  1. My wife and I received a notice to appear for interview at our local USCIS office 9/21/2015. We'll be in China for our traditional wedding/banquet during that time so we need to postpone it. The instruction says to call the national customer service center; we called twice and received conflicting instruction: First time: agent told us to mail copy of notice and a detailed explanation for the need to postponement. The agent did not specify where to mail the letter (national center? local uscis office?) so we called back the Second time: The agent told us to follow the notice's instruction, which was to call the national customer service center. She then told us since there's no specific instruction, she will put in a request to the powers to be which will take 15 to 30 business days for a decision. Does anyone know what's the right thing to do? Thanks! John

I read the following from Shusterman's Immigration Update: New Rule Will Allow Thousands to File I-485s in OctoberThanks to President Obama, a new rule will take effect onOctober 1, 2015 which will allow thousands of immigrants with backed-up priority dates in the employment-based andfamily-based categories to apply for adjustment of status (as well as for EADs and Advance Paroles) even though their priority dates are not yet current. And not only the principal immigrant but their spouses and children will be able to apply for these benefits. This is, without a doubt, the most positive executive action to benefit the legal immigration system that I have seen in the 40 years that I have been practicing immigration law!   3. Hi folks, Now that I have my wife in the States, we want to start the process for her son, my step-son, who was 20 when we got married, but over 21 by the time she got her CR-1 visa. I now have the following questions: 1. Is there any information we need to send with the I-130 application, other than the hefty check of $420? 2. About when will they request any other information, if not sent with the application? 3. Any ideas about what the current wait times are for a person to get through the que? (In other words, about how much time may it take for my step-son to get to the States? We heard it is about seven years.) 4. I will be out of the States for the next nine months, almost immediately following the I-130 submission. Would there possibly be anything too complicated for me to do over the phone with my father for getting documents to USCIS? Anything that might require a signature?
  4. Hi All, In my I-797 (notice of approval for I-129F), There's an A# number above my then fiancee's name. Is this the Alien number?   5. My wife and I are petitioning for her parents from China to adjust status. They came here on a visitor’s visa and we decided to file I-130 and I-485 simultaneously prior to overstaying the visa. Regarding the I-485, application for adjustment of status, we recently received a RFE: You have submitted a family census register, family relation register or a notarial certificate. However, the evidence you submitted does not contain the applicant's name. You must submit a family census register, family relation register or a notarial certificate that contains the applicant's name. Title 8 Code of Federal Regulations, Section 103.2(b)(2)(ii) states: Where a record does not exist, the applicant or petitioner must submit an original written statement on government letterhead establishing this from the relevant government or other authority. The statement must indicate the reason the record does not exist and indicate whether similar records for the time and place are available. It must contain the following: A legible seal A legible stamp A signature with a title containing the words: secretary, registrar or births and deaths Prior to submitting the application, we knew there would be a possible issue. My parents in law have no birth certificate, as at that time the Chinese government did not issue them. Long story short, to obtain this document, my parents in law must travel to China to obtain it in person. The catch 22 is that if they travel outside of the country now, the I-485 petition will be considered abandon. Any advice? I plan to call the USCIS customer service line tomorrow to ask some specific questions, however my experience has been this is useless. We made every attempt to obtain the required certificate from the China office before sending the petition. We wrote, signed and notarized several different letters as requested by the China notarial office. Each time we submitted a document to the china notarial office, they requested a more outlandish document instead, saying the letter they requested previously was insufficient. Finally, we submitted with the I-485 all of the letters we had made attempting to obtain the certificate from the china office, along with an explanation of why we could not obtain it, and their Chinese Family Registration Book (and of course a translation of it). Again, catch 22. We can't get the document without appearing in China in person to get it, and we can't leave the US until the request for advance parole is approved or forfeiting the I-485 petition. The last requested document from the china notarial office was a request for notarized letters from the Chinese embassy here in the US, stating that her parents are in the US and request the notarial certificate. The nearest embassy is in Chicago, 500+ miles away. As a family of 6 with a 19 month old and a 3 month old, that is a difficult request. Based on the 3 previous attempts to provide letters, they would then request a more outlandish document to provide the requested certificate. None the less, we will attempt to contact the embassy to see if they could even provide such a document. Frustrated and turning in circles with both governments.
