  1. Can anybody tell me if I can get a temporary drivers license in China. I heard you could at some airports for short stays. My wife has a car and asks me to drive when I visit her mostly on the highways. Or any other advise. ( besides don't drive in China haha ) I have a US license
  2. My wife is taking driving lessons in china and hoping to get her drivers license in the US ASAP. (It's too late to get a Chinese license, which we now realize would have been transferable.). We could show residence in Illinois because we have a joint bank account there and get our taxes mailed there. Anyway, how long does it take to get you SSN once you arrive? Is it possible to get a drivers license before you get your SSN? Thanks in advance.

  4. I was told by a chinese friend of mine that she is driving legally in Chicago IL using her Chinese drivers license. I didn't believe her. She told me that her husband had checked on this and found that she could legally drive in the US (using her Chinese drivers license) for up to 2 years. To validate her story - she told me that she was pulled over for speeding in Chicago a few weeks ago and that the police officer did not cite her for driving without a drivers license - that he only gave her a warning ticket for the speeding violation. She has been in the states for almost 2 years so far. This all sounds a bit crazy to me because a Chinese drivers license is completely written in Chinese - How would an officer in the states even know it is a drivers license??? Does anybody know about this FOR REAL??? What is the TRUTH to thre use of a Chinese drivers license here in the states? Are some states different or do they all use the same guidelines? Thanks, Scott
  5. I took my wife for her written drivers license test yesterday in Tennessee. I took all the information required on the Tennessee drivers testing website. Once at the testing center we were told that my wife cannot apply for a drivers license because her visa has expired. My wife arrived in the US on March 26, 2009 on a K1 visa, we were married on April 25, 2009. My wife¡¯s visa expiration date is September 16, 2009. The drivers license testing center will not consider any date beyond the June 25, 2009 date shown on the I-94. I told them the June 25 date no longer applies since we were married within the ninety days but they said whether we are married or not means nothing to them, only the date on the I-94. I showed them our biometrics appointment letter (July 21) but they said this means nothing to them. My wife can only apply for a drivers license when she gets a new visa. She is not happy with this answer. Has anyone else had a similar experience? If so what did you do and/or is there anything we can do?
  6. Li got her driver’s permit today. In Beaumont TX or Houston TX it depends who you talk to if you can use an electronic translator. The first time we went to Beaumont driver’s license place the lady told us what papers we would need and I asked her if Li could use her electronic translator to take her test. The lady said yes she could. We went back the next day with the correct paper work. We got a different lady there so Li asked her if she could use her electronic translator the lady asked the lady next to her and she said it is up to you. So she asked her boss the boss said no. The boss said she could use a paper dictionary. Li took her test without anything. She did not pass had a score of 65. In TX they only have Spanish and English test. So today we went to Houston TX to take her test. I asked the lady if Li could use a electronic dictionary. She said she did not know so she went and ask someone and came back and said she could use it. So Li took her test and passed with an 84. So now comes the fun part and teaching her how to drive.
  7. Several weeks ago the local Tennessee Drivers License Testing Center refused to allow my wife to take her written test. They said her visa had expired and even though we were in the process of adjusting her status she could not take her test until she received her new visa. Following is the response I received from my e-mail to the TDL main office. As you can see, the local office is wrong again!!! This applies to Tennessee but anyone preparing to take the DL test should check with the main DL office in their state and go armed with the correct information before attempting to take the DL test. "I apologize for the confusion you encountered at the local driver license testing center in Sevierville. The requirements vary slightly for how to process someone in a K1 status with expired I-94 and it appears the examiners may not have been familiar with this process. When the I-94 has expired the applicant must provide the I-797 Notice of Action showing that USCIS has received the application for conditional residency/adjustment of status. As long as you have this I-797 along with the passport, expired I-94 and the certified marriage certificate your wife would qualify to apply for the Temporary Driver License (TDL). If your wife passes the required exams she will be issued a one (1) year TDL. During that year she should receive her conditional resident card that will be valid for 2 years. Once she has received that 2 year card she can return to the driver testing center and get the TDL renewed until the expiration date as shown on the conditional resident card. (Note: She can choose to wait until the 1 year expiration to renew but the length of time issued and cost for the renewal will remain the same under either course of action.) After the duration of the 2 year conditional residency period your wife will be eligible to renew/upgrade to a full permanent Tennessee Driver License (DL). She will again be required to provide the documentation (I-797) from USCIS showing that her application for "removal of conditions" has been APPROVED. (Note: If her TDL is expiring and she has not yet been approved by USCIS she may renew the TDL for another 1 year period as long as she has an I-797 showing USCIS has received her application for removal of conditions and/or an I-797 showing her conditional residency has been extended for 1 year.) The I-797 along with her valid (or expiring/expired) conditional resident card will be required at the time of this renewal/upgrade." Hope this helps someone.

