  1. Hi All - I'm mostly active on the VisaJourney website but wanted to post here to get some opinions. We already filed our K1 in November 2010 so we dont have much of an opportunity to change anything in the petition, however for the P3 and P4 I have the following concern. My divorce was finalized on November 16, 2010 and we filed the K1 11 days later on Nov 27. The basic story behind this is as follows: JoAnne and I have been seeing each other since March 2006. I moved to China in July 2008 and lived there until March 2010. In May 2010, my wife and I filed for divorce and in California there is a six month waiting period. The Divorce was final on November 16, 2010. I was contemplating using the services of a lawyer but at this point everything has been handled on our own. The question for anyone with expertise or experience here is this: Is there any thing that I should prepare in writing that describes the events and what questions related to this should JoAnne be prepared to answer during her interview at GUZ? i.e. how can I minimize this fact from becoming an issue?   2. I want to thank everyone in advance for your help. I do not know how anyone without the information from you fantastic people here can get through the Visa process!!!! These might be silly questions but I am just trying to make sure everything is in order. A little background real quick. Started talking to my lady in June of 2009. Have been to see her 3 times now. Oct of 09...national holiday, Feb of 2010......Chinese New Year, and Sept of 2010......mid autumn festival. I just got home a few days ago..haha. I am putting the package together and have these questions. 1. Should I include the receipts of places visited....Great wall, Tianamen square, some other simple places in Beijing. I have the ticket stubs of many places we visited in Beijing, Hong Kong, Macau, and Xiamen. They are more ticket stubs than receipts. 2. I am listed on the hotels that we stayed at as 1 guest. Her name does not appear on anything. Possible problem? 2a. Should I include the bill of the hotel we stayed at with receipt of payment? 3. Did you include your itinerary with your boarding passes as proof of you actually going to China? now my last question....send to Lockbox in Dallas or the address? I want to have proof of sent. I will be sending everything Fed ex...not overnight but just the cheapest. Thanks everyone again for your help. I will be starting my time line here soon.   3. I know it will take some time to process and get the NOA or NOA2 or whatever its called. Anyway, in the meantime what should I be doing?
  4. First of all is this the time when you "front load" your application? I remember reading somewhere about you only need to send in a few pictures at this time. If thats true when do i send in all the receipts, conversations and 100+ pictures? 2nd. How do you file the forms electronically when they required hand written signatures? I took the forms to her to sign while i visited. So can I just fill them out by hand and mail them in the traditional way?

  6. I sent my 129F for a K1 in August 09, received word that NVC was sending to Guangzhou in December of 09. I never received my passport or supporting documents back from the NVC/UCIS. Is this normal that they retain the petitioner's passport? I want to visit my fiancee (and need to be able to make some international travel for work), so I submitted an G884 (request for return of original documents). Does anyone have any experience how fast this return happens? And more importantly, can I assume that requesting the return of my passport won't interview with the processing of the K-1??
  7. Our I 129f was denied in July 08 and sent back to USCIS who received it on Jan. 21, 09 for review, (reason not a B/F relationship). Don't bother asking for a more detailed reason for the denial because we don't know, can only guess it may have been to short of time from last divorce, to short a time knowing each other. Only the denying VO knows the reason. Anyway my question is, in a little more than 2 months USCIS will have had it for a year. We have never heard from them during this time except to notify us they had received it. Should we just consider it has been left to expire? We since married and filed an I-130 and she has her interview on 9 Dec.09. Did the I-129f and I-130 ever cross paths while they were both at USCIS as we submitted the I-130 in Dec 08, so for a time the USCIS had both petitions. Also once my wife has had her interview, gets a visa, arrives in the US do these two petitions get combined into one file? I never heard what happens to petitions once they are left to expire at the USCIS.
  8. My wife, origanally applied for a I-129f visa. It was denied for the not a bonafide relationship, and sent back to USCIS for review, USCIS received it in Jan 09 . After we were denied, I returned to China and we were married and now have our I-130 knocking on GUZ's door, the NVC sent it to them in Aug. What should we do if in fact we get a letter from USCIS stating our I-129f has been denied or revoked, especially if she is granted a visa on our I-130? Do we just reply that we have applied for an I-130 and no longer want to continue the I-129f process. Thanks, Gary
  9. Ok I should get a Fedex package from China tomarrow morning with the G-325a from from Hui. after I have that form I will have all of the required forms and supporting documents together. Now I have been reading the term "Front loading the application". What dose this mean? I am including in the application about 10 pictures, a EOR, all the banking and tax items.... Do I need to print out and send in the E-mail, MSN chat logs and Phone records at this time or is this stuff send in with her to the interview? What should be sent now to help my application? Please wise GURUS of CFL tell me what I should do.... Robert
  10. Hi, I heard about the new electronic processing option in NVC. I am a K-1 petitioner. First I read that the new pilot program is available for the other visas, then on this forum it says the K-Visas are automatcially enrolled, then I read someone here called NVC about it two weeks ago and were told that they are sending the case electronically to GuangZhou automatically. I called NVC last night to find out more. They told me the case will be sent via DHL, the old way. I am confused and hope that they would send files to GuangZhou via electronic means. Does anyone have any experience for K-1 visas regarding the new NVC pilot program? Thanks!
  11. Our I-129F is not even approved yet and it is a rocky relationship. If we decided to cancel, how does that work, just send a letter in requesting to cancel? I will need to take time to heal, but if I found someone down the road, how long do I need to wait before I even think of filing for another beneficiary. Thanks

