  1. Does not happen very frequently, but they do make special considerations for our boys in uniform. It is very possible to have it done during the info pass if they can accommodate you, so I would follow Dan's advise.
  2. Thanks, C4, I had read that link, which makes me think the lawyer was misinformed, but then on another uscis site (Guide to Citizenship) it stated this:(Note the bold underlined "ALL") U.S. CITIZENSHIP FOR CHILDREN Questions and answers about the U.S. Citizenship laws for children, place of birth and how that affects their U.S. Citizenship, information you need to know about the Child Citizenship Act of 2000, and much more. 1.If I am a U.S. citizen, is my child a U.S. citizen? A child who is born in the United States, or born abroad to a U.S. citizen(s) who lived in (or came to) the United States for the required period of time prior to the child's birth, is generally considered a U.S. citizen at birth. A child who is: ◦Born to a U.S. citizen who did not live in (or come to) the United States for therequired period of time prior to the child's birth, or ◦Born to one U.S. citizen parent and one alien parent or two alien parents who naturalize after the child's birth, or ◦Adopted (stepchildren cannot derive or acquire citizenship through their stepparents) and is permanently residing in the United States can become a U.S. citizen by action of law on the date on which all of the following requirements have been met: ■The child was lawfully admitted for permanent residence*; and ■Either parent was a United States citizen by birth or naturalization**; and ■The child was still under 18 years of age; and ■The child was not married; and ■The child was the parent's legitimate child or was legitimated by the parent before the child's 16th birthday (children born out of wedlock who were not legitimated before their 16th birthday do not derive United States citizenship through their father); and ■If adopted, the child met the requirements of section 101(B)(1)(E) or (F) of the Immigration and Nationality Act (INA) and has had a full and final adoption; and ■The child was residing in the United States in the legal custody of the U.S. citizen parent (this includes joint custody); and ■The child was residing in the United States in the physical custody of the U.S. citizen parent. I think this is where this lawyer was getting her info. My wife doesn't want citizenship at this time, because she's a property owner in shenzhen. I PM'd Lee Fisher earlier. We'd like to get citizenship for the boy as quickly as possible since he's starting college next year. I'm afraid I may have dropped the ball on this by not adopting him sooner. Yeah, it is rather confusing. Before, they had a statement about needing to adopt before 16 listed in the N-600 instructions. What we need to know is the statement about legitimizing the child, include adoption or not. The way I read it, it is all about children born out of wedlock. That's why I think a call or info pass is in order. The more I read on the internet, the more I think it applies to adopted children as well. So it may be too late.
  3. Here is what the USCIS says about adoption through parents. USCIS Citizen through Adoption Requirements N-600 Instructions I know when Lee Fisher went through this process, the forms all said under 16 for adoption. I know cause we thought of bring my wife's son to live with us. We thought about this process. The legitimating is talking about a child born out of marriage. Totally different than what you are wanting to do. They have a statement that says the laws have changed over the years. It appears to me the age limit has been raised to 18 for adoptions. I think this is worth a call to USCIS or an info pass to double check the rules. Contact USCIS
  4. The issuance of visas is all about intent. The reason for many to get denied a visitor visa is because they assume an intent to immigrate. If you use a visa with the incorrect intent, it makes it that much harder get another visa. Here is the definition of a K1 visa as stated by the Department of State. If you do not intent to immigrate to the US than it is best to use another type of visa. The argument the consulate will use is, "Last time you told us you were going to immigrate, but did not. Why should we believe you this time?" You will also find that when you use a visa for its intended purpose, you will get another visa much easier. They will tend to believe you that much easier.
  5. Yes - you need to figure out what happened to her green card that was mailed to her within a month of her arrival. If you can't find it, you may need to apply for a replacement with the I-90 form. I thought that for the first year and 9 months she was here, she was a "conditional residence" and that we can't apply for her green card until within 3 months of the second anniversary of her getting her CR-1 visa...which would be next spring...OVERALL THOUGH I AM TOTALLY CONFUSED BY THE ENTIRE PROCESS...AND COULD USE AANYHELP I CAN GET..???? The visa has nothing to do with this now. It is only to travel to the US once. Any one who arrives on a CR1 visa is mailed a two year conditional green card upon arrival to the US. She should not have left the country without this green card in hand. She will not be able to return without it or some form of travel document. If she has the two year card they mailed, then it is still a green card and good for entry back to the US. It is not, it is not impossible to get this problem resolved. Two things you can do. File an I-90 for replacement of the green card, then FedEx it to her or have her visit the USCIS Beijing Field Office to see what she can do to get a travel document.
