  1. NVM typed wrong number in the system. Wow, that was a really fast way to upset the wife. From now on I will Cut and paste and not type the application number.
  2. Hi everyone: I appreciate your help. My wife completed her medical examination and all vaccinations in China (Guangdong Int'l Travel Healthcare Center) as part of her K-1 Visa. The hospital gave her a sealed envelope AND a bag full of other stuff; including Form DS3025 and a sealed CD which was separate from the sealed envelope. At the K-1 Document Intake, she gave them all things but they only took the sealed envelope. The person told her 'america might want to see the DS3025 and CD' when she arrive to USA. However, at POE, SFO immigration did not ask to see any medical so we still haver this sealed CD and DS3025. (she was expedited through SFO immigration in less than 2 minutes by the way. ....) Now, we are looking to complete the AOS and I am so confused on what to do. I understand that since we completed the vaccinations in China that we dont need to do it again here, but do we still need to see a civil surgeon to certify the DS3025 (and sealed CD?) and complete the I-693 just for vaccinations? Or do we just give the DS3025 (and CD?) with the AOS package with no I-693? This is so confusing because the i-693 instructions say we dont need to see a civil surgeon but it doesn't say what K-1 needs to give to the AOS. Also, I perused the pinned thread and the info there wasnt wasn't clear to me on what someone with in our situation (unsealed DS3025/sealed CD£©should do. Please advise. Also, assuming we need to see a civil surgeon, would her primary care physician from my health insurance = a Civil Surgeon, or do we need to see somebody special?
  3. Jing entered the USA on July 5 in SFO. We're getting married on the 15th of September? Is that too late in the pocess? When we got our marriage certificate this morning, they said it takes up to 10 days after you turn in your signed/completed marriage license to get a certificate. Is this going to pose a huge issue? Should we reschedule the wedding to an earlier date? Alex Wait
  4. Afternoon everyone, Yuan And filed for her AOS, EAD and AP at the same time. Her Biometrics appointment is on Aug 1, 3 weeks from mailing date. My question is, the Appointment letter has the I485 and I765 application Numbers on it. But does not list the I-131. Is this going to be a problem? The I-131 is the most important part of the process for us to get completed ASAP. Thanks for your time.
  5. Yuan and I just filed for her AOS, They have received her packet and cashed the check. Today I was offered a HUGE opportunity at work, free housing with a very large salary, the only problem is that the first 6 months of this job are in India. I do not think there is any chance for her greencard to arrive before that time. She might get her AP before the job starts. Any suggestions other than to have her wait in the states until the 2 year Conditional greencard arrives? Thanks in advance for your advice.
  6. On question 25 of the I-864, the box says "I have filed a federal tax return for each of the most recent tax years. I have only been working for a year and a half so that's not applicable to me. My parents are joint sponsoring my wife, so they will provide their past 3 years tax returns. Should I still check the box and attach my tax returns for last year or should I just leave that space blank altogether? Thanks! Mike
  7. This is concerning a K1 visa. Plan is for her to arrive May 13th, possibly marry May 20th, but before June 1st. However, we will have to move on June 1st, since my lease will be up. It will be nice to have a lease under both our names and a new place for my future wife and I. Our plan also is to submit for AOS (including EAD and AP) June 1st or a few days afterwards. Our questions are: 1) Since, we are moving (current petition is listed with my current address (up to May 31st) ), what forms do we need to fill out and submit? We are aware of an AR 11(can this be done online or offline?), but does anything else need to be submitted in addition to this? Plan is to submit AOS (EAD and AP with the new address, not the current one) 2) When can we submit for her SS# 3) Anything else that we need to be aware of or keep in mind and any suggestions?
