-751 application fee ? 2. when would they set the appointment for biometric ?shortly after filing or it may take sometimes ? In case she is travelling abroad at that time , how should this be handled ? The 1 year automatic extension letter after submitting the I -751 .   9. IEveryone here has been so great to us - I hope I can give back a little re: our recent experience applying for AOS. Short version: For those in the queue, just hang in there, hurry up and wait Long Version: Here is our story -Applied to Vermont Service Center around Thanksgiving -Got a notice that it was received on November 30th -Wife checked web site 2-3 times a week for a status update - her most recent check was on Wednesday - it still said "in processing" -Received letter in mail Saturday that 10 year green card has been approved and is on it's way within 60 days -Based on other posts here I am expecting it sooner - maybe in 3-4 weeks Based on great advice here we included: - 3 years tax returns, - a slew of bills with both of our names on them (based on what we owe - this was NO PROBLEM for us - hahaha), - 6 letters from neighbors and coworkers who knew us both well -everything else mentioned in a checklist we found here AND We got the advice here that a PICTURE is worth 1000 words [but we got the advice late in the game so we didn't have a lot of pictures] SO we took some -pictures, pictures, pictures - we send about 120 of them in total What I did was copied them onto standard paper and printed on a color printer by making a collage of 4 pictures per page - we got a great tip that wherever we were together, get someone to snap a pciture oif both of us in front of a sign showing the location But we were behind the power curve because we had taken some but we hadn't taken a lot of pictures togetherd SO - here's how we "caught up" - when we flew to LA with stops in ST Louis and Kansas City to change planes, we got pictures in those airports even though we were "just passing through" We framed the picture to cut off the word airport and it said "Welcome to St Louis" - hahaha - we also got tons of pictures together in small towns in front of "Welcome to ______town" signs, pictures in front of state park signs, pictures showing us together at a slew of places and sometimes (if the sign advertised July 4th fireworks or Memorial Day parade) also showing we were together at a date Nothing fancy - a small pocket camera or cell phone is fine and just hand to a stranger and ask them to take a picture of you together with the sign showing location and in some cases also showing an upcoming event date. Don't forget that every different town in the"suburbs" counts so if you don't have a huge travel budget (we didn't) then take a picture with each of 12 suburb signs shows travel together within your state. Even if you "travelled" 20 miles to visit 12 small suburb towns in one day - it can look like you were travelling together over an extended time. Note: bring spare, shirts, jackets,, sunglasses and hats, change poses, camera settings and orientation and time of day to help "mix up the look". So If you are filing in a week or 2 and you want to take a couple days to rack some up (USCIS isn't going to make the connection that all 12 pictures may be taken in 1 day) carry spare shirts, jackets, hats and sunglasses in the car so if you take 12 pictures in 1 day you can "vary the look" and it looked like separate days, months or even years. BTW I never put a date on the pictures or don't advocate that you are untruthful. Just labelled the pictures for what they were - various pictures 2010-2012 and let USCIS draw their own conclusions Good luck everyone!   10. Since I'm about to file our I-751, I've pulled together info I used and will share what we did. Maybe this will turn into an FAQ with comments from others or at least the thread can stand on it's own as well. -------- I-751: Removal of Conditions -------------------------- A lawful permanent resident is given the privilege of living and working in the United States permanently. Your permanent residence status will be conditional if it is based on a marriage that was less than two years old on the day you were given permanent residence. You are given conditional resident status on the day you are lawfully admitted to the United States on an immigrant visa or receive adjustment of status. Your permanent resident status is conditional, because you must prove that you did not get married to evade the immigration laws of the United States. You and your spouse must apply together to remove the conditions on your residence. You should apply during the 90 days before your second anniversary as a conditional resident. The expiration date on your alien registration card (commonly know as green card) is also the date of your second anniversary as a conditional resident. If you do not apply to remove the conditions in time, you could lose your conditional resident status and be removed from the country. Upon removal of conditions, the green card is valid for 10 years, and then a person has to get a new one, but the status as Permanent Resident does not expire after 10 years. NOTE: You can't file before the 90 days (green card expiration). 