We got June's SSN last week and went down to the DMV to see about getting her an instructional permit for driving in TX but they pointed out we had to have an "unexpired form I-94 with a defined expiration date: Form I-94 must have been issued for a period of at least one year and have at least six months validity remaining." On the K1 visa, you only get 90 days on the I-94. We pointed out that we are married and that according to the INS, she is in the country legally as she waits for the AOS with intention of family-based immigration. We were told we don't have acceptable identification documentation for getting her a drivers license in Texas. Oh and they said it made no difference that she had a driver's license in China. She still has to start from square one. So, it seems that the only way we can get what the DMV requires on the I-94 is if we wait out the AOS approval and get her green card or EAD right? Gosh, so she will be unable to drive for several months according to the wait times at the Texas processing office, right? That's a real hardship on us. Somebody please tell me there is an angle I am not seeing here. P.S. This is new regulation that was enacted as of March 2008 in Texas. Thanks a bunch!
  9. This is what is on a web site for getting a drivers license Proofs of Identity Foreign passport - in English and with a U.S. Visa and valid I-94 or unexpired I-155 stamp attached. If not in English, a certified translation by the embassy or consulate of the issuing country is required. For details, see the publication Proofs of Identity (ID-44). From what I am reading it is off to the embassy for more translation. With a k-1 visa I-94 is valid for how long. It seems trying to get a drivers license is almost as hard as getting a visa What is the issuing country China for passport or US for visa?
  10. Today I received information from the State of Indiana on what documentation is necessary for my SO to obtain a drivers license in the State of Indiana. Below is list of what is needed. (A lot of what is listed below is not applicable to our SO's, but I decided to include everything on the list since each of our cases are different.) Although each state may have some different requirements my past experience in dealing with state government agencies is that has shown me that they are notorious for plagiarizing what other states have done. So this list may be pretty close to what your state will require. Indiana Bureau of Motor Vehicles Document List PRIMARY DOMUMENTS Must present one (1) document Primary Group- Acceptable Immigration Documents Valid foriegn passport with photo with a visa that includes form I-94 indictating the authorized duration of stay in the United States. Valid foriegn passport with a current visa that states "Upon Endorsement Serves as Temporary I-551 evidencing Permanent Residence for 1 year" Canadian passports are not required to have a visa or a form I-94 Applicants from the Federated States of Micronesia & the Republic of the Marshall Islands are not required to present a visa but must submit a form I-94. Passports with I-94 indicating F-1/F-2 status must provide a valid I-20 ("Certificate of Eligilibility"). For these applicants, the form I-20 serves as a secondary document. Passports with I-94 indictating J-1/J-2 status must be submitted with a valid form DS-2019 ("Certificate of Eligilibility"). For these applicants the form DS-2019 serves as a secondary document. Authorization for parole of an alien into the United States (form I-512). Employment authorization card (I-688B). Employment authorization card (I-766). Form I-94 stamped with "Section 207" refugee status. Form I-94 stamped with "Section 208" asylum status. Permanent resident card (I-551). Temporary I-551 stamp with passport or I-94 with alien number. Temporary resident card (I-688) Travel document (I-131). An I-797 "Notice of Action" including an applicants "Approval Notice" may be used to extend the validity of an original primary document. ============================================================== SECONDARY DOCUMENTS Must present one (1) document Any document from the list of Primary Documents may be used as a Secondary Document. Certified academic transcripts from schools in the United States and it's territories. School report card dated within 12 months of the application. School identification card with a phtot or yearbook within three (3) years of application. An identification card with photo issued by a foreign consulate. An identification card with photo issued by the federal government. An Indiana identification card. A drivers license , identification card, or permit with photo issued by another state. Original driving record from another state. Valid form I-20 with a valid form I-94 and a F1/F2 status in passport. Valid form DS-2019 with a form I-94 and a J1/J2 status in passport. Indiana county pre-sentence investigation report with clerk stamp or seal. Indiana gun permit. Indiana probation identification with photo, name and date of birth. Letter from probation officar, caseworker or social worker on official letterhead, certified with stamp or seal with the applicant's name