  1. Now that my petition has been sent to GUZ, how do I find out when they recieve it and any other info. I know that there should be a GUZ number instead of what USCIS issued for the case number, will this be on the letter from NVC when I revieve it? Just wanted to know how to follow the steps now. I do not remember being able to do this in 2003 when I filed last time :P .

  2. Ok, I just got off the phone with NVC. My K-1 was ELECTRONICALLY transfered to GUZ on Sept 2nd. As you can guess this makes me happy. The lady I talked to was very nice. I asked her about the electronic filing. She said that it is still random wether or not your file will be sent electronically or not, but that most are now being sent electronically. I think this is good news for everyone :D .

  3. There is not INCOME REQUIREMENT per se. But you've already answered yourself as to the 2009 poverty guidelines 125%. What can be newer than 2009?

     

    What the VO goes by is being satisfied that the immigrating alien will not become a 'public charge'. The poverty guideline is just an easy pseudo-test, but the reality is that a VO will look at what is called the 'totality of the circumstances'.

     

    You can read about all this in the 9FAM, which is the field guide for VOs.

    I think that you should at least line up a co-sponsor just in case. Be prepaired for all possiblities.

  4. I startd thinking about this reading another post today. My SO has talked to her husband and there is still no answer on whether he will let her daughter come here with her. If he says no.....then there will be no letter from the father at the interview. I am wondering, if 5 or 6 months passs and he decides that she can come, what do we do? Can she still get the K-2, or do we need to file an I-130 for her after her mother adjust status?

  5. I have a question. Up until last year when I divorced I was a Semi-stay at home dad. My Income was maybe 14-16 thousand a year. Now I work 60 hours a week split between 4 jobs.

     

    Will I have a problem with the Minimum Income requirements? I make about 26-28 thousand a year now and meet the requirements for the 125% lvl based on the size of the family.

     

    I will have a good looking return this year but the past 2 will be less then the required amount.

     

    I included letters from my Employers with my K-1 application. Will this be ok or do I need to send GUZ a Email explaining what is going on?

    Yours might be a close call. You should be prepared for a Co-Sponsor just in case.

  6. Hmmm Msn Dose not keep a Log of when we talked..... Is there a way I can keep records of our chat times? I mean I can type them all out but wont the VO want something official looking?

    Check your IM program's prefrences, Yahoo can be set to keep a record of all chat sessions. Skype does this too and records any Skype out calls on their website in your account.

     

    If MSN does not offer this, then consider switching to Yahoo, Yahoo can communicate with people that use MSN.

     

    I have copies of all of our chats if this is what you mean. I was thinking like something that showed we used the webcam and voice chat everyday or can I just write a cover letter explaining this?

     

    Skype does keep a log even when voice, webcam, or chat.

     

     

    Web cam is not a real big deal. I f they read any of your sample chats they should be able to see that the 2 of you can see each other while you are chatting. They are more interested in how you communicate than if you can see each other while doing so.

  7. None of these problems will ever be solved as long as people keep asking for handouts because they are to lazy to wrk for something. Our Government is more interested in buying votes than fixing anything or doing what is right.

    For K-1, it should just be a few days. If you look at the timelines at Vj, it's normally two days to a week.

     

    I am always immpressed with the information that you come up with. I was just wondering if it might have to do with the fact that I filed a K-1 in 2003 and maybe they are looking a little closer. I would have thought that they would do that at USCIS though. I am sure all my paperwork is in order........I am just not very trusting when the Government starts looking at things :blink: . I would assume that if there was a problem that they would tell me about it ......or would they just send the papers to GUZ knowing that it would reslt in a white slip?????

    I used Vermont...the 131 days seems about normal for that center on a K-1. Hoping to get interview date in late October or Early November.

  11. I have always sent my letters and packages via USPS "registered" and all have arrived.

     

    You have had much better luck then me. Whenever sending any type of package to Hunan (Changsha) using the USPS it was a crap shoot. Anytime the package had more then just paper items inside, it never arrived. When they did arrive (Illinois to Changsha) they were always right at 3 weeks for regular mail.

     

    Another thing I noticed while sending packages there using USPS is that whenever the envelopes or packages included stamps rather then "postage paid" stickers they never made it. I always assumed that somewhere along the line someone had a fancy for the American stamps.

     

    Once a USPS package hits China it is no longer under the control of the USPS. At least thats what I was told when inquiring about missing items.

     

    From my experiences, I would never send a bank card, anything of value or anything containing personal information using USPS to China. DHL was my preferred method but the cost was very high.

     

    Bank Cards - Check oversea rates for usage. I have found the bigger banks charge around 3% per transaction while a small local bank charged 0%. I set up a specific account at the small bank to be used exclusively for transactions in China.

     

    Flat rate boxes or envelopes - Within the states they are great and very competitive.

    I use USPS to send Global Express to Hunan Province "XiangTan", and have never had any problems. I have sent gifts and important papers to her and always there in 2 weeks. I would never, however send a bank card with anyone other than Fed Ex.