  6. This has been talked about before. My wife and I also did some research as we wanted to bring our nephew to come live with us. Bottom line... there to no way to make this happen.
  7. More like a scam as they get $100 for every denial. We quit after the second one. Mom and Dad are with us now. Won't let them visit. Fine. Immigration it was.. Goes pretty fast and they can stay as long as they want.
  8. What your research found limiting to only Ultimate or Enterprise edition is called "Language Packs". This is so you can completely change your regional settings. The computer desktop, program interface.. essentially everything would be in Chinese. This is different from what you are looking for which is "Language Support". Chinese language support, as others have mentioned, is available on all versions of Windows 7. This allows you to read Chinese. You can also write Chinese with either the built in IMEs (Input Method Editor) or other IME programs like King Soft. I would recommend King Soft myself as my wife hates the Microsoft version. She uses an IME called "Wubi" which is similar to how a stenographer types. She inputs shorthand and flies through typing emails. It was a method she learned in college. When she doesn't use this one she prefers Kingsoft.
  9. I don't get the impression that GUZ asked for the house mortgage documentation but rather that his wife suspects his name still being on the note along with his ex-wife, i.e. meaning they still legally own the property jointly, might be part of the reason for the blue slip. Actually in case of a divorce the court will file a Quit Claim Deed. This will confirm the ownership to one party and absolve the other from being able to make any claims against the property. So the property belongs strictly to his ex. The bank does not care squat about ownership once it has a signed mortgage. It has a document which says, both parties are responsible to pay. The OP needs to push for the ex to refinance. The bank will never release one party from the mortgage. As Lee stated, the only way for one party to be removed from the mortgage is for the other party to refinance. This should have been pushed for as part of the divorce. It is also very possible the ex can not secure a refinance by herself. This means the OP may not get off the mortgage for some time. This happens all the time, so I would be surprised if GUZ would use this against the OP.
  10. Yes, it is important for the wife to be able to inject some Chinese ideas into the marriage. It is also critical for the husband to be involved in the marriage. By this I mean fully involved. You are already on your way because you are searching for how to do this before she comes to the US. I will respond to David's points and show how I worked on these problems. 1. First off, know who you married. Is she a city gal or is she a country gal? Chances are if you met online she will be a city gal. You can't expect her to sit home while husband is working. She will be bored to death and will not feel she is participating in the marriage. I signed my wife up for ESL classes downtown, bought her a monthly bus pass and showed her how to ride the bus/light rail around Portland. She went to class four days a week. This got her out of the house and major side effect is she made some friends. She was also able to go anywhere she wanted on bus or light rail. Within a month she had a job. 2. Listen to her very carefully. You don't need to relinquish the finances to her, but you had better listen. My wife hates paying the bank for anything. This means get rid of the credit cards. Go onto a cash only basis. This is the way they live in China, this is the way they will expect finances here to be handled. We came to a compromise. I hold two credit cards. Delta Sky miles Gold Card. The biggest reason she agreed to this was the way I handle payments. It is paid off at the end of every month so we pay zero in finance charges. The second bonus is that it brought her parents here for $60. Can't beat that. She has her way with our finances and she has her parents here. Now I am not saying this will work for your marriage as every marriage and each Chinese lady is different. The key here is to listen very carefully to what your wife needs. She is a Chinese Lady, she will not be bashful about telling you. 3. Take care of what she needs. Absolutely, another key factor in a successful marriage. You may not need to take care of her for one month after baby. Again, each lady if different. My wife went back to work within a week or two after our first was born. She plans on returning to school less than a week after our second. I do have to be a very active Dad. I am involved in his feeding and changing his diapers. On weekends I let my wife have an afternoon of sleep. I take care of everything the baby needs. Food, changing and rocking to sleep. Again, talk with your wife and listen to what she needs. Many Chinese ladies think she is crazy not to rest for at least a month. gotta go.. have to burp the baby.....