3 months can be more than 90 days (92). If you submit too early, they will reject your application. The Usual Suspects: 1) Payment of $505+$85 ($590) to US Department of Homeland Security. 2) Cover Sheet. 3) Form I-751, plus any attachments. 4) Copy of the green card (front and back). 5) Evidence of a bona-fide relationship. Samples of evidence of a bona-fide relationship (suit to your situation): 1) A deed, showing co-ownership of your property or a lease agreement with both of your names on the lease. 2) Utility bills, credit card bills, and other types of bills which have both of your names on them. Since many utilities will only put a bill in one person's name, some bills in one name and other bills at the same address but in the other spouse's name serve the same purpose: showing your financial & social lives intermingled. 3) Copies of actual credit cards, health insurance cards, or other "joint" cards that you have together, showing same account number. 4) Car, health, or life insurance that has both of your names on the policy or the other spouse listed as the beneficiary. 5) 401K or other retirement plan with spouse listed as beneficiary (right to survivorship is the technical term). 6) Bank or stock accounts or loans with both of your names on them. 7) A copy of your joint tax returns. Tax transcripts from the IRS are still the preferred method. 8) A car title or other titles to property showing joint ownership with your spouse. 9) Birth certificate of any children that have been born to your marriage. 10) Documentation of any vacations that you have taken, including flight itineraries, hotel bills, pictures of you together on vacation. 11) Other family pictures of you together. 12) Copies of Christmas cards and other holiday cards addressed to you both. 13) Any other sort of common, ordinary correspondence addressed to either or both of you at the same address. 14) Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship.   11. Hi all, for the I-751 will they require proof of financial viability. I understand that we will need to submit our tax returns, but will we also need to submit recent pay stubs and multiple months of bank statements? I mean do you need to prove you are above the poverty levels again, such as in the original visa petition? Also do you know if applying for any kind of federal aid/health programs will have any effect on the application. Thanks!

  13. I need some help. We filed on 9/9/2011 for the 10 year green card for my stepson. We did the biometrics and are waiting...and waiting and then finally on July 30th 2012 we recieve an RFE that required a signature. We signed it and overnighted it back to them. They said in the RFE that it would be a minimum of 16 days before we would here anything else. It is now the middle of September and we still have heard nothing. The case status is the same online. The proccessing times at VSC are into October already. Is there a way to contact someone by phone or get an appointment to find out what is going on? His one year extention letter runs out on 10/11/12..................... Thanks,

  15. Hi, So I just noticed my Wife's name on the past 2 years of tax returns has her name mispelled by one letter. They have it as SuQuing instead of SuQing. What can I do to fix this or will this be an issue sending the Tax Transcripts in with the I-751? Thanks, Vinny
  16. Hi, My wife and I entered the U.S. on 07/01/2010, she entered on a CR-1 visa and was awarded a 2 year green card. We have moved maybe 3 times since that time, and every time I've done a change of address for both her and myself as the petitioner. I'm getting ready to fill out the I-751 as the 90 days until 2 year anniversary is coming up, but her company has decided to relocate her North of Dallas, so we'll be moving again. We're going up on spring break to look at places where we can live, but at this time the company doesn't know which store they will put her in, nor do we know an address where we will be living. What should I do about the I-751? I called USCIS, but the guy wasn't very nice and spoke to me like I was wasting his time, so I wanted to get confirmation of what he said. He told me to just file the form and when we get the address then to call them and notify them so they could update the address which could take up to 15 days for confirmation during a pending case. Seems like doing that could lead to some confusion and problems if you ask me. My second question is that my wife is currently pregnant, and the baby's due date is 07/04/2012 (no it wasn't planned! ) Obviously that's 3 days after her 2 year anniversary although due dates are an estimate. Can I just send a copy of the ultrasound pictures which have her name on the pictures to show that she is pregnant, or will they notate that at the BIO scan? If the baby decides to come out early and we get the birth certificate while the case is still pending, is it worth sending it to them? That's all I can think of for now... Thank you, Tom