  6. Hello, Thanks everyone for posting all the useful information. I learned a lot for my green card application:) However here are two questions that I couldn't find a clear answer for: 1. For petitioner I-864 part 6 item 13, should I try to separate my husband (petitioner)'s income from the adjusted gross income in 1040 of our joint tax return? I have my name in 6a-c of part 6, but this item 13 seems to ask for petitioner only. 2. The current I-864 is expiring on 3/31/15, so does that mean I have to mail it out before that, if I'm using this current form? Or only the signature date matters please?   8. Hello guys, I have a question about my upcoming interview. But first a bit of background. I am an American Citizen, and my wife is Chinese, living in the US for the past 5 years on an F-1 visa. When she was in college, her parents pretty much forced her to join the CCP, and she never quit. Her membership is nominal, as she has never attended any meetings, held any offices, or even paid any dues. She told me that she doesn't have to pay membership dues because she is supposed to receive some money from the party every year (which she never collected) that exceeds the party dues amount. We recently got married, and last month we filed for Adjustment of Status from F-1 to Permanent Resident. On form I-485, we truthfully indicated that she is a nominal member of the CCP. Couple of days ago, we received a notice that our case is in the "Testing and Interview" stage. My question is will the CCP issue cause any delays? I searched through the forums as well as visajourney.com, and the great majority of the folks her are adjusting from K-1, where the CCP issue is addressed during the interview in China, and a blue slip is usually given and handled before coming to the US. However, since the upcoming interview will be the first time my wife's CCP membership issue will be addressed, what should we expect going in. Also, what can we take from us that can mitigate the need for an RFE after the interview, i.e. an affidavit of sorts. Anyway, thank you for any help or insights that you may have.
  9. Hi, When I received my K-1 visa I was living in the UK. The Varicella (chickenpox) was not available. I obtained all other shots and this was included with my medical. Those were all taken when I entered the country. Do I need to get the shot before I submit my I-485? Thanks Liz
  10. I am trying to file I-485 for my dad, one of the document needed is his birth certificate. He was born in China in 1935 and no birth certificate was issued back then. He does have a notarial certificate of birth (Gong Zheng Chu) from China's Notarial Office. Does he still need to have 2 affidavits from relatives or is the notarial certificate good enough to fulfill the record of birth requirement?
  11. Since this change is took place only last month, I will post it for anyone else who has been under the same rock as I have. "Effective April 26, 2013, DHS began automating the admission process. An alien lawfully admitted or paroled into the U.S. is no longer required to be in possession of a preprinted Form I-94. A record of admission printed from the CBP website constitutes a lawful record of admission. See 8 CFR § 1.4(d)." From the US Customs and Border Protection website.
  12. Hi all. My wife had her AOS interview about a month ago and because of some problems with paperwork, my step son's interview was delayed. His interview is later this month. Any ideas on how we should prepare for his interview? His AOS is based on hers, which she already has. Not sure how an interview for him will go down or what we would need to bring. We brought marriage doc, bills....etc for my wife's. Any input would be appreciated. thanks all
  13. Hello all, I have been reading a lot about how to adjust status from K1 to green card. And I am following those steps right now. I am having a very detailed question regarding to form I-765. So I was in U.S on a student visa before. And after I graduated with the master degree, I applied for one year OPT(Optional Pratice Training) Becuase of this OPT, I had this Employment Authorization Card only valid for one year. And this was A# coming with it. My question right now is on the form there is a question asking: Have you ever applied for employment authorization before? Should I answer YES? And if yes, there are following questions as Which USCIS office? Dates? Where can I get those information? The card didnt contain that information. BTW, another general question, for my understanding so far, it might take a while to get the green card. But for the work authorization, how long does it usually take? Thanks
  14. We had our AOS interview this morning for 2 yr conditionl and I left there with mixed feelings. The very first thing I was asked was "what is your father in laws name?" I drew a complete blank. The times I have been around him I call him "Ba Ba". Then she grilled my wife about CCP. The officer misunderstood her answer but after letting my wife explain I think that part was OK The officer asked my wife how she wants her name to appear on the card. The rest of the questions went pretty well. Then she asked for evidence of our marriage and we gave her about 20 photos, a bank statement showing both our names on the account, and my health insurance statement showing she is on my health insurance. Then the officer asked me who is the beneficiary of my life insurance policy through work and I told her my wife is. She asked me for proof and I didn't have it. Then she asked if my wife is on my rental lease and I told her we haven't added her yet because our lease is up next month and we were planning to add her then. I felt really good at times during the interview and really bad at times. I got a lot of mixed feelings during this interview. The officer told us my step-son's interview is coming soon and that we can bring more documentation to that. Do you think we are sunk? thanks all
  15. We received my wife's interview letter from USCIS to schedule her interview. The letter has a LONG list of what we are to bring to the appointment. Anyone have experience with the AOS interview and the things we are REALLY supposed to bring? Alot of the things they are requesting us to bring, we have already provided to them when we applied for I-485. Also, they want me to go there and they want us to bring supporting evidence of our relationship such as joint assets...etc. The only thing we have like that is our joint bank account because we have only been married a few months. Any help you guys can provide would be greatly appreciated thank you Don
  16. Well the fourth Infoapss appointment was the charm, we found out that the CSC never scanned her paperwork into the system. So when it arrived at Buffalo they were able to process the forms up to a certain point but not finish the process. The officer said after the last appointment he just had to click 2 buttons and she would of been finished. But alas that is not my luck. So now they have to send the entire packet with his approval information by mail so it can be scanned so they can generate the paperwork to print her actual GC. They did stamp her passport for us so we can apply for her reentry permit. I just hope they will accept the copy of her passport with the stamp in it instead of the actual GC. Ohh more great news. Just received information that they transferred her paperwork to another office for processing. But the status still shows initial review. I have a bad feeling about the reentry permit application. I am so glad I have no hair on my head to pull out at this point.