  11. Make sure and get her transcripts. She will need her current license. Right now, you need to do some research as requirements vary from state to state. Oregon has something called "Re-Entry Program". Here is the information about this program. It is designed so foreign nurses do not have to go back and attend a full curriculum of nursing school. They will test or update their skill set and teach them Oregon Law pertaining to nursing. Your state should have something similar.
  12. You will want to send some emails and chat logs. I sent in the print out from Outlook which showed the volume of emails we exchanged. Then I selected about 20 key ones throughout our relationship. It is important that they show the progression of your relationship, at what point you decided to marry and why the two of you feel you are a good match. Think about which 20 provide the most proof of a bonafide relationship. This is why including emails are important. They can help your case immensely. Also, make sure to include photos of the two of you together, these should also show the two of you with family and friends. They don't need to be anything fancy. I printed mine out on plain paper six to a page. I sent in around 20 -30. Make sure to label and date them. I included photos from our engagement party. Think of how to convince someone who has never met you, that the two of you are meant for each other and should not be kept apart. This is your second goal with this application. The VO will have this file in there hands at time of interview. Include anything you want the VO to be aware of during this time. There are many items they will not accept at interview time. This is when you get a blue slip and what you are trying to avoid. Don't leave them guessing. Include enough to help steer them in your favor. So it looks like you did good in what you included. You can rest easy on this part.
  13. Which just proves you aren't stupid afterall. Hang in there Yemmie, I have every confidence Mike will get you fixed up. I bet if we took a vote this would be the most intelligent thing any husband here could do. I ran across this kind of setup up with one of our customers. Had some very similar issues with Vonage. So it is not the phone service, just having two routers on one network. Okay, so they can't give you an SP-1001. You should be able to disable the DHCP services on the SP-2102. Next set the network port to a static address on your network. This will basically turn off the router abilities of the SP-2102 turning it into a network switch and place it on your normal network. This should give the SP-2102 better access to the internet. I would try this with your old SP-2102 you plan on sending back. This way if it really messes up the configuration, you have an easy way to set it back. Not necessarily to get it to working, but to make sure it is set the way ITalkbb wants it. This is important when asking for further help. I know I probably mentioned some things outside of your normal vocabulary. If you need someone to help you change these settings a remote session is always possible.
  14. Hi£¬ same router as you MI 424-WR. On a speed test it downloads at about 15 MB, uploads at about 5MB. I believe the plan calls for the same as you as well. We may be getting down to the issue. What device do you have from ITalkbb. Is it a Linksys SPA1001 or an SPA2102 Sounds like the router SPA2102? Usually not a good idea to have two routers on the same network, unless you are sub-netting. When you have two, usually it is best to turn off some capabilities of one which turns it basically into a network switch. I opted to get just the Analog Telephone Adapter (Linksys SPA1001) from ITalkbb. I did not want an additional router on my network. As you can tell, the firewalls and other protocols will fight each other. Best to avoid the configuration nightmares you can have with this setup. I would see if ITalkbb will change your router for just an Analog Telephone Adapter.
  15. Somethings things come along that help you to reassess how you live your life. My wife has always been, "Let's save money. Want to buy a big house. Don't need to go any where or do any thing. Work Hard and Save." Recently, my blood test showed an elevated PSA level. For those of you who are not familiar. This is the blood test that screens for prostate cancer. So my doctor recommended I see a urology specialist. The specialist said, his scope showed signs of growths on my prostrate. He took some biopsies this last Monday. Can you say, "NO FUN !!!" Then of course comes the unbearable wait. Your mind plays out all sorts of what ifs. What am I gonna do. How am I gonna make sure she and my sons are taken care of. Well, the call came in yesterday. Phew!!! The tests were negative. Yeah, that's right. This is the time negative is really good!!!! Get home. Tell my wife. We talk a little bit. She has watched some of our friends who have lots of money, big house, do nothing and get very little enjoyment out of life. He is always gone. They never do anything. Yet they have a big house. She has also seen some other friends who scrap to make ends meat, they don't have much to save. They are always on the go, traveling together to see family. They do not own a house, but they enjoy the hell out of life. Now my wife is. Screw the big house. Let's go some where next year. I want to enjoy our life together. Let's go to Europe. Well, we talk and have decide maybe that's a little more than we can manage. But we can definately take son to San Diego. See the Zoo, Sea World and just have some fun. A bright blaring reminder just how mortal we are and how little control we have over life. Amazing how a little scare puts some perspective back in your life. BTW ... For those of us over 50... Don't forget to have your blood test done.....
