  1. I have been a green card holder since 2009. Recently, I plan on starting my citizenship process. I currently own 2 apartments in Shanghai, China. I just want to make sure becoming a US citizen doesn't have any effect on my property in China. I can't seem to find a definate answer online. Anyone has any ideas? Also I will eventually sell those properties. Any restrictions on the sales after I become a US citizen? Thank you guys!
  2. Here is an interesting article about home ownership in China. One can own a house but normally only can lease (for 20-70 years) the land that the house stands on: http://www.msn.com/en-us/news/world/what-good-is-owning-a-home-if-china-owns-the-land/ar-BBtIHoB I had heard about this; "Like every other homeowner in China, Mr. Chen and his neighbor own their homes but not the land underneath them. All land in China is owned by the government, which parcels it out to developers and homeowners through 20- to 70-year leases." I didn't realize this; "When the neighbor — whose surname is Wang — tried to sell her apartment, local officials told her that her lease on the land had expired. To sell her apartment, they told her, she would have to pay them one-third of the sales value." Helps explains in part about China's policy for leasing land power; "Giving land to the people would not be easy. Local governments in China do not have the power to levy taxes, so leasing land is one of the few ways they have to raise money." Nice to know; "In 2007, China moved to reassure homeowners by requiring local governments to renew 70-year leases automatically. Yet the law was silent on whether homeowners would have to pay for the renewal and what would happen to those with shorter leases." Always wonder how this can be; Ms. Wang and her family bought her 860-square-foot apartment three years ago for 1.4 million renminbi, or about $210,000 at today’s exchange rates. How do the Chinese buy and are able to afford buy a house for 210,000 USD when the typical yearly income is normally less than 10,000 USD a year? ( I am guessing at the yearly income but I think I am in the ball park, anyone agree?) 210,000 divide by 10,000 dollars would represent 21 years of total savings one's year income. Am I missing part of the picture? I thought this is an interesting subject, Housing ownership in China. Danb
  3. You know- somebody said, Starting next year (2013) Chinese born naturalized US Citizens will have their local ID cards confiscted based on an "new" system linking Chinese or US Passports to local IDs. This is just a really bad rumor, right?
  4. My wife's family has property in China which is in my wife's name and my wife's family is paying in on her national health insurance which I think in another 10 years she'll be "vested". If she becomes a US citizen will that cause complications with either her family's property and/or her health insurance? She has a 10 year green card which she's into now for 3 years.   5. Hi all, What are the benefits of going through the citizenship process to become a US citizen? Just voting and such? My wife doesnt need to become a US citizen if she doesnt want to, right? She can stay in the USA with greencard, right? Just need to get it renewed every 10 years? Our concern is she is listed as owner on the home her parents currently live in (in China). How does China view this is she becomes a US citizen? Is it best for her to stay a Chinese citizen? Can she? How will she travel in and out of the USA down the road? Greencard and China passport? China passport expires in 5 years. She needs to be US citizen to get US passport, correct? Sorry for all the questions. We are confused
  6. In December 2010 I brought my Chinese citizen fiancee over to the USA via K1 visa and married her. Just this month she received her conditional permanent resident status (green card). She still owns her condo in Tangu/Teda Tianjin. I have read around that foreigners are only allowed to own property in China in certain areas, property that foreigners own in restricted areas can be seized by the government. Is Tangu/Teda Tianjin an approved area for foreigners to own property? If not, when my wife becomes a US citizen in 3 years will her condo in Tianjin be seized because she is a foreigner or will she be grandfathered in? Also, I have heard that foreigners are not allowed to conduct business in China unless partnered with a Chinese person/entity or incorporated into a Chinese corporation, and that this rule extends to leasing out a property. My wife and I are looking into leasing out her condo in Tianjin. If it is leased out at the point when she becomes a US citizen will we have to incorporate into a Chinese corporation to conduct that leasing business. I realize these questions are peculiar but information on this subject seems to be sparse and far between. I appreciate any and all input, thank you!
  7. My stepson is 17. We went to the free initial consult with an adoption attorney last week (she also claims to be an immigration attorney). She told me that since I had not adopted my stepson before he was 16 that subsequently he wouldn't be eligible for automatic citizenship. I have checked on the uscis naturalization guide and the closest thing I can find is where it says" "The child was the parent's legitimate child or was legitimated by the parent before the child's 16th Birthday." Anyone had a similar or opposite experience? Thanks Hank

  9. When buying a home in China, what is the best way to transfer the funds from the US for the purchase?

I would be very interested in having a dialog about buying property in China, with and without a mortgage, obtaining the the title, the kind of title obtained and any cases of resale for full value or for degraded value for lack of clear title. I believe this is a vital issue for us here on CFL as many of us have a 'China retirement' gleam in our eye, if only part time. GZBILL has very graciously started the topic, but it has been stated that thing differ regionally. So, it would be VERY GOOD to capture data from as many regions as possible based on actual experience. I am in the process of buying a home in Jilin province, NE China. My Wife owns property in Liaoning province but has only a city government title. Those are the data points I can share publically. -James and Loving Candle and Daughter