  17. Well Buffalo looked at Yuan's AOS finally and sent a RFE for more information, sadly we had the whole interview packet with us last Friday when we were there for Infopass. But they could not find the paperwork, here is my list from the reply letter, please check it over and see if anything is obvious that I missed. Dear Sir or Ma’am, Please see the attached pages for the RFE for Bona fide marriage. 1. Copy of Marriage Liscense 2. Copy of Beneficiary page from Life Insurance Policy listing XXXXXX as beneficiary 3. Copy of Insurance card listing XXXXXXX and XXXXXXX as covered members 4. Copies of our Visa cards showing same Account Number 5. Bank Statement from 10-25 (Please note XXXXXXX XXXXXXX is also on this account as he will be handling our business affairs while we will be abroad). 6. Medical Bill from Jones Memorial Hospital for myself and XXXXX. 7. Copy of receipt for payment from Jones Memorial Hospital for my wife and myself 8. Copy of envelope from the Social Security Administration With XXXX's Name and our address showing 9. 2 copies of envelopes from wedding cards. 10. Picture of the first ultrasound of our baby. 11. Picture #1 Yuan and Ross at a neighbors graduation party 12. Picture #2 first visit to Niagara Falls to plan wedding 13. Picture #3,4,5 Wedding pictures 14. Picture #6 outside of restaurant for wedding reception 15. Picture 7 and 8 pictures or my visit to China to meet her family. C Congratulation card from my Aunt and Uncle on our having out first child with envelope showing address and mailing stamp Thank-you for your help as always.

  19. I-485 instructions say to make a copy of I-94 and include that in with the form. VJ says make a copy of the front and back of I-94 and submit with I-485. There is nothing on the back of my wife's I-94. Everything is on the front. Make a copy of front and back anyway? sorry for this type of question but we are pretty much ready to submit AOS and this kind of stuff...as you guys know...always seems to come up thanks all
  20. Hi all. My step son will turn 14 in about 4 months. Do we still submit everything based on him being 13 now? IE...no G-325a required for him...etc. Also, is USCIS Chicago Lockbox where we mail our AOS? thank you Don
  21. Well the infopass appointment was well worth the trip. Due to financial and medical reasons they transferred our case from CSC to our local office for processing. We now need to have an interview but should have the GC processed very soon.
  22. Hi all. When we requested my wife's social security number, we had them add my last name as she wanted to take my name. When moved her maiden name to now be used as her middle name Should she be signing all the forms as her NEW name (which includes my last name) or the name from her passport? I ask this because she has signed all the forms with her new name except for I-693. The Dr had her sign I-693 with the name that matched her passport. will this cause us a problem? thanks all
  23. Hi all. When filling out the I-864 for my wife, it asks in #9 if I am sponsoring any other family members. I assume I list my step son here. Question is...if I list him here do I also need to fill out an additional I-864 for him, including supporting tax and pay docs? thanks all
  24. Where can I go to check status of AOS? We had biometrics done in early February and 2 weeks later received a letter saying our case was sent to CSC.
  25. Hi all. We have been back in the US and married for about 10 days now. As we are now looking to start working on the AOS, is there something I need to do prior to filing? One thing that comes to mind is do we need to start getting her name added to power bill accounts, phone bills, bank account...etc to show proof that she and I live together? Appreciate the help thanks Don
