Intentionally delaying the interview is a very bad thing to do. Keep in mind once the I-94 expires, the applicant's status here is only legal while the case is being adjudicated . Basically, the applicant is only allowed to be here because the gov't knows it takes them time to process the application. This status basically expires once the case has been adjudicated. Of course if the application is approved the applicant becomes a permanent resident. But if it is denied the applicant must leave the country. The applicants status can expire before the EAD card does. So, an applicant who seems to want to delay adjudication is sending a strong signal that they believe they will have to leave once the case is decided. I understand where you are coming from but, don't risk it.

is the only road block in financial aid? To receive Federal Financial one needs to be a citizen or permanent resident- certain refugees qualify too. There are always private loans, etc.

my wife studied on a k1 at a community college. they just needed legal presence verificaition and the i-94 was sufficient. Check to see what their policies are after the I-94 expires so she doesn't have to drop mid semester. out of state tuition though. but a good thing for her to have the opportunity to do something before the Ead comes

as far as i can tell me wife is now a permanent resident. we got the welcome letter today. card should be in the mail within 3 weeks. i guess we got lucky, it actually took only three months after applying and 4 months after being married. this included an rfe during the adjustment. and if you look at our timeline you will see that her travel document and ead card came only weeks before pr. i guess that was a waste of 350 $. The interview for aos was a joke, it was much less stressful than the one at guangzhou. i'll post on it later, but as long as you guys live with your wives/husbands don't worry about it, just bring the appropriate docs. My wife was able to get her drivers permit the same day we sent in our AOS documents. They only granted it until January 8, which is the day the I-94 expires. We have attempted to extend this by showing the 797c (the receipt notice) and our notice to appear at our initial interview which is after the i 94 expires. The DMV will not grant/or extend id cards, drivers licenses, learner's permits until they get proof she's allowed to be here. They will accept EAD cards, Permenant Residence cards and approved 797(notice of approval) but they won't accept a 797c. Has any body had this problem and are there any ways to get around this? we're in california. Also, will she not get her EAD card until after the initial interview we have scheduled for jan 31? thanks happy holidays

i got the frequest for initial evidence. I am a tad bit confused. my situtation is i am student who didn't make any money in 2005 and am not currently employed. However, my father is a joint sponsor and his income is adequate. I included my taxes, but no w2's or 1099. my taxes had me earning a small amount of interest. i also do not have an employment letter. however, i included my father's w2 and letter of employment. the request was for. F. (40). sponsor's or joint sponsor (if required) on Form I 0864 Affidavit of Support must submit the following. . w-2's , and 1099 . evidence of current employemnt . federal income tax for most recent year. So basically, the joint sponsor submitted them, but I as the sponsor do not have the first two. Is there a problem? Secondly, the Fequest for inital Evidence also stated the following: "you are ineligible for intermim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2((10)(ii) until 90 days after the missing initial evidence is received." does that mean that my spouse can't get an ead card until 90 days after the get this information? that is not very good

don't know what it could be. we certainly included i 693 vaccination supplement. My SO's left arm was the size of mine for about a week. of course it could have been lost. The customer service guy was saying he thinks it may be a request for criminal history of me in compliance with marriage brokers act. Don't know why that would come into play because we're already married. (either way there is no criminal history). Just throwing out ideas while i wait i'll let you know

I checked online to see the status of our 485 application. It said request for additional evidence. I called the hotline and they said wait for mail. my mail is very slow and am often not getting lots of mail. Is there a way i can find out what evidence is requested? Also, our receipt number is for the missouri office. But we live just outside San Francisco. Any advice. I thought we were through with all the crap. Guess we never will be.

I will mail an application for ap (131) along with 485 and 765. the form says to write on a separate sheet of paper the reasons for requesting ap. No emergency as of now. Mostly so she has opportunity to return to china, in case pr takes too long. Her uncle and grandfather may have health issues come up. so applying in advance is our plan. Does anyone have a template for this? I couldn't find one on visa journey. thanks

My so applied for a ssn. we should get it in about 2 weeks. in the meantime i am filing out the aos documents. under the questions for ssn's what should i list? we don't have one now, but will get a number soon as the application is pending?

My So and 6 month old puppy will be arriving on tuesday. i'll let you know of any problems. you can ship the dog as cargo, the catch is China requires an agent to handle this an dthey charge high prices, probably 2,000 dollars. Our puppy is flying as excess baggae at a cost of 100 dollars. For the "k9" visa... it takes one week (so long as the dog has been vaccinated properly by an authorized Chinese veterinarian at least thrity days prior). The k9 visa applicant (dog) must go to a Chinese animal export place (get the local number from an airline) and receive a physical and get injected with a identification tag. It costs about 100$ in Shanghai.

Photo copy the back regardless of it is blank and just explain that it's blank. One good place is to do this is very briefly in a cover letter. Try to write short sentences that can explain anything that might cause a adjudicator to think something's off. For example, ....#1.A Completed I 129F.....#3)A copy of petitioner's birth certificate. (Please note: South Dakota's birth certificates do not contain writting on the back). This may also be a good place to explain why there's no certificate number. A comprehensive cover letter that explains everything greatly minimizes the chances of gettign a request for more evidence. Just to let you know..... make sure you include the following 1. Photocopies ofVisa stamps of you entering China. (if possible, but not necessary include boarding passes, if you don't have these find something close and explain why you don't have them in the cover letter). 2. Make sure the photos are of the exact size they ask for. 3. If you don't get a notice of receipt within two weeks be sure to call uscis. Believe it or not there shouldn't be too much of a problem at this stage so long as you follow instructions.

Don't worry, It is only important to show that you were in China (and met your fiancee). Your U.S. stamps are irrelevant anyway

Definitely report him to USCIS. Hopefully some jail time would be in order. we can all thank guys like this for making our lives harder. if you Write a letter to his employer whether it be his union or company be very careful. must be accurate otherwise you can get a slander suit against you in return. even if you win a slander suit against you, attorneys fees wolud be expensive (you can't get a contigency fee in a defense of a slander suit) as for what you would sue him for in civil court.. don't know.... maybe under some kind of breach of an implied contract. Maybe there is some form of action under some trafficking humans related laws....Intentional, or at least negligent, infliction of emotional distress may work. Definitely talk with an attorney. There must be some way to at least get expenses in return. see if there is an asian legal center in the area. these non profit organizations usually deal with stuff like this.