  13. Even though Li Hong had been separated from her husband for three years since we met, she has just recently gotten her divorce papers. No easy task sense they both live in Beijing but had to go to Changchun where they were married. It has been a couple of months and I plan on submitting my I-129F in the next few weeks. Is there any reason for concern or delay my I-129F because of this timing?? Thanks!
  14. On 03 October 2008 USCIS received my RFE. They said to expect a response with in 60 days. My question is any one here who had to submit an RFE, how long did it take to hear back from them?
  15. Hi again, I am in Shenzhen, China. Where do I get something notarized here? I keep asking my lady and she tells me she doesn't know. Also per previous topic from another member, Affidit of marriagebility, Do I need this included in the beginning process when I file the I-129F, G-325A forms? or the initial process? or Do I even need this at all?   16. I am not sure if I posted this in the right place but I am in desperate need of help. I am a convicted felon in the state of Indiana. It happened 6 years ago and it was not for any of the specific crimes listed on the I-129F form. Also, my fiancee already knows about it. Since I am a felon, will the USCIS automatically deny my petition? Are there any other felons on here that went through the Visa process? If there are, could you please help me.   17. Hi Everyone, I have a questions regarding the #2 (Address) item on I-129F. Can I give an PO Box address here? while in the G325A, I guess I cannot give the PO Box (which is alright, I can provide the current residential address). I want to receive all correspondence from USCIS at the PoBox, is that possible? Also, line #14, which asks for address where fiancee intends to live. I will give the residential address here for sure. I guess my concern is, can I give a PoBox address in line #2???? Thanks in advance. -Z

I am planning to do so this upcoming Monday or Tuesday. I want to make sure I have everything, so can you make sure I have everything I need. My list in order (front to back) from what you see: I have made two copies of everything (one for me to keep and one to send to my fiance later) Payment Check for the Application Cover Letter I-129F Application I-129F Supplement: Part B, Question 18, Explanation of Meeting In Person G-325A Forms (Petitioner) -w/ passport photo (placed in a bag attached to sheet of paper, behind G-325A form) G-325A and passport style photo (Beneficiary) -w/ passport photo (placed in a bag attached to sheet of paper, behind G-325A form) Birth certificate (Petitioner) Letter certifying intent to marry (Petitioner & Beneficiary) Proof of having met in person in the past two years: All are copies, -Passport Stamps -Airline Itinerary -Airline Boarding Passes -Photographs (placed in a bag attached to sheet of paper) -Engagement Ring Receipt Proof of ongoing relationship -Couple of pages of Emails Being the extremely overally anal person that I am, I always feel like I¡¯m missing something. Anyways, I have some final questions. -How should I send this? What carrier (UPS, FedEx) and what package options? Should I also get a tracking receipt or a ¡°receive¡± receipt or anything? -Anything else I should do/check? Thanks!
  19. My fiance Yanxia was married for a very short while, and now I need to prove to USCIS that she is divorced. I have a few questions: 1, I know that we need a notarised copy of the divorce decree form the notary office 2, we also need the translator to sign a form certifying the translation. 3, The question is do we have to have the tranlated copy notarised as well. The crux of the problem is that the divorce was in Lizhou, a small city whose notary office is unable to translate the document to English. We can get the document translated in Guangzhou but it would be a pain to then get the translated copy notarised back in Lizhou. thanks Jay