and signature of the probation officer, caseworker or social worker. Prison release documentation (Yeah hanging out as the womens prison on parole day is how I meet all my women.) U.S. District Court pre-sentence investigation report. (If you haven't been sentenced yet aren't you being overly optimistic about whether you will even be on the street to use your new drivers license?) Valid banking card or MasterCard, Visa, American Express or Discover card issued in the name of the applicant with his or her signature. Bank statement issued within sixty (60) days of application. From W-2 (federal or state) or From 1099 with applicants name and address. Valid employee identification card with photo. Valid Indiana professional license. Valid insurance card. Medicare or Medicaid card. Divorce decree certified by court of law with stamp or seal. Application of Marriage or Record of Marriage that is certified with stamp or seal. ==================================================================== Social Security Number Documents Must present one (1) document for all NEW issuances Required by Indiana State and Federal law for all license and permit transactions. Social Security card. Social Security card bearing the legend "Valid for Work Only with DHS Authorization Social Security card bearing the legend "Not Valid for Employment" Numident report - stamped and issued in the applicant's name by the Social Security Administration. Letter verifying the applicants Social Security Number issued in the applicant's name, signed and stamped by the SSA.
  11. my so received her ead on dec. 31st and on jan. 3rd she took and passed her dl test but they wouldnt issue her dl because they couldnt verify her immigration status thru the save system. we returned on jan. 13th as instructed and still no save verification. i was wondering if anyone else had this problem or knows how long it should take for the save verification process? is there anything i can do to speed things up?
  12. We have recently filed and sent out our AOS forms. My wifes (k-1 visa holder) I-94 expired on 11/27/08, which is 3 months after her entry into the U.S. Is she going to encounter problems at the DMV, with an expired I-94? Thanks for your help!
  13. well we are finding out first hand that your EAD is not only your working permit but alot more. its the only dated identification that matters before you have your GC. i dont know about other states but as far as florida you can not get your DL without either your non expired original k1 visa, or your non expired EAD. So now we wait till her EAD comes in order to renew her drivers license. what a freakin head ache. we would have had her EAD already but they could not find her in the system and sent it all back saying you need to file AOS in order to file for EAD. we sent a copy of the AOS and recieved the NOA for the EAD. im hoping she can get a 30 day permit to hang over the access time it takes for EAD to get here. ive really become an expert waiter.

Last week Lisa passed her driving test with a perfect score What it all got down to was for me to get out of the car and out of the way so she could finally fiqure out on her own how to parrell park and to back up for some distance . So now there aren't any DWA jokes in the household and Lisa's getting her own license has really made life easier for everyone here. She actually had driven over 2 thousand miles during the last 2 months and the daily driving made the big difference to improve her skills . She now is comforable with driving a car
  15. My wife was able to get her drivers permit the same day we sent in our AOS documents. They only granted it until January 8, which is the day the I-94 expires. We have attempted to extend this by showing the 797c (the receipt notice) and our notice to appear at our initial interview which is after the i 94 expires. The DMV will not grant/or extend id cards, drivers licenses, learner's permits until they get proof she's allowed to be here. They will accept EAD cards, Permenant Residence cards and approved 797(notice of approval) but they won't accept a 797c. Has any body had this problem and are there any ways to get around this? we're in california. Also, will she not get her EAD card until after the initial interview we have scheduled for jan 31? thanks happy holidays

But she does not speak english - at least not enough. Do they issue drivers licenses to such persons? How do we get around the language barrier? Thanks, Scott