  19. Is there anybody filed for 10-year greencard in May, 2012? Have you received your 10-year GreenCard? I had my fingerprint taken on 06/04/12 and since then, I have not heard anything.... My two-year GreenCard is going to expire by the end of July, so I can not get my license without the new 10-year GreenCard (they won't give me 4-year driver's license) I did check the status on-line, it says " initial review" which does not tell anything.... I just wonder how long does it usually take to receive the 10-year GreenCard? Any help is appreciated Thanks, Ruby
  20. The question on part 4 is asking of whom you gained your conditional residence. My step-son came here several months after his Mom, thus we filed the follow up visa and conditional resident for him.   21. My wife received an RFE for her Removal of Condition. We sent the below initially Check for $590 to the Department of Homeland Security I-751 Form • Copies of the green card, driver license, social security, and student ID cards of (My Wife's name). • Copy of the tax transcripts of our 2009 and 2010 joint US tax return. • A letter from my company of the designation of my benefits to (My Wife's name). • A copy of car insurance notice. (I am excluded due to high cost of insurance) • A copy of our car finance summary, showing joint ownership. • A copy of our Vehicle Registration Card showing joint ownership and common address. • A copy of our Vehicle Registration Renewal Notice showing joint ownership and common address. • A copy of our Mastercard and credit card statement showing a joint account. • A copy of our hotel reservations for our Las Vegas trip in September of 2009 and April of 2010. • A copy of our hotel reservation for our Laughlin, Nevada trip in July of 2011. • Copy of our various casino players¡¯ club cards. • A copy of my credit card statement showing airline ticket purchase for my wife¡¯s vacation back home and class tuition for her college. • 24 pictures of us and our family and friends. The RFE is asking for the exact samething that was sent. We are a young couple and don't have enough money to move out so we do not have a lease or a mortgage. My parents is the typical Chinese that is afraid to sign anything related to the government so me making up a lease or rent agreement is out of the question. We are living at my parents house and do not have a lease or agreements. We are living rent free at my parents. My wife is a full time student so she is not working at the moment. The only thing we own together is a car that we bought that I am currently paying off. I am also paying for her insurance. We have a PO Box and all of my wife's important mail is going there, the only thing we get at my parents house from her is advdertisements like credit card offers, etc.. I am planning to send the what I sent initially and adding tax transcrips for 2011 and some more credit card statements. I paid Bank of America $10.00 to send me a letter about our joint account. My wife did receive a letter from the SSA at my parents house as well as USCIS letters, should I send those as proof that she lives with me? Please suggest what else I should include.
  22. We have everything together, just wondering your experience as to how to package the form and supporting docs. I'm thinking a folder that easily slips the papers in and out? Or perhaps a ring binder with clear protective pockets for each document?
  23. My wife has just had her approval letter received here for her permanent residence and no interview was required. We now have to soon start the procedure (I-751) for her son. My question is: Do we gather all the same materials and go about the same procedure as we did with his Mom? I understand that there is rarely an interview for the sibling, which is fine either way, but want to be sure we send immigration the correct package. Thank you very much. Mark

  25. Hello I am totally confused about what should be a simple concept. With the help of everyone here I was able to get married - K1 to 10 yr green card for my wife and CR-2 for my stepson. I was able to relax for a while but now my stepson's CR-2 status is almost up. I'm sure I have to file the I-751 for him, but now I'm lost. I remember filing the I-751 for my wife and we submitted all types of evidence to prove that we are married. My questions are : What do I need to prove now? Relationship evidence between my stepson and me? Or evidence between my wife and I? Who should fill out and submit the I-751 form? Me , my son or my wife and I? Thanks, AlDO