  22. Well, so begins my saga of learning the proper procedure of mailing Fiance Petition Documents. After spending over a month intently collecting the required documentation to file the I-129F petition, I had finally completed the compilation and was ready to mail. I had the address and package and promptly proceeded to the Federal Express Office, where I stood in line to get it overnighted to the Texas Service Center. There, the clerk told me that Federal Express does NOT deliver to PO boxes, but only physical addresses. I would have to use the US postal service to mail it. So, I waited out the weekend, and took it to the Post Office first thing last Monday morning, 6/6/2005. I wanted to track and confirm the package throughout it's process, but the clerk sold me the incorrect mailing package. He picked Priority Mail with signature confirmation, instead of Express Mail. I was told the the Priority Mail would take 2-3 days to arrive and I would be able to track the package and get confirmation upon it's delivery. Well, not so. I am not able to track the package, and have yet to receive confirmation of it's delivery. So, let's see....I mailed the package early morning of 6/6/2005. Today it's 6/13/2005 and no confirmation, and no proof of delivery. Very frustrating. Just a piece of information for those that correspond via US Mail to always make sure that you Express Mail and have tracking proof. Right now I have no way of knowing whether my package, with hours invested in creation, has arrived, is lost, or whatever.... ...burning up.... J & L
  23. Hi all, FF (still FF, not FH yet) from China. We got notice our 129-F was approved at CSC on Oct 14th. Now we are looking ahead to the P3, which I would guess we'll receive in a couple of months. I downloaded donahso's wonderful P3 sample packet, and on the OS-169, it contains the following statement: PLEASE READ THE FOLLOWING CAREFULLY Third: As soon as you have obtained all of the documents that apply to your case, carefully read the statement at the bottom of this form, sign and date it, and send the form to the consular office processing your case, you will not be scheduled for an appointment until you sign and return this checklist. The documents they are referring to include the I-134, the Birth Certificate, and the Police Certificate. Question #1 is: when people say "sent P3 to Guangzhou" in their signatures, are you giving the time you return the DS-230 part 1, or the time you send in the OS-169, or both? Question #2 is: it seems like it usually takes 4 & 1/2 months to get an interview from the time Guangzhou receives "the P3." Does the clock start ticking after they receive the DS-230? Or does it not start ticking until they have received both the DS-230 and the signed OS-169? Some people here have said that you don't have to get police and birth certificates until around P4 time, but... according to what it says on the OS-169, it doesn't seem like it should be possible to get a P4 until you have gotten the certificates and sent them the OS-169. The reason I ask these questions is, Fiona is still nervous about asking her work unit for the certificates. She'd like to wait until she passes her probationary period in March, and establishes better relationships with everyone at work. We're thinking we might get the P3 in January. If she waits two months to send in a signed OS-169, will that delay us a couple of months? Incidentally, we still have a couple of days to decide whether or not to abandon the I-129F and get married. These issue are related. Every time she thinks about going into work and asking for certificates, she thinks she would like to be married first. I hate to abandon an APPROVED I-129F (!) but I understand her point of view. If she has to wait a couple of months to feel "safe" enough to get the certificates from her work unit, maybe there is no advantage in continuing with the I-129F anyway. I'll be in Beijing until Saturday, so any and all opinions would be gratefully received. - FF ps. We looked on 001.com.cn to try to find a way to get the certificates without going through Fiona's work unit at the Ministry of Finance. It doesn't look good. The person at 001 in a position closest to Fiona's used forgeries! We don't want to do that.

  25. Hi Everyone, This is my first post on this site. Have a question that maybe one of you may be able to help with. I am applying for the K-1 Visa for my fiancee in China and received a Request for Additional Evidence notification in the mail recently. The wordings of this request are something like: Submit the documents the petitioner used to obtain the China Notarial Divorce Certificate between XXX and XXX. NOTE: Do not send a copy of the Notarial Certificate already received at the office. In my initail I-129F, I had submitted my fiancee's Notarized Divorce Certificate as proof of her divorce, so I'm not certain I understand what they are now looking for. The application form used to obtain the Certificate? Other additional proof of her divorce? etc.. I called up BCIS and asked for clarification and the immigration officer had no idea what the request may mean. Isn't it odd they don't even know what they want me to send?