  12. Ok I have Kiled the K-1 and have got a reciept number to track with.

     

    What can I expect from here on besides long periods of time where my file seems to sit in a pile in the corner of some building...:(

     

    I have been looking at timelines and it seems like it is getting closer to a 12 month wait then a 10 month wait.

     

    My silly lawyer seems to think 5-6 months. I dont think he knows the China delay.

     

    Why do papers sometimes seem to sit in customs for 2-3 months once they get to China.

     

    Also the lawyer did nto seem to think it was a big deal to have her address in Chinese character in section 16. I included a K-1 witht he address in Chinses but he used the one his Office generated to file. Anyone think this will be a problem? Can I Email the Chinese address to them?

    I did not see what service center you used, I sent mine to Vermont and got mine approved on August 18. 131 days. As of yet it is not at NVC but I will keep checking. I am trying to find out how they will send it to GUZ. Hang in there, it will be over soon enough.

    one thing i'd like to comment back is that finances is something more of a private matter so that is why i'm avoiding saying specifics.

     

    you can say I am an IT specialist since I am the sole technician for the company I work for of 8 years.. on the I-864, the employee letter even states that I worked as long as I have.

     

    Also, you can say I am near the poverty level, but it is at least at the 125% rate. not saying i didn't get paid for the year of 2008 but 2 months off is a lot if you're near that level.

     

     

     

    I can understand the 'hard love' approach, but when you've been shafted for 2 years+ just waiting on a dead end answer, the case in point becomes moot. I already understand the 'cruel' aspects of this world enough already so it's pointless to make posts like 'cry moar' since that's what deters people from posting to begin with.

     

    Anyways, the logical approach is the one that I've always followed which is by the book. We've done all we were requested even during our blackhole K1 visa period..

     

    it's totally unfair and screwed up that we got shafted as bad as we did.. and that others, whom didn't or were 'lucky' to get a pink the 'cheat' way that the world isn't more fair.

     

    logically speaking, if someone got held up 2 years with no sort of recourse, where is the freedom / checks & balances / due process?

     

    the USA is suppose to be a place of equality.. the way that we were shafted out of our time especially since it is suppose to be a 6 month max to get a yes/no response doesn't do much to the people who are honest hardworking people to get the short end of the stuck because some crappy people decide to go do a visa fraud.

     

    anyways, my wife is egging me to go to bed ;) so that's all I'll post for today ^^

    You really need to let go of the past, Keeping all that in your mind will destroy you and your relationship. There is no one in particular to blame for this...it is the system. Most people learn at a very early age that life is not fair and good people do not always finish first. Accept it and move on, do what they ask and you should have no problems.

  14. Since I am set up for emails and I did get an email from them saying that the NOA2 was being sent.....Will I also recieve email's about when it is sent to NVC and then out of NVC. If not, how do I find these things out?

    No emails from NVC,

     

    The notification system is at USCIS part of DHS.

     

    NVC is part of DOS, a completely different department of the US government.

     

    To get status info for case at NVC you need to Call and TALK to an operator or send an email request for status. call the National Visa Center at 603-334-0700 or email NVCINQUIRY@state.gov

  15. This morning I recieved notice by email that my case has been approved by USCIS. As you can imagine this is a happy day although there is still alot yet to be accomplished.

     

    I was concerned about it for only one reason, I checked my paperwork several times before I sent it to USCIS. When I got the NOA1 a few days later I went to file in in the folder and thought I had more copies of my Divorce degree's than I should. I was wondering if maybe I forget them :huh: . I called USCIS and asked if I could send in the papers just in case and they said no because they would never ba able to link them to the petition. So I just held my breath waiting to see if they sent me a request for more info. Apparently I did include all copies :D . I have always wondered why they need every divorce paper if you have been married more than once. If the last marriage ended in divorce and you have the papers that is all you should need, to prove eligabilty to marry again. My SO is aware of my previous marriages so that is all that counts IMHO.

     

    Anyway....Happy day today.

  16. Hi, Robert, besides Mike's suggestion, I would like to mention another way, it is QQ email box. Since your wife is Chinese, it should be very easy for her to register for a QQ email box. My friend in IL sent me files as attachments via QQ email which were often up to 300MB for each one, each time I could receive them. I have never used QQ email until early this year, my friend asked me to register one so that she could transfer files to me. I did. Then I was surprised by QQ email's ability of tranfering files, though I never used that QQ email for any other purpose.

     

    She could register a QQ email then you two share the same email box, very simple.

     

    QQ mail sounds pretty good. I will ask her to register today. Do I also need to register, or do I just sign in to the same account?

    You could register another QQ email if you want but that is not necessary if you two don't mind each other seeing what is this common email box. Your wife register one. That is enough.

     

    She could tell you the email box ID and password. Then you could put whatever files in that email box. She could open the email box in China and see what you put in the email box; you could open the same email box in USA and see whether she opened some files or not.

     

    Imagine you tell your present email ID and password to your wife and your wife could open it in China and see what is in your email box. The QQ email way is the same like this. But definitely you could keep your own space and don't have to share everything in your present email box with your wife.

     

    Thanks Fineart, We will try this and see how it works. If it doesn't we will try the FTP option.