  16. Lets start at the basics. What model router do you currently have? What is the download / upload speeds on your plan. My router is an Actiontec Wireless MI424-WR. My speeds are 15MB down / 2MB up.
  17. I had Comcast for a long time. Hooked up Italk on it and my wife would always complain about the connection when calling China. I switch to Verizon FIOS for years. Never had any problems. It was so much better than Comcast. ITalkbb is crystal clear. Like you are next door. Even when calling China. Have you tested your download / upload speeds to make sure you are getting what you are paying for? What package did you sign up for? 5MB, 15MB or 20MB? I would not run ITalk or any VoIP on any connection less than 10MB. I did a test shortly after install. Verizon had to make some changes to get the speeds correct. It wasn't much faster than Comcast at the start. Once Verizon made the adjustments it started flying. I am in Oregon. Verizon FIOS here is now Frontier. Same great connection.
  18. You can also use this search page to find a walk in service in your area. Most City Governments in our area offer this service. They should have one in yours. http://iafdb.travel.state.gov/ Also, don't worry. You will not be giving them your Citizenship Papers. They only need a copy. Even if you mailed it, you would only mail a copy. Never give any one your Naturalization Papers. Only give them a copy !!!!
  19. Remember, China has 3.2 billion people. This creates a big problem with keeping a surplus of workforce busy. So they create ways to need people. Carl always mentions that he is amazed to see construction sites where they will demolish a building, then instead of bringing in a scoop and a dump truck ( 2 people) they bring in wheel barrows and shifts of 100's of people for the clean up. Actually pretty smart on their part. If you don't keep enough people busy which can equate to feeding the masses, then you lay the ground work for revolutions.
  20. I am not sure if this is the right forum, but as Delta Sky miles member, I have an American Express SkyMiles Card. The new announcement this month is that American Express now offers Chinese Yuan Travelers Cheques. It says they are exchanged for local currency at Bank of China. Not sure what the exchange rate is, but they say it is better than Chinese Yuan cash. Another option in taking money to China. The nice thing has always been if stolen they are replaceable. Might be a nice option for us occasional travelers to China.
  21. My wife says there is also a huge flesh business. Many illegal brides (and I am sure prostitutes fit in here also) are smuggled across the Vietnamese border into Guangxi. Where they are sold within China is any bodies guess, but the demand is very high. So of course there are those who will supply.
  22. Vermont Service Center has always been known for fast processing of K1 applications. This was not unheard of even when other centers were backed up making applicants wait almost six months. The rest of the process will go at normal speeds for your application as now all applications no matter what service center does the processing, follows the same route through NVC. Time lines have changed recently due to the changes they have made in processing, so I will let someone who has been through the process recently, tell you what to expect. Yes, NOA 2 carries a expiration date of four months from the approval date. You don't need to worry though. It is normal processing for Guangzhou to extend the expiration date. It is at their discretion that they can and always do extend the expiration date to a time that works for them as they never used to be able to get the processing done this quick. The extension is automatic and you don't need to do anything to have them do this.
  23. But someone with a GC who is a LPR should be able to purchase "normal" healthcare insurance. Isn't that what I suggested??????? Sure. I was just confirming that an immigrant with a GC who is a LPR could be condsidered a regular individual and thus the OP does not need to be concerned with all the immigrant insurance information. Okay, just a long day, long week, lots of work making me read things crazy.
  24. But someone with a GC who is a LPR should be able to purchase "normal" healthcare insurance. Isn't that what I suggested???????
  25. Yes there is what insurance companies call health insurance for immigrants. Most health insurance for immigrants includes visitors, students, and those with work visas. This kind of insurance is for short term. Usually you can only buy it for one year at a time. It is more expensive compared to other insurance. Of course cost depends on deductible, co-pay and other benefits received. She will not be short term, so it would be best just to get her a regular, individual health care policy. If you really want to look into this kind further check out these links. http://www.immigrationhealth.com http://www.usnetcare.com/ I have looked into this because of my wife's parents. I have found these kind of plans are double what I find for just getting them a normal, individual plan.