  8. Hello, We have a couple quick questions regarding the I485 form. Lili came to the States on a KI Fiancee visa on Dec 22nd. We married on Dec 29th. Here is our questions: Part 1. Question - What is your current USCIS Status? What do we put here? K1? Question - Expires on? What do we put here? The I94 expiration date? Part 3. Question - In what status did you last enter? What do we put here? Question - Nonimmigrant visa number - Is this the control number on her visa? Question - It says to list your present spouse and all of your children. Do we put my name here since we are married now? Part 3. Processing Information It says to list present and past membership with every organization. I assume they are asking for CCP information again, correct? We then answer a bunch of yes or no questions. One question is about the communist party. We answered yes. Should we include our CCP letter of explanation again? Thanks, Matt and Lili
  9. Hi All, Its been a crazy and hectic last 2 weeks. But all worth it!!! I flew to HKG to get my love, spent a week in the Rockies (UT) and got married :)Now the next steps and I have a few questions..... 1)Is there a link on here on what exactly is needed for AOS? Do we need the actual marriage license for this? I only have the marriage certificate thus far. Maybe another 2 weeks before we get the marriage license in the mail. 2)When can I get her a SS Card/SS number? What is needed? 3)I assume we cant do her name change yet. We need the marriage license first, correct? 4)We are planning to go back to China the end of March for a Chinese wedding.I dont think we will have her green card by this time. What is needed for Lili to leave the States for the China wedding and get back into the states after? 5)Finally, we currently live in Texas. However, we are moving to Utah in March.   10. I'm so tired of all of this. Now they're asking for additional evidence for the I-485, although I don't know what it is. Just saw it online when I was checked on the status. I'm supposed to get notified via email asap but haven't got that either. Very frustrating. I put all my trust in this attorney, and all he's done was screw things up. Says the case has been suspended until the information is received.
  11. If some of you've been following, lawyer messed up our app. I need to call USCIS tomorrow (per USCIS employee suggestion...30 days and no action) and see where we are at. But as I read everything I have a question. Rosie legally doesn't have a visa. The K1 expired (Feb 19) 90 days after she entered the U.S. Is she still able to go forward with the I-485? On the 485 the attorney typed in OVERSTAY as the status of her visa. Your thoughts? Sorry I ask so many questions. I just need to make sure I do everything right after he botched it the first time. Additionally, does someone have a link of a site that shows us exactly what we need to do to file the I-130 for her unmarried daughter that's 20 years old? What papers do we need to send in for that when we can send them in. We are going to do this all on our own. No more attorneys.
  12. Hello, Parents in US on visa, will be doing I-130 and I-485 while they are here. My concern regarding documents is the following: On birth certificates: Is the white book(notarial certificate)enough evidence as a birth certificate? The Department of State Reciprocity section states that these are at best considered secondary evidence. has anyone ever had a problem or RFE because of not providing originals, and/or other evidence? On marriage Certificate: Parents marriage certificate (white book) has copy of red book and translation. But my concern is that translation states "The above mentioned persons apply for marriage which is in conformity with the provisions of the Marriage Law, the People's Republic of China and are hereby permitted to register and this certificate is hereby issued." Does this mean that they are married or just that they are permitted to marry? Is this document enough evidence of marriage for parents? Also have notarial certificate of spousal relationship for them. I appreciate any help you can give me. Thank you.
  13. I'm not sure which forum this should go in. I'm still wrapping my head around everything that needs to take place, but I've really appreciated everyone's help in the past. This has been quite the journey. So my fiancee is coming to the US in a month. Is there a checklist somewhere I can consult for everything we need to do once she gets here? SSN, adjustment of status, etc., and the order these should be done in? At what point will she get a work permit and a temporary visa that would allow her to leave the country?
  14. The day I mailed out the AOS and I-765 package, I was sure everything was there. I came back home and wanted to make a copy of something and soon as I opened up my copier, I saw a photocopy of her I-94 and visa that I had copied earlier. I had grabbed that one to make a copy for her I-765 application as well and just forgot to pull it out of my copier and add it back into the I-485 package. So as I sat there, I dreaded that might give me a RFE for missing that in the I-485 package. However, I thought to myself, well ya know I did include a copy of it, it just happens to be with the I-765 section of the package that was mailed TOGETHER in the SAME package. Well sure enough, I got a nice yellow sheet today. I am not too worried about it because she already has a biometrics scheduled and when I checked the status on USCIS website, there is only a RFE placed on her I-485 case and her I-765 is processing as normal. To us, the EAD card is more important and almost has the same privelages she has been waiting for. Being able to work and drive are the big ones. Anyways!! I am just ranting!