  17. If you have a valid PRC license, do you need to take the road test and written test in Florida to get a Florida license? Tried to call Florida Dept of Motor Vehicles and have been "on hold" for well over 5 hours over the parts of the last 3 days so I have used up all my cell phone minutes for the month. Thought someone might know the answer here. My wife had a Chinese drivers license and let it lapse. She lived in the big city and didn't have a car. She is going back to China for a visit this summer and thinks she can learn faster from a Chinese speaking driving instructor. "Other Chinese women here in the USA" (that she knows in other states) said she will have great difficulty understanding the road test examiner. She hopes to avoid the Florida road test because they failed the road test due to nerves and not understanding the examiner. I understand that getting a drivers license in China is probably not going to make her a safe driver in America. Also I intend to buckle up and ride shotgun for the first six months or however long it takes for her to become a safe driver in the USA. Just wondering if it makes sense for her to get her PRC license while she is in China as a way to avoid the road test. She is sharp and will have no problems passing the written test and I can teach her the road part over time and am willing to do it. We only have one car so as a practical matter she can't drive without me in the car anyway. Just trying to calm her since "other Chinese women here in the USA" said she will have great difficulty understanding the road test examiner. And we all know anything said by "another Chinese woman here in America" is taken with the weight of Moses commandments carved into stone. Anyone know? Ideas?   18. Wife needs to go to China for extended period. We will apply for a 2-year Reentry Permit with I-131, it looks like. I guess I will send a photo copy of her drivers license for the first one. Copy of Green Card. What is this Biographic pages of her passport? Got the visa in her old passport and the stamp when she entered. Or does this simply mean the front dang page of her passport with picture and Chinese stuff?

  21. I applied for the AOS and EAD for my fiancee and her daughter prior to the 90 day expiration of her K1 visa. They each received 2 notices for biometrics. One for the EAD and the other for the AOS. Her drivers license is expired since in Florida they only allow the license for the expiration of the visa. Her biometric appt is in mid August but they will not even provide anything in writing to show this. What can I do? Also my stepdaughter is 7 and they even have a biometric appt for her. I am going to have her go however, my understanding is that this was not required.
  22. I filed the AOS for my wife and her daughter on May 20th. I sent it Express Mail and was received a few days later. Her drivers license in FLA will expire next month. Will I receive something shortly than I can use to extend her license. Her K1 visa is to expire next month. How do I obtain something to show FL DMV? Do they send an acknowledgement?

First hope I spelled it correct, has anyone heard of getting an international licensce,? one that is good for a number of countrys, the wife meantioned she could get one so she could drive in China along with the U.S. Eric may know more about this, how about you Owen or anyone else on this subject, I know people come from Germany and drive here without a problem.
  25. Hello everyone. I have been reading that if an LPR spends more than six months consecutively outside the USA, the immigration officer at the US entry checkpoint may question them regarding their “intention to abandon their LPR status in the USA”. My wife has been in china for nearly 7 months. We knew for certain her trip would be under a year, so maybe a bit naïvely on our part, did not file for a re-entry permit. We did not realize this may become an issue. Some back info: My wife is an LPR, and we are in the middle of removing conditions. She has, and is fully within the NOA I-751 extension letter parameters for her green card validity. My wife returned to China Febraury 26th, and will return September 21st with myself, and 3 of my friends from the USA. Originally she intended to return early July, but varying items came up that delayed her return: My wife makes money teaching & tutoring English to Chinese children. She returned to China end of February to renew her Chinese teaching license, and complete becoming fully TESOL certified. The process should have taken about 3-4 months. Furthermore we have been married for 3.5 years, but have been so busy we have not had time yet to hold a substantial wedding ceremony. We were planning to finish the trip by holding a larger wedding ceremony in her home town (Chongqing), and both returning in early July. Per her family tradition, they visited a fortune teller that told us we need to have our wedding September 16th. So, we obliged to keep her parents happy. We have our ceremony planed for September 16th, and a small vacation planned with her family, friends, and some of my friends that are coming from the USA as well. We decided that instead of spending the extra $1500 on a flight to return for 1-2 months, we would just wait it out, this also allowing her to attend to some business matters before returning. I have decided to bring some basic documentation (our apartment lease, US credit cards with her name on it, drivers license, ceremony pics, etc.) to show as evidence of being anchored / established in the USA. Has anyone / or their loved ones experienced being questioned about abandoning their LPR status in the USA? Can she potentially be denied entry, or do we need to plea at a later day in immigration court?? Any input for proper documentation to bring? Many thanks in advance to everyone.