  15. Now studying up on all the AOS phase processes. Everything in the FAQ is very clear on the last name change and is easy to accommodate, however at the same time we want to legally change her FIRST name to her chosen english name. From what I have been able to determine, this must be done at your local courthouse with a petition for name change. I got the info, no problem. I presume we do this after we get married so we can demonstrate the last name change as well. Seems ok to do this even with no green card yet. In the state we are marrying (Florida) they don't appear to ask what your married name will be but I presume you can't change a first name at that time anyway? She already has a Michigan state ID and SS card with her Chinese name from the time she studied in the U.S.. Very helpful... so no rush on the ID and SS card. She won't need to work or drive. I imagine after we get the name change approved, then go get a new Washington State ID and then file for AOS referencing the new first/last name as the married name (and include a certified copy of the name change I imagine). That should get everything processed through them with the new name. At this time can start using the new name on everything else... bank account, credit cards, etc... But do NOT file for the name change with SS until we get the Green Card from what I read? It will go smoother if they get data from USCIS on this first?

  17. My friend Jeff is getting married to Chinese woman on June 26,2010. Here is his question. My fiance came to the US on Apr 29th. Her son did not accompany her but wants to come later. Can someone please tell me what he has to do since he has turned 18 since her arrival. Also what do we have to do on this end? What forms need to be filled out besides the I-485? He was included on her original K-1 visa application. Thanks, Michael

  20. My wife has a friend who came here on a K-3 visa almost 2 years ago and in August her visa will expire. The problem is her husband doesnt want to renew her visa, she keeps asking him about it but he either doesnt want to talk about it or he tells her he wants to file for an extension. She is feeling her husband just wants to control her and there are other things that point to this that we dont want to go into. The question is what are her options if he wont file the papers for her extension? Thanks for any help you can give us.
  21. How do I change the font size in the spaces. My attorney filled out my K-1 visa, but I am doing the AOS. They were able to make the text smaller in some spaces then others to fit it all in.
  22. AOS papers getting ready to go out. OK, let me make sure I have this thing correct. 1. Only need "Suppletmentel Form To I-693"? No need to submit any part of the I-693 form because she had her exame in China less than one year ago? I will include a copy of that. 2. Only pay $1010 for all of this? The other fees (I-131 and I-765) are waved becuase she is doing a K-1 AOS? 3. 2 passport photos for I-485, 2 for I-131 and 2 for I-765. 6 total? 4. Mail all of this to : USCIS P.O. BOX 805887 Chicago, IL 60680-4120 5. Make two copies of everything! I got the C 9 thing! Thanks!!!
  23. My fiancee, now my wife recieved her k1 visa not too long ago. Now we are in the states and ready to start the AOS process.... Now can anyone give like a detailed guide on how and what excat documents that we need to file? Also, I see that we need to submit A copy of Approval" for I-129F Now I can't find that document or even know how it looks......Is it necessary? Thank You
  24. I-693, Medical Examination of Aliens Seeking Adjustment of Status. (If you already have this from your overseas Visa Interview submit a copy that medical check form; No fee is required in this case. If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement (I-693A), not the entire medical report. You may include the vaccination supplement with your adjustment of status application.) The POE took her medical forms, so we don't have anything to submit with the AOS packet. Am I just to submit the vaccination I-693A supplement? Or do we need to get a new medical examination here to submit?

I received notice for their Biometric appointments about two weeks ago. They will be here in Virginia not far from where we live. Today, I received another notice of action for my wife and son (I-797C) in relation to their I-485s. It says: Notice type : Transfer Notice This is to advise you that in order to speed up processing we have transferred the above case to the following USCIS office for processing: California Service Center, 2nd Flr, 24000 Avila Road, Laguna Niguel, CA 92607-0111. That office will notify you of the decision made on the application or petition.